Marriage is a rule to authorize the relationship of two different gender to become husband and wife. Sociologically, there are marriage that was done by religious law but was not recorded by the state even until it produced children. Law Number 1 from Year 1974 on Marriage confirms that marriage is valid if conducted according to the religion and registered as regulated on binding law.This study aims to examine the law protection of civilization rights on childrens’ birth from the unregistered marriage. Research methods is normative research with statute, conceptual, and case approaches. Conclusion, recording is one of the important aspects in marriage, if marriage is not recorded, even though it is legal based on the religious law, but in the state provision, marriage does not have the legal force. Furthermore,  it is not recognized by the state because it does not have the right to manage all interests related to the state. Law protection on childrens’ birth from the unregistered marriages can be taken by isbat nikah to legalize the marriage of their parents.Key Words:  Legal Protection, Children, Unrecorded, Marriage, Alimentation, Inheritance, Islamic Law

Abstract Egypt’s Coptic community is currently appealing to different legal jurisdictions in the struggle over divorce and remarriage. While the Coptic Orthodox Church is claiming the right, based on Islamic law, to apply its own communal law for marriage, others are calling on the church to reinterpret the biblical texts regarding divorce. Still other Copts are appealing to the constitution and to unitary state law to override a communal approach to personal status law. The case of divorce and remarriage in Egypt illustrates the ways in which Christian communal law, unitary state law, and Islamic law do not exist as a priori concepts but are in the process of continual negotiation with one another. In examining these negotiations, this article sheds light on one of the most important legal conundrums currently facing the relationship between the Coptic community and the state in Egypt.

Marriage is a very sacred bond. The purpose of this research is to study and analyze the existence of household life phenomena that occur misunderstandings, disputes, quarrels, which are prolonged, which trigger a break in the relationship between husband and wife, but there are also disputes in the household but do not break the relationship in the sense of divorce but the husband has an affair. The research method used in this research is normative legal research, with a statutory approach, conceptual approach and case approach. The results of the research show that the husband performs the next marriage, it is permissible in Islamic law as long as there is honesty and permission from the first wife, but if a marriage is carried out secretly without the permission of the first wife then this marriage will bring harm to the parties and this kind of marriage will not will be recognized by religious law and State law which will result in the parties not getting recognition and protection by law because the marriage is considered invalid and can be canceled.

