The authority of Local Government regarding on management islands in the border area requires access from the Central Government. The purpose of this research is to find a new concept of local government authority at the border. The methodology used is the normative juridical method. The results of the study: there is an overlapping authority of the Central Government and Local Government, limited access and authority of the Local Government to develop border areas, border development requires decentralization and the authority of the Local Government. In conclusion, the Central Government handed over the federative authority to the Local Government regarding the managing islands in the border areas, the budget for developing the potential of the border areas and the managing islands in the border areas towards the World Maritime Axis.

Nowadays, The Institutional of environmental in regional experinced many changes, its cause of stipulated of Law No. 23 of 2014 on Local Government and Government Act No. 18 of 2016 on Local Government Organization. Rule about central government authority and local government authority on environment aspect that ruled by Act No. 32 of 2009 on Protection and Management of Environment must be adjusted with Act No. 23 of 2014 on Local Government and Government Act No. 18 of 2016 on Local Government Organization. This research analyze about institutional harmonization on statute approaches. It is expected that this research give a knowledge of affairs which central government authority, province government authority, and district/regency government authority clearly especially on environment aspect. The minister of environment and forestry in order to implementing coordinative function, should be obliged to synchronize working program of environment institution between local and central government for making integrated environment management (policy) approaches.

In Act No. 23 of 2014 on Regional Government, where there mention of the obligatory functions and affairs of choice, where one obligatory This is an investment, then in Government Regulation No. 38 Year 2007 on the dealings between the central government, provincial government and district / city government, a local government authority is in the field of investment, government Bandung, capital investment is obligatory and one local government authority is placed in the structure organization Bappeda Bandung is in the Investment Sector, is of course contrary to the Law No. 23 Year 2014 and Government Regulation No. 38 of 2007. This paper provides the organizational structure of institu-tional investment in the city of Bandung.Dalam Undang-Undang Undang-Undang Nomor 23 Tahun 2014 tentang Pemerintahan Daerah dise-butkan mengenai urusan wajib dan urusan pilihan, dimana salah satu urusan wajib ini adalah pena-naman modal, kemudian dalam Peraturan Pemerintah Nomor 38 Tahun 2007 tentang Pembagian urusan antara pemerintah pusat, pemerintah provinsi, dan pemerintah kabupaten/kota, salah satu kewenangan pemerintah daerah adalah dalam bidang penanaman modal, di pemerintahan Kota Bandung, penanaman modal yang merupakan urusan wajib dan salah satu kewenangan pemerintah daerah ditempatkan dalam struktur organisasi Bappeda Kota Bandung yaitu pada Bidang Pena-naman Modal, ini tentu saja berseberangan dengan UU No. 32 Tahun 2004/UU No. 23 Tahun 2014 dan Peraturan Pemerintah No. 38 Tahun 2007. Artikel ini berisi tentang struktur organisasi kelem-bagaan penanaman modal di Kota Bandung.

AbstractLaw Number 3 of 2020 is a new chapter in the development of mining law politics in Indonesia. The latest Minerba Law brings a number of major changes, one of which is the regulation of the authority to issue mining permits which has been transferred entirely to the central government. These changes caused controversy because the were considered contrary to constitutional values and the spirit of reform by eliminating the role of local governments in mineral and coal mining activities. The purpose of this study is to determine the legal politics of transferring mining permits to the central government and its implications for local government authority. This research is quantitative study using a normative juridical method through a statue approach and conceptual approach. This research finds that the legal politics of transferring mining permits to the central government is aimed at solving mining permit problems that facilitate investment activities so as to increase the country’s economic growth. However, the implications of this transfer of authority make regional governments no longer have attributive authority to issue mining permits. The current mining law should move to create synergy between governments, not by placing the central government and local governments on different paths for the sustainability of future development.Keywords : Politics of law; Mining Permit; Local Government Authority.                     AbstrakUU Nomor 3 Tahun 2020 merupakan babak baru dalam perkembangan politik hukum pertambangan di Indonesia. UU Minerba terbaru membawa sejumlah perubahan besar salah satunya mengenai pengaturan kewenangan penerbitan izin pertambangan yang dialihkan seluruhnya kepada pemerintah pusat. Perubahan tersebut menimbulkan kontroversi karena dianggap bertentangan dengan nilai konstitusi dan semangat reformasi dengan menihilkan peran pemerintah daerah dalam kegiatan pertambangan minerba. Tujuan penelitian ini adalah untuk mengetahui politik hukum pengalihan izin pertambangan kepada pemerintah pusat dan implikasinya terhadap kewenangan pemerintah daerah. Penelitian ini merupakan penelitian kuantitatif dengan metode yuridis normatif melalui pendekatan undang-undang dan pendekatan konseptual. Penelitian ini menemukan bahwa politik hukum pengalihan izin pertambangan kepada pemerintah pusat ditujukan untuk mengurai permasalahan izin pertambangan yang memudahkan kegiatan investasi sehingga dapat meningkatkan pertumbuhan ekonomi negara. Namun, implikasi yang ditimbulkan akibat pengalihan kewenangan tersebut membuat pemerintah daerah tidak lagi memiliki kewenangan atributif dalam melakukan penerbitan izin pertambangan. Seharusnya hukum pertambangan yang ada saat ini bergerak untuk menciptakan sinergisitas antar pemerintahan bukan dengan menempatkan pemerintah pusat dan pemerintah daerah pada jalan yang berbeda demi keberlangsungan pembangunan di masa depan.Kata kunci : Politik Hukum, Izin Pertambangan; Kewenangan Pemerintah Daerah.

