В статье кратко рассмотрены перспективы реформы отечественного законодательства об административной ответственности, озвученные в докладе на круглом столе «Законодательство об административной ответственности: современное состояние, перспективы развития», состоявшемся в Дальневосточном федеральном университете 9 апреля 2019 г. Кодекс Российской Федерации об административной ответственности претерпел на 2019 г. уже более 3000 изменений (правок), а нормы об административной ответственности на сегодня содержатся в большом количестве федеральных законов, сам Кодекс содержит большое количество бланкетных норм, а правоприменители отличаются слабыми знаниями законодательства, что в совокупности затрудняет правоохранительную функцию законодательства об административной ответственности. Автором на основе материалов судебной и правоприменительной практики предлагается внесение в концепцию реформы законодательства об административной ответственности инициатив по введению специального общественного квалификационного экзамена для правоприменителей законодательства об административной ответственности; установлению строгой категории вины юридического лица и вины должностного лица, учитывающей избежание наказания двух лиц за совершение одного административного проступка; либерализации административной ответственности по административным проступкам, совершённым впервые, вплоть до ограничения такой ответственности замечанием. Автор убеждён, что реформа федерального и регионального законодательства об административной ответственности в Российской Федерации должна носить комплексный характер и должна быть направлена не на карательную функцию норм, а на правоохранительную, с целью избежания злоупотребления правоприменителями своими полномочиями и создания условий для нормализации функционирования коммерческих и некоммерческих организаций в Российской Федерации, повышения уровня защищенности бизнес-климата в стране. The article reviews the prospects of reforming the legislation on administrative responsibility based on the round table report “Legislation on administrative re-sponsibility: modern state, development prospects” in the Far Eastern Federal University on April 9, 2019. As of 2019, over 3000 changes (amendments) had been introduced into the Russian Federation Code on administrative responsibility; administrative responsibility norms can nowadays be found in many federal laws; the Code contains a lot of blanket norms; law enforcers have an insufficient knowledge of the legislation thus hindering the law-enforcing function of the legislation on administrative responsibility. Based on the material of court and law-enforcement practices, it is suggested to introduce the initiatives on implementing a special public qualifying examination of the law-enforcers for the legislation of administrative responsibility, strict categories of the corporate body’s guilt and office holder’s guilt that would avoid punishing two people for committing the same administrative offence, liberalization of administrative responsibility on administrative offences committed first time including reducing this responsibility to admonition. The author of the article is sure that reforming the federal and regional legislations on administrative responsibility in the Russian Federation has to be complex and switch its function from punishment to preventing the law enforcers from misusing their authority; it also has to create the conditions for normalizing the functioning of commercial and noncommercial organizations in the Russian Federation and increase the level of business climate protection in the country.

The article examines the features of the application of federal legislation in terms of limiting its action in certain regions of the Russian Federation. The practice of land and town planning regulation under such restrictions is analyzed. Proposals are given for further improvement of the law in terms of creating special conditions for the selection of land plots in the conditions of the "Far Eastern hectare program".

The article analyzes the provisions of the draft of the Code of the Russian Federation on Administrative Offenses, developed on the basis of the Concept approved in 2019 by the Russian Government. Attention is drawn to the fact that the Concept, for the first time in domestic practice, contains a provision stating that improving the institution of administrative responsibility will require work to transform it from a predominantly punitive-fiscal instrument into the institution of sentencing, subject to differentiated application taking into account the risk-based approach. Based on the analysis of particular compositions of the draft of the Code of Administrative Offenses, it has been concluded that the punitive-fiscal orientation in it remains. Suggestions have been made on possible ways to overcome this. Administrative penalties should only provide general and specific prevention. The economy of administrative repression should become an element of the administrative policy of the executive branch. After the entry into force of the new Code of the Russian Federation on Administrative Offenses, it has been proposed to conduct annual monitoring of its application, which will make it possible to identify the compositions that bring the greatest income to the budget. The problem of the existence of a profitable business on administrative responsibility is outlined. Attempts to introduce public-private partnership related to the provision of police assistance are assessed negatively. Based on Russian realities, it can be assumed that in practice this will lead to abuse by police officers and, as a result, to violation of human and civil rights and freedoms. Only in the future, the Russian police should gradually transform from a purely security structure focused on the use of state coercion measures into a structure that is largely service, providing citizens with specific services, in particular, providing them with police assistance when necessary. The idea is supported to recognize the “right to error” and “the right to forgiveness” for an administrative offender. It is proposed to implement it by expanding the possibilities of applying a warning as an alternative to such a punishment as an administrative fine, as well as by expanding the list of possible grounds for exemption from administrative liability. It is concluded that the adoption of the draft of the Code of the Russian Federation on Administrative Offenses does not look obvious.

