Same same but different?: The European Border and Coast Guard and the “new” Perspective of Joint Border Surveillance at the External Borders of the European Union

According to the title, the subject of this article is the activity of Frontex (European Border and Coast Guard Agency) on the Western Balkan route during the migrant crisis, the escalation of which took place in mid-2015. The main part of the text has been divided into four parts. In the first part of the article, the author briefly described the genesis of Frontex and its current activity in the normative perspective. In the second part, the author characterised the determinants of the migrant crisis, focusing on the challenges for the European Union which the crisis generated. In the third part, the author described the course of the Western Balkan route and analysed statistical data on the population migrating that route. In the fourth and last part, the author analysed Frontex’s activity on the Western Balkan route, describing the determinants of the actions taken.

The research reveals the peculiarities of the Distance Learning (DL) development in the framework of border guards training in the European Union (EU) countries. Theoretical and practical concepts, modern stage and peculiarities of border guards’ DL development were substantiated in the article. The special attention was paid to possibilities of educational web platforms, which are widely utilized in the training of personnel of the border guard agencies, namely: Web Platform Virtual Aula of the FRONTEX Agency; E-Net Web Platform of the CEPOL (The European Police College); EU Coast Guard Functions Training Portal (CGFTP); ILIAS Learning Platform of the EU Mission EUBAM (EU Border Assistance Mission to Moldova and Ukraine); Connect & Learn platform of the UNHCR (The Office of the United Nations High Commissioner for Refugees); Global eLearning Program of the UNODC (United Nations Office on Drugs and Crime). The authors have also conducted the comparative analysis of DL courses of educational platforms with border guard components in the EU countries, which showed that the platform with the biggest number of border guard-oriented courses is Virtual Aula platform of FRONTEX Agency. Suggestions and proposals on DL development and prospective directions based on the experience gained during DL introduction into the system of the border guards’ training system supported by the survey results are given in the conclusion of this article in order to facilitate the improvement of border guards’ DL systems in the EU countries. The prospects of the border guards’ DL system development are based on 5 key factors: aligning all DL training courses to the Sectoral Qualification Framework and Common Core Curricular for border guarding: unification of the skills and knowledge of European border guards; enhanced use of the Internet and social media; introduction of common educational web-platforms; organizing specialized training for the specialists in DL use and management, and developing common eLearning tools and programs.

The study reveals the theoretical and practical approaches of developing training programs for Remotely Piloted Aircraft operators in the sphere of border surveillance of the state border protection agencies of the European Union and Ukraine using multicriteria optimization to find required rational parameters. The results of the study within the educational grant of Frontex Agency conducted by the team of experts from the Border Guard Services of Ukraine and EU countries were used to enhance the training program of air reconnaissance units of border protection bodies at the Main Training Centre of the Border Guard Service of Ukraine based on the best EU practices, in order to ensure obtaining of knowledge and practical skills by personnel of the border guard Remotely Piloted Aircraft external crews, which will increase the level of interoperability and professional competence of border guards while conducting border surveillance tasks.

Libya is a significant transit country for irregular migration to Europe and is therefore the site of much effort by external policy makers, notably the European Union. External actors have been unable to formalize workable agreements with Libyan authorities to address or stop onward migration to Europe. Instead, they have been forced to develop arrangements with Libya’s neighboring countries to work around this impasse. This article examines the rhetoric behind efforts by individual European countries and the European Union to implement externally produced migration policies. From crisis narratives to invoking a humanitarian imperative to “save lives,” it is argued that these tropes justify various, at times competing, agendas. This results in almost no tangible improvement to the situation of irregular migrants or the capacity of authorities to deal with irregular migration, with one exception being that of the Libyan coast guard.

Drawing on archives gathered in the six founding member states of the European Union, this book offers a new perspective on the ‘constitutionalization’ of the European treaties, which was launched in the 1960s by the Court of Justice of the EU. By highlighting the professional and personal backgrounds of the first European judges and advocates general, its author studies the dynamics which prevailed within the institution during its ‘revolutionary’ years and analyzes the Court’s relationship with the Member States of the European Communities. Through a detailed study of the selection process of the members of the Court, it also provides new answers to the question of whether governments tried to put an end to its bold jurisprudence.

In this paper I will use concepts from innovation theory to analyse the work of the Court of Justice of the European Union in its important role as sole interpreter of EU law. In that regard, I define ‘innovator’ as one that facilitates use of new or existing inventions. Thus innovation is portrayed as a process in which several actors may contribute and where it all starts with an invention (the solution) and it ends with the innovation (the process of making use of the invention). The Court of Justice of the European Union may be an inventor in as much as it is allowed to invent solutions in order to solve new or existing problems, and it may be innovative in as much as it hands down judgments that shall be followed (i.e. it makes use of the invention).The substance of the paper deals with case-law from the Court of Justice of the European Union in the field of cross-border infringements. The cases will be analysed in relation to the idea that legal decision-making can be described as an innovative process. An approach like this makes it possible to draw conclusions regarding the Court of Justice of the European Unions ability to innovate. It will be apparent that the Court is primarily concerned with so called reactive innovation (i.e. innovation that builds on existing knowledge). Only in exceptional circumstances do we find examples where the Court has proved to conduct in proactive innovation (i.e. inventing and applying new solutions) and this may, according to the author, prove to be a preferred standard. Better to drive safely than to drive in the ditch.

Justice and home affairs (JHA) is one of the most salient policy fields at European Union (EU) level. It deals with issues closely related to the sovereignty of member states including immigration, borders, and internal security. This article takes stock of the policy’s development and current academic debates. It argues that EU justice and home affairs is at a crossroads. Most EU actors underline the value added of European cooperation to tackle transnational threats such as terrorism and organized crime as well as the challenge of international migration. Indeed, the EU has increased its operational cooperation, data-sharing and legislative activities. The EU home affairs agencies, notably the European Police Office (Europol) and European Border and Coast Guard Agency (Frontex), have been substantially empowered. Yet JHA has also become a playing field for those attempting to politicize the European integration process. Therefore, recent years have seen major conflicts emerge that risk fragmenting the EU. These include controversies over the distribution of asylum seekers within the EU and the upholding of rule of law standards in some Eastern European states. Scholars have followed these developments with interest, contributing to a multifaceted and rich literature on aspects such as the dynamics of EU decision-making and the policy’s impact on the member states’ respect for fundamental rights and civil liberties. Promising avenues of further research include the implications of the politicization of the field and the consequences of ever more interconnected internal security databases and technologies.
