In Islam, a nafkah is the responsibility of a husband. As in Indonesia family lawappliesthat nafkahis the responsibility of a husband and also it imposes joint property. The obligation of a husband to feed raises an issue regarding the implementation of obligations of a husband that can lead to a legal loophole that could undermine the principle of legal certainty and justice community. It is important to be discussed about nafkah and the concept of joint property in Islamic law and KHI, as well as the obligations to provide nafkah for her husband. Based on this research, understandably ifjoint property was appliedthen it becomes the collective responsibility of husband and wife. It also brings the consequence that all the household duties can beduties in together. Thus Islam adheres to the principle of balance and fairness in the relationship of husband and wife.

 Dapat dideskripsikan, bahwa pelaksanan pembagian harta gono-gini dalam perkawinan poligami adalah sama dengan pembagian harta gono-gini dalam perkawinan monogami, yaitu masing-masing pasangan mendapatkan bagian sama antara suami dan para istri, sebagaimana maksud Pasal 37 Undang-undang Nomor 1 Tahun 1974 dan Pasal 97 Kompilasi Hukum Islam.  Ditetapkan harta bersama dalam perkara ijin poligami, adalah demi kemaslahatan dan melindungi Harta bersama Pemohon dan Termohon, agar istri yang  baru tidak mengklaim harta bersama tersebut dengan menerapkan 3 pilar tujuan hukum yaitu keadilan, kemanfaatan dan kepastian hukumKata kunci: kepastian hukum, poligami, perkawianan It can be described, that the distribution of the gono-gini assets in the polygamy marriage is the same as the distribution of the gono-gini assets in a monogamous marriage, where each pair gets an equal share between husband and wife, as intended in Article 37 of Law Number 1 of 1974 and Article 97 Compilation of Islamic Law. Determined joint property in the case of a polygamy permit, is for the benefit and protection of Assets with the Petitioner and Respondent, so that the new wife does not claim the joint property by applying the 3 pillars of legal objectives namely justice, expediency and legal certainty Keywords: legal certainty, polygamy, marriage