Abstract This paper is intended to illustrate the applicability of the results obtained from the investigations of social aspects of seismic hazard of the Russian Federation (RF) through the example of the high-seismicity region – the Far Eastern Federal District (FED). Within the FED the comparison of the areas of various seismic zones as per regulatory maps of General Seismic Zoning dated 2016 (GSZ-2016) has been performed and population estimates for each zone have been obtained. For the first time population estimates for zones with increased seismic hazard – grades A, B and C as per GSZ-2016 – are provided. The data obtained may be used for the evaluation of additional risks for FED’s population.

Статья направлена на раскрытие и характеристику основных полномочий органов государственной власти субъектов Российской Федерации и органов местного самоуправления в сфере управления многоквартирными домами. Законодательство Российской Федерации наделяет региональные органы власти различными функциями, такими как лицензирование деятельности по управлению многоквартирными домами. К полномочиям региональных органов власти отнесена деятельность по установлению тарифов на коммунальные услуги. Региональные органы государственного жилищного надзора правомочны привлекать к административной ответственности участников деятельности по управлению многоквартирными домами, допустивших нарушение законодательства. Органы местного самоуправления отбирают управляющую организацию в определенных законом случаях, организуют избрание совета многоквартирного дома, если он не избран собственниками. Эффективность управления многоквартирным домом, его содержание во многом зависит от того, каким образом, органы государственной власти субъектов Российской Федерации и органы местного самоуправления реализуют на практике предоставленные им полномочия. The article is intended to define and characterize the main powers of bodies of state power of the subjects of the Russian Federation and local government bodies in management of multi-family dwellings. The legislation of the Russian Federation empowers the regional authorities with various functions, such as licensing the management of multi-family dwellings. The powers of regional authorities include also the utility tariff-setting activity. The regional authorities of state housing oversight are authorized to bring the participants in the management of multi-family dwellings, who have violated the law, to administrative responsibility. The local self-government authorities select the management company in cases specified by law, organize the election of the council of multi-family dwelling, if it is not elected by the owners. The efficiency of management of multi-family dwelling and its maintenance largely depends on how the bodies of state power of the subjects of the Russian Federation and local self-government authorities put the powers granted to them in practice.

The subject of the study is the extension of the principle of federalism on the validity of the Code of Administrative Offences of the Russian Federation. The paper raises the issue of its extension to normative legal acts adopted by the public authorities of the constituent entities of the Russian Federation and municipal normative legal acts. The author has analyzed the decisions of courts of different levels on bringing to administrative responsibility on the basis of the Administrative Code of the Russian Federation for violations of the law rules of constituent entities of the Russian Federation. The article contains conclusions about the need to correct the provisions of Article 1.3 of the Administrative Code of the Russian Federation. The proposed design of the norm will clearly delineate the powers of the Russian Federation and the constituent entities of the Russian Federation in determining administrative responsibility and excluding the possibility of brining to administrative responsibility for the violation of normative legal acts of constituent entities of the Russian Federation and municipal bodies on the basis of the rules of the Administrative Code of the Russian Federation.

The article presents a little explored issue in the Russian historiography on the history of appearance and the essence of «the cipher catalog of Chinese books of the Oriental Institute Library» in Vladivostok. The author shows the process of formting the Chinese Department of the University Library in the late XIX – early XX centuries, the contribution of Sinologists professors A. V. Rudakov and P. P. Schmidt and others in the book collection creation. The theme is disclosed on the basis of reports published in the «Proceedings of the Institute of Oriental Studies», «Reference books on Oriental Institute in Vladivostok for 1909», and the documents of the central and local archives of the Russian Federation, some of which are introduced into scientific circulation for the first time. The importance of the bookcatalogue of the China Department is shown both for the Institute, China studying, and Chinese language teaching, for Far Eastern sinologists and Russian Sinology.

The subject of this research is the social relations arising in the context of application of administrative sanctions for violating forestry legislation. The object of this research is the legislation on administrative offenses of the Russian Federation and foreign countries, law enforcement and judicial practice. The author observes the ambiguity of application of legislation on administrative offences by the state forestry departments in some constituent entities of the Russian Federation. Therefore, this scientific article indicates one of the relevant issues that stir up disputes among the law enforcement agencies – imposition of cumulative administrative penalty for violating forestry legislation. Using the universal dialectical, descriptive, and hermeneutical methods, the author analyzes the current administrative legal norms that regulate the procedure for imposition of cumulative administrative penalty. Special attention is given to the factors of ambiguity in law enforcement practice in terms of imposition of cumulative administrative penalty, which has developed due to the flaws in legal writing: 1) the absence of conceptual scientific developments dedicated to imposition of administrative penalty for cumulative administrative offenses; 2) simplified approach towards legal regulation of certain institutions of administrative responsibility that generates gaps in the legislation on administrative responsibility, which must filled in by law enforcement practice; 3) inappropriate interpretation of norms of the Article 4.4. of the Code of the Russian Federation on Administrative Offences by the law enforcement, and namely, judicial bodies. The scientific novelty consists in recommendations for improving the provisions of the Code of the Russian Federation on Administrative Offenses in this sphere. The conclusions are based on the formal-legal and logical methods of research.
