The number of existing regulations in Indonesia often has the effect of reducing the effectiveness of implementing laws and regulations due to the overlap between regulations. With the enactment of Act Number 11 of 2020 on Job Creation, many labor regulation have been changed, one of which is related to a specific time work agreement. Therefore, this study aims to conduct a study on change to the provision in the employment agreement for a certain period of time, which certainly affects the rights and obligation between worker and employment, this change must be understood by both worker and employment. Through normative legal research, it can be seen that there are a number of things that need to be discussed in relation to the enactment of Act Number 11 of 2020 on Job Creation. As a result of discussion, this study describes absenteeism and the rights of employment if the worker terminates the employment agreement for a certain period of time before the end of the agreement.

Reforms in the field of employment law is done with the purpose to improve and enhance the quality of labor and personnel welfare. Reformation in the field of employment law begins with the issuance of Act No. 21 of 2000 concerning Trade Union / Labor United. Then followed with the release of Act No. 13 of 2003 on Manpower. Problems in this reasearch: (1) To identify and analyze the Implementation of the Employment Agreement in the Specific Time (PKWT) At the National Land Agency of Kendal. (2) To identify and analyze the forms of legal protection for workers at National Land Agency of Kendal with the Specific Time of Work Agreement (PKWT). The results of this study are: (1) Implementation of the Employment Agreement in the Specific Time (PKWT) at the Land Office of Kendal by implementing probation on each worker who recruits including contract workers. Which it is not supposed to apply probation at a certain time and labor agreements remain to be done if the employment agreement becomes null and void. (2) The legal protection of workers / laborers at Specific Time Work Agreement (PKWT) inemployeein practice has not run optimally, given the frequent violations, because of the vagueness of the rules on the implementation of the Employment Agreement for specific time periods, in providing protection against labor law for employees in the Land Office of Kendal.Keywords: Legal Protection; Labor Contract; the National Land Agency.

This type of research is normative legal research, namely research that puts law as a system of norms, namely about principles, norms, laws and regulations, court decisions, agreements and doctrines. Based on the explanation above, it can be concluded that omnibus law is a legal concept that focuses on simplifying the number of regulations because it revises and revokes many laws at once. Therefore, before the omnibus law concept is actually applied in forming regulations, the principles of participation, transparency, and accountability need to be put forward first. Law Number 11 of 2020 concerning Job Creation, which was designed with the aim of transforming the economy towards advanced Indonesia by 2045, in its Draft and Academic Papers encountered many problems. Especially in the Employment cluster, these problems are related to the reduced rights of workers/laborers. Although it’s undeniable that Law Number 11 of 2020 concerning Job Creation has several positive sides such as providing job loss guarantees for workers/laborers after Termination of Employment, but in reality the positive side of Law Number 11 of 2020 concerning Job Creation is not commensurate with the number of problems that exist.

The enactment of Act 11/2020 on Job Creation in October 2020, resulted in several changes in laws and regulations. One of the crucial articles that were abolished by the Job Creation Act was Article 93 of the Environmental Act (UUPPLH) which regulates rights to file a lawsuit at the Administrative Court, this is contrary to the private law. Also based on Article 2 of the Environmental Act states that environmental protection and management is carried out based on the principle of Participation. This research focuses on the impacts of eliminating Article 93 of the Environmental Act by the Job Creation Act specifically on the principle of Participation. The method used in this research is normative legal research conducted with qualitative analysis. The result is that the elimination of Article 93 of the Environmental Act by Article 21 and Article 22 of the Job Creation Act is contrary to the Participatory Principle contained in Article 2 letter k and Article 70 of the UUPPLH. The abolition of Article 93 of the UUPPLH also causes the judicial power to be unable to exercise the principle of checks and balances.