<p>Judul Penulisan jurnal ini diharapkan menjawab rumusan masalah mengenai bagaimana pengaruh terapi konstruktif untuk membangun komunikasi keluarga islami?. Berdasarkan permasalahan tersebut di atas penulisan jurnal ini menetapkan tujuan yaitu untuk mengetahui pengaruh terapi konstruktif untuk membangun komunikasi kelurga islami. Metode yang penulis gunakan dalam penelitian ini adalah metode kepustakaan. Setelah pemaparan teori yang berhubungan dengan permasalahan maka dapat disimpulkan bahwa pernikahan merupakan satu-satunya sarana untuk membina keluarga yang menghalalkan hubungan pasangan suami istri untuk memperolah keturunan. Setiap pasangan laki-laki dan perempuan melangsungkan pernikahan tentu tujuannya tidak lain adalah untuk memperolah kebahagiaan, keberkahan, dan keturunan. Namun seiring dengan dibangunnya bahtera rumah tangga, seringkali banyak problem keluarga yang muncul silih berganti. Dan terkadang permasalahan itu tidak bisa diselesaikan secara mandiri oleh kedua pasangan suami istri—mereka membutuhkan pihak lain untuk menjadi <em>problem solver</em>. Di sinilah terapi konstruktif dalam pernikahan diperlukan sebagai usaha untuk membantu mengentaskan kesulitan-kesulitan pasangan suami istri dalam rumah tangga mereka untuk memperoleh kebahagiaan dalam menempuh kehidupan berumah tangga. Salah satu alternatif model terapi yang digunakan dalam mewujudkan keluarga islami adalah terapi konstruktif, yaitu model terapi disandarkan pada pemahaman tentang keluarga yang tidak sekedar berkonsentrasi pada teori-teori tetapi, juga tentang cara keluarga berfungsi secara normal. Melalui terapi konstruktif seorang konselor bisa membantu konseli keluar dari permasalahan keluarga mereka.</p><p><strong>Kata Kunci</strong>: Terapi Konstruktif, Komunikasi, Keluarga Islami</p><p> </p><p><em>BUILDING ISLAMIC FAMILY COMMUNICATION THROUGH CONSTRUCTIVE THERAPHY</em><em>. </em><em>The title of the journal writing is expected to answer the formulation of problems about how the influence of constructive therapy to build communication Islamic family?. Based on the problems in the writing of the journal of this specifies the purpose of which is to know the influence of constructive therapy to build communication do away with the Islamic. The method that I will use in this research is the method literature. After revealing the theory that related with the problems it can be concluded that marriage is the only means to build the family which justifies the relationship of husband and wife pair permission for generations. Each couple male and female holds the marriage of course the aim is to permission of happiness, blessings, and offspring. But along with constructing the ark household, often many problems in the family that appears to surmount. And sometimes the issue could not be completed independently by the two pairs of husband and wife and they need other parties to become the problem solver. This is where the constructive therapy in a marriage is required as an effort to help alleviate the difficulties the couple of husband and wife in their household to obtain happiness in taking the life of housekeeping. One of the alternative therapy model that is used in realizing the family of Islamic law is constructive therapy, namely therapy model is predicated on the understanding of the family that is not just to concentrate on the theory of the theory but also about how the family is functioning normally. Marriage is a rule to authorize the relationship of two different gender to become husband and wife. Sociologically, there are marriage that was done by religious law but was not recorded by the state even until it produced children. Law Number 1 from Year 1974 on Marriage confirms that marriage is valid if conducted according to the religion and registered as regulated on binding law.This study aims to examine the law protection of civilization rights on childrens’ birth from the unregistered marriage. Research methods is normative research with statute, conceptual, and case approaches. Conclusion, recording is one of the important aspects in marriage, if marriage is not recorded, even though it is legal based on the religious law, but in the state provision, marriage does not have the legal force. Furthermore,  it is not recognized by the state because it does not have the right to manage all interests related to the state. Law protection on childrens’ birth from the unregistered marriages can be taken by isbat nikah to legalize the marriage of their parents.Key Words:  Legal Protection, Children, Unrecorded, Marriage, Alimentation, Inheritance, Islamic Law

This study examines more deeply about the judge's consideration in establishing a Muslim as an heir of the assets of a non-Muslim heir in Indonesia, and why wajibah must be chosen as a solution in providing inheritance to non-Muslim heirs in Indonesia. This research is a normative legal research by using statute approach conceptual approach and case approach. The result showed that firstly the judges' considerations that deviate from the Word of the Prophet (peace be upon him): "It is not right for a Muslim to inherit unbelievers, nor do infidels inherit Muslims" is based on the values of justice and legal certainty regarding the rights of heirs to the inheritance arising from the relationship of the heirs arising from the relationship kinship that is so close and peaceful despite different beliefs/different religions, the ability of Muslim heirs to receive inheritance from non-Muslim heirs will bring more kemashalatan (goodness) for Islam. By leaving the inheritance of non-Muslim heirs to Muslim heirs, it will safeguard these assets to bring good deeds in accordance with the teachings in Islam. Secondly, mandatory wills are chosen as a way out in giving inheritance to non-Muslim heirs, because the heir does not leave a will or grant during his lifetime to non-Muslim heirs, so that for the sake of fairness, usefulness and legal certainty, the judge with his authority has the authority to determine compulsory testaments to non-Muslim heirs. Because the kinship system in Islamic law is more important when compared to religious differences as a barrier to inheritance.

The division of marital joint property after the breakup of marriage, whether dropping out of marriage due to divorce or due to death, is a new thing in Islamic jurisprudence (fiqh). This is because the concept of mutual treasure is not known in the books of classical Islamic jurisprudence of Muslim scholars of the schools at their times, in which their work are always made as referral in the legal cases up to the present days. In Indonesia, the distribution of common property is regulated in the Compilation of Islamic Laws Articles 96 and 97, which stipulate the rules of distribution of joint property for married couples whose married are off as a result of divorce or death. Article 97 of the Compilation of Islamic Law actually provides an overview of the flexibility of the distribution of common marital property, including in certain cases because the article is regulating (regelen) rather than forcing (dwigen), so that the division is not absolutely divided equally between husband and wife, and casuistically the provisions of that article may be disregarded.

