Land buying and selling according to customary law needs to know the validity and strength of the evidence, so that if a claim can be maintained in court. The formulation of the problem of this research is how a juridical review of the validity and strength of evidence of land buying and selling according to customary law. The research method used is normative legal research. The results of the discussion indicate that a juridical review of the validity of buying and selling according to customary law is legal as in the Supreme Court Jurisprudence Number 952k / Sip / 1974 that buying and selling is legal in fulfilling the requirements of customary law, in real, cash and known by the Head of Village / Head The village, while the strength of the evidence is that if the land is bought verbally, the strength of the evidence is free, whereas if done in writing, the strength of the evidence is the beginning and will be perfect if acknowledged by the parties or supported by other evidence tools such as evidence statement from 2 witnesses

This study aims to analyze the need to establish a special election court which has the authority to solve various election law cases in order to realize elections with integrity; and analyzing the formulation of election special justice in order to realize the integrity of the election. The research method used is the method of normative legal research and the implementation of this research collects data from various sources in order to get an answer to the issues that have been formulated. The results of the study shows that  the purpose of the need for the formation of special judicial elections; First, to meet the growing demands of increasingly complex justice in society and more election law enforcement so as to realize the integrity of the elections; Second, To handle the election law cases quickly and simply so as to obey the integrity of the election. Formulation; First, the election special justice to be able to work quickly and simply in handling election law cases, domiciled at the central and provincial level, then entering the District Court or the High Court; Secondly, the Guidelines for the election special judicial law shall be based on Supreme Court Regulation Number 4 Year 2017 on Procedures for the Settlement of Administrative Offenses of the General Elections in the Supreme Court. Penelitian ini bertujuan untuk menganalisis perlunya membentuk peradilan khusus pemilu yang mempunyai kewenangan menyelesaikan berbagai perkara hukum pemilu agar terwujud pemilu yang berintegritas; dan menganalisis formulasi pembentukan peradilan khusus pemilu dalam rangka mewujudkan integritas pemilu. Metode penelitian yang digunakan ialah metode penelitian hukum normatif dan pelaksanaan dari penelitian ini mengumpulkan bahan hukum dari berbagai sumber guna mendapatkan suatu jawaban atas pokok-pokok permasalahan yang telah dirumuskan. Hasil penelitian menunjukkan bahwa tujuan perlunya pembentukan peradilan khusus pemilu; Pertama, Untuk memenuhi tuntutan perkembangan akan keadilan yang semakin kompleks dalam masyarakat dan lebih penegakan hukum pemilu sehingga mewujudkan integritas pemilu; Kedua, Untuk menangani perkara hukum pemilu dengan cepat dan sederhana sehingga mewudkan integritas pemilu. Formulasi; Pertama, Peradilan khusus pemilu agar bisa bekerja cepat dan sederhana dalam menangani perkara hukum pemilu, berkedudukan di tingkat pusat dan provinsi, selanjutnya masuk pada Pengadilan Negeri atau Pengadilan Tinggi; Kedua, Pedoman beracara pada peradilan khusus pemilu berdasarkan pada Peraturan Mahkamah Agung Nomor 4 Tahun 2017 tentang Tata Cara Penyelesaian Pelanggaran Administratif Pemilihan Umum Di Mahkamah Agung.