In the formation of employment agreements, there are two kinds, namely PKWT and PKWTT. However, in its implementation, the implementation of PKWT carried out by the company is not in accordance with the provisions stipulated in the work agreement and the Manpower Act so that the regulation regarding employment is still stretched various constraints and problems as well as challenges faced and require resolution through the court. Based on these explanations, the researcher raised the formulation of the problem 1) How is the Legal Relationship Between Workers and Companies in a Specific Time Work Agreement (PKWT) According to Law Number 13 Year 2003 and 2) What is the Form of Legal Protection Against Workers in a Specific Time Work Agreement Under the Act Law No. 13 of 2003. This study uses normative research methods. The legal materials used are primary, secondary. Work relations that occur between workers and employers are based on an employment agreement as explained by Article 50 of Law Number 13 Year 2003 Regarding Employment. In addition, PKWT can also be updated if the company so wishes. Dalam pembentukan perjanjian ketenaga kerjaan, terdapat dua macam yaitu PKWT dan PKWTT. Namun dalam pelaksanaanya, penerapan PKWT yang dilaksanakan oleh perusahaan ada yang tidak sesuai dengan ketentuan yang diatur dalam perjanjian kerja dan Undang-Undang Ketenagakerjaan sehingga pengaturan mengenai ketenagakerjaan masih terbentang berbagai kendala dan masalah serta tantangan yang dihadapi dan memerlukan penyelesaian melalui pengadilan. Berdasarkan penjelasan tersebut maka peneliti mengangkat rumusan masalah 1) Bagaimanakah Hubungan Hukum Antara Pekerja Dengan Perusahaan dalam Perjanjian Kerja Waktu Tertentu (PKWT) Menurut Undang-Undang Nomor 13 Tahun 2003 dan 2) Bagaimana Bentuk Perlindungan Hukum Terhadap Pekerja dalam Perjanjian Kerja Waktu Tertentu Berdasarkan Undang-Undang Nomor 13 tahun 2003. Penelitian ini menggunakan metode penelitian normatif. Bahan hukum yang di gunakan yaitu primer, sekunder. Hubungan kerja yang terjadi antara pekerja dan pengusaha didasarkan atas perjanjian kerja seperti yang dijelaskan oleh Pasal 50 Undang-Undang Nomor 13 Tahun 2003 Tentang Ketenagakerjaan. Selain itu, PKWT juga dapat diperbarui apabila perusahaan menghendaki.

AbstractAfter Law No. 11 of 2020 concerning Job Creation has been enacted, there are several changes regarding the provisions related to fixed-term employment agreements previously regulated in Law No. 13 of 2003 concerning Manpower. Law No. 11 of 2020 experienced rejection from many workers because there were several changes to the provisions regarding fixed-term employment agreements which were feared to cause problems in its implementation. One of them is related to changes in the provisions regarding the period of time for a fixed-term employment agreement which is determined by the employment agreement itself and is not limited by law. This research uses normative legal research methods. The results of the analysis show that there have been several changes related to the regulations regarding fixed-term employment agreements in Law No. 11 of 2020 and with these changes, there are still some problems and legal voids in several provisions, thus the government should issue government regulations and/or other implementing regulations deemed necessary to address these problems.Keywords: employment agreement; fixed-term employment agreement; job creation lawAbstrakSetelah diundangkannya Undang-Undang No. 11 Tahun 2020 tentang Cipta Kerja, terdapat beberapa perubahan mengenai ketentuan-ketentuan terkait perjanjian kerja waktu tertentu yang sebelumnya diatur dalam Undang-Undang No. 13 Tahun 2003 tentang Ketenagakerjaan. Salah satunya adalah terkait perubahan ketentuan tentang jangka waktu untuk dapat dilakukan perjanjian kerja waktu tertentu yang lamanya ditentukan oleh perjanjian kerja dan tidak diatur mengenai batas maksimalnya dalam undang-undang. Penelitian hukum ini merupakan penelitian hukum normatif. Hasil dari analisa menunjukkan bahwa terdapat beberapa perubahan terkait aturan-aturan mengenai perjanjian kerja waktu tertentu dalam Undang-Undang No. 11 Tahun 2020 tentang Cipta Kerja dan terhadap perubahan-perubahan tersebut masih ditemukan beberapa permasalahan serta kekosongan hukum pada beberapa ketentuan, sehingga pemerintah patut menerbitkan peraturan pemerintah dan/atau peraturan pelaksana lainnya yang dianggap perlu untuk menangani permasalahan tersebut.