The problem of debt is included in the field of personal status, where marriages are carried out between spouses, which as a result of the law of debt become a burden to be borne together from marriage agreements between citizens, especially related to the distribution of joint assets. How is the legal liability of debtors to creditors in the final period of marriage? and How is the legal protection for the debtor's innate property? Regarding the marriage agreement, it is regulated in Article 29 of Law Number 1 of 1974 concerning Marriage. This is because of the agreement made between the husband and wife both regarding joint property after marriage and the child's guardianship rights as well as the citizenship status of the child and each party. The method used in this research is normative juridical and empirical juridical research which is analyzed using legal certainty theory and legal liability theory. From the results of the research. Events that often occur in the field of debt, debt repayments that must be paid by the debtor are often not as agreed. In the legal certainty of customer credit guarantees on objects of land and building mortgages, there is a decrease in the appraisal value by the bank, but the binding of credit guarantees with mortgages is carried out if a customer or debtor obtains credit facilities from the bank. Divorce is an abolition of marriage accompanied by a judge's decision. or at the will of one of the parties, both husband and wife, through the submission of a claim by one of the parties to the marriage. This type of research used here is a type of empirical research where this research is carried out on the real situation in a community or the surrounding environment with the aim of finding facts or existing legal problems The results of this study indicate that the legal power of mediation in the trial process at the Badung Religious Court namely with the peace deed the results of the peace agreement get legal certainty

This research was motivated by the decision of the Tembilahan Religious Court judges who decided the joint property case in which the judge decided the Plaintiff (husband) got 1/4 while the Defendant (wife) got 3/4 of the shared property. However, Article 97 in the Compilation of Islamic Law states that: "Widows or widowers are each entitled to half of the joint property as long as it is not stipulated otherwise in the marriage agreement." This research is in the form of library research using case No.0233/Pdt.G/2018/PA.Tbh, as the primary reference, while the secondary material in this paper consists of laws and regulations related to the object of the research decision No. 0233/Pdt.G/2018/PA.Tbh as well as books, journals, scientific works related to the object of research. The author's data collection technique uses interview techniques and study documents or library materials. The results of the verdict research are in accordance with the judge in deciding the case based on Legal Certainty (legal certainty) and Legal Justice (legal justice), legal certainty is what has been outlined by the laws and regulations, Compilation of Islamic Law, like this case according to legal certainty then the distribution it is the wife gets 1/2 and the husband also gets 1/2 then if only this which is applied rigidly in the case will reduce the values of justice itself, thus the judge in determining the joint property case uses Legal Justice.