Kajian ini untuk mengkaji eksistensi Komisi Yudisial Republik Indonesa dalam menciptakan hakim agung yang berkualitas dan berintegritas. Metode peneltia yang digunaka menggunakan metode peneltian hukum normatif. Hasil kajian menunjukkan bahwa Kewenangan Komisi Yudisial sebagaimana diatur dalam Pasal 24B ayat (1) UUD 1945 mengalami dinamika dan perubahan dalam penafsiran baik pada tingkat legislasi di DPR, ajudikasi di Mahkamah Konstitusi dan Mahkamah Agung, maupun pada tingkat regulasi di Mahkamah Agung dan Komisi Yudisial.Eksistensi Komisi Yudisial mengusulkan pengangkatan hakim agung telah mengalami perluasan makna mencakup hakim ad hoc di Mahkamah Agung serta penguatan dengan dihapuskan kewenangan DPR untuk memilih calon hakim agung dan hanya menyetujui atau tidak menyetujui calon hakim agung usulan Komisi Yudisial. This study is to study the existence of the Judicial Commission of the Republic of Indonesia in creating high-quality judges with integrity. The research method used uses normative legal research methods. The results showed that the authority of the Judicial Commission as referred to in Article 24B paragraph (1) of the 1945 Constitution experienced dynamics and changes in interpretation both at the legislative level in the DPR, adjudication in the Constitutional Court and Supreme Court, as well as in the Supreme Court and Judicial Commission. The existence of the Judicial Commission proposing the appointment of a Supreme Court judge has broadened the meaning including ad hoc judges in the Supreme Court and strengthened by abolishing the authority of the DPR to elect candidate judges and only approving or not approving candidates for the proposed Judicial Commission.

Today's Balinese customary law recognizes two ways to carry out a marriage, namely marrying by memadik (engaging) and marrying by means of Ngerorod (kawin lari). If during the engagement period the parents and families of both parties have the blessing, the marriage will be done by memadik. Conversely, if the engagement period does not get the blessing of the parents and family of one or both parties, while the couple has already fallen in love and it is no longer possible to be separated, then ngerorod is the only way to get married. This study aims to determine the validity of the Ngerorod marriage (kawin lari) in the village of Kelusa, and to determine the legal settlement of the Ngerorod marriage in the village of Kelusa. The research method used is an empirical legal research method with a sociology of law approach. The results showed that the legality of the ngerorod marriage that usually occurs in Kelusa village is that the man and the woman make a statement that the woman is legally in the house of the man she loves. The male family came to Bendesa Adat and Kelian Adat to discuss the ngerorod marriage, then the man picked up the woman in front of her house. Then, the legal settlement in the Ngerorod Marriage in Kelusa village was because the woman was still married to another person, after going through a sangkep (meeting) by the traditional village prajuru giving customary sanctions and being directed or obliged to legally divorce according to the provisions of the Law.

At this time layoffs for efficiency reasons are still a polemic because there are two different interpretations caused by the provisions of Article 164 Paragraph (3) of the Manpower Law. This raises problems in Manpower so it needs to be investigated in this paper is whether in case No.825K / Pdt.Sus-PHI / 2015 has been in accordance with the efficiency criteria set by Law Number 13 Year 2003 on Manpower. The research method used in this writing is the method of normative legal research. Based on the results of the analysis that layoffs for efficient reasons is one of the reasons of the many causes of layoffs provided for in Article 164 of the Manpower Act. In the case of No.825K / Pdt.Sus-PHI / 2015, the layoffs made by PT. PG. Gorontalo Unit PG. Tolangohula, to employees of Cindra Husain is not in accordance with the provisions set forth in Article 164 paragraph (3) of the Manpower Act specifically regulating the Amount of Severance Pay as it does not take into account the Wages of Workers during the Court proceedings. This is corroborated by the Supreme Court Judge declining the appeal of the cassation and the company is considered to have committed acts contrary to the Manpower Act.