In the discipline of Islamic law research, strong proofing and clear Istinbat method are key pillars in the construction of Islamic law based on the application of the science of usul al-fiqh and maqasid al-shari'ah. However, what happens at the state of Johor’s fatwa institution is the opposite. The fatwa research methods applied by the Fatwa Committee of Johor in resolving current fatwa issues is not based on the right and true discipline of Islamic law research. In fact, current inputs related to fatwa issues are not explicitly stated in the method of determining the law either in the form of reality or scientifically verified. Therefore, this paper will discuss the fatwa procedures undertaken by the Fatwa Committee of Johor based on the methods applied in resolving current issues. The research methodology adopted is library and interview methods. This study shows that fatwa management and production in the state of Johor is placed under the jurisdiction of the Mufti of Johor’s Department. The methods adopted by the Fatwa Committee of Johor covers two methods, namely: internal research methods including literature review through the application of original source and proofs based on syarak. Second: field research method that includes an external review or going to the location of study such as conducting observation, questionnaires and interviews including referrals to specialists of different fields. Maslahah and mafsdah consideration are also implemented by the Fatwa Committee in every fatwa decision based on the standard that meets the interests of maqasid al-shari'ah. Namun begitu, apa yang berlaku di institusi fatwa negeri Johor adalah sebaliknya. Kaedah penyelidikan fatwa yang diaplikasi oleh Jawatankuasa Fatwa Negeri Johor dalam menyelesaikan isu fatwa semasa tidak berasaskan kepada disiplin penyelidikan hukum Islam yang tepat dan sebenar. Malahan input-input semasa yang berkaitan dengan isu fatwa juga tidak dinyatakan secara jelas dalam kaedah penentuan hukum sama ada dalam bentuk realiti yang berlaku atau pembuktian secara saintifik. Justeru, kertas kerja ini akan membincangkan prosedur fatwa Jawatankuasa Fatwa Negeri Johor berdasarkan metode-metode yang diaplikasi dalam menyelesaikan isu-isu yang bersifat semasa. Metodologi kajian yang digunakan dalam kajian ini adalah melalui metode perpustakaan dan metode lapangan. Hasil kajian menunjukkan bahawa pengurusan dan pengeluaran fatwa di negeri Johor hanya terletak di bawah bidang kuasa Jabatan Mufti Johor. Metode fatwa yang diamalkan oleh Jawatankuasa Fatwa Negeri Johor merangkumi dua metode iaitu pertama, kaedah penyelidikan dalaman yang merangkumi kajian kepustakaan menerusi pengaplikasian dari sumber asas dan dalil-dalil syarak. Kedua, kaedah penyelidikan lapangan yang meliputi kajian luaran atau turun ke lokasi kajian seperti observasi, soal selidik dan temubual dan rujukan kepada pakar dalam bidang yang berlainan. Pertimbangan maslahah dan mafsdah juga dimplementasikan oleh Jawatankuasa Fatwa dalam setiap keputusan fatwanya berasaskan standard yang menepati kepentingan maqasid al-shari’ah. La policía comunitaria es una institución de los pueblos indígenas de Guerrero conocida por su capacidad para enfrentar a la delincuencia y generar alternativas de paz social., através de un sistema de justicia y seguridad autónomo. En los últimos años, sin embargo, el sistema comunitario enfrenta el acoso de actores diversos vinculados al incremento de la violencia y la inseguridad que se vive en el país y especialmente en el estado de Guerrero; dicha situación está impactando a la institucionalidad comunitaria, obligando a su redefinición. En este trabajo destaco aspectos centrales de dicha conflictividad así como las respuestas que han dado los comunitarios para hacer frente a las tareas de justicia y seguridad en el marco de nuevos contextos marcados por el despojo neoliberal y la impunidad de actores estatales y no estatales. En este proceso se actualiza la relación de la policía comunitaria con el Estado revelando el peso de la ambigüedad legal y los juegos del poder así como los usos contra-hegemónicos del derecho para disputar la justicia. ---SEGURANÇA E JUSTIÇA SOB ACOSSO EM TEMPOS DE VIOLÊNCIA NEOLIBERAL: respostas do policiamento comunitário de GuerreroO policiamento comunitário é uma instituição dos Povos Indígenas do Guerrero conhecidos por sua capacidade de lidar com o crime e gerar paz social de forma alternativa, usando um sistema próprio de justiça e segurança. Nos últimos anos, no entanto, o sistema da UE enfrenta assédio de várias autoridades envolvidas no aumento da violência e da insegurança que reina no país e, especialmente, no estado de Guerrero; essa situação está afetando as instituições comunitárias, forçando a sua redefinição. Neste artigo, destaco os principais aspectos do conflito e as respostas que têm a comunidade para lidar com as tarefas da justiça e da segurança no contexto dos novos contextos marcados por pilhagem neoliberal e a impunidade de atores estatais e não estatais. In recent years, however, the EU system faces harassment from various people responsible for the increase of violence and insecurity within the country and especially in the state in Guerrero; this situation is impacting instituitions in the community, forcing their redefinition. In this paper I highlight key aspects of the conflict and the community's responses to deal with the tasks of justice and security in new contexts marked by neoliberal plunder and impunity of the state (as well as non state figures). In this process, the relationship of the community police with the state is updated revealing the weight of legal ambiguity and power plays, as well as counter-hegemonic use of the right to dispute justice.key words: neoliberal vilence; Guerrero; indigenous people.

The distinction in the normative character of legal traditions will give an effect of the state different attitude to those traditions. In the case of Islamic law and adat law in Indonesia, we see that although having different basic character in terms of its foundation of legal creation, Islamic law can relatively be closer to the character of the state law, which is uniform and nationally effective. It is clear here that the nationalization of Islamic law built on the basis of its adherents, and not on the tribe, clan, language, or other local denominations, becomes an effective tool for its rapprochement with the state law, which is also nationalized on the basis of citizenship. Thus, although it is not possible to equalize Islamic law and state law due to the sacredness of the religious law, the scope in the efficacy of both laws can be an effective means of legal rapprochement. This is however not the case with adat law. The character of adat law as a local and heterogeneous legal tradition is intrinsically not in line with the philosophy of national law, which is anti-localism and homogeneous. It is just impossible to bring adat law to become an effective law for all Indonesian citizens. As a result, the rapprochement is difficult between adat law and state law.

