Issues of co-financing of drug provision for the population: international and Russian practice

Russian President Vladimir Putin defined increase in life expectancy from 72.7 to 78 years by 2024 as a national aim in the Decree № 204 of May 7, 2018. Achievement of this aim depends on drug provision system among other factors. Strategy of drug provision for the population of the Russian Federation for the period until 2025 sets the goal of increasing availability of high quality, effective and safe medicines to meet needs of the population and the health system based on the formation of a rational and balanced system of drug provision for the population of the country with available resources. The health care system should expand the possibilities of using modern and effective mechanisms to ensure the financing of drug provision for the population.

The essence of the problems and ways of improving the single-channel system of financial support of health care system implemented in the Russian Federation today are described in the article. The basic advantages (payment of the final result, the principle of extraterritoriality, etc.) and disadvantages of this type of financing (the growth of corruption in health care facilities, the claiming by regional authorities in advance reduced volumes of work of medical institutions under the territorial program programs of compulsory health insurance etc.) are highlighted. The legal aspects of functioning of the single-channel financing system are represented. In our view the measures for optimize the work of the health system in the Russian Federation should include: transition to the new salary system of health workers and the development of basic and additional list of criteria for the effectiveness of both health professionals and managers of health facilities. The problem of satisfaction of staff requirements in the Russian health care system has a systemic, multifactorial character. Forming an interconnected list of criteria of efficiency of medical staff and their managers would allow, on the one side to attract qualified staff to the region, on the other - to improve control of financial and economic activity of the heads of medical institutions. Furthermore, these measures will allow slightly reduce social tension among health care workers, that will positively impact on the quality of medical care.

Healthcare - an industry that affects every citizen of the country, and on the most sensitive issues - health and often life. The health system provides the country’s national security, without healthy citizens, it is impossible to increase their production and provide defenses. Health the last ten years intensively reorganized. The article presents the results of a study of the problems of criminal legal assessment of criminal attacks on the health care system during the COVID-19 pandemic. The social background of such crime and its criminological characteristics are studied. Given the fact that most of criminal law, aimed at preventing crime, reducing the capacity of the state in the fight against novel coronavirus infection treated in depth by the legal and regulatory framework is impeding the spread of the pandemic COVID-19, and analyzed Federal laws, decrees of the President of the Russian Federation, decisions and orders of the Government of the Russian Federation, orders of the Ministry of health of Russia and other state bodies governing the functioning of public authorities, medical institutions and organizations, the rights and obligations of citizens and legal entities, this includes measures for the prevention of this disease in various areas of social life that are additionally regulated during the COVID-19 pandemic. The task of optimizing the criminal law provision of health care during the COVID-19 pandemic is formulated, taking into account the actual situation with the spread of this infection and the practice of countering it. As part of this task, based on a critical analysis of existing approaches in the science of criminal law, we formulate our own concept of crimes that infringe on the health system during the COVID-19 pandemic, characterize the problem, study their legal and social nature, and systematize such crimes. On the basis of the obtained data, a General description of crimes that encroach on the health system during the COVID-19 pandemic is given, their criminal-legal features are considered, theoretical approaches to determining their essence are studied, and the author's position on this issue is formulated. The author's classification of crimes that hinder the provision of health care during the COVID-19 pandemic is given. Groups of such crimes are consistently considered. A General description of their objective and subjective characteristics is given. Proposals for improving the interpretation of the relevant criminal law norms in science and law enforcement practice have been developed, and suggestions for their improvement have been substantiated and formulated. The article is addressed not only to scientists and practitioners of law enforcement agencies, but also to doctors who often work in conditions of a lack of legal knowledge about their rights and obligations, the qualification of certain acts from the point of view of criminal law, the grounds and limits of criminal liability for those that constitute a crime, and algorithms for actions in case of detection of such acts.

The causes and dynamics of the infant mortality (IM) in the USSR and the Russian Federation (1980-2012) are presented in the context of reforming the health care system. The stages of changes in the IM for this period were determined. One of the peculiarities of IM in the USSR is indicated to be seasonal fluctuations with peaks in July-September. At the same time, the Central Asian republics had the dominated influence on this peak. The experience of the organization of state and medical measures for effective reduction of IM in the USSR is described. The improvement of the maternity and childhood protection system in the Russian Federation allowed significantly reduce IM.