This article reflects on the experience of undertaking a knowledge exchange project with a local government authority to improve services for older lesbian, gay, bisexual and trans (LGBT) adults. It frames this project in terms of local government equality work, existing research and initiatives concerning older LGBT people and the coming of austerity. The project methodology is detailed, including discussion of the generation and measurement of impact. Some critical issues that arose during the project are considered, including suggestions that these may have been related to economic austerity. The article concludes that although knowledge exchange work with older LGBT people faces challenges in such times, future research and initiatives are warranted.

Penyelenggaraan kewenangan pemerintah daerah telah bergeser ke arah prinsip ultra vires doctrine yang nampak pada perumusan kewenangan pemerintah daerah menjadi urusan pemerintah daerah, dan pembagian kewenangan pemerintah pusat dan daerah mengedepankan prinsip yang kongkuren.Kondisi ini ditandai dengan penyelenggaraan urusan pendidikan yang terbagi antara pemerintah kabupaten/kota dengan pemerintah provinsi, dimana untuk pendidikan dasar diselenggarakan oleh pemerintah kabupaten/kota sedang pendidikan menengah dikelola oleh pemerintah provinsi. Penelitian ini dilakukan dengan pendekatan motode kualitatif melalui observasi dan kajian pustaka.  Hasil dari penelitian ini menunjukkan penyelenggaraan urusan pendidikan menengah yang dialihkan kepada pemerintah provinsi akan menimbulkan sejumlah kecenderungan baru dalam pengelolaannya baik pada pemerintah daerah maupun pada pemerintah provinsi. Pertama, bahwa kebijakan – kebijakan yang selama ini dikeluarkan oleh pemerintah daerah terkait bidang pendidikan tidak seluruhnya akan diakomodir oleh pemerintah provinsi. Kedua, kecenderungan pada meningkatnya alokasi anggaran pada pemerintah provinsi sebagai ekses pengalihan kewenangan tersebut. Ketiga, proses evaluasi, pengawasan dan pengendalian penyelenggaraan pendidikan menengah oleh pemerintah provinsi yang akan semakin berat dilihat dari sisi letak geografis wilayah, dan keempat kekhawatiran akan kurang terakomodirnya muatan kearifan lokal dalam penerapan kurikulum, dimana sebelumnya setiap kabupaten/kota tentunya memiliki karakteristik budaya yang berbeda sebagai bentuk kearifan lokal yang dapat menjadi penguat dalam penyusunan kurikulum pendidikan. Key Words : Penyelenggaraan Urusan Pemerintahan, Pendidikan Menengah   Abstract Implementation of local government authority has shifted towards the principle of ultra vires doctrine which appears on the formulation of local government authority to the affairs of local government, and the division of central and local government authority put forward the principle of kongkuren. This condition is characterized by the implementation of educational affairs divided between district / municipal governments and provincial governments, where basic education is administered by district / municipal governments while high school is managed by the provincial government. This research was conducted with qualitative motive approach through observation and literature review. The results of this study indicate that the implementation of secondary education affairs transferred to the provincial government will lead to new trends in the management of both local government and provincial governments. First, that the policies that have been issued by local governments related to the education sector will not be entirely accommodated by the provincial government. Second, the tendency to increase budget allocation to the provincial government as an excess of the transfer of authority. Third, the process of evaluation, supervision and control of the implementation of high school by the provincial government will be more severe in terms of geographical location of the region, and the four concerns will be less accommodated local wisdom content in the application of the curriculum, where previously each district government / different as a form of local wisdom that can be a reinforcement in the preparation of educational curriculum. After the fall of Soeharto Regime in 1998, the Reform Era in Indonesia began by promoted freedom and autonomy. The centralized approach based on the New Order’s Act No. 5/1974 was replaced by the Act No. 22/1999 on Local Government Autonomy by gave considerable authority to regencies (kabupaten) and municipalities (kota or kotamadya). Some of the scholars labelled the Act No. 22/1999 as “one of the most radical decentralization programs attempted anywhere in the world” (Aspinall 2003: 3). Several years later Act No. 22/1999 was replaced by Act No. 32/2004. Some scholars have suggested that Act No. 32/2004 indicates “recentralization” in the sense that it strengthens the central government by giving it a degree of control over administrative and fiscal matters (Pratikno 2009: 57; Buehler 2009: 102). However, the significant point in the Act No. 32/2004 which introduced direct local head election mechanism for electing local government head was the structural opportunities for women to take greater leadership in local politics. As result, the direct local election from 2005 until 2017 demonstrates the trend of increasing number female political leaders elected as governors/regents/mayors in local politics in post-Suharto (see figure 1).

Weipa is a small mining town with a population of 3,000, located on the west coast of far North Queensland. The mining of bauxite and kaolin by Comalco Mineral Products provide the reason for Weipa’s existence. Frequently described as a ‘closed town’, Weipa has no local government authority. All housing is supplied by Comalco and most of the working population is employed by the company. Those not employed by Comalco are mostly government employees or service personnel. Now twenty-six years old, Weipa is facing a possible change from company control to local government management, a move referred to as ‘normalisation’, and one which has evoked mixed feelings.

<p><strong><em>Abstract</em></strong></p><em>The promulgation of Law no. 23 of 2014 re. Local Government, strengthening local government’s authority, is expected to provide a way out to the problem of how to harvest geothermal energy found in forest protected areas (within the jurisdiction of local government) to supply the increasing demand for electricity throughout Indonesia. For more than 10 years after the promulgation of Law no. 32 of 2004, the central government program to accelerate the utilization of geothermal energy source found within protected forest zones had come to a full stop.  This article discusses the issue of how government authority (central-local) related to the above problem had been distributed and the existing tension between central-local government.   The central government tendency to take back authorities previously granted to local authorities defies the whole effort at making government more accountable, efficient and prevention of externalities.</em>
