This research has purposed to discover the legal protection for a customers which is using ATM card in Indonesia banking systems and to discover the dispute resolution against skimming system in banking sector. This research used normative research method. The conclusion from this study that is the legal protection for customers who is using ATM cards is based Act Number 8 of 1999 concerning Customer Protections and Act Number 21 of 1999 concerning Financial Services Authority especially on The regulation of Financial Services Authority Number 1/POJK.07/2013 concerning Customers Legal Protection on Financial Services. The dispute resolutions for skimming system problems can be resolved by litigation and non litigation.

This study aims to determine the form of legal protection, dispute resolution, and provide legal understanding. The normative research method using a qualitative approach describes legislation and a case approach, and Law Number 21 of 2011 concerning the Financial Services Authority, Law Number 19 of 2016 ITE, and OJK Number 77/POJK.01/2016 concerning Borrowing Services. . Data collection techniques through (1). Interview, (2). Surveys (3). Documentation study. Conclusion (1). Many customers are victims as users of unlicensed services. (2). Efforts to protect customers against the implementation of OJK services (3). Cooperating with the Indonesian Joint Funding Fintech Association (4). Determination of the upper limit on loan interest and code of conduct for the loan collection process, (5). OJK cooperates with the Ministry of Communication and Information.

This study aims to find out how the form of legal protection carried out by the Financial Service Authority towards consumers who experience disputes with insurance companies in Indonesia. This research is a normative legal research that is the prescriptive approach. The data are taken from secondary data types that consist of primary and secondary legal materials. Data collection techniques used are library studies, and the analytical techniques used are deductive by syllogism method. The result of the study shows that a form of repressive protections is carried out by the Financial Service Authority after a dispute between consumers and insurance services and a legal defense that contains many weaknesses. Settlement of disputes between consumers and Insurance Companies can be done through litigation/ court and non-litigation/ out of court settlement. In the litigation process through the Commercial Court. The non-litigation process that will carried out with the institution/ internal dispute resolution step, limited facilities through mediation that facilitated by Financial Services Authority and finally through the external dispute resolution or the arbitration institution.

Technology has become the part of today’s people life. Then, it is actually close to the application of it. Absolutely, it has example; such as the electricity for having more sophisticated in financial technology (Fin-Tech). The simplicity and speed of this technology have led people to adopt it in everyday’s life. One of the innovations in developing business and the economy, especially in the banking sector, is currently to develop Fintech (Financial Technology) which is able to facilitate all types of buying and selling transactions, investments and fundraising. Next, the purpose of this study is to explain and provide an understanding of the technical, procedures and benefits of the application, it is called Sharia FinTech. Then, it is also to contribute to the literature on the capacity of the latest technological and non-technological innovations. The research method used is descriptive research method with a qualitative approach. It is to describe and explore the phenomena in the form of engineering human innovation in the financial technology industry. It is done by taking into account the characteristics, quality, and interrelationships between activities It has several aspects; they are: conducting the observation, having an interview session, creating the documentation, and the last one is doing the Literature review. The result of this study is to increase the knowledge, skills and confidence of the community in managing personal finances to be better and to provide access to be having convenient and accountable financial services. Afterwards, this study linits on explaining and providing an understanding of the technical, procedure and benefits of Sharia Fintech for all people in need. Thence, the limitation of the research only discusses the role of Islamic Fintech in increasing the public financial inclusion and literacy. As for the the next researchers, they can be even wider by adding the collaboration of fintech and the banking world. The novelty of this research is the use of the android application as a digital platform in financial inclusion and literacy.

The existence of competition causes the original brand owner to feel disadvantaged because the sales result has decreased. It is permissible for someone to use another party's mark as long as they ask permission from the trademark owner first. The owner can give trademark rights to other people as agreed in an agreement. The formulation of the problem in this research is as follows: how is the legal protection of trademark rights and how to resolve violations of trademark rights. The research method used in this research is normative legal research. The results of the discussion in this study are as follows: Legal protection of the right to a trademark has been regulated by Law Number 20 of 2016 concerning Trademarks and Geographical Indications, in the provisions of the Law it is expressly stated that if it has been registered in the law that the right to a trademark has been protected. The sanction imposed on the perpetrator of the crime of trademark rights is a fine of Rp. 20,000,000, - (twenty million rupiah) on condition that if the fine is not paid, he will be subject to imprisonment for 6 (six) months. Settlement of trademark cases can be carried out through institutions that can be used to resolve trademark disputes, including: Alternative Dispute Resolution, Arbitration and Courts. Alternative dispute resolution wants the disputing parties to resolve their own dispute with the aim of obtaining a mutual agreement, if the agreement fails, can take arbitration, namely the disputing parties to be able to resolve the dispute to the arbitration institution based on the agreement, furthermore, if the arbitration is successful the last action is through the court, namely the commercial court which has the authority to adjudicate trademark disputes.