<p>The relationship between the religion represented by Islam and the State that is represented by the democratic political system continues remain to be a problem. Ideological debates that Islamic law should be implemented and escorted through Islamic countries experiencing resistance against groups who argued that Islam is a substance that is in compliance with democracy. Religious ideology has often been a motivation to justify the struggle through the violence that has been done. Strengthening of violence in the name of religion is regarded as a form of struggle for bottomic beliefs and religious form in kaffah. Nationalism of Islamic religion Leaders by receiving Pancasila as the Indonesian ideology  its been a moderate wisdom that has taken to maintain the unity of Indonesia, while keeping the existence of religions living. The relationship of religion and the State by Islamic religion Leaders of Nahdhatul Ulama (NU) considered as a mutual-connection with maintaining Indonesian nationalism without discriminating treatment of religions, tribes, and inter-group relations is face Islam Nusantara in Indonesia. Politics as the source of radicalism muted by NU leaders with a fatwa that receiving of Pancasila both as the nations foundation and as a spirit of Islam Nusantara. This research uses psychology politics theory and the theory of social identity’s approach that analyzing potential radicalism in society.</p>

The Birth of Law No. 23/2011 marks a new era of transformation of the national charity which has given rise to a new paradigm of charity management in our country. Some rules are the result of constitutive ijtihadin the ?eld of charity gets a reaction from some quarters, especially related to the management of charity by the state authority. Regardless of the debate which led to the material and formal lawsuit, there are several key issues to be further analyzed in relation to the reconstruction of ?qh paradigm evaluated from the perspective of contemporary Islamic law. First, the authorities and the involvement of the state as charities through the agency or institution that is of?cially established or recognized by the state, so that the management of charity can be done effectively, guaranteed. And have legal certainty. Secondly, the absence of sanctions for muzaki who shirk the obligation of charity in Law No.23 / 2011 shows that the payment of charity is voluntary, therefore charity regulations in Indonesia are still considered weak in the legal framework that can bind to the individual or business entity that is exposed to the taxpayer , Third, the reform paradigm of subject, object and charity tas{arruf ?eld have already accommodated in Law No.23 / 2011 in accordance with the principle of mas}lah}atand justice. Fourth, the relationship of charity and tax reaf?rmed in the amendment of new Law charity as?scal incentives for charity payers to make charity as a reduction of PKP (tax deduction), although this provision has not been able to realize the position of charitywhich is more signi?cant as a tax deduction(tax credit).

<p><em>The concept of state in Islam only regulates principles or principles, among others, about leaders who must be honest, trustworthy, fair, transparent, and protect human rights (fitrah). Islam teaches and gives guidance in the life of the state. This means that the State must be built as a home to uphold justice in accordance with the rights that are basically owned by every citizen. The success of the Prophet Muhammad. Building a Muslim community in Medina by some Muslim intellectuals is called the City State.  The problem in this research is how the concept of the rule of law in the perspective of Islamic law. The method used in this research is descriptive research, descriptive research is intended to provide data as thorough as possible about an effort, symptoms, events and events that occur at the moment, and is deductive based on general theories applied to explain about a set of data, the relationship of a set of data with another set of data. In this study the method used is a normative juridical approach. The activities carried out are the inventory of legal materials, identification of legal materials, classification of legal materials, systematization of legal materials, and interpretation and construction of legal materials.  Based on the results of the study shows the concept of the State of Islamic Law Perspective with various scopes between the idea of state, Religion, State and law according to </em><em>Al-Quran</em> <em>and Hadith as well as the contribution of Islamic Law to the development of National Law.  </em></p>

