THE QUESTION OF THE NATURE AND THE REASONS OF LEGAL COLLISIONS

В статье анализируется правовая природа юридических коллизий, систематизируются предложенные в юридической литературе последних лет определения понятия «юридическая коллизия», выделяются достоинства и недостатки исследуемых подходов, формулируется авторское определение данного понятия. Под юридической коллизией предлагается понимать противоречие между нормами права, а равно нормами права и (или) положениями правоприменительных и интерпретационных правовых актов, потенциально или практически порождающее трудности в реализации права. Коллизии в праве (юридические коллизии) рассматриваются в их соотношении с другой разновидностью правовой неопределенности - пробелами в праве. Автор статьи приходит к выводу о том, что, хотя оба этих явления имеют негативное влияние на развитие правовой системы государства и юридическую практику, именно юридические коллизии создают наиболее серьезные трудности в ходе правоприменительного процесса. Если причины возникновения пробелов в праве носят смешанный объективно-субъективный характер, зачастую с уклоном в сторону объективных причин (нормы права объективно не всегда оперативно подлежат формальному закреплению вследствие очень высоких темпов развития общественных отношений), то причины возникновения юридических коллизий преимущественно субъективны. Любая юридическая коллизия, так или иначе, представляет собой ошибку правотворца, правоприменителя или интерпретатора. Сделан вывод о том, что для предотвращения «разрастания» коллизионности в российском праве требуется снизить темпы правотворческого процесса, четко определить границы законотворчества и подзаконного правотворчества, но прежде всего - ужесточить профессиональные требования к субъектам правоприменительной, интерпретационной и особенно правотворческой юридической практики. The article analyzes the legal nature of legal collisions, the definitions of the concept of «legal collisions» proposed in the legal literature of recent years are systematized, the advantages and disadvantages of the investigated approaches are highlighted, the author's definition of the concept is formulated. It is proposed to understand a legal collision as a contradiction between the norms of law, the norms of law and the provisions of law enforcement and interpretive legal acts, potentially or practically giving rise to difficulties in the implementation of the law. The legal collisions are considered in their relation to another kind of legal uncertainty - gaps in law. The author of the article comes to the conclusion that, although both of these phenomena have a negative impact on the development of the legal system of the state, legal collisions create the most serious difficulties in the course of the law enforcement process. The reasons for the appearance of gaps are rightfully objective, and the nature of legal collisions is predominantly subjective. Any legal collision is, in one way or another, an error. It is concluded that, in order to prevent the "growth" of collision in Russian law, it is necessary to reduce the pace of the lawmaking process, to clearly define the boundaries of lawmaking and bylaw lawmaking, toughen professional requirements for subjects of legal practice.

The article is aimed at the study of the procedure for publishing of regulatory legal acts in accordance with Russian legislation. Normative legal acts affecting the rights, freedoms and duties of man and citizen are the most important source of Russian law and should be officially published. It is with this fact that the law connects their entry into force. Given that there are no legal definitions of a regulatory legal act, official text, publication, problems arise in law enforcement practice. In addition, the diversity of normative acts by the level of their adoption indicates the diversity of sources of their official publication. This scientific article has been delivered in order to determine the rules for the publishing of laws and other regulations, national and international documents. The author concludes that it is necessary to improve legislation in field and the legal definition of the concepts under study.

Based on the problem situation conditioned by indeterminacy of institutional position of the standards of law enforcement ethics within the mechanism of contemporary law enforcement regulation, the author attempts to analyze the legal nature of the above standards. The study reveals that the legal nature of standards of law enforcement ethics is conditioned by the necessity to protect the identity of citizens and the law enforcement system itself from the negative impact produced by various forms of irregular conduct by subjects of law enforcement. As a result of comparing the standards of law enforcement ethics and the rules of law the author establishes that according to the technical-legal forms of their external expression and other attributes, as well as their regulatory potential, the standards of law enforcement ethics are comparable to the status of the rules of law. The study permits us to conclude that the standards of law enforcement ethics possess the classificatory identity typical of the protective rules of law represented by relations in the field of law enforcement activity. This identity is conditioned by the specificity of the subject of their regulation. The standards of law enforcement ethics are of subsidiary significance as they supplement and develop standards of status laws in matters of legal regulation of the moral aspect of the law enforcement activity.

