The presented article addresses the issue of readaptation of convicts as part of the program of preparation for release from prison on the basis of art. 164 of the Penal Enforcement Code . The author presents the assumptions of the discussed institution of executive criminal law. Then, he defines the areas of activity and specific tasks of the probation officer for adults, implementing the convict to leave the prison in the light of applicable regulations and his own practice. He notices the deficiencies in the applicable provisions regarding the detailed specification of tasks and procedures of the body preparing the “dismissal program”. Indicates specific examples and the need to create specific legal regulations. He postulates the development of a coherent and complementary system of social readaptation of convicts, in which each institution obliged to implement the above objective would have a clearly defined role and tasks in practice.

Este trabajo tiene como finalidad analizar el tratamiento penal que durante el siglo XIX se dispensó a los actos indebidos para con el cuerpo y memoria de las personas fallecidas. Para ello, este texto se inicia con un recorrido normativo por los Códigos Penales españoles del siglo XIX (1822-1848-1850-1870) con el propósito de analizar la forma en que el Legislador penal fue incorporando esta cuestión en los distintos textos normativos. A continuación, y como forma de continuar este análisis, se estima adecuado detenerse en las razones político criminales subyacentes a la tipificación de estas conductas. De esta forma, se intenta realizar una aproximación a las lógicas punitivas decimonónicas inherentes a una esfera tan particular como el castigo penal a los actos irrespetuosos para con los difuntos. Por último, se incorpora un apartado conclusivo en el que abordar algunas ideas que, por razón de estructura narrativa no encontraban un acomodo idóneo en otras partes del texto pero que igualmente resultan de importancia para esta propuesta de análisis político-criminal histórico.This work aims to analyse the criminal law treatment that during the 19th century is dispensed to wrongdoing with the body and memory of deceased people. For that purpose, this text begins with a normative view of the Spanish Criminal Codes of the 19th century (1822-1848-1850-1870) in order to investigate how the Criminal Legislator incorporated this issue into the various normative texts. Hereunder, as a way to continue this analysis, it is considered appropriate to dwell on the criminal political reasons typification of these conducts. In this way, an attempt is made to approximate the decimonic punitive logics inherent in an area as particular as criminal punishment to disrespectful acts with the deceased. Finally, a concluding section is incorporated in order to address some ideas that, by reasons of narrative structure, did not find an appropriate accommodation in other parts of the text but which are also relevant for this proposal of historical political-criminal analysis.

ABSTRAK Artikel ini membahas cyber crime dalam bentuk phising berdasarkan Undang-Undang tentang Informasi dan Transaksi Elektronik. Penelitian yang digunakan yakni penelitian hukum normatif. Hasil penelitian yang telah dilakukan menunjukan: 1) Pengaturan hukum terhadap cyber crime dalam bentuk phising berdasarkan Undang-Undang tentang Informasi dan Transaksi Elektronik tidak dapat dikenakan Pasal 35 jo Pasal 51 Ayat (1) dan Pasal 28 Ayat (1) jo Pasal 45A Ayat (1). 2) Kebijakan hukum terhadap cyber crime dalam bentuk phising berdasarkan Undang-Undang tentang Informasi dan Transaksi Elektronik adalah dilakukannya perubahan terhadap Undang-Undang tentang ITE dengan merumuskan konsep phising dan merubah isi Pasal 35. ABSTRACT This article discusses cyber crime in the form of phishing based on the Law on Electronic Information and Transactions. The research used is normative legal research. The results of the research that have been conducted demonstrated that: 1) Legal regulations on cyber crime in the form of phishing based on the Law on Electronic Information and Transactions cannot be subject to Article 35 in conjunction with Article 51 Paragraph (1) and Article 28 Paragraph (1) in conjunction with Article 45A Paragraph ( 1). 2) the criminal law policy against cyber crime in the form of phishing based on the Law on Electronic Information and Transactions is the amendment of the Law on ITE by formulating the concept of phishing and amending the contents of Article 35.

The body is falling backwards, facing the sky. The hands are clasped together in a sampeah, as if in greeting, as if in prayer. For the artist of the Cambodian Tragedy Memorial, also called A ceux qui ne sont plus là (For those who are no longer here), the body “speak[s] both to and beyond individual identity.” By standing both as personal testimony of loss and “in memory of the Cambodian genocide and its impossible representation,” the memorial raises longstanding questions on the authority and limits of testimony, on representation, and, importantly for this symposium, on the relation between art and international criminal law.

The fundamental premises of Islamic law are that Allah has revealed His will for human-kind in the Holy Quran and the inspired example of the Prophet Muhammad (Peace be Upon Him), and that society's law must conform to Allah's revealed will. The scope of Islamic law is broader than the common law or civil law. In addition to core legal doctrines covering the family, wrongs, procedure, and commercial transactions, Islamic law also includes detailed rules regulating religious ritual and social etiquette. In Islam, religiosity is not asceticism in monasteries nor is it chattering from the pulpits. Instead, it is behaving in a manner that is requested from the Creator under all circumstances, places and times, in belief, statement and actions. Historically, law and religion have never been completely separated. They have never been so independent as to achieve complete autonomy from each other. Religion has essentially been embodied in legal systems, even in those that have aspired to privatize religion. Based on this fact, this paper discusses such fact i.e religiosity on specific theme of Islamic law that is criminal law which means the body of law dealing with wrongs that are punishable in Islamic law with the object of deterrence.