Abstract: The Concept of  Joint Assets and its Implementation in the  Religious Court. Legislation in Indonesia stipulates that any property acquired during marriage becomes joint property of husband and wife, without distinguishing who works and who registered the property. If the marriage come to an ends, either through death or divorce, the property must be divided equally. In general, this study found that a panel of judges in the religious court division decided a case of the distribution of joint property is not outside of the statutory rules. Since no agreement or reconciliation had been made   by the husband and wife in dispute about the portion of the division of their property, the judge decided that the joint property be divided in the same amount. However, if there is an agreement between husband and wife, the division of the joint property will be based on that agreement.Keywords: community property, Compilation of Islamic Law, judgment, Court of Religion.Abstrak: Konsep Harta Bersama dan Implementasinya di Pengadilan Agama. Perundang-undangan di Indonesia mengatur bahwa setiap harta yang diperoleh selama perkawinan dijadikan sebagai harta bersama suami isteri, tanpa membedakan siapa yang bekerja dan harta itu terdaftar atas nama siapa. Apabila perkawinan itu berakhir, baik karena kematian maupun karena perceraian, maka harta tersebut harus dibagi dua sama banyak nilainya. Penelitian ini menemukan data bahwa secara umum majelis hakim Pengadilan Agama dalam memutuskan perkara pembagian harta bersama tidak keluar dari aturan perundang-undangan tersebut. Selama tidak ada kesepakatan atau perdamaian yang dibuat oleh suami dan isteri yang bersengketa tentang porsi pembagian harta bersama, majelis hakim memutuskan harta bersama tersebut dibagi sama banyak. <p>Abstract<br />The purpose of this article  to determine the judge’s considerations using penal mediation in the settlement of Domestic Violence (KDRT) cases and its formulation in the future. This is a normative study with case approach, comparative approach and conceptual approach. The legal matterial of this research are primary legal matterial and secondary legal material with deductive analystic mind. Reffering the research above, Showed that there is a difference of judges consideration using the result of penal mediation in the form of peace between offender and victim who still have relationship of husband and wife in the settlement of case of domestic violence for offense. First, it is based on the benefit and recovering of the relationship of the offender and the victim, to the exclusion of the legalistic rules, so that the Judge arrives at the decision of the prosecution otherwise unacceptable. Second, based on expediency, but the legal process continues with the imposition of a conditional penalty. The existence of differences in consideration and judgment because the mediation of penal itself is not yet regulated in positive criminal law in Indonesia. However, with the starting point on the principle of benefit and the theory of pragmatic realism, the Judge should not worry or hesitate to use the results of peace in penal mediation as a way of resolving a domestic violence case by  stopping the proceedings, although considered to be contrary to the principle of legal certainty. This has implications for the achievement of substantial justice for offender and victim, a quicker settlement of cases and avoid the accumulation of cases in the Court. Therefore the future needs to be formulated for mediation of penal entry into inseparable part in the procedure of settling the case of domestic violence, especially for offense complaints, ranging from the level of investigation, prosecution and court.<br />Keywords: Penal Mediation; Domestic Violence; Judge’s Decision</p><p>Abstrak<br />Tujuan artikel ini adalah untuk mengetahui pertimbangan Hakim menggunakan mediasi penal dalam penyelesaian perkara Kekerasan Dalam Rumah Tangga (KDRT) dan formulasinya di masa mendatang. Penelitian ini merupakan studi normatif dengan pendekatan  kasus, pendekatan komparatif dan pendekatan konseptual. Bahan hukum yang digunakan berupa bahan hukum primer <br />dan bahan hukum sekunder dengan pola analisis deduktif. Hasil penelitian, menunjukkan bahwa adanya perbedaan pertimbangan Hakim menggunakan hasil mediasi penal berupa perdamaian antara pelaku dan korban yang masih ada hubungan suami istri dalam penyelesaian perkara KDRT untuk delik aduan. Pertama, mendasarkan pada kemanfaatan dan pulihnya hubungan <br />pelaku dan korban, dengan mengenyampingkan aturan yang bersifat legalistik, sehingga Hakim sampai pada putusan berupa penuntutan dinyatakan tidak dapat diterima. Kedua, mendasarkan <br />pada kemanfaatan, namun proses hukum tetap dilanjutkan dengan penjatuhan pidana bersyarat. Adanya perbedaan pertimbangan dan penjatuhan putusan tersebut karena mediasi penal sendiri <br />memang belum diatur dalam hukum positif pidana di Indonesia. Akan tetapi dengan bertitik tolak pada asas kemanfaatan dan teori realisme pragmatis, semestinya Hakim tidak khawatir atau <br />ragu menggunakan hasil perdamaian dalam mediasi penal sebagai jalan penyelesaian perkara KDRT dengan menghentikan proses perkara, meski dianggap bertentangan dengan asas kepastian <br />hukum. Hal tersebut berimplikasi pada tercapainya keadilan substansial bagi pelaku dan korban, penyelesaian perkara yang lebih cepat dan menghindari penumpukan perkara di Pengadilan. <br />Kedepannya perlu diformulasikan agar mediasi penal masuk menjadi bagian tidak terpisahkan dalam prosedur penyelesaian perkara KDRT, khususnya untuk delik aduan, mulai dari tingkat penyidikan, penuntutan dan pengadilan.<br />Kata kunci: Mediasi Penal; Kekerasan Dalam Rumah Tangga; Putusan Hakim.</p>