The article is devoted to the analysis of the problems of notaries in the law enforcement system of Russia in modern conditions. The author adheres to the scientific position of a wide range of the “law enforcement system”, where any activity in society should be aimed at ensuring the rights, freedoms and legitimate interests of citizens. Based on this, identifying the problems of notaries and their causes is the key to finding a rational solution towards the formation of the institution of notaries that meets the requirements of modern society. The main disputes of specialists are concentrated in the fluctuations between public and private notaries, as well as in the choice of a direction of development like the Latin notary and the introduction of the model of an active notary, where each direction has its own advantages and disadvantages. However, the process of development of society is endless and the ongoing globalization processes in the world require the unification of the activities of the notary, taking into account the national, ethnic and historical characteristics of states, which, ultimately, will significantly simplify economic and business cooperation between peoples of different countries.

The article conducts a theoretical and legal study of the concept and system of principles of budget law, scientific approaches to understanding and implementing the principles of the budget system of Ukraine. The analysis of approaches to the definition of principles of law, financial law is carried out, definitions of principles of budgetary law which are contained in scientific national and foreign legal literature are considered, features of influence on the formation of principles of budgetary law and normative-legal fixing are specified. The difference between the principles of budget law and the principles of budget activity is indicated. The place of budget law as a sub-branch of financial law is defined. Budget law is an element of the financial law system. The system of principles in force in budget law is similar to the system of principles of financial law with the difference that a group of special principles is added to them. These principles can be called their own, as they apply only to budgetary relations, have a unique legal scope, and are externally normatively expressed in the budget legislation in the form of principles of the budget system of Ukraine. The system of principles of budget law includes: general principles of law inherent in the entire legal system; intersectoral principles inherent in financial law, all elements of this branch of law; principles inherent only in financial law and apply to all elements of this branch of law; principles inherent only in budget law, own principles that apply to all elements of this subsector and are normatively expressed in budget legislation as the principles of the budget system of Ukraine. The definition of �principles of budgetary law� is given, it is proved that as a mechanism of regulation of budgetary activity the principles are manifested in law-making and law-enforcement documents, normative-legal acts.

<p>The new paradigm of decision based on art. 20 of the LINDB: analysis of the text according to the theories of Richard Posner and Neil MacCormick</p><p> </p><p>O presente trabalho visa analisar o art. 20 da Lei de Introdução às Normas do Direito Brasileiro (LINDB), introduzido pela Lei nº 13.655/2018. Para tanto, será mostrado como os valores jurídicos foram excluídos e novamente reintroduzidos na prática jurídica e como essa reintrodução gerou preocupações quanto ao aumento da discricionariedade da aplicação do direito. O artigo apresentará as teorias pragmática e consequencialista, segundo a doutrina de dois de seus principais expoentes, Richard Posner e Neil MacCormick. No afã de cumprir o objetivo central do artigo, serão delimitados os conceitos de valores jurídicos abstratos e consequências práticas da decisão, no contexto do art. 20 da LINDB, e, por fim, definido o espaço de aplicação do dispositivo.</p><p> </p><p>This work aims to analyze art. 20 of the Law of Introduction to the Rules of Brazilian Law (LINDB), or Law No. 13.655/2018. To do so, it will be shown how legal values were excluded and reintroduced in legal practice and how this reintroduction raised concerns regarding the increase of discretion in the application of the law. The article will present pragmatic and consequentialist theories, in line with the doctrine of two of its main exponents, Richard Posner and Neil MacCormick. In order to meet the key objective of the article, the concepts of abstract legal values and practical consequences of the decision will be described in the context of art. 20 of the LINDB, concluding with a definition of the area in which the law is applied.</p>