Employment relationships may end due to abuse by workers. The existence of abuse must be medically proven. This research aimed to analyze the existence of a visum et repertum for the occurrence of abuse that can be used as evidence in termination of employment. This legal research was normative with a statutory approach. The results showed that persecution was a criminal act. There was no requirement for a judge's decision in the District Court which already had permanent legal force for the occurrence of persecution as a condition for the validity of the layoff as if the visum et repertum was no longer needed. It was enough that the acts of abuse committed by workers were regulated in the Employment Agreement, Company Regulation or Collective Labor Agreement, then the persecution as a form of an urgent violation can be used as a valid reason for the termination of employment (Article 81 number 37 of the Job Creation Law jo.  Article 151 / 3 Manpower Law jo. article 52/2 Government Regulation 35/2021. The researchers’ efforts to review labor regulations related to urgent violations in the Indonesian manpower system are a form of evaluation of the weaknesses of the Job Creation Law and its implementing regulations can be able to assist legislators to develop and enforce laws that protect certain vulnerable groups namely workers in applying the principle of presumption of innocence.Keywords: Forensics; Persecution; Termination. Eksistensi Visum Et Repertum Atas Terjadinya Penganiayaan Sebagai Alat Bukti Pemutusan Hubungan KerjaAbstrakHubungan kerja dapat berakhir karena adanya penganiayaan yang dilakukan oleh pekerja. Adanya penganiayaan harus dibuktikan secara medis. Penelitian ini bertujuan untuk menganalisis adanya visum et repertum atas terjadinya penganiayaan yang dapat digunakan sebagai alat bukti dalam pemutusan hubungan kerja. Penelitian hukum ini bersifat normatif dengan pendekatan perundang-undangan. Hasil penelitian menunjukkan bahwa  penganiayaan adalah perbuatan pidana. Tidak adanya keharusan putusan hakim di Pengadilan Negeri yang sudah memiliki kekuatan hukum tetap atas terjadinya penganiyaan sebagai syarat keabsahan PHK seolah mengakibatkan visum et repertum tidak dibutuhkan lagi. Cukup perbuatan penganiayaan yang dilakukan oleh pekerja diatur dalam Perjanjian Kerja, Peraturan Perusahaan atau Perjanjian Kerja Bersama, maka penganiayaan sebagai wujud telah terjadi pelanggaran yang bersifat mendesak dapat digunakan sebagai alasan keabsahan pemutusan hubungan Kerja (Pasal  81 angka 37 UU Cipta Kerja jo.  Pasal 151 /3 UU Ketenagakerjaan jo.Pasal 52/2 Peraturan Pemerintah 35/2021. Upaya penulis untuk mereview peraturan perburuhan terkait pelanggaran yang bersifat mendesak dalam sistim ketenagakerjaan Indonesia merupakan bentuk evaluasi atas adanyan kelemahan UU Cipta Kerja dan Peraturan pelaksananya, akan dapat membantu legislator untuk mengembangkan dan menegakkan hukum yang melindungi kelompok rentan tertentu yaitu pekerja dalam menerapkan asas praduga tak bersalah.Kata Kunci: Forensik; Penganiayaan; Pemutusan Hubungan Kerja Наличие Visum Et Repertum в случае преследования как доказательство прекращения работы АннотацияТрудовые отношения могут прекратиться из-за жестокого обращения со стороны работников. Наличие жестокого обращения должно быть доказано с медицинской точки зрения. Это исследование было направлено на анализ наличия visum et repertum в случаях злоупотреблений, которые могут использоваться в качестве доказательства при увольнении. Это правовое исследование было нормативным с законодательным подходом. Результаты показали, что преследование было уголовным преступлением. В районном суде не требовалось вынесения решения судьей, которое уже имело постоянную юридическую силу в связи с преследованием в качестве условия действительности увольнения, как если бы в visum et repertum больше не было необходимости. Достаточно того, чтобы акты жестокого обращения, совершенные работниками, регулировались трудовым договором, регламентом компании или коллективным трудовым договором, тогда преследование как форма неотложного нарушения может быть использовано в качестве уважительной причины для увольнения (статья 81 № 37 Закона о создании рабочих мест, ст. 151/3 Закона о рабочей силе, ст. 52/2 Постановление правительства 35/2021. Усилия исследователей по пересмотру трудового законодательства, касающегося неотложных нарушений в индонезийской системе кадровых ресурсов, являются формой оценки Слабые стороны Закона о создании рабочих мест и его подзаконных актов могут помочь законодателям в разработке и обеспечении соблюдения законов, которые защищают определенные уязвимые группы, а именно работников, в применении принципа презумпции невиновности.Ключевые слова: судебная экспертиза, преследование, прекращение действия

