In the aftermath of the breakup of the Soviet Union and the birth of new sovereign nations bordering the Caspian Sea, the legal status of the sea has emerged as one of the most contentious international problems facing the region. The discovery of large offshore oil and gas deposits in the area has added urgency to the need to resolve the twin issues of the legal status of the sea and the corresponding mining rights.The Caspian, the largest inland body of water in the world, is approximately the size of Japan. The south Caspian is the deepest part and contains the most productive oil and gas fields. The oil-producing area of the south Caspian that holds the most promise extends along a narrow structural zone across the sea from the Apsheron Peninsula in Azerbaijan to the Peri-Balkhan region of western Turkmenistan.

After twenty-two years of negotiations, in Aktau on August 12, 2018, Kazakhstan, Azerbaijan, Iran, Russia, and Turkmenistan signed the Convention on the Legal Status of the Caspian Sea. The preamble of the Convention stipulates, among other things, that the Convention, made up of twenty-four articles, was agreed on by the five states based on principles and norms of the Charter of the United Nations and International Law. The enclosed Caspian Sea is bordered by Iran, Russia, and three states that were established following dissolution of the Soviet Union, namely Azerbaijan, Kazakhstan, and Turkmenistan.

Since the collapse of the Soviet Union in late 1991, the Caspian Sea region has been seen as a potential major oil and natural gas reservoir. For more than a decade, the five nations that share the Caspian—Azerbaijan, Iran, Kazakhstan, Russia, and Turkmenistan—have sought to develop the basin’s hydrocarbon resources. This paper provides an assessment of these resources and examines two major hurdles: lack of consensus on the legal status of the Caspian and disagreement of the most cost effective pipeline routes. It argues that oil and natural gas from the Caspian is certain to contribute to global energy security. However, the Caspian Sea should not be seen as a replacement to the Persian Gulf.

The article touches upon the problem of technogenic risks arising in the course of building and operating oil and gas complexes in the Caspian Sea taking into account the adoption of the Con-vention on the legal status of the Caspian Sea and regulation of the territorial division of the Caspian Sea. Technological risks are presented from the position of safety of industrial facilities in the offshore area and in the coastal zone, the impact of these facilities on the ecology of the Caspian is considered. The risk analysis was carried out taking into account world experience, as well as incidents that occurred at the offshore oil and gas production facilities in the Caspian Sea. There has been presented the layout of oil and gas fields at the bottom of the Caspian Sea and the division of the bottom based on adopting the Convention. A general description of the Caspian Sea has been given; unique features of the Caspian and the most unexplored seismic effects have been stated. It has been recommended to conduct a comprehensive assessment of the state of the seabed according to seismological, mud, volcanic and engineering-geological conditions; to develop measures for preventing and reducing the damage from hazardous natural processes and exploitation of oil and gas fields; to forecast the fluctuations of the Caspian Sea level, taking into account today’s economic activity; to study the natural and technogenic factors determining the environmental safety of the Caspian Sea; to monitor seismic phenomena, crustal movement in zones of tectonic faults at the sea bottom, etc. The speed and direction of wind currents in the Caspian Sea have been analyzed. The maps of mud volcanoes location in the Caspian basin (located on land, hidden and identified by seismic, geological, geophysical and geochemical methods, etc.) are illustrated. Conclusions are made about the high risks for developing hydrocarbon deposits in the Caspian Sea basin. There is the need to take into account environmental requirements and standards, to use modern technologies, to prevent incidents at offshore oil and gas production facilities.

The article analyzes the legal basis for cooperation of the states of the Caspian region - Russia, Azerbaijan, Kazakhstan, Turkmenistan and Iran. With the signing of the Convention on the Legal Status of the Caspian Sea in 2018, the relations between five countries have reached a qualitatively new level. While with the collapse of the Soviet Union centrifugal trends dominated cooperation, especially after the former Soviet republics gained independence, recent years have been characterized by centripetal tendencies, and the COVID-19 crisis has clearly demonstrated that only by joint efforts the countries can confront today's challenges and threats. An important aspect of cooperation among the Caspian littoral states is their membership in various integration groupings, which imposes certain obligations on these states, undoubtedly affecting their interaction in the Caspian region.

Azerbaijan is a nation with a Turkic population which regained its independence after the collapse of the Soviet Union in 1991. It has an area of approximately 86 000 km2. Georgia and Armenia, the other countries comprising the Transcaucasian region, border Azerbaijan to the north and west, respectively. Russia also borders the north, Iran and Turkey the south, and the Caspian Sea borders the east. The total population is about 8 million. The largest ethnic group is Azeri, comprising 90% of the population; Dagestanis comprise 3.2%, Russians 2.5%, Armenians 2% and others 2.3%.

