The article is a part of the broad current of the philosophy of responsibility. It analyses and describes the basic elements of human activity in the anthropological and ethical perspective. A particular feature discussed in the article is selflessness, which is analysed in the perspective of the main ethical currents. In personalistic philosophy, responsibility and selflessness result from the will, whereas in deontological philosophy they result from the moral norm adopted by the subject. The concept that describes the nature and fundamental elements of an act is the theory of supererogatory act. According to it, a selfless act is a free, conscious act resulting from the realization of a norm immanent to the subject.

Intoxication as a ground to set aside a contract is not something that has proved to be easy for the law to regulate. This is perhaps not very surprising. Intoxication is a temporary condition of varying degrees of magnitude. Its presence does however raise questions of contractual autonomy and individual responsibility. Alcohol consumption is a common social activity and perceptions of intoxication and especially alcoholism have changed over time. Roman law is surprisingly quiet on the subject. In modern times the rules about intoxicated contracting in Scottish and English law is very similar. Rather more interestingly the law in these two jurisdictions has reached the current position in slightly different ways. This history can be traced through English Equity, the works of the Scottish Institutional writers, the rise of the Will Theory, and all leavened with a dose of judicial pragmatism.

Freedom is the focus of the first of the writings included in The Two Fundamental Problems of Ethics. The attention that Schopenhauer devotes to the subject does not stop here, however, since freedom appears recurrently in different parts of his system. It is linked to his theory of knowledge, metaphysics, aesthetics, and the denial of the will. This chapter follows that track and examines the presence in different contexts of Schopenhauerian thought of a freedom that is so undeniable as unexplainable. In this way will be shown Schopenhauer’s transition from the freedom of the voluntas to the freedom of noluntas [non-willing] and the state of great liberation that occurs because the will frees itself from itself. It is a transition that begins and ends at the same point: mystery

This article examines how the formation of markets in bottled water has relied on assembling a particular subject: the subject of hydration. The discourse of hydration is a conspicuous feature of efforts to market bottled water, allowing companies to appeal to scientifically framed principles and ideas of health in order to position the product as an essential component in self-health and healthy lifestyles. Alongside related principles, such as the ‘8 × 8 rule’, hydration has done much to establish new practices of water drinking and consumption in which the consumer appears to be always at risk of dehydration and must engage in practices of ‘frequent sipping’. This article traces the emergence of the concept of hydration from its origins in exercise science and explores its circulation, contemporary uses and purchase. I argue that the appeal to biomedical languages and concepts found in the discourse of hydration connects with much broader ways of conceiving and acting upon the self that have become prevalent in contemporary society – what Rose and Novas call ‘biological citizenship’ – indicating how the ensemble of hydration participates in wider-ranging transformations in forms of rule. The story of hydration reveals how biomedical techniques of the self can be made to double up as ‘market devices’ by offering specific procedures for assessing the self and calculating the body’s needs. In order to grasp these developments, I position the health sciences, and health and fitness in particular, as a potent site of popular culture in which bodies learn to be affected by the procedures of scientific experiment. A critical grasp of this context is best enabled, I argue, by situating the producers and consumers of scientific principles and commercial products as embodied and looking at their interconnection in processes of emergence. Through these means, we can begin to develop a fully materialized account of the question: how have we become so thirsty?

