The article is devoted to the analysis of Article 350 of the Criminal Code of the Russian Federation, which provides for criminal liability for violation of the rules of driving or operating cars, the evolution of this article and the problems of sentencing under it are considered. One of the suggestions for improving this article is to change its sanction, which will eliminate the identified significant legal gap. The author conducted a comprehensive analysis of various aspects related to the criminal violation of traffic safety rules and the operation of military vehicles, and proposed the author's solution to the problematic aspects. The study used specific dialectical methods: comparative, hermeneutical, discursive, formal-legal, as well as some sociological methods: observation, methods of expert assessments and analysis. The provisions contained in the materials of the article can be used to improve the current criminal legislation and to develop explanations of the Plenum of the Supreme Court of the Russian Federation in reviews of judicial practice.


In the framework of this work, the main regulatory documents on this topic are analyzed. It is noted that the qualification requirements are not identical to the presence of a document confirming the right to drive a vehicle. Qualification requirements are the requirements for the knowledge, skills, and professional skills of the driver. A legal conflict was established for drivers who received a driver’s license earlier than 12/12/2014: the presence of a Russian national driver’s license of the corresponding category makes it possible to speak of non-compliance with professional requirements, and in turn, the lack of knowledge, skills and professional skills in working with various types of tachographs clearly indicates a mismatch with qualifications requirements. It is noted that to confirm the availability of skills, professional skills in working with various types of tachographs to persons who have received a driver’s license before 08/12/2014, only a document confirming training in the training program that meets the requirements of Order of the Ministry of Transport of the Russian Federation of January 17, 2012 No. 7 can be confirmed. The volumes of freight and passenger traffic on the railways of the Russian Federation are increasing every year. Along with the increase in the transportation work, the likelihood of occurrence of undesirable incidents in railway transport increases. The assessment of the level of comprehensive (integrated) safety is an important scientific and technical problem in the current conditions of the functioning of railway transport. The methods used to assess the level of safety do not always meet the requirements of complexity in view of comparison of various-scale violations of traffic safety (crash, accident, faulty operation). The paper proposes a mathematical method for assessing the level of integrated safety in railway transport and calculation of the safety index of train traffic. For the calculation, statistical data for a certain period are used. These data summarized in a specialized dictionary of traffic safety violations, the mathematical treatment of which provides information on the level of integrated safety in railway transport in the Russian Federation. The proposed index allows determining the effectiveness of management decisions in the field of train traffic safety, as well as assessing the effectiveness of implementing certain innovations in the field of traffic safety. It is possible to use data on integrated traffic safety to reduce insurance premiums for cargo insurance on railways.

Relevance. The paper is devoted to problems of ensuring road traffic safety in Russia, which is the public task of great importance involving the implementation of the policy for protecting people's health, life, and property.Intention. To look for ways of optimizing and implementing the measures aimed at preventing the technogenic emergencies.Methodology. To analyze the indicators of road traffic accidents in the Russian Federation over five years as well as the federal laws in the field of road traffic safety.Results and Discussion. Risk factors of traffic accidents include: alcohol intoxication, speed limit exceeded, overtaking in the wrong place, driver talking, smoking while driving, driver fatigue. In the Russian Federation, there is a persistent downward trend in the number of accidents. In 2019, 164,358 traffic accidents (-2.2 %; all comparisons vs 2018) occurred, 16,981 (-6.8 %) persons died, 210,877 (-1.9 %) persons were injured. According to the Ministry of Internal Affairs, the number of accidents due violation of the Road Rules by drivers was 146,688 (-1 %); 14,420 (-5.7 %) persons died and 195,037 (-0.8 %) persons were injured. In 2019, road traffic accidents caused by drunk drivers tended to decrease (12,040; -3.5 %); 11,510 (-4 %) persons died and 160,725 (-0.4 %) persons were injured.Conclusion. Drivers' health is directly related to road traffic safety; health promotion would contribute to decreasing the number of road traffic accidents and traffic-related injuries.

