This study aims to discuss the right to health, comparing collective and individual health and analyzing the impact of judicialization on the Unified Health System (SUS). Therefore, it addresses the right to health, presenting its concept and minimum content; discusses the principle of integrality; discusses the judicial control of public policies, weighing up the reserve of the possible and the minimum existential; and defends the prioritization of public policies that benefit the community. As a methodology, bibliographic research was adopted based on the literary review of books, articles and legislation that are dedicated to the theme in order to seek solutions to reduce expenses with judicialization.

The present work has as its study the analysis of public policies, regarding access to the right to public health, as well as the difficulties, the neglect of the provision and the length of the concession. The difficult way for doctors to exercise their profession, excessive shifts, lack of specialists, medicines and beds, lack of fair remuneration and various problems; the analysis of the judicialization of public health and the institutes that medicine calls: Euthanasia, Orthothanasia, Dysthanasia and Mistanasia. The methodology used was the tool: bibliographic. At the end of this article, there will be an examination of the studies analysed, and the effectiveness of the judicialization of public health.

O artigo examina o direito à saúde a partir da dispensação judicial de medicamentos no Brasil e a possibilidade do uso da ferramenta e-NatJus como elemento de suporte técnico aos magistrados nessas decisões. O objetivo deste breve estudo é, a partir do direito à saúde, definir quais são os critérios adotados no Judiciário para o fornecimento de medicamentos no Brasil, examinados a partir da necessidade de tutela efetiva aos jurisdicionados. Justifica-se o estudo do tema, uma vez que os Poderes Legislativo e Executivo não têm conseguido desenvolver e implementar políticas públicas na mesma velocidade que os cidadãos delas necessitam. Assim, o Poder Judiciário, não tradicionalmente projetado para o desenvolvimento de políticas públicas, na prática o vem fazendo, com consequências de toda sorte. Para tanto, realizou-se pesquisa de cunho exploratório, em doutrina, legislação e jurisprudência, valendo-se do método dedutivo.   El artículo examina el derecho a la salud de la dispensación judicial de medicamentos en Brasil y la posibilidad de utilizar la herramienta e-NatJus como elemento de apoyo técnico para los jueces en estas decisiones. El propósito de este breve estudio es, basado en el derecho a la salud, definir cuáles son los criterios adoptados en el poder judicial para el suministro de medicamentos en Brasil, examinados a partir de la necesidad de una protección efectiva a los tribunales. El estudio del tema está justificado, ya que los Poderes Legislativo y Ejecutivo no han podido desarrollar e implementar políticas públicas a la misma velocidad que los ciudadanos los necesitan. Así, el poder judicial, no diseñado tradicionalmente para el desarrollo de políticas públicas, en la práctica lo ha estado haciendo, con consecuencias de todo tipo. Con este fin, se realizó una investigación exploratoria en doctrina, legislación y jurisprudencia, utilizando el método deductivo.   The article examines the right to health from the judicial dispensation of medication in Brazil and the possibility of using the e-NatJus tool as technical support for judges in these decisions. The purpose of this brief study is, based on the right to health, to define what are the criteria adopted in the Judiciary for supplying medication in Brazil, based on the need for effective protection by the jurisdiction. The study of the subject is justified, since the Legislative and Executive Powers have not been able to develop and implement public policies at the same rate as citizens need them. Thus, the Judiciary, not traditionally designed for the development of public policies, in practice has been doing so, with all sorts of consequences. To this end, an exploratory research was conducted in doctrine, legislation and jurisprudence, applying the deductive method.

Abstract The More Doctors Program (PMM) was created in 2013. Guided by social needs, it set a new regulatory framework for medical education and residency in Brazil. This study is based on public policies and their actions aimed at implementing changes in medical education in PMM, as well as their results until 2015, by analyzing documents from official sources and the literature. The following results were identified: decrease in regional inequalities in the distribution of undergraduate course seats; education internalization; increase in medical residency seats specialized in Family and Community Medicine; expansion of preceptorship qualification; and creation of the National Registration of Specialists. The challenges faced by PMM to effectively achieve its goals, the need for State commitment and the current threats to this vital dimension of the program (ensure the right to health) are pointed out.