Straipsnyje aptariama graikiškojo filosofavimo genezė, t. y. nagrinėjamos pirmojo filosofijos teiginio susiklostymo prielaidos ir tų prielaidų numanoma teiginio prasmė. Filosofijos istorijoje nusistovėjusios pirmųjų filosofų teiginių interpretacijos kilmė siejama su Aristotelio filosofija. Teigiama, kad Aristotelis graikiškąjį filosofavimą jau visiškai įkurdina rašte. Iš rašto pozicijų Aristotelis žvelgia ir į pirmųjų filosofų ištaras, todėl suvokia jas vien kaip rašto (teorinio mąstymo) elementus. Straipsnyje daroma prielaida, kad filosofavimas prasidėjo ne kaip raštas, o kaip su žmogaus veikla susijęs tradicinis kalbėjimas. Filosofavimo kaip konstruktyvios kalbėjimo atmainos specifiką lėmė antikoje susiklosčiusi refleksijos situacija, kuri siejama su septynių išminčių imperatyvu ‘Pažink save!’ Parodoma, kad šis imperatyvas steigia skirtį tarp logo ir kosmo, kurią antikos išminčius išgyvena kaip sinkretinio gyvenimo vidujybės netektį. Straipsnio autorius interpretuoja filosofavimą kaip kalbėjimą ir veikimą, kuriais antikos išminčius siekia susigrąžinti ikirefleksinę būseną. Teigiama, kad sinkretinių mąstymo įgūdžių nepraradęs antikos išminčius savąjį filosofavimą linkęs aiškinti kaip pritapimo prie kosmo būdą. Kadangi refleksija įkurdina žmogų teorinio mąstymo erdvėje, tai pritapimo prie kosmo veiksmas tegalimas mąstymo plotmėje, todėl filosofavimą steigianti skirtis tarp logo ir kosmo besiplėtojančiame filosofavime nuaidi skirtimis kosme. Tačiau pirmieji išminčiai dar tikisi pilnatviško pritapimo prie kosmo ir tokio pritapimo regimybę jie dar pelno kosmo kaip grožio išgyvenimu, kurį Platonas ir Aristotelis sieja su nuostaba. The circumstances of the appearance of the first utterance in Greek philosophy and their impact upon its meaning are revealed. The traditional interpretation of the first utterances in the early Greek philosophy is attributed to Aristotle. The latter is said to have transferred Greek philosophizing totally into writing and subsequently to treat the first utterances as elements of writing. In the article, the suggestion is put forward that philosophizing did not begin as a writing but rather as a talking activity immersed in human activity in general. The specificity of philosophizing as constructive talking is related to the situation of reflection, caused by the imperative of the Seven Sages, namely by the imperative ‘Know thyself!”. It is shown here that the imperative introduces the difference between logos and cosmos, which is experienced by a Greek Sage as a loss of sincretic life. Philosophizing is then introduced as an activity of talking, provoked by the will to reestablish the original sincretic state. The author argues that because of syncretist skills, this activity is treated by early Greek philosophers as a way of partaking in cosmos. As reflection conveys a philosopher into the realm of theoretical thinking, partaking in cosmos is possible only as a way of thinking. Consequently, the difference between logos and cosmos in philosophizing resolves itself in the differences of cosmos. Nevertheless, the first philosophers still retained some hope for complete partaking in cosmos, and they gained the illusion of such a partaking by aesthetic experience of cosmos, which was attributed by Plato and Aristotle to wondering. Consequently, the first utterance of Greek philosophy is interpreted in this article as a kind of poetic discourse that refers to the activity of aesthetic partaking in cosmos.Keywords: writing, reason, reflection, cosmos, partaking, arche, the beautiful, truth, being.

The paper focuses on two types of the 17th century public discourse – of exclusion and tolerance. The research is based on the analysis of the works of Szymon Starowolski (Braterskie napomnienie, Prawdziwe objaśnienie Braterskiego napomnienia) and Samuel Przypkowski (Braterska deklaracyja) which constitute a polemical chain or a series of works combined on the basis of discussion replies. The purpose of the sketch is to characterize the subjects of the discourse, describe the communication strategies used and reconstruct presented attitudes and values. The subject of the discourse of exclusion assumes the approach of a hegemon attempting to discredit the object of the discourse and lead to its isolation. It invokes to insinuation and emotional arguments. The subject of the discourse of tolerance represents an irenic attitude and presents a society based on amicable coexistence, the will of cooperation, respect for law and freedom of conscience.

