Management of the Public Land in Morocco Actors and Logics

The land heritage held by the public authorities represents an important part of the Moroccan land system. The management of this land heritage obeys various logics arising from its functional, legal, and institutional complexity. The objective of this study is to identify the numerous logics that drive the management of land assets by various actors and to describe the impact of these logics on the land management. The adopted methodology is to analyze the theoretical aspects and functions of the land tenure, study the regulatory framework of the land and the territorial land, and deal with the institutional framework of the land heritage management. The achieved consequences of this study have enabled the authors to distinguish three logics: the conservative logic, the regulatory logic, and the promoting logic. The goal behind the chapter is to provide the stakeholders with a functional paradigm to take into account for creating the conciliation tools reinforcing the coordination to carry out the urban development of the country.

The Right to Information Act 2005 was passed by the UPA (United Progressive Alliance) Government with a sense of pride. It flaunted the Act as a milestone in India’s democratic journey. It is five years since the RTI was passed; the performance on the implementation frontis far from perfect. Consequently, the impact on the attitude, mindset and behaviour patterns of the public authorities and the people is not as it was expected to be. Most of the people are still not aware of their newly acquired power. Among those who are aware, a major chunk either does not know how to wield it or lacks the guts and gumption to invoke the RTI. A little more stimulation by the Government, NGOs and other enlightened and empowered citizens can augment the benefits of this Act manifold. RTI will help not only in mitigating corruption in public life but also in alleviating poverty- the two monstrous maladies of India.

The ongoing ‘refugee crisis’ of the past years has led to the migration of refugee researchers (RRs) to European countries. Due to the COVID-19 pandemic, RRs often had to work from home and/or to continue their social, cultural and economic integration process under new conditions. An online survey carried out to explore the impact of the pandemic on the refugee researchers showed that RRs found it difficult to adapt their everyday working life to the ‘home’ setting. The majority have had neither a suitable work environment at home nor the appropriate technology. Although they stated that they are rather pleased with the measures taken by the public authorities, they expressed concern about their vulnerability due to their precarious contracts and the bureaucratic asylum procedures, as the pandemic has had a negative impact on these major issues. The majority of RRs working in academia seem not to have been affected at all as far as their income is concerned, while the majority of those employed in other sectors became unemployed during the pandemic (58%). Recommendations are provided to the public authorities and policy makers to assist RRs to mitigate the consequences of the pandemic on their life.

In France, there is increasing interest in health impact assessments (HIAs) and most are performed on urban projects. The field of expertise is still under development and mostly established within the public health sector. To date, in France, all HIAs conducted in urban planning are stand-alone HIAs disconnected from the required environmental impact assessment (EIA). The paper opens with an introduction of the close and complex relationship between health and urban planning, HIA and a description of key elements needed for understanding the French context. Then, the paper analyses the context and the implementation process for four HIAs in progress in order to understand the specific characteristics of urban development, identify the key stages for introducing a health perspective into urban projects, and extract avenues to be explored when adapting HIAs applied to urban planning in France. Using a qualitative multiple case study design, an analysis framework was built to compare several aspects of the four HIAs and made it possible to highlight three pathways for adapting HIA to the urban planning sector: the schedule, links between the EIA and HIA, and the complementarity of the initiatives to involve residents. Legal measures enable a point of contact that brings health institutions and cities closer together. HIA is yet another tool that public authorities now have at their fingertips to work together in strengthening democracy and in reducing social, geographical and environmental health inequalities. More research must be undertaken to develop an understanding of the practice-related context; to judge HIA’s capacity to draw on existing approaches in different fields; and to explore the different avenues leading to increased health, wellbeing and equity.

The past few years have seen a fundamental and broadly based change in the response to domestic violence perpetrated by men against women. The Act on Protection against Domestic Violence which entered into force on May 1st, 1997 reflects this new orientation, or rather this shift in paradigm, which has led to a new understanding of the phenomenon of domestic violence and defines appropriate response by the state by it. The impact of this shift in paradigm is considerable: not only have public authorities and private women?s institutions changed their attitudes towards domestic violence, but the general public now responds to this phenomenon in a manner that is entirely different from what it was prior to the approach. Reports on cases of violence no longer merely state the facts indifferently, but now invariably end with the question whether the authorities had been informed and whether they had taken any action to prevent the crime. Thus the public authorities have come to assume responsibility for combating domestic violence as a result of societal developments.

Joined Cases C-404/12P and C-405/12PThe Aarhus Convention was concluded in order to strengthen the rights of the public on access to information, public participation in decision-making and access to justice in environmental matters. The Convention provides that members of the public shall have access to administrative or judicial procedures to challenge measures by private persons and public authorities that contravene provisions of national law relating to the environment. At EU level, a regulation made the Aarhus Convention applicable to EU institutions. Pursuant to that regulation, review of measures adopted by EU institutions is limited to administrative acts. Two NGOs challenged the legality of that limitation and filed legal action. The case was related to the establishment of EU maximum residue levels for active substances contained in crop protection products. The Commission refused to review this measure which it considered to be no administrative act. The Court of Justice of the European Union has recently given its judgment in that case. The impact of the judgment goes beyond the crop protection sector as it concerns the scope of the internal review concept in general. Further, but not less important, the Court has clarified to which extent international treaties concluded by the EU can be relied upon by individuals.