Resumo: A crescente Judicialização chama atenção ao passo que denuncia a inefetividade das políticas públicas, bem como impacta no entendimento do tribunal referente à demanda judicial pleiteada. Indubitavelmente, o direito fundamental à saúde é objeto de um contingente considerável da Judicialização, muito em razão do préstimo deficiente das instituições. Sabe-se que o direito à saúde tem previsão constitucional e infraconstitucional, atribuindo a responsabilidade ao Estado para sua realização por meio de políticas públicas e programas de governo. Contudo, a via administrativa-executiva estatal encontra dificuldades na efetividade desse direito a todos os indivíduos, na verdade não atende satisfatoriamente a população. Diante desse cenário, a alternativa subsidiária torna-se a Judicialização da pretensão, ou seja, o cidadão, objetivando a tutela do seu pleito à saúde busca-o na prestação jurisdicional. Nesse sentido, o presente trabalho tem como objetivo delinear o direito fundamental à saúde no entendimento do Tribunal de Justiça do Estado do Rio Grande do Sul, especificamente nas demandas de pleito de medicamentos. Por meio da pesquisa qualitativa técnica de revisão bibliográfica e do estudo de julgados no TJRS, utilizando do método fenomenológico-hermenêutico, buscar-se-á delinear o entendimento do referido tribunal, em grau de apelação, referente ao fornecimento judicial de fármacos pelo Estado, como forma de compreender quais são as variantes que direcionam o (não) deferimento da pretensão judicial do indivíduo e como o direito à saúde se apresenta neste cenário jurisprudencial.Abstract: The increasing judicialization calls attention to the step that denounces the ineffectiveness of public policies, as well as impacts on the court's understanding regarding the lawsuit filed. Undoubtedly, the fundamental right to health is the subject of a considerable contingent of judicialization, largely because of the inadequate facilities of the institutions. It is known that the right to health has constitutional and infraconstitutional foresight, assigning responsibility to the State for its fulfillment through public policies and government programs. However, the state administrative-administrative route finds difficulties in the effectiveness of this right for all individuals, in fact does not satisfactorily serve the population. In view of this scenario, the alternative alternative becomes the judicialization of the claim, that is, the citizen, aiming to protect his claim to health seeking it in the jurisdictional provision. In this sense, the present work aims to outline the fundamental right to health in the understanding of the Court of Justice of the State of Rio Grande do Sul, specifically in the lawsuits for drug litigation. Through the qualitative technical research of bibliographic review and the study of judgments in the TJRS, using the phenomenological-hermeneutic method, it will be sought to delineate the understanding of said court, in degree of appeal, regarding the judicial supply of drugs by the State, as a way of understanding which are the variants that direct the (non) deferment of the judicial claim of the individual and how the right to health presents itself in this jurisprudential scenario.

AbstractThe last decades present a significant development of the economic, social and cultural rights and specifically, the right to health. Until 2000, the right to health has not been interpreted officially. By providing international standards, General Comment No.14 on the right to the Highest Attainable Standard of Health has led to wider agreement that the right to health includes the social determinants of health such as access to various conditions, services, goods or facilities that are crucial for its implementation. The Reports of the Special Rapporteur on the right to health within the UN human rights system have contributed to the process of gaining the greater clarity about the right to health. It is obvious that achieving the highest attainable level of health depends on the principle of progressive implementation and the availability of the necessary health resources. The possibility individual complaints to be considered by the Committee on Economic Social and Cultural Rights was introduced with the Optional Protocol to the International Covenant on Economic, Social and Cultural Rights, entered into force in 2013.