The Supreme Court sentenced PT Dongwoo Enviromental Indonesia (PT DEI) for disposing of hazardous and toxic wastes polluting the environment. Meanwhile, PT Adei Plantation & Industry (PT API) was charged with crime for the destruction of land damaging the environment. The research method used is normative legal research, which focuses on two approaches: case approach and conceptual approach. The results show that, first, PT DEI and PT API are charged criminally represented by the board as functioneel daderschap or directing mind and will. Second, PT DEI is charged with subsidized charges, while PT API is charged to alternative charges. Third, PT DEI and PT API are said to have committed a criminal act because management either the directors or regular employees commits a criminal offense for and on behalf of the corporation or in favor of the corporation. Fourth, to prove a corporation fault is through the aggregation of management mistakes or controlling personnel or regular employees in the corporation structure. Fifth, the principal penalty imposed on PT DEI is a fine of Rp 1.500,000,000. Similarly, PT API is fined Rp 650.000.000. Sixth; PT DEI is charged to additional crime in the form of deprivation of profits and closure of the company while PT API is an improvement due to crime. Seventh, with the closing of the company, the judges did not order the executors to liquidate the assets of PT DEI. Eighth, the imposition of the company's closing sanctions should take into account the impacts, such as the termination of employee relation and the interests of shareholders.

LPD as one of the MicroFinance Institutions is very rapidly growing in Bali Province. LPD is said to be the business center of the informal sector. The existence of LPD as a credit institution in the village has been recognized based on customary law. In 2020 LPD in Bali amounted to about 1,433 LPD from a total of 1,485 Indigenous Villages in Bali which more served loans for villagers for various purposes. Therefore, in the management of LPD must be managed properly, correctly, transparency so that there is no misuse of LPD in its management and designation. The research method used in this research is normative-empirical legal research. This research is a blend of normative legal research and empirical legal research. Normative legal research is legal research that uses secondary data, while empirical legal research is legal research that uses primary data.  Based on the results of this pre-study can be concluded the occurrence of criminal acts of corruption committed both the Board and lpd managers cause disputes. Disputes conducted by lpd managers and managers cause conflicts of interest either between the manager with customary karma or between managers and managers both in the duties and functions of their authority. Disputes over customary issues in the Village within the scope of LPD either indicated that cause village losses or violations of applicable laws and regulations are often resolved through national law compared to customary law that applies in an LPD area. LPD sebagai salah satu Lembaga Keuangan Mikro sangatlah berkembang pesat di Provinsi Bali. LPD dikatakan sebagai pusat usaha sektor informal. Eksistensi LPD sebagai lembaga perkreditan di desa telah diakui keberadaannya berdasarkan hukum adat. Tahun 2020 LPD di Bali berjumlah sekitar 1.433 LPD dari total 1.485 Desa Adat di Bali yang lebih banyak melayani pinjaman bagi masyarakat desa untuk berbagai keperluan. Oleh karena itu didalam pengurusan LPD haruslah dikelola dengan baik, benar, transparansi agar tidak terjadi penyalahgunaan LPD di dalam pengelolaan dan peruntukannya. Metode penelitian yang digunakan dalam penelitian ini adalah penelitian hukum normatif-empiris. Penelitian ini merupakan perpaduan antara penelitian hukum normatif dan penelitian hukum empiris. Penelitian hukum normatif adalah penelitian hukum yang menggunakan data sekunder, sedangkan penelitian hukum empiris adalah penelitian hukum yang menggunakan data primer.  Berdasarkan hasil pra penelitian ini dapat disimpulkan terjadinya tindak pidana korupsi yang dilakukan baik itu Pengurus dan pengelola LPD menimbulkan sengketa. Sengketa yang dilakukan oleh Pengurus dan pengelola LPD menimbulkan konflik kepentingan baik antara pengurus dengan karma adat atau antar pengurus dan pengelola baik dalam tugas dan fungsi kewenangannya. Sengketa permasalahan adat di Desa dalam ruang lingkup LPD baik itu terindikasi yang menimbulkan kerugian desa ataupun pelanggaran Peraturan Perundang Undangan yang berlaku seringkali sengketa tersebut diselesaikan melalui hukum Nasional dibandingkan dengan hukum adat yang berlaku di suatu wilayah LPD.

