Work Patterns, Training, and Clinical Supervision Demographics of Home-Based Professional Counselors

Home-based counseling is an emerging modality of providing mental health counseling services to clients across the lifespan. However, minimal graduate training programs and home-based agencies provide training and preparation for professional counselors. In addition, educational and professional requirements are currently ill defined. A nonexperimental pilot survey exploring home-based professional counselors work-based, and clinical supervision and training patterns was conducted. Results suggest home-based professional counselors serve diverse populations and have limited training regarding home-based competencies. Findings from the study are presented. Implications for training and practice for home-based counselors are discussed.

PROBLEMS OF FORMATION OF PROFESSIONAL COMPETENCE OF TEACHERS EMPLOYEES OF DRIVING SCHOOLS

В статье рассматриваются проблемы подготовки (переподготовки и повышения квалификации) педагогических работников автошкол, а также отдельные аспекты определения их профессиональных компетенций, требующие совершенствования. Предлагаются возможные способы решения выявленных проблем. The article defines the problems of training (retraining and advanced training) of teachers of driving schools, as well as certain aspects requiring improvement related to the establishment of professional requirements for them. Possible ways of solving the identified problems are proposed.

Training of translators at the university: new challenges

Актуальность статьи обусловлена несоответствием содержания вузовской подготовки переводчиков требованиям, предъявляемым современной профессиональной средой к выпускникам этого направления. Описаны результаты трехлетнего исследования, нацеленного на выявление набора переводческих компетенций, включающих, кроме лингвистических и метакогнитивных навыков, личностные характеристики и умения регулировать социокультурные противоречия. Показано, что в контексте межъязыкового общения переводчик выступает регулятором коммуникации, а, значит, должен демонстрировать эффективные приемы воздействия на индивидуальное или групповое сознание. Авторы убеждены, что развитие новых качеств может также положительно сказаться на уровне мотивации будущих переводчиков, что было подтверждено в ходе проведенного формирующего эксперимента. Статья предназначена для руководителей образовательных переводческих программ и специалистов в области перевода, планирующих разработку алгоритма применения нового профессионального стандарта «Специалист в области перевода». The relevance of the article is due to the inconsistency of the content of the university training of translators with the today’s professional requirements placed on the graduates of this direction of studies. The article describes the results of a three-year study aimed at identifying a set of translation competencies, including, in addition to linguistic and metacognitive skills, personal characteristics and the ability to regulate socio-cultural contradictions. It is shown that in the context of interlingual communication, the translator acts as a regulator of communication, and, therefore, must demonstrate effective methods of influencing individual or group consciousness. The authors are convinced that the development of new qualities can also have a positive effect on the level of motivation of future translators, which was confirmed by the formative experiment. The article is intended for managers of educational translation programs and specialists in the field of translation who plan to develop an algorithm for applying the new professional standard "Specialist in the field of translation".

SCULPTURE WORKSHOP: PROFESSIONAL REQUIREMENTS FOR CREATING A LEARNING ENVIRONMENT

One of the necessary and mandatory conditions for high-quality professional art education is training in an environment that encourages creative work and provides the necessary level of comfort, ergonomic, technological, sanitary and technical requirements and proper organization of labour protection. Compared to other artistic professions, the working environment of a sculptor is more complex. It must be equipped with the necessary technical equipment (mostly quite large) and manual and mechanical tools, take into account functional requirements and complex technological processes, as well as provide the necessary and diverse indicators of lighting level, temperature, humidity, noise, etc. All these requirements also apply to sculpture academic workshops, where students learn the basics of the profession. Subsequently, graduates of sculpture departments use the acquired skills in their creative activities. Stating a certain degradation of the requirements for the profession of the sculptor, the authors of the publication express worries about the obvious underestimation of requirements for the workplace of a professional sculptor, which can be observed in numerous examples, and remind the reader of these basic requirements

THE QUESTION OF THE NATURE AND THE REASONS OF LEGAL COLLISIONS

В статье анализируется правовая природа юридических коллизий, систематизируются предложенные в юридической литературе последних лет определения понятия «юридическая коллизия», выделяются достоинства и недостатки исследуемых подходов, формулируется авторское определение данного понятия. Под юридической коллизией предлагается понимать противоречие между нормами права, а равно нормами права и (или) положениями правоприменительных и интерпретационных правовых актов, потенциально или практически порождающее трудности в реализации права. Коллизии в праве (юридические коллизии) рассматриваются в их соотношении с другой разновидностью правовой неопределенности - пробелами в праве. Автор статьи приходит к выводу о том, что, хотя оба этих явления имеют негативное влияние на развитие правовой системы государства и юридическую практику, именно юридические коллизии создают наиболее серьезные трудности в ходе правоприменительного процесса. Если причины возникновения пробелов в праве носят смешанный объективно-субъективный характер, зачастую с уклоном в сторону объективных причин (нормы права объективно не всегда оперативно подлежат формальному закреплению вследствие очень высоких темпов развития общественных отношений), то причины возникновения юридических коллизий преимущественно субъективны. Любая юридическая коллизия, так или иначе, представляет собой ошибку правотворца, правоприменителя или интерпретатора. Сделан вывод о том, что для предотвращения «разрастания» коллизионности в российском праве требуется снизить темпы правотворческого процесса, четко определить границы законотворчества и подзаконного правотворчества, но прежде всего - ужесточить профессиональные требования к субъектам правоприменительной, интерпретационной и особенно правотворческой юридической практики. The article analyzes the legal nature of legal collisions, the definitions of the concept of «legal collisions» proposed in the legal literature of recent years are systematized, the advantages and disadvantages of the investigated approaches are highlighted, the author's definition of the concept is formulated. It is proposed to understand a legal collision as a contradiction between the norms of law, the norms of law and the provisions of law enforcement and interpretive legal acts, potentially or practically giving rise to difficulties in the implementation of the law. The legal collisions are considered in their relation to another kind of legal uncertainty - gaps in law. The author of the article comes to the conclusion that, although both of these phenomena have a negative impact on the development of the legal system of the state, legal collisions create the most serious difficulties in the course of the law enforcement process. The reasons for the appearance of gaps are rightfully objective, and the nature of legal collisions is predominantly subjective. Any legal collision is, in one way or another, an error. It is concluded that, in order to prevent the "growth" of collision in Russian law, it is necessary to reduce the pace of the lawmaking process, to clearly define the boundaries of lawmaking and bylaw lawmaking, toughen professional requirements for subjects of legal practice.

Analysis of professional requirements for a modern logistician

The article is devoted to the research of modern labour market requirements for experts in logistics. The reasons of logistics importance for the proper functioning of national and international economies were outlined. The list of requirements set by business representatives to successful candidates is summarized. The analysis of the job market was performed using topic-related websites that cover job markets in Ukraine, the United Kingdom of Great Britain, Austria, Slovakia and the Russian Federation. Empirical studies, data analysis and synthesis, expert assessments, and generalization methods were used to perform the scientific inquiry. The number of specific competencies mentions in the job ads analyses and the relative difference between studies’ indicators were counted. It was revealed that there is a great demand in almost all areas of the economy for logistics specialists. The tendency to find the personnel, who are willing to learn and improve on a continual basis, and can demonstrate a larger range of soft skills in addition to being an effective communicator, has been traced. Assumptions were made about possible changes in the requirements of employers to candidates, in connection with the presence of drivers of Industry 4.0 environment forming. Recommendations for further research of labour market requirements were provided.