The objectives of this study are: 1) To determine and analyze the legal protection of consumers from traditional medicine with the method of cupping treatment in the Regency and City of Bogor. 2) To find out and analyze the responsibilities of cupping treatment businesses in Bogor Regency and City towards consumers who have suffered losses. The research method used in this study is a normative juridical research that uses a qualitative approach. The results of this study are: 1) Protection of cupping treatment consumers in Bogor Regency and Bogor City, in dispute resolution can be done through a mechanism that has been regulated in the Consumer Protection Law, namely through a dispute resolution mechanism in court or outside the court. 2) The responsibility of the cupping treatment business actors to consumers who are harmed can be accountable for their actions both civil and criminal. This is aimed at increasing the bargaining position of consumers in making transactions with business actors, so that they are not treated arbitrarily because there is a law that regulates it.Keywords: Legal Protection; Consumer; Traditional Treatment.

The growth of Fintech in Indonesia is very rapid, this condition is directly proportional to the legal problems that arise, the legal policy of regulation and protection of Fintech is still focused on the OJK, while the OJK still has many weaknesses in the implementation of supervision and protection of fintech activities, especially in the era of the covid pandemic. -19. The purpose of this study, first, by outlining the legal regulations issued by Bank Indonesia and the Financial Services Authority regarding fintech in Indonesia by looking at the legal weaknesses so that it is important to establish the Fintech Law. second, the urgency of the establishment of a fintech law on fintech consumer protection in Indonesia. Meanwhile, the importance of this research is that it will explain the development of the fintech industry in Indonesia, especially during the Pandemic, where the fintech industry experienced significant development so that this is an idea to provide a clear legal framework for the fintech industry. The research method used is normative juridical using library data and observations of fintech developments through library studies. Research findings show that so far fintech in Indonesia has used regulations contained in the POJK and PBI as the basis for implementing fintech, although it is felt that the regulations issued by POJK and PBI have not been able to provide maximum legal protection for the implementation of the fintech industry. so it is necessary to establish a law in order to provide legal protection for the development of the fintech industry now and in the future.

This study aimed to analyze the role of Bank Indonesia (BI) and the Otoritas Jasa Keuangan (OJK) of the banking activities in Indonesia and to analyze the legal protection of bank customers. There are two issues discussed in this study, the first regarding the role of OJK and Bank Indonesia in supervising crime in the banking world and the second regarding legal protection for customers victims of savings accounts break-ins crime. The research method used was normative juridical, by studying and reviewing legal principles derived from library materials. The discussions that were discussed in this article were how the role of OJK and Bank Indonesia in supervising crime in the banking world and how legal protection is for customers who are victims of savings account burglary in Indonesia. The Otoritas Jasa Keuangan regulation (PJOK) also requires banks to compensate for losses suffered by customers. Article 29 PJOK Number 1/PJOK.07/2013 states "Otoritas Jasa Keuangan is required to be responsible for Consumer losses arising from errors and/or negligence, management, employees of Financial Services Business Actors and/or third parties working for the interests of the Financial Services Providers. Financial Services Business. Lawsuits that can be pursued through the courts can be in the form of criminal charges or civil lawsuits. Embezzlement of bank customer deposits may be subjected to Article 372 and Article 374 of the Criminal Code (KUHP).

Tujuan artikel ini adalah untuk mengetahui adanya perlindungan bagi nasabah dalam penggunaan internet banking saat melakukan transaksi perbankan, disamping itu juga untuk dapat melindungi hak-hak nasabah selaku konsumen jasa perbankan. Metode penelitian yang digunakan yaitu metode penelitian normatif. Penulisan artikel ini menggunakan pendekatan perundang-undangan dan pendekatan kasus, yang mana dalam penelitian normatif ini meliputi beberapa kajian mengenai asas-asas hukum, sistematik hukum, serta sinkronisasi hukum. Hasil studi menunjukan bahwa penggunaan dari media telekomunikasi dan juga teknologi informasi dalam era globalisasi kali ini menempati kedudukan yang penting guna memudahkan proses dalam bertransaksi khususnya transaksi perbankan dan perdagangan bebas. Dengan terjadinya perkembangan di bidang teknologi dan informasi tersebut membuka peluang bagi tiap orang dengan mudahnya untuk melakukan perbuatan hukum seperti misalnya melakukan transaksi perbankan jual-beli. Dalam prakteknya internet banking merupakan salah satu delivery channel layanan di bidang perbankan yang erat kaitannya dengan teknologi, di satu sisi memberikan banyak manfaat, namun di sisi lain juga dapat menyebabkan kerugian bagi nasabah. Maka dari itu perlunya perlindungan hukum yang lebih spesifik untuk layanan internet banking tersebut. The purpose of this article is to determine whether there is protection for customers in the use of internet banking when conducting banking transactions, in addition to protecting the rights of customers as consumers of banking services. The research method used is the normative research method. The writing of this article uses a statute approach that prioritizes legal materials in the form of statutory regulations as a basic reference for conducting research. The results of the study show that the use of telecommunication media and information technology in this era of globalization occupies an important position in order to facilitate the process of transactions, especially banking transactions and free trade. With the development of technology and information, it opens up opportunities for everyone to easily take legal actions, such as buying and selling banking transactions. In practice, internet banking is one of the service delivery channels in the banking sector which is closely related to technology, on the one hand it provides many benefits, but on the other hand it can also cause losses for customers. Therefore, there is a need for more specific legal protection for internet banking services.