AbstractThis article examines how the so-called disembodied criminal subject is given structure and form through the law of homicide and assault. By analysing how the body is materialised through the criminal law’s enactment of death and injury, this article suggests that the biological positioning of these harms of violence as uncontroversial, natural, and universal conditions of being ‘human’ cannot fully appreciate what makes violence wrongful for us, as embodied entities. Absent a theory of the body, and a consideration of corporeality, the criminal law risks marginalising, or altogether eliding, experiences of violence that do not align with its paradigmatic vision of what bodies can and must do when suffering its effects. Here I consider how the bionic body disrupts the criminal law’s understanding of human violence by being a body that is both organic and inorganic, and capable of experiencing and performing violence in unexpected ways. I propose that a criminal law that is more receptive to the changing, technologically mediated conditions of human existence would be one that takes the corporeal dimensions of violence more seriously and, as an extension of this, adopts an embodied, embedded, and relational understanding of human vulnerability to violence.

The issue of environmental protection through criminal law is primarily associated with the fight against the most serious attacks on the environment. The progressive degradation of natural ecosystems, which is an important consequence of the development of human civilisation, has shown that one of the most important challenges of modern man is to provide the environment with adequate and effective protection. It should be emphasized that although the main burden of such protection is implemented through administrative law and to a lesser degree through civil law instruments, the use of criminal law in environmental protection as an ultima ratio of this protection has proved to be absolutely necessary. Legal regulations regarding the criminal law protection of the environment in Poland have gone a long way in terms of development. It should be emphasized, however, that the shape and development of criminal law protection of the environment in Poland has been significantly influenced by European legislation, which was obviously related to Poland’s accession to the European Union in 2004 and international law, in particular the Convention on International Trade in Endangered Species of Wild Fauna and Flora, signed on March 3, 1973 in Washington, DC, and the Convention on the Control of Transboundary Movements of Hazardous Wastes and Their Disposal, which was opened for signature in Basel on March 22, 1989. The article presents the most important issues related to the impact of European and international law on the development of environmental protection through criminal law in Poland.

The main principles of draft legislation concerning juvenile liability under criminal law formulated at the beginning of the Second Polish RepublicThe paper is devoted to the main principles of draft legislation concerning juvenile liability under criminal law formulated in the early days of the Second Polish Republic. The author discusses the most important legal terms and constructs of the drafts formulated by Józef Reinhold and the Codification Commission of the Republic of Poland.He demonstrates that juvenile liability under criminal law was presented in a concise and clear manner in the draft regulations, with the legislators reaching a compromise over the latest views of the proponents of the legal doctrine at the time and making a creative use of the solutions used in other countries as well as these countries’ experiences. The aim of the Polish proposals was, first of all, to reform the juvenile offenders and not to put them in prison. The reform of criminal law applying to juveniles was meant to formulate special legal regulations as well as an autonomous adjudication procedure. It should be emphasised that the suggestions formulated in the Polish legal doctrine and legislation in the inter-war period were taken into account in the Polish Criminal Code of 1932 and still constitute the basis for dealing with juveniles committing criminal offences.Hauptgrundsätze der zu Beginn der Zweiten Polnischen Republik ausgearbeiteten Gesetzesvorschläge betreffend die strafrechtliche Verantwortung MinderjährigerDie Bearbeitung betrifft die Hauptgrundsätze der Projekte betreffend die strafrechtliche Verantwortung von Minderjährigen, die in den Anfängen der Zweiten Polnischen Republik ausgearbeitet wurden. Besprochen wurden die wichtigsten Begriffe und Rechtskonstruktionen des Projektes von Józef Reinhold und der Kodifikationskommission der Republik Polen.Es wurde bewiesen, dass die strafrechtliche Verantwortung von Minderjährigen in den polnischen Entwürfen synthetisch und durchsichtig ausgedrückt wurde. Sie berücksichtigten auch die neusten Meinungen der damaligen Doktrin des Strafrechtes und nutzten kreativ die entsprechenden Lösungen und Erfahrungen anderer Staaten. Das Ziel der in Polen ausgearbeiteten Lösungen war die Besserung der minderjährigen Straftäter und nicht ihre Bestrafung mit dem Freiheitsentzug. Die Reform des Strafrechtes für Minderjährige führte zur Aussonderung spezieller rechtlicher Regulierungen und einer autonomen Entscheidungsart. Zu betonen ist, dass die in der polnischen Rechtslehre und in der Gesetzgebung zu den Anfängen der Zwischenkriegszeit des 20. Jahrhunderts ausgearbeiteten Forderungen in dem polnischen Strafgesetzbuch aus dem Jahre 1932 berücksichtigt wurden und weiterhin eine Verfahrensgrundlage bei straffälligen Minderjährigen darstellen.