This article reports the results of an in-depth analysis of the transport situation in the Russian Federation and presents the main programmes, aimed at its improvement. The paper deals with the major ways of reducing risk of traffic accidents and increasing traffic safety. The paper proposes the scientific and methodological approach, providing the specialists with the opportunities of conducting a comprehensive assessment of the causes of emergencies and aiming at eliminating road accidents rates. The origin of the process of an emergency situation occurrence has been investigated and designed, the key components (constituents) of the process have been identified and the basic mechanisms, influencing the basic components, have been analyzed. The algorithm of the application of the proposed and developed scientific and methodological approach at the level of departmental organizations has been suggested. The article describes the mathematical model of the process of emergency situations occurrence, which, together with the applied telematics systems and intelligent transport systems, will help to achieve the basic objectives of the study.

Introduction. One of the important problems in the Russian Federation is road safety improvement (RS). This is due to the enormous damage that accidents inflict on the national economy. The Russian Federation lags behind the leading countries of the European Union in the field of road safety in terms of key indicators by 3.5 times. To close the gap, in January 2018, we adopted the 'Strategy for road safety in the Russian Federation for 2018 - 2024’ (Strategy). The goal of the Strategy is to strive for zero mortality in road traffic accidents (RTA) by 2030, and in 2024 to reduce the social risk to 4 deaths per 100 thousand inhabitants.Materials and methods. The developments are based on a new theory developed at SibADI - this is the cyclical dynamics of road accidents on a national scale, subordinate to the level of the economy. During crisis, there is a decrease in the number of accidents; this is influenced by a number of factors, the main one is a decrease in the total mileage of vehicles. During such periods, the effectiveness of measures to reduce road accidents is often confused with the real cause, which leads to a decrease in funding and the curtailment of work to improve road safety, which should not be done. When the economy recovers, the level of road accidents recovers and even begins to grow due to the loss of qualifications of drivers who are idle during the crisis.Results. There are two different approaches to achieving this goal. At the federal level, there is a programmatic approach, while in the regions the project method is used within the framework of the 'Safe and High-Quality Highways’ national project (BKAD). A similar project was adopted in the Omsk region. A feature of the road safety project implementation in the Omsk region is the involvement of science. Research is carried out at the Organization and Traffic Safety Department and is introduced into the educational process and implemented at the Federal Training Center for advanced training of workers involved in the training of drivers, created in SibADI.Discussion and conclusion. The scientific approach guarantees the identification and quality solution of the main problems of the road safety project. This applies to recommendations for stabilizing project financing, justifying the development of public transport, using new technologies, improving the regulatory and legislative framework in all areas of urban planning and infrastructure.

The subject of this research is the international and Russian normative legal acts aimed to ensure unavoidability of liability for violators of the Road Traffic Rules of the Russian Federation, namely the drivers of vehicles registered in foreign countries. The object of this research is the administrative legal relations that arise in the course of proceedings in such cases. The article traces the correlation between the increase in violations of the road traffic rules and consequences of the traffic accidents caused by such drivers; as well as the reason for lack of evidence required by the Main Directorate for Traffic Safety to hold the responsible to account. The article explores the questions of interaction between the Main Directorate for Traffic Safety of the Ministry of Internal Affairs of Russia and other state departments in order to eliminate the flaws in organization of the work on ensuring unavoidability of liability by drivers of vehicles registered in foreign countries. The conclusion is made on the need to form a unified database on owners of motor vehicles registered in foreign countries and individuals bringing them into the Russian Federation, determine the federal department of executive branch and delegation of power thereto for ensuring that individuals crossing the border of the Russian Federation adhere to these administrative laws, as well as introducing amendments into the legislation of the Russian Federation on restricting the right of foreign citizens to cross the state borders of the Russian Federation if failed to pay an administrative penalty. The author also underlines the need for the development of international agreements between the Russian Federation and foreign countries on the mutual recognition and liability for traffic violations recorded by automated monitoring systems.