We are pleased to present an academic interview with the Ambassador of the Vatican Archbishop Celestino Migliore, the Apostolic Nuncio to the Russian Federation, who kindly agreed to answer questions asked by Maria A. Burganova, the editor-in-chief of the journal Burganov House. The Space of Culture. The meeting between Russian President Vladimir Putin and Pope Francis, which will undoubtedly facilitate further development of relations in the context of the positive historical dialogue that has long been developing between the Vatican and Russia, was the impetus for the interview. Archbishop Celestino Migliore, an Italian prelate and Vatican diplomat, is the Apostolic Nuncio to the Russian Federation since May 28, 2016. Archbishop Migliore has a master’s degree in theology from the Center of Theological Studies in Fossano and Doctorate in Canon Law from the Pontifical Lateran University in the Vatican. He has been in the diplomatic service of the Holy See in different countries since 1980. He was appointed as Special Envoy to the Council of Europe in Strasbourg, the Under-Secretary of the Section for Relations with States of the Vatican’s Secretariat of State, and the Permanent Observer of the Holy See to the United Nations. Celestino Migliore received his episcopal consecration from John Paul II on January 6, 2003.

The legislation in the field of e-health, adopted in 2017, opens fundamentally new opportunities in the development of medical care using telemedicine technologies. The article provides an analysis of regulatory legal documents that establish the legal framework for the provision of medical care using telemedicine technologies. An assessment is made of the current state of telemedicine legal regulation in Russia. The law on telemedicine requires adjustment and refinement of existing regulations, procedures, standards of medical care with a detailed regulation of tools and situations of their application.

In the health-care system in the Russian Federation, the units providing medical care in outpatient and inpatient conditions employ more than 55,000 individuals of dental doctors of various specialties, dental doctors and dental hygienists every year from 2014 to 2018. The availability of dentistry by doctors tends to decline from 4.20 (2014) to 3.75 (2018). By 2018, 99.45% of dentistry doctors and 99.3% of dental doctors have a specialist certificate and accreditation certificate. 38.16% of dentistry doctors and 54.88% of dental doctors confirmed their qualification category. In dynamics there is a tendency to decrease the passing of certification for obtaining qualification category by these specialists. These facts show a decrease in the availability and quality of dental care, as it is ensured by the availability of the necessary number of health workers and their level of qualification.

The article deals with topical issues of the organization of a “new model” of clinical examination taking into account the requirements specified in the Message of the President of the Russian Federation to the Federal Assembly of 02/20/2019, using the example of the Rostov region.


The article considers the systems of remuneration in the organizations of the private health-care system in the Russian Federation on the basis of the analysis of works of modern scholars. A special attention is paid to medical workers having secondary jobs in organizations of the private health-care system. For such organizations in Russia, secondary-job employing is a common practice. The author substantiates the necessity of providing more freedom of parties of labour contracts without time limit determined by the Government of the Russian Federation and the Russian Ministry of Labour to prevent payments of illegal salary. Some changes to the Labor Code of the Russian Federation are proposed. In particular, the author suggests to introduce a rule under which parties of a secondary-job labour agreement may establish limits of working time by their consent and extend it.

The article suggests legislative implementation of certain “medical” amendments to the Constitution of the Russian Federation. The authors propose to add two articles to the Federal law “on the basics of public health protection in the Russian Federation” dated 21.11.2011 N323-FZ. In one article, it is proposed to reveal and specify the content of the newly introduced in the Constitution of the Russian Federation concept “unified legal bases of the health care system”. Another proposed article reveals the forms and content of work on the coordination of health issues, again referred by the Constitution of the Russian Federation to the joint responsibility of the Russian Federation and the subjects of the Russian Federation. According to the authors, the proposed changes in legislation will allow to ensure in practice the proper implementation of “medical” amendments to the Constitution of the Russian Federation, which in turn will ensure the improvement of legal regulation of the organization and activities of health care, and strengthen its material and technical base.