For almost three centuries, starting with the campaign of Peter the Great in 1721-1722, Russia has traditionally played a key role in the Caspian Sea. The situation changed dramatically with the collapse of the USSR in 1991 and the emergence of three new regional players-Azerbaijan, Kazakhstan and Turkmenistan. For Russia, this meant a significant reduction in influence in the region and the loss of control over most of the water area and the sea and its resources. In the historiography devoted to the region, the emphasis is placed on assessing the new round of geopolitical struggle, the position and interests of Western and regional powers. The author of this article provides a critical analysis of changes in Russian policy towards the Caspian Sea over the past 30 years and assesses the effectiveness of these changes. The difficult transition from the role of a dominant player in a region closed to external competitors to an open geopolitical confrontation over resources, their transportation routes, and political influence at the first stage was not in favor of Russia. Russia could not defend the principle of a condominium for joint development of hydrocarbon resources of the sea. With the active assistance of Western competitors, Russia lost its status as a monopoly transit country for oil and gas from the region. At the same time, thanks to diplomatic efforts and increased political dialogue with its neighbors in the region, Russia managed to resolve all territorial issues at sea by 2003, maintain the closed status of the sea for the military forces of third countries, and by 2018 complete work on the Convention on the international legal status of the sea, which established the principles of cooperation in the region that are important for the Russian Federation. Thus, official Moscow managed to achieve the strategic goals adapted after the collapse of the USSR by using the traditional strengths of its foreign policy and consolidate its status as the most influential player in the region.

The Caspian Sea is the largest body of water in Eurasia: After the collapse of the USSR, the water area of this region is a zone of interest for many states. [1] The Caspian region rightfully serves as one of the most significant regions for most countries interested in the mineral resources that the Caspian is rich in. The Caspian Sea has a significant hydrocarbon reserves. According to the Energy Information Administration (EIA), hydrocarbon resources in the Caspian basin have the following values: oil - 48 billion barrels of oil, natural gas - 292 trillion. cubic feet (found and probable reserves), of which 75% and 67%, respectively, are produced or may be produced offshore. The northern part of the Caspian Sea contains most of the oil reserves, while the southern sector of the Caspian Sea is rich in natural gas.[2] It should be emphasized that the list of states that have the rights to use the resources of the Caspian Sea is as follows: Azerbaijan, Iran, Kazakhstan, Russia and Turkmenistan. It is impossible to correlate the importance of the oil and gas resources of the Caspian reservoir for each of the above countries, for the following reasons: Azerbaijan and Turkmenistan are countries for which the hydrocarbon potential of the Caspian is the most important predictor of the formation and development of the economy, while for Kazakhstan, the use of oil and gas resources of the Caspian Sea plays an important , but not the most decisive role, since oil and gas deposits in this country are not limited to the Caspian region, but its economy is developing in other directions. Iran and Russia, however, are interested in influencing the direction of flows of oil and gas raw materials, including their transit through the territory of the countries. [3] The last years for the Caspian region have become the years of a shift in the development of the oil and gas industry of the Caspian "five", which account for 17.6% of oil reserves and 46.4% of gas reserves in terms of global reserves. It is assumed that on the territory of the Caspian shelf, which belongs to Russia, oil reserves amount to 270 million tons, natural gas reserves - 0.5 trillion cubic meters. m of gas. [4] Of course, it is worth noting that the potential of the Russian sector of the Caspian Sea is significantly lower than the oil and gas potential of Yamal or Western Siberia, but the development of this region is important for the strategic development of the oil and gas sector, in particular offshore drilling.

This article critically examines the shortcomings of the offshore industry regulation in the Caspian Sea and proposes a framework to strengthen it. It considers the hydrocarbon industry and resources of the Caspian Sea region and analyses the extent and impacts of Caspian offshore oil and gas activities on its environment, reviews selected regional and global regulatory frameworks for the offshore oil and gas industry and their effectiveness, discusses existing shortcomings of the national and regional regulation of the Caspian offshore oil and gas industry, and provides suggestions on how it could be improved, drawing on the experience and regulatory formulations from other regions of the world.

Caspian region has always been a point of intersection of interests for multiple states. Throughout all historical periods, the presence of influential states in the Caspian Sea coast led to escalation of tension in the region. Such factors as heterogenic population of littoral states and differences in mentality further aggravated the situation. Thus, the military-political activity of the Caspian states has always been of paramount importance. The significance of military-political activity for the countries of Caspian Basin was substantiated by the following key factors: concentration of the majority of explored hydrocarbon deposits of these countries on its continental shelf; presence of substantial reserves of various biological resources in the waters of Caspian Sea; location of the region on the junction of important geopolitical paths; largely populated coastal regions. After the collapse of the Soviet Union and formation of new states in the region, this activity acquired a special character.

This study focuses on the question of the role of the Caspian Sea at a large scale in the current Russian foreign policy. It is noted that though in the historical perspective the Caspian Sea basin had been totally dominated by Russia since the beginning of the 19th century, this domination was contested and considerably reduced after the collapse of the Soviet Union. Paradoxically, in parallel for various reasons exposed in the paper, the Caspian Sea gained more importance in the Russian foreign policy giving rise to new challenges for the future of the Russian power in the region.