This paper will discuss the side of the interlegality and interlaw among customary law, religious law and state law in tribal societies in Indonesia, which is focused on the marriage of Sasak people. As an Indonesian local community, the Sasak community has their own local laws in undergoing interactions and social contracts between each other, especially in matters of marriage. Along with the embrace of Islam by the Sasak community, the Islamic law also contributes in decorate every process of the marriage. In addition to the existence of customary law and Islamic law that adorn the marriage of the Sasak community, there is also a modern legal tradition, namely state law. As part of the Indonesian society, the Sasak people cannot escape the great influx of modern legal tradition or national law positivism, which is directly echoed by the state. Departing from this illustration, the discussion in this paper includes: the interlegality between Sasak customary law and religious law (Islamic law); the interlegality between Sasak customary law and state law; and the last is the interlegality among Sasak customary law (local legal order), religious law (Islamic law/Islamic legal order), and state law (state legal order).Tulisan ini akan membahas sisiinterlegalistikantara hukum adat, hukum agama dan hukum negara pada masyarakat kesukuan di Indonesia, yang difokuskan pada perkawinan masyarakat suku Sasak. Sebagai masyarakat lokal Indonesia, masyarakat Sasak memiliki hukum lokal sendiri dalam menjalani intraksi dan kontrak sosial antara satu sama lain, khususnya dalam persoalan perkawinan. Seiring dengan dipeluknya agama Islam oleh masyarakat Sasak, maka hukum Islam pun memberi andil dalam menghiasi setiap proses-proses perkawinan itu. Selain keberadaan hukum adat dan hukum Islam yang menghiasi perkawinan masyarakat Sasak, terdapat juga tradisi hukum modern, yakni hukum negara. Sebagai bagian dari masyarakat Indonesia, masyarakat Sasak tidak bisa melepaskan diri dari arus besar legisme atau positifisme hukum nasional, yang secara langsung digaungkan oleh negara. Berangkat dari ilustasi ini, maka pembahasan dalam tulisan ini meliputi: interlegalistik antara hukum perkawinan adat Sasak dan hukum agama (Hukum Islam); interlegalistik antara hukum perkawinan adat Sasak dan hukum negara; dan terakhir adalah interlegalistik antara hukum perkawinan adat Sasak, hukum agama (hukum Islam), dan hukum negara.

<p>Judul Penulisan jurnal ini diharapkan menjawab rumusan masalah mengenai bagaimana pengaruh terapi konstruktif untuk membangun komunikasi keluarga islami?. Berdasarkan permasalahan tersebut di atas penulisan jurnal ini menetapkan tujuan yaitu untuk mengetahui pengaruh terapi konstruktif untuk membangun komunikasi kelurga islami. Metode yang penulis gunakan dalam penelitian ini adalah metode kepustakaan. Setelah pemaparan teori yang berhubungan dengan permasalahan maka dapat disimpulkan bahwa pernikahan merupakan satu-satunya sarana untuk membina keluarga yang menghalalkan hubungan pasangan suami istri untuk memperolah keturunan. Setiap pasangan laki-laki dan perempuan melangsungkan pernikahan tentu tujuannya tidak lain adalah untuk memperolah kebahagiaan, keberkahan, dan keturunan. Namun seiring dengan dibangunnya bahtera rumah tangga, seringkali banyak problem keluarga yang muncul silih berganti. Dan terkadang permasalahan itu tidak bisa diselesaikan secara mandiri oleh kedua pasangan suami istri—mereka membutuhkan pihak lain untuk menjadi <em>problem solver</em>. Di sinilah terapi konstruktif dalam pernikahan diperlukan sebagai usaha untuk membantu mengentaskan kesulitan-kesulitan pasangan suami istri dalam rumah tangga mereka untuk memperoleh kebahagiaan dalam menempuh kehidupan berumah tangga. Salah satu alternatif model terapi yang digunakan dalam mewujudkan keluarga islami adalah terapi konstruktif, yaitu model terapi disandarkan pada pemahaman tentang keluarga yang tidak sekedar berkonsentrasi pada teori-teori tetapi, juga tentang cara keluarga berfungsi secara normal. Melalui terapi konstruktif seorang konselor bisa membantu konseli keluar dari permasalahan keluarga mereka.</p><p><strong>Kata Kunci</strong>: Terapi Konstruktif, Komunikasi, Keluarga Islami</p><p> </p><p><em>BUILDING ISLAMIC FAMILY COMMUNICATION THROUGH CONSTRUCTIVE THERAPHY</em><em>. </em><em>The title of the journal writing is expected to answer the formulation of problems about how the influence of constructive therapy to build communication Islamic family?. Based on the problems in the writing of the journal of this specifies the purpose of which is to know the influence of constructive therapy to build communication do away with the Islamic. The method that I will use in this research is the method literature. After revealing the theory that related with the problems it can be concluded that marriage is the only means to build the family which justifies the relationship of husband and wife pair permission for generations. Each couple male and female holds the marriage of course the aim is to permission of happiness, blessings, and offspring. But along with constructing the ark household, often many problems in the family that appears to surmount. And sometimes the issue could not be completed independently by the two pairs of husband and wife and they need other parties to become the problem solver. This is where the constructive therapy in a marriage is required as an effort to help alleviate the difficulties the couple of husband and wife in their household to obtain happiness in taking the life of housekeeping. One of the alternative therapy model that is used in realizing the family of Islamic law is constructive therapy, namely therapy model is predicated on the understanding of the family that is not just to concentrate on the theory of the theory but also about how the family is functioning normally.