Tujuan penelitian ini untuk mengetahui bagaimana pengaturan tentang penyelesaian tentang konflik norma antara peraturan menteri terhadap undang-undang dan unruk mengetahui bagaimana sifat putusan mahkamah agung dalam hak uji material. Metode yang digunakan adalah metode penelitian hukum normatif dengan pendekatan perundang-undangan dan pendekatan konsep. Pengaturan tentang penyelesaian konflik norma antara Peraturan Menteri Terhadap Undang-Undang, metode penyelesaian konflik norma itu dengan digunakannya asas lex superior derogate lex inferior ini, yang digunakan dengan terjadinya konflik norma antara UU Peraturan Perundang-Undangan dengan Permenkumham Nomor 2 Tahun 2019 terkait pengaturan penyelesaian konflik norma antara peraturan menteri dengan Undang-Undang, maka berdasarkan asas tersebut yang digunakan adalah UU Peraturan Perundang-Undangan, sehingga Permenkumham Nomor 2 Tahun 2019 harus dikesampingkan. Maka, Pengaturan mengenai Penyelesaian Konflik Norma Antara Peraturan Menteri Terhadap Undang-Undang, menjadi kewenangan Mahkamah Agung berdasarkan Pasal 9 UU Peraturan Perundang-Undangan. Dan Sifat Putusan Mahkamah Agung dalam Hak Uji Materiil dalam memberikan putusannya yang pada prinsipnya yang memiliki konsekuensi hukum aturan tersebut apabila terbukti secara sah dan meyakinkan bertentangan dengan aturan di atasnya maka aturan tersebut akan menjadi tidak sah serta tidak berlaku, dan menjadi tanggungjawab instansi terkait untuk mencabutnya. The purpose of the study is to find how adjustment of the settlement of norm conflicts between Ministerial Regulations toward the Constitution and to find out how the nature of the Supreme Court decision in the right of judicial review. The method used was normative legal research method with the legislation approach and concept approach. Adjustment on resolving norms of conflict between Ministerial Regulations toward the Constitution, the method of resolving norms conflicts by using the principle of lex superior derogate lex inferior, which was used in the norm conflicts between the Constitution on Laws and Regulations with Minister of Law and Human Rights Regulation Number 2 of 2019 in relation to conflict resolution arrangements the norm between Ministerial Regulations and the Constitution, then based on the principle used was the Constitution on Laws and Regulations, so Minister of Law and Human Rights Regulation Number 2 of 2019 must be set aside. Thus, the adjustment on resolving norms of conflict between Ministerial Regulations toward the Constitution became authority of the Supreme Court based on Article 9 of the Constitution on Laws and Regulations. And the nature of the Supreme Court's Decision in the Right to Judge Material in providing its decision which in principle had legal consequences of the rule if it was proven legally and convincingly contrary to the rules above, the rule would be invalid and not applicable, and it was the responsibility of related agencies to revoke it.

