Effect systems have been a subject of active research for nearly four decades, with the most notable practical example being checked exceptions in programming languages such as Java. While many exception systems support abstraction, aggregation, and hierarchy (e.g., via class declaration and subclassing mechanisms), it is rare to see such expressive power in more generic effect systems. We designed an effect system around the idea of protecting system resources and incorporated our effect system into the Wyvern programming language. Similar to type members, a Wyvern object can have effect members that can abstract lower-level effects, allow for aggregation, and have both lower and upper bounds, providing for a granular effect hierarchy. We argue that Wyvern’s effects capture the right balance of expressiveness and power from the programming language design perspective. We present a full formalization of our effect-system design, showing that it allows reasoning about authority and attenuation. Our approach is evaluated through a security-related case study.

Purpose: Engineering, procurement, and construction (EPC) contracts are on their way to becoming the most common type of contract used by the private sector for large-scale infrastructure projects. Every project requires a strong relationship between all of the experts participating in EPC projects and the client. This relationship must be solidly established by an architect; otherwise, the project may fail for all parties involved, including the client, contractor, lenders, government, and others. The purpose of this study is to identify if the working of the EPC contracts is favourable for the architectural profession, and to identify the way in which the working could be improved. Methodology: A qualitative approach was applied to analyze the critical points of EPC contracts based upon reviews of related case studies from the public sector and supplementary interviews with professionals in the field. Main Finding: The architect's role in an EPC contract is not crucial and is equal to other stakeholders involved in the project. Also, EPC contractors have the power to dictate the workflow of the project and hence, architects might have to compromise in terms of the design, compensation, etc. Implications: It is very important for every project to have an outcome based on each stakeholders/consultants inputs specially on larger projects, this article is a step towards understanding the role of architects under an EPC contract as the future projects will come under its purview.  Novelty: The study is done under the lens of a newly graduated architect and not as any other professional, thereby trying to develop an understanding for fresh architects.

Traffic accidents are of worldwide concern, as they are one of the leading causes of death globally. One policy designed to cope with them is the design and deployment of road safety systems. These aim to predict crashes based on historical records, provided by new Internet of Things (IoT) technologies, to enhance traffic flow management and promote safer roads. Increasing data availability has helped machine learning (ML) to address the prediction of crashes and their severity. The literature reports numerous contributions regarding survey papers, experimental comparisons of various techniques, and the design of new methods at the point where crash severity prediction (CSP) and ML converge. Despite such progress, and as far as we know, there are no comprehensive research articles that theoretically and practically approach the model selection problem (MSP) in CSP. Thus, this paper introduces a bibliometric analysis and experimental benchmark of ML and automated machine learning (AutoML) as a suitable approach to automatically address the MSP in CSP. Firstly, 2318 bibliographic references were consulted to identify relevant authors, trending topics, keywords evolution, and the most common ML methods used in related-case studies, which revealed an opportunity for the use AutoML in the transportation field. Then, we compared AutoML (AutoGluon, Auto-sklearn, TPOT) and ML (CatBoost, Decision Tree, Extra Trees, Gradient Boosting, Gaussian Naive Bayes, Light Gradient Boosting Machine, Random Forest) methods in three case studies using open data portals belonging to the cities of Medellín, Bogotá, and Bucaramanga in Colombia. Our experimentation reveals that AutoGluon and CatBoost are competitive and robust ML approaches to deal with various CSP problems. In addition, we concluded that general-purpose AutoML effectively supports the MSP in CSP without developing domain-focused AutoML methods for this supervised learning problem. Finally, based on the results obtained, we introduce challenges and research opportunities that the community should explore to enhance the contributions that ML and AutoML can bring to CSP and other transportation areas.

This Case Note analyzes the Ninth Circuit’s approach to the issue of whether patients and doctors destroy proximate cause in cases where third-party payors (“TPPs”) sue drug companies for fraudulently misrepresenting the health risks associated with their products. In the 2019 case Painters & Allied Trades District Council 82 Health Care Fund v. Takeda Pharmaceuticals Co., the Ninth Circuit held that TPPs suing to recover damages from a pharmaceutical company for the fraudulent omission of a drug’s health risks could satisfy the proximate cause requirement for a civil cause of action under § 1964(c) of the Racketeer Influenced and Corrupt Organizations Act (“RICO”). The Ninth Circuit’s decision is satisfactory in that it faithfully (1) observes the Supreme Court’s direct relation test and (2) follows precedent establishing that a plaintiff satisfies the proximate cause requirement when their alleged injury is a foreseeable and natural consequence of the defendant’s fraud. As a matter of public policy, this holding is positive because it hamstrings pharmaceutical companies’ ability to escape liability by hiding behind patients, doctors, and other actors inhabiting the chain of causation. Additionally, the Ninth Circuit’s holding is positive in that it adheres to Supreme Court precedent and helps deter future injurious conduct. In support of these assertions, this Case Note begins by examining the factual background and procedural posture of Painters. The Note continues by analyzing the majority’s opinion with respect to related case law and closes by suggesting ways to address some of the potential problems that could stem from the Ninth Circuit’s decision.

The article conducts a comprehensive scholarly analysis of framework agreements – a public procurement technique often used across different European jurisdictions. Besides examining the general legal framework of the EU and Lithuanian law on framework agreements, the article also examines the newest EU case law. The authors analyse the relationship between the initial tender procedure establishing the framework agreement and the subsequent mini-competition that follows under the former to award the public contract. In contrast to the Lithuanian legal regulation and related case law, the authors argue that these two stages are interconnected and must be viewed as a unified part of the same procurement process in line with European legal doctrine. Finally, the article highlights the differences between framework agreements and public contracts.