Resumo: Este artigo tem como objetivo descrever um breve histórico sobre diferentes tendências pedagógicas da educação no Brasil e debater a relação entre esses modelos e a busca da formação do conhecimento, através da iniciação da pesquisa, usando, para isso, uma experiência realizada numa disciplina do Curso Técnico de Edificações do Instituto Federal de Educação, Ciência e Tecnologia Sul-Riograndense. O estudo parte do pressuposto de que é preciso apreender com rapidez, em um mundo frenético, onde o ensino necessita de múltiplos contextos. “Roubemos”, então, parte de uma conversa deleuziana, na qual aprender é pensar, e do entendimento de que o professor reflexivo é o que procura desencadear, arrolar e romper o pensamento. Frente à ruptura feita pela tentativa de inovação em sala de aula, o paradigma dominante aqui se desconstrói, necessitando novas conexões para seguir. Assim, esta pesquisa parte da narração de uma nova prática, em que a inovação demonstra que o interesse dos estudantes é proporcional à curiosidade que a disciplina ou as atividades podem propiciar. A pesquisa desvincula-se do apenas ir para o laboratório de materiais de construção e realizar análises hipotéticas. Aqui, altera-se e amplia-se com o estímulo da vontade dos estudantes em analisar um produto que eles mesmos criaram. Desse modo, os estudantes são provocados a produzir, na forma de um texto científico, o conteúdo abordado, tendo a possibilidade de introdução na iniciação científica e de perdurar nela durante o semestre inteiro. Professor reflexivo.  THE REFLECTIVE TEACHER AND EDUCATION BY RESEARCH: PERSPECTIVES OF A PRACTICE WITH STUDENTS OF THE BUILDING TECHNICAL COURSE Abstract: This article aims to describe a brief history of the different pedagogical trends of education in Brazil and discuss the relations between these models and the pursuit of knowledge formation through the initiation of research, by using it for an experiment conducted in the discipline of Building Technical Course of Federal Institute of Education, Science and Technology Sul-Rio-Grandense. The study assumes that we need to grasp quickly, in a frantic world, where teaching requires multiple contexts. We pick part of a conversation from Deleuze, by whom learning is thinking, and the understanding that the reflective teacher is looking trigger, roll over and break the thought. Face to break made by attempt of innovation in the classroom, the dominant paradigm here is deconstructed and need new connections. Thus, this research is the narration of a new practice, where innovation shows that student interest is proportional to the curiosity that the subject or the activities can provide. The research is disassociated of the only go to the lab of building materials and perform what if analysis here alters and expands on the stimulus of the will of the students in analyzing a product that they themselves created. Therefore, students are provoked to produce a scientific text about the studied subject, and they are given the opportunity of experiencing the undergraduate research and continuing it during the semester. The article explores the variety of theoretical approaches to legal interpretation. It has been determined that the variety of approaches to legal interpretation is due to the complexity of the nature of the origin of this phenomenon, the conditions for the development of post-non-classical science, and the recent influence of the paradigm of comparism, which assumes pluralism of opinions and ideas in legal research. It was found that in modern science there are four traditional theoretical approaches to the essence of legal interpretation. It has been determined that the content of the first approach is revealed within the framework of legal hermeneutics through a number of categories. The essence of the second approach (formal dogmatic or static) is expressed in the fact that the subject of interpretation must strictly and rigorously follow the letter of the law, establish only the meaning of the normative legal act, which the lawmaking body enshrined in it at the time of the publication of the act. That is why normative legal acts cannot, through interpretation, adapt to the changing economic, social, political, cultural internal and external conditions of public life. It is proved that the essence of the dynamic theoretical approach lies in the fact that the subject of legal interpretation adapts the normative legal act to the changes that occur in various social relations. It was found that there is a contradiction between the dynamic and static approaches in legal interpretation, which is reflected in the traditionally called objective and subjective theories of interpretation. According to the subjective theory, the purpose of legal interpretation is to establish the «will of the legislator», and according to the objective theory – to establish the «will of the law». It has been substantiated that the essence of the activity approach is that interpretation is considered as a special kind of legal activity aimed at understanding and clarifying the