AbstractBlock-chain technology has been utilized in various countries in the world, specifically in Indonesia. Block-chain brings positive impact on the development of businesses in Indonesia, but it also has negative impacts if the government of Indonesia doesn�t keep an eye on it. The Positive impacts are that block-chain can improve the efficiency of time and transactions fee. But on the other hand, block-chain gives opportunity to the beginning of cybercrime, for example data theft, client�s financial data. The formulation of problems are: 1. What is the urgency of the establishment of law concerning block-chain technology utilization in Indonesia based on the perspective of dignified justice; 2. What kind of legal protection should be established concerning consumer and business founder protection on the utilization block-chain technology. This research method is a normative empirical method conducted the way of analyzing norms, the laws and regulation on regarding the topic and with profound interviews with experts/officials who has decent knowledge in this specific area. The purpose of this research is to analyze the consumer and founder protection related on the usage of block-chain and to give an input to the ministry on the urgency of the formation of the law on blockchain in Indonesia. The results of this study are that the blockchain technology has been used in various businesses, such as financial / banking sector, agriculture, etc. Blockchain technology can change the paradigm in the financial sector from a centralized system to a decentralized system and to improve system security. Blockchain must be monitored because the blockchain system contained data privacy, financial privacy to prevent the criminal acts. Apakah yang menjadi urgensi pembentukan peraturan perundang-undangan terkait manfaat teknologi blockchain di Indonesia berdasarkan perspektif keadilan yang bermartabat; 2. Apa jenis perlindungan hukum yang perlu dibangun tentang perlindungan konsumer dan pelaku usaha dalam penggunaan teknologi block chain. Metode yang digunakan ialah normatif empiris yang dilakukan dengan cara menganalisis norma, peraturan perundang-undangan terhadap topik yang diangkat dan dengan metode wawancara yang mendalam kepada narasumber/pejabat yang memiliki kompetensi di bidang tersebut. Tujuan penelitian untuk menganalisis perlindungan konsumen & pelaku usaha terkait penggunaan blockchain dan untuk memberi masukan bagi Kementerian terkait tentang urgensi pembentukan peraturan penggunaan blockchain di Indonesia. Hasil penelitian ini adalah teknologi blockchain telah dipergunakan di pelbagai usaha, baik di sektor keuangan/perbankan, pertanian dan lain sebagainya. Teknologi blockchain dapat merubah paradigma di sektor keuangan dari sistem sentralisasi menuju sistem desentralisasi dan untuk meningkatkan keamanan sistem. Blockchain wajib diawasi karena di dalam sistem blockchain terdapat privasi data, privasi keuangan dan agar tidak disalahgunakan untuk melakukan tindak pidana.   The aims and objectives of the research are to find out the practice of resolving sharia economic disputes in a non-litigation manner and the application of sharia economic dispute auctions. In order to achieve the aims and objectives, this research uses a normative juridical research method with an approach that refers to the Qur'an, Al-Hadith, ijtihad, legal theory, legal principles and legislation. Sources of data are obtained from the Qur'an, Al-Hadith, books, laws and regulations, court decisions, and so on as long as they are interrelated. The practice of resolving sharia economic disputes in a non-litigation manner can be pursued by arbitration, namely through the Sharia Arbitration Board (“Basyarnas-MUI”) and by alternative dispute resolution methods, namely through Consultation, Negotiation, Mediation or Expert Assessment. This is related to arbitration through the Basyarnas-MUI for the procedures and procedures that have been regulated. Meanwhile, alternative dispute resolution by means of Consultation, Negotiation, Mediation or Expert Assessment has not been sufficiently regulated. Despite this, there is already a National Committee for Islamic Economics and Finance (KNEKS) whose function is to formulate and provide recommendations for solving problems in the Islamic economy and finance sector. In addition to that, there are also arbitration institutions and other alternative dispute resolution, but these institutions have not specifically regulated the non-litigation settlement of sharia economic disputes. The application of sharia economic dispute auctions can be carried out on material guarantees by means of parate execution, executive titles or underhand sales. However, against the auction mechanism, the debtor can still take legal action, namely the cancellation of the auction or resistance / objection to the auction. This of course, apart from being less effective, it does not provide as intended the purpose of the law and legal protection for interested parties.