Each legal concept has not only content (content), but also a form. The form requires compliance with the rules for the definition and construction of concepts. Improving legal terminology is impossible without deep development and observance of the rules of analysis and the precise construction of the conceptual apparatus. Gaps in legislation and regulations are derived from inaccuracy, lack of clarity and simplicity of conceptual constructions. The inconsistency of certain legal norms found in various laws and regulatory legal acts, the inconsistency of norms with the prevailing realities of legal life in the state and society impede the fulfillment by state authorities, including law enforcement, of their functional responsibilities. Mistakes made in the preparation of draft laws and regulations, methodological recommendations mainly boil down to the violation of the requirements of the unified laws of logic: the law of identity, the law of contradiction, the law of the excluded third and the law of sufficient reason. The use of inappropriate terminology causes complications in the application of legal norms. The Constitution of Ukraine assigns to the prosecutor the function of representing the interests of a citizen or state in court in cases specified by law. The term representation is not exactly chosen. The word "representation" means: the performance of the duties of a representative; an institution representing the interests of someone; elections, as well as the law, the procedure for the election of representatives to any bodies; representation is a legal relationship in which one party (representative) is obligated or entitled to make a transaction on behalf of the other party that it represents; representation means activity on behalf of someone, on behalf of a person. By its legal nature, a representative can only be authorized for transactions that the person he represents is entitled to carry out. The representation of the prosecutor's office in court is specific, since this body does not need instructions, contracts or other documents. The prosecutor or his deputy should act not on behalf of someone, but on behalf of the state in favor of the person and citizen, state or society, within the limits established by law. In the legislation there is a conflict (conflict) in the law regarding the term «representation». To eliminate such a conflict, it is necessary to amend the Law of Ukraine «On the Prosecutor's Office». Key words: definition of concepts, laws and regulations, accuracy, clarity, brevity of terms.

The article discusses and analyzes some of the provisions of the current operational-search legislation of the Republic of Kazakhstan. Based on comparative analysis and study of legal literature, the problems arising in law enforcement activities in the implementation of certain provisions of the law are raised. The author makes suggestions and recommendations for improving legal norms aimed at solving problems related to the prevention, prevention and suppression of the most dangerous criminal offences.

This article deals with the definition of overcoming the corruptogenic factors of the criminal law; notes its positive role in combating corruption in the criminal justice and highlights the main features: universality, casuistry, functional character, law-enforcement level of the implementation. This article discusses some of the most important ways of overcoming the corruptogenic factors of the criminal law: the uniformity of practical activity (the same understanding and application of the criminal law to all situations with a similar set of actual data and identical criminal-legal nature); motivation (rational explanation subject to enforcement activities of the reasons and circumstances underlying the decision on this or other legal and penal question) and formalization of the decision-making (development and implementation of the criminal law or court practice on certain criteria that must underlie the adoption of any authority of any decisions in criminal matters and to narrow the scope of his discretion); raising the level of legal awareness of subjects of criminal-law relationships.

The present study elucidates approaches developed in the juridical science and defining legal practice as a socially significant legal activity of the participants. The authors propose their own social-philosophical and legal justification of legal (administrative) practice as a means of transforming reality. To this end, legal practice is acting as a necessary social, organizational and legal means of improving human activity in the implementation of state and municipal administration. The authors propose a social and philosophical understanding of administrative (state-administrative) practice as the result of state-administrative activities arising in the development of administrative relations and entailing the achievement of socially useful goals of state (municipal) administration in the form of an administrative legal act or repeated organizational act of the body and (or) public administration official (usages of administrative practices). In the course of the research the authors give their own understanding of forms of objectification of administrative practice when state and municipal administration is being carried out. Such forms include empirical non-normative legal act and the usage of administrative practice. The result of the study of the nature and forms of objectification of administrative practice involves the definition of its importance for law enforcement practice, which is mandatory practice for the participants of State and municipal administration when they implement internal State and municipal administration. A mandatory nature of empirical administrative legal acts for administered entities within the framework of external state and municipal administration is mediated insofar as they become participants of administrative legal relations within the framework of which the provisions of these acts are implemented. In other cases, these acts are not mandatory for the administered entities. In addition, an administered entity is not deprived of the right to act in compliance with the provisions of the law or a bylaw rather than in compliance with the provisions of a nonnormative administrative legal act that formally is not a normative legal act, but in fact it of regulatory nature. The study defines the meaning of the usages of administrative activities as one of the forms of objectification of administrative practices.

The Russian competition law does not include the definition of the concept of collective dominance, and the notion of this institution itself contains many gaps. The indicated disadvantages of statutory regulation and simplified approaches of the Federal Antimonopoly Service, which became possible due to the formal approach, have led to the formation of controversial law enforcement practice by the antimonopoly authority and courts. The article presents the analysis of legal regulation, as well as the law enforcement practice, and proposition on solutions to the stated problems.