content of legal texts. The authors of this article point out that in order to establish the true nature of legal interpretation, the methodological foundations of the study should be presented much broader and more diverse, and not be limited only to traditional approaches. When studying it, a comprehensive, integrative approach is needed, which, based on the relevance of interdisciplinary relationships, would include logical, language (linguistic), philosophical, sociological, psychological, axiological (value), ethical, legal, historical, economic, political, mathematical and other substantiation of legal interpretation. The purpose of the article. Theoretical analysis of personal mediation of manipuiative tendencies. Methodology. The basis of this study is a theoretical analysis, synthesis, generalization, systematization of available scientific literature on the subject. Results. Manipulation of consciousness is one of the ways to dominate and suppress the will of people by acting on them through the programming of their behavior. This action is aimed at the mental structures of man, which is carried out secretly and aims to change the thoughts, motivations and goals of people in the right direction for a certain group of people. In this case, the purpose of manipulation – hiding their true intentions, to encourage another person to take certain actions, change values, ideas and opinions, etc., while maintaining the illusion of independence in general and independence of decisions or actions. In other words, to motivate a person to what he does not want to do, to distract from what he aspires to, but at the same time to create in him the confidence that he is acting of his own free will. Practical implications. The need to study manipulative tendencies is to determine the main ways and methods of manipulation and ways to protect against manipulative action. To reveal the main features of the manipulator’s personality and the category of people who are most prone to manipulative action. Theoretical materials can be used in the training process of the courses “Psychology of personality”, “Age Psychology”, “Differential Psychology”, “Fundamentals psychological correction”. Originality/value. It was found that the criteria for manipulation are: the attitude of the manipulator to the objects of manipulation as a means to achieve their own goal, the desire to gain unilateral advantage, the hidden nature of influence, use of force, motivation, motivation and skill in the process of manipulative influence. A tribe is a regional security organization. It ties together a number of local primary face-to-face groups. It is charged with control of territory, defense against outside intruders, and protection of humans, livestock, and productive resources, such as wells and cultivation. Whatever productive activity tribesmen are primarily engaged in, such as pastoralism or cultivation, each male, with the exception of holy men, serves also as a warrior. Tribes are usually defined by a symbolic idiom that asserts a primordial connection among tribesmen. Descent from a common ancestor is an idiom used to define many tribes. Tribal names are often those of the ancestor that all members share. Internal divisions may also be defined by ancestry; a descent idiom allows group divisions at every level of the genealogy. Tribal subgroups are also charged with security and are defined as having “collective responsibility”; that is, the moral norm is that each member is responsible for what other members do and, as a consequence, all members are seen by outsiders as equivalent. There is also a moral norm to aid fellow tribesmen, the obligation stronger for close kin, weaker for more distant kin. Internal tribal relations among subgroups are based on what anthropologists call “balanced opposition” or “complementary opposition.” Each tribal subgroup is “balanced” against other subgroups of the same genealogical order, which in principle, and often in practice, serves as a deterrent against hostile acts. Tribal leadership can take the form of primus inter pares. However, in tribes in contact with states, more formal leadership roles, with at least the trappings of authority and power, can develop. Whatever the role of the tribal leader, he depends upon consent of the tribesmen. In tribal subgroups, political process tends to be highly democratic, and leaders are those who can elicit agreement among the members and then carry out the will of the community. Tribes are social organizations that are not static and do not always maintain form. They respond to environmental opportunities and constraints. If a state nearby is in trouble, with failing leadership and an unruly population, a tribe may mount a campaign to invade and conquer the state, setting itself up as a ruling dynasty. In these cases, tribes lose their tribal characteristics and become a ruling elite. However, if a nearby state gains strength and expands its territorial control, it may overrun and defeat the tribe, encapsulating it, incorporating it, and even assimilating it.