This research aims to review the legal protection for freelancers in Indonesia, stipulated in Law Number 11 of 2020 concerning Job Creation. In-Law no. 13 of 2003 concerning Freelance Employment in Indonesia is claimed not to have a clear legal umbrella. The problems examined in this research include the form of freelance legal relations in Indonesia? And the legal protection for freelancers in Indonesia in Law Number 11 of 2020 concerning Job Creation? This research uses normative methods with a statute, case, and historical approach. The results showed that freelance legal relationships in Indonesia were divided into two categories: freelancers who entered into work agreements through platforms that acted as intermediaries and freelancers who entered into work agreements directly without intermediaries. Previously, there were only additional regulations in the form of Kepmenakertrans No. 100 of 2004 concerning the Provisions for the Implementation of a Work Agreement for a Specific Time, and no specific regulation has been found in Law no. 13 of 2013 concerning Manpower. After the enactment of Law Number 11 of 2020 concerning Job Creation and also Government Regulation No. 35 of 2021 concerning Specific Time Work Agreements, Transfer, Working Time and Rest Time, and Termination of Employment, the legal status of freelance workers in Indonesia has a clear legal umbrella, which is classified as a specific time work agreement (PKWT). This finding also answers the concerns of previous researchers who stated that there is no legal protection for freelancers in Indonesia.

Juridical Analysis of a Specific Time Work Agreement (PKWT) to Realize the Protection of Workers' Rights and Welfare (Research Study at the PT. Bersama Gemilang Property Batam Office), has been carried out as it should, in accordance with Law Number 11 of 2020 concerning Job Creation. There are factors related to the protection of the rights and welfare of contract workers. The qualifications/types of writing in this journal use normative legal writing, and then integrate it with sociological/empirical legal writing, and to analyze some of the problems in this journal, Lawrence M. Friedmen's big theory, Jeremy Bentham's middle theory, and application theory are used. / applied theory Mochtar Kusumaatmadja. The results of the analysis are still experiencing several obstacles both internally and externally. The obstacles faced have not been the implementation of rights and welfare, which have been prioritized and carried out but not yet perfectly. It is very necessary and improved in terms of supervision in terms of quality and quantity in order to suppress and not give space to violators who do not comply with contract workers. There is also a need for wider socialization in a timely manner regarding the implementation of the new law on the rights and welfare of contract workers.

The Community Security and Order is the bearer of community policing in villages. Community Security and Order has objective to carry out preventive functions by directly partnering with the locals, therefore being the tip of the spear of state police in realizing community behavior in line with certain norms to create, maintain and uphold a peaceful, safe and beneficial community environment. The purpose of this study was to determine the effectiveness of Community Security and Order in implementing its functions in Riau Islands Regional Police jurisdiction as regulated in Head of the Indonesian National Police Regulation Number 3 of 2015 about community policing, and Head of the Indonesian National Police Decree Number: KEP/773NII/2016. The effectiveness of Community Security and Order in implementing its duties was reviewed based on the theory of legal effectiveness that coined by Prof. Dr. Soerjono Soekanto. This research was conducted using empirical legal research methods. The author uses primary data obtained from interviews, random sampling of data regarding Community Security and Order activity in Riau Islands Regional Police and activity of Community Security and Order members in each Resort Police within the jurisdiction of Riau Islands Regional Police, as well as conducting observation with a member of Community Security and Order in one of the villages of Batam. Based on the gathered data, the author then processed and compiled it into a comprehensive research report. Research concluded that the implementation of Community Security and Order functions in Riau Islands Regional Police jurisdiction have already been carried in accordance to laws and regulations that is currently in effect. The presence of Community Security and Order helped in shaping community customs to remain positive and maintain a conducive, safe and peaceful environment. However, in overall perspective the implementation of Community Security and Order purposes are not yet fully effective caused by unavailability of specific regulations dictating the functions of Community Security and Order, lack of personnel, as well as limitations in facilitator needs.

Health is essentially one of the supports for the welfare of human life, therefore, in order to create an increase in the degree of health, a law is needed to regulate and foster everything about health. In the process of getting a decent job several agencies or companies apply a health test at the stage of completion of work acceptance. Health checks before work are health checks carried out by doctors before a worker is accepted to do the jobs. Problems arise when the results of a medikal examination or medikal record in the form of a file containing records and documents about the patient's identity, examination, treatment, actions and other services that have been provided to patients out are fully provided to the agency or employer. This type of research is a normative legal research method. Normative legal research means that the existing problems are examined based on existing laws and regulations and the literature relating to the existing problems. Based on the results of the study that the authors describe, it can be concluded that in the implementation of health tests carried out by the agency or company are not allowed to take the results of the medikal record unilaterally without giving access to prospective workers as parties who are the object of examination at the health test.