ABSTRAKPenelitian ini mempermasalahkan pembuktian sederhana dalam proses kepailitan terkait kewajiban pemberitahuan adanya peralihan piutang (cessie) kepada debitur. Putusan Nomor 02/PDT.SUS.PAILIT/2014/PN.Niaga.Mks telah mengabulkan permohonan kreditur cessionaries yang dikuatkan oleh Putusan Nomor 19 K/PDT.SUSPAILIT/2015, namun pada upaya hukum peninjauan kembali majelis hakim justru mengabulkan permohonan peninjauan kembali dengan alasan pembuktian sederhana terhadap cessie belum diberitahukan kepada debitur secara resmi melalui juru sita pengadilan. Rumusan masalah penelitian ini ialah bagaimana konsep pembuktian sederhana dalam kepailitan terhadap kewajiban pemberitahuan pengalihan piutang (cessie) pada pertimbangan majelis hakim peninjauan kembali Nomor 125 PK/PDT.SUS-PAILIT/2015. Metode penelitian ini menggunakan penelitian hukum normatif. Kesimpulan penelitian ini adalah konsep pembuktian sederhana di dalam pembuktian kepailitan tidak ada kewajiban pemberitahuan secara resmi melalui juru sita pengadilan karena Pasal 613 BW tidak mengaturnya, pemberitahuan hanya diajukan secara tertulis dan bisa kapanpun diberitahukan kepada debitur. Kata kunci: kepailitan, pembuktian sederhana, cessie.ABSTRACTThis analysis intends to question the simple proof in bankruptcy proceedings related to the transition of receivable notification obligation (cessie) to the debtors. The Commercial Court Decision Number 02/PDT.SUS.PAILIT/2014/PN.Niaga.Mks has granted the petitions of creditor’s cessionary which was strengthened by the Supreme Court Decision Number 19 K/PDT.SUSPAILIT/2015, but on the judicial review attempt, the Supreme Court has granted the petition for the judicial review on the grounds that a simple proof of cessie has not been officially disclosed to the debtor through a court bailiff. The formulation of this research problem is how the concept of simple proof in bankruptcy proceeding to the obligation of notification of transfer of receivables (cessie) in the consideration of Court Decision Number 125 PK/PDT.SUS-PAILIT/2015. The research method of this analysis is normative legal research. This analysis resolves thatin the simple proof concept of the bankruptcy proceedings, there is no obligation of official notice through the court bailiff because it is not set on Article 613 of Indonesia Civil Code Law, so the notification is only submitted in writing and may at any time be notified to the debtor. Research Aims to find out the characteristics of crooked land regulation in Indonesia. The research method is legal research. the results of the study indicate that the Characteristics of Crooked Land Regulations in Indonesia can be explained through three bases, among them are about crooked land according to customary law, bent land according to Law number 5 of 1960 and crooked land according to Crooked Land according to Indonesian Law No. 6 of 2014. Crooked land has various forms, can be in the form of rice fields, dry land or in the form of fish ponds or ponds. The surrender of land is crooked to the village head and his device, but this will again be the village's right if the Village Head and his apparatus no longer hold office, so that the crooked land will be handed back to the Village Head and Village Equipment who replaced himPenelitian Bertujuan untuk mengetahui mengenal karateristik pengaturan tanah bengkok di Indonesia. Metode penelitian merupakan penelitian hukum. hasil penelitian menujukan bahwa Karateristik Pengaturan Tanah Bengkok Di Indonesia dapat dijelaskan melalui tiga dasar, diantaranya adalah tentang tanah bengkok menurut hukum adat, tanah bengkok menurut UU nomor 5 tahun 1960 dan Tanah bengkok menurut Tanah Bengkok Menurut Undang-Undang No. 6 Tahun 2014. Tanah bengkok memiliki bentuk yang bermacam-macam, dapat berupa tanah persawahan, tanah tegalan maupun berupa kolam ikan atau tambak. Penyerahan tanah bengkok kepada kepala desa dan perangkatnya, namun hal tersebut akan kembali menjadi hak desa jika Kepala Desa dan perangkatnya tidak menjabat lagi, sehingga tanah bengkok akan diserahkan kembali kepada Kepala Desa dan Perangkat Desa yang menggantikannya.

This study examines the existence of the Bali customary law for the transfer of land rights in Blimbingsari Village, and examines function of the Inheritance Certificate for the transfer of rights to land through inheritance. The research method used in this study is an empirical law research. In this case the research uses empirical legal research conducted in Blimbingsari Village, Jembrana Regency. The results showed that the inheritance law that applies to Christian Balinese tribes in Blimbingsari Village, Jembrana, Bali is receptive to Balinese customary inheritance laws which should only be used for Hindus. In its implementation, it is not the Hindu religious law that was received by the Blimbingsari Village community but the Balinese customary inheritance law that was received. Moreover, legal force of a Certificate of Inheritance issued by the village head for the Christian Balinese community in Blimbingsari Village, Jembrana, Bali can be used as a basis in the transfer of ownership rights to the land for the heirs.
