Concession agreements as a source of attracting investments in the regions of the Russian Federation: current state and implementation problems

The article analyzes the mechanism of public-private partnership as a source of attracting extra-budgetary funds in order to implement investment projects at the regional level. Particular attention is paid to concession agreements, as a classic form of public-private partnership, which implements most of the projects in this area. The authors note that despite the fact that in Russia in recent years the mutual interest of state bodies and the private sector in expanding mutual cooperation has increased and the number of PPP projects is constantly expanding, there are a number of restrictions that have a constraining effect on the implementation of this form of partnership, including, legal and institutional factors. A number of measures have been proposed, aimed not only at supporting ongoing projects, but also at stimulating programs for launching new project initiatives.

Рассматриваются особенности регулирования отношений государственно-частного партнерства в иностранных государствах. The article is devoted to the main problems associated with the formation of state policy for the implementation of the mechanism of public-private partnership in the transport sector. The analysis examines the understanding of public-private partnership in this area, examines the current state of public relations, es- pecially the regulatory legal regulation of public-private partnership in connection with the implementation of the Transport Strategy of the Russian Federation. The features of the regulation of public-private partnership relations in foreign countries are considered.

In the current crisis economic conditions, the public-private partnership (PPP) mechanism can be used as one of the key ways to attract extra-budgetary sources of funds for the implementation of investment projects at the regional level. Despite the growing number of PPP projects in Russia, the presence of significant institutional constraints at the regional level hinder the further development of this mechanism. In particular, there is a lack of interconnection of PPP projects with long-term investment and state development programs at the regional level, low sectoral diversity of projects, high dependence of PPP projects on state financial institutions, and insufficient information support of regional PPP practices. The situation is aggravated by the lack of long-term money in the economy against the backdrop of limited private partners’ funds for the implementation of long-term PPP projects, as well as by existing legal restrictions. The practical purpose and scientific value of this article lie in the construction of a holistic and logical vision of solving the identified institutional problems of PPP development at the regional level.

The article analyzes the current state and level of development of publicprivate partnership (PPP) projects in the subjects of the Russian Federation. The authors conclude that a significant proportion of projects is implemented on a concession basis at the municipal level in the communal sphere. A detailed analysis of the project data showed that the structure of the projects is deformed in favor of the central regions of the Russian Federation, and a significant share in the total amount of financing falls on the transport sector. At the stage of assessing the level of development by the subjects of the Russian Federation, criteria were proposed, and index and integral indicators were used, which ensured comparability of the estimates obtained. At the end of the analysis, the regions were ranked and clustered according to the level of PPP development, which allowed to reveal the number and structure of leaders and outsiders.

The essence and significance of public-private partnership (PPP) are disclosed, its forms and role as the key tool for solving important problems of balanced economic development are highlighted due to the involvement in the implementation of strategies of private operators. Defined forms of cooperation aimed at organizing interaction under the «business-government-community» scheme, the classification of PPP types is described, its forms and significance are analyzed in the system of providing of natural and technological and environmental safety on the basis of preventive safety. The promotion of the partnership mechanism in preserving and developing the ecological infrastructure is disclosed. The use of PPP as a mechanism for attracting investment projects to financial resources, redistributing risks and strengthening the responsibility of PPP parties for the implementation of investment projects is shown.

Public-private partnership (PPP) in the conditions of the set strategic tasks by the President of the Russian Federation until 2030 can become one of the sources of attracting financial resources for implementation of the large-scale projects. In this regard, it is relevant to systematize the forms of PPPs and the scope of their application. Based on a study of different views on the essence of PPP, as well as taking into account the development of public administration in Russia, the author proposed the use of public-public-private partnership as a form of development of cooperation between the state, private business and society. The polyformism of PPPs is reflected in the presented classification. Based on the analysis of PPP development in the regional context, hypothesis on the correlation between the level of PPP and the socio-economic development of the subject of the Russian Federation was confirmed.

The article discloses the essence of the public-private partnership mechanism, various approaches to its definition, both at the level of legislative acts of the Russian Federation and international organizations (UN). Different forms of PPP projects, their peculiarities and distinctive features are described in accordance with federal laws on public-private partnership and concession agreements. Instruments are being considered to support investors implementing investment projects of social infrastructure on the basis of PPPs, from federal and regional development institutions, as well as state authorities. An analysis of the level of PPP development in the Udmurt Republic is carried out, concrete examples of successful cooperation between private and public parties on the organization of financing and implementation of the project on the basis of public-private or municipal-private partnership are given. The use of this mechanism allows to obtain a significant economic effect due to the fact that there is a personal interest of a private person in obtaining income from a built or modernized facility. In addition, the social component plays an important role, PPP allows you to direct funds to those industries that are initially considered not promising enough to conduct business, but are often of key importance for the development of the region and ensuring a comfortable urban environment for the population.

Background: This article is based on a multidimensional empirical research study investigating aspects of the suitability of the public–private partnership environment of Uganda for road infrastructure development. The foundation of the article is the implementation of the relationship between existing legal and regulatory frameworks on the ground in Uganda.Aim: Key aspects and realities of the legal and policy frameworks that support public–private partnership, road investment projects and programmes in Uganda are examined from the perspective of a transparent, effective and efficient service delivery.Setting: A brief exposition of Uganda’s historical realities and present challenges, especially in terms of road infrastructure, an introduction of key aspects of the legal and regulatory frameworks is presented.Methods: The research is based on an exploratory research design methodology founded on a thorough literature review, exhaustive documentary analysis of primary and secondary sources and 30 interviews with senior and middle managers in the public and private sectors in Uganda. A semi-structured questionnaire was utilised.Results: The analysis of data was based on a dissection of the policies and systems as foundations of solid implementation, existing legal violations, the local private sector’s present conundrum and capacity gaps, the realities of integrity and corruption and the existing approach of citizens towards the problems and challenges.Conclusion: The lack of integrity in both the private and public sector has serious negative effects on the processes, functions, planning, designing, outputs and outcomes of infrastructure initiatives undertaken.