The nurse-patient relationship involves complex attitudes and behaviours with ethical and deontological implications. It has been linked to improvements in patient health outcomes, although there is still no consensus in the scientific literature as to the definition and characterisation of the concept. This article aim to define the concept of the nurse-patient relationship. A concept analysis was conducted using the Walker and Avant method to identify the attributes defining the nurse-patient relationship. An integrative review of the literature was conducted using the PubMed, Web of Science, Scopus, and Cumulative Index to Nursing & Allied Health Literature databases. A review of the grey literature and other minor non-indexed publications on the topic was also conducted. A total of 36 articles were included in the review. A model case, a contrary case, a related case, and empirical references were produced to clarify the concept and identify its essential attributes. The concept is defined as a helping relationship involving interaction between different players. It is the basis of nursing care and is intended to meet the healthcare needs of the individual receiving this care. It is also viewed as an intervention in itself, requiring a specific training process just like any other nursing skill. The essential attributes of the relationship are empathy, presence, contact, authenticity, trust, and reciprocity. In conclusion, the nurse-patient relationship is a helping relationship established with the patient and/or their family based on interaction, communication, respect for ethical values, acceptance, and empathy in order to encourage introspection and behavioural change. Key components include communication, active listening, and respect. Bioethical values and confidentiality must also be present to ensure that the relationship is built on equality and intimacy.

This article expands on the usability of the concepts of “place making” and “place attachment” as recently developed in urban studies research in the context of housing insecurity of marginalized communities in today’s neo-liberal city. Particularly, against the growing threat of urban evictions, the article utilizes a transdisciplinary approach, showing the relevance of both concepts for (a) a better understanding of bottom-up processes of spatial production and attempts to create a sense of place on the part of such communities, and (b) offering an innovative legal strategy for doing justice to these communities in terms of their compensation rights, especially where a title to land has not been registered on a private basis. These issues are critically examined on the site-related case of the Givat-Amal quarter in Tel Aviv, Israel. This district is now under actual final threat of forced evictions following seven conflicted decades with the state, municipal authorities and private entrepreneurs. Our transdisciplinary study is based on qualitative methodologies in human geography such as fieldwork, visual evidence, and interviews, with a glimpse into philosophy. It is equally based on revisiting “traditional” legal property rights through the lens of post-liberal human rights analysis. The argument can apply to many situations of forced evictions across Africa, Latin America, and the West itself.

Managerial accounting is an activity or process that produces information that is useful for management for making economic decisions in carrying out management functions. Sekolah Binis dan Manajemen – Institut Teknologi Bandung (SBM-ITB)  collaborated with the MarkPlus Institute to carry out the OMNI MBA Program 2020 Batch III on February 5, 2021. Out of the twelve subject topics contained in the program, one of them is entitled Accounting in Marketing Perspective that scheduled on Friday, 5 February 2021 with the author as the facilitator. The subjects include the Break-Even Point (BEP) theory, the Cost Classifications theory with the concept of Different Cost for Different Purposes, as well as related case studies. This training is expected to increase the competence and productivity of company managers in maximizing their role. This training went smoothly because of the strong enthusiasm of the participants. In addition, the inhibiting factor is the limited training time.

Abstract Background Medicaid expansion has been adopted by 38 states and the District of Columbia,1,2 contributing to lower rates of uninsured individuals in the US.3 During the COVID-19 pandemic, Medicaid enrollment offset employer-based insurance losses precipitated by the recession.4 The aim of this study was to evaluate whether Medicaid expansion may have impacted COVID-19 mortality. Methods We conducted an ecologic study that included all US counties in the 50 states and District of Columbia. County-specific Medicaid expansion status was based on whether expansion was adopted within the state. COVID-19 cases and deaths for each county were obtained from the Centers of Disease Control (CDC). Unadjusted and multivariable negative binomial regression with robust standard errors to account for clustering of counties within each state were used to evaluate the association of COVID-19 case fatality rate and Medicaid expansion status. Adjusted models included the addition of four sets of county-level covariates thought to influence the association of Medicaid status and COVID-19 fatality rate: demographics, comorbidities, economic indicators, and physician density. These analyses were then performed in subgroups of counties defined by urbanicity (metro, suburban or rural) and quartiles of poverty rates. Incidence Rate Ratios (IRR) and 95% confidence intervals (CI) are reported. Results A total of 1,814 Medicaid expansion and 1,328 non-expansion counties were included in the analysis. Crude case fatality rates were 2.1% (non-expansion) and 1.8% (expansion). Medicaid expansion was not associated with a significantly lower COVID-19 case fatality rate in either the unadjusted (IRR: 0.86; 95% CI: 0.74, 1.01) or fully adjusted (IRR: 1.02; 95% CI: 0.90, 1.16) models. In adjusted models, Medicaid expansion status was also not associated with differences in COVID-19 case fatality rate when counties were stratified by either urbanicity or percent of individuals living below the poverty line. Conclusion In this county-level analysis, Medicaid expansion status was not associated with a significant difference in county-level COVID-19-related case fatality rates among people of all ages. Future individual-level studies are needed to better characterize the effect of Medicaid on COVID-19 mortality. Disclosures All Authors: No reported disclosures