Linking urban development and urban drainage models is a more and more popular approach when impacts of pavement of urban areas on sewer system performance are evaluated. As such an approach is a difficult task, this is not a feasible procedure for everyday engineering practice. We propose an alternative method, based on a developed simple near-quadratic relationship, which directly translates change (increase or decrease) of paved area into a change in the return period (RP) of the design rainfall event or design rainfall intensity. This formula is simple to use and compatible with existing design guidelines. A further advantage is that the calculated design RP can also be used to communicate the impact of a change in impervious areas to stakeholders or the public community. The method is developed using a set of 250 virtual and two real-world case studies and hydrodynamic simulations. It is validated on a small catchment for which we compare system performance and redesigned pipe diameters. Of course such a simplification contains different uncertainties. But these uncertainties have to be seen in the context of overall uncertainties when trying to predict city development into the future. Hence it still is a significant advantage compared to today's engineering practice.

Amid the ongoing COVID-19 pandemic, the relatively small number of reported cases of the coronavirus for the last 8 months in Taiwan suggests that the country has successfully managed to mitigate the outbreak. Following a proactive strategy, an immediate response, and a well-orchestrated monitoring system, the public authorities prevented the epidemic and avoided lockdowns, curfews, or business closures enforced by other governments across the globe. This case study explores the implications for the restaurant sector of governmental control measures created to combat the spread of the virus. Based on ethnographic research, the paper investigates the impact of the health crisis management plan on the economic sustainability of small restaurants in tourism areas of Tainan City, in the south of Taiwan. Proceeding inductively, this research identifies seven key factors for restaurant viability during the COVID-19 pandemic. The results of the study indicate that cultural context, social cohesion, and the cooperation of restaurant professionals are essential to the effectiveness of any strategy for containing the coronavirus. The proposed model aims to provide a feasible tool for food and beverage providers in other countries to adjust their efforts and actions for surviving during a pandemic.

The article sets out to examine the concept of customary or traditional land within the context of Zambia’s dual land system that is categorized as: customary/traditional land. In turn, the traditional land is controlled, allocated, and regulated through the Chiefs. Then there is formal land that is owned and controlled by the State through the Commissioner of Lands who works in consultation with the Ministry of Land and Natural Resources, in conjunction with the Ministry of Local Government and its District Councils. The article will thus examine the history of dual land system in Zambia; and will further evaluate the Land Act of 1995, whose purpose was to propose a wave of new land system reforms. The latter was intended to establish a more efficient system of land tenure conversion in Zambia. The article also examines the administration of conversion process of traditional/customary and State land. The article sets out on the premise that without effective tenure conversion policies in administering land, sustainable development in both traditional or customary and State areas will be hampered. To this effect, the issue of boundaries in customary or traditional communities will be discussed as a way of building territorial integrity and land management in customary land, through cadastral surveys that is apparent with the rise in population and demand for market-based activities in rural areas. The article will argue that without clearly defined systems of administration and demarcation of boundaries, between customary/traditional and State/formal lands in Zambia, this process will be prone to more land conflicts hindering socio-economic progress. Hence, the aim of the article is to investigate how the United Church of Zambia’s land has been administered and managed, considering the fact that most of its land is based both in customary/traditional areas that are controlled by the Chiefs and formal or State lands that are largely controlled by the government institutions. The methodology that will be used in or der to examine how the United Church of Zambia manages and administer its land will be qualitative methodology. The article will conclude that there is need for the United Church of Zambia to develop a land management policy that will assist the Church to manage and administer its lands that is both located in the traditional and government areas. Above all, the Church needs to ensure that leasehold conversion that is both customary and traditional authorities through the local Chiefs and the government through its Ministry of Land and Natural Resources, Commissioner of Lands, together with the Ministry of Local Government are legitimately acquired.

The paper presents possibilities for establishment of a new market-based concept of the urban land management in Serbia in the period of transition. Urban land system and land policy are very important factors for competitiveness of cities in Serbia and initiating changes in this field is a necessity. The article discusses an option for privatization of urban public land and possible establishment and inclusion of leasehold land. Some open questions concerning the choice of the urban land system concept are considered, the possibility of urban land privatization and possibility for the establishment of leasehold of urban public land in Serbia. The paper concludes that there is a lack of political will to fairly solve problems of urban land reforms under the new market conditions. Some current research options suggested a reform based on privatization of public urban land, but there was no research on other options (leasehold for the majority of public land).
