Problems Related To Reintegration Of Young Ex-Offenders In Estonia

based on 22 semi-structured interviews with 24 young ex-offenders in estonia, this article looks at the effect that stigmatization has on the reintegration of young ex-offenders. the study looks at to what extent and in which domains ex-offenders experience stigma, how they manage it, and what effect it has on social participation and involvement. the results indicate that young ex-offenders experience stigma while looking for jobs and accommodation and when interacting with the criminal justice system. the strategies for managing stigma mostly include secrecy and withdrawal. these strategies are closely related to self-stigmatization, low societal participation, and a low level of trust toward state institutions Show More ... ... Constructing Criminological Knowledge: The Experience Of The Development And Implementation Of Interdisciplinary Criminology Studies At Vilnius University

taking a social constructionists perspective, the article presents not widely known sides in the development of modern lithuanian criminology related to the emergence, formation and development of criminological studies at vilnius university. since the emergence of the first criminological courses in lithuanian academic institutions, they, as in other european continent universities, were usually taught in law faculties and schools. however, in the mid of 1990s, a unique situation occurred at vilnius university, where sociologists and psychologists started teaching criminological courses at the faculty of philosophy. later, in 1999, with the methodical help of the faculty of law, the teaching staff of the faculty of philosophy developed and implemented two-year masters programs in sociological and psychological criminology.the gained educational experience in managing and implementing interdisciplinary criminology programs at vilnius university paved the way for introducing in 2017 new interdisciplinary bachelor study programme in criminology. on the one hand, the emergence of such studies would be impossible without long-term close and constructive collaboration between the sociologists, psychologists and lawyers of vilnius university and, on the other, - without the active involvement of the new generation of young criminologists in the educational process. authors emphasise, that the emergence and development of the criminology studies in lithuania was influenced by both the developmental context of criminology at european and north american universities and the methodological and organisational support, which lithuanian criminologists had been receiving from their colleagues from western academic institutions.authors also present and describe the developmental process of both master and bachelor studies: they introduce the leaders, organisers and lecturers of these programs, observe their structure and inner consistency, analyse the role of interdisciplinarity in organising criminology studies. the article identifies the challenges and problems facing both the teaching and learning processes and their potential solutions, which should ensure the quality of studies, their correspondence to the state-of-art methods in criminological research and practical needs of contemporary society Show More ... ... Biopolitics And Disciplinarity In The Legislation Of Conduct In Public Spaces Of Vilnius

this article presents the specific rhetoric of social control present in the sections of national and municipal legislation pertaining to conduct in public spaces of vilnius, lithuania.theoretically, the paper utilises m. foucault’s framework of power modalities both because of foucault’s engaged questioning of power and the applicability of his insights to the spatial dimensions of the city. the paper bases its interpretive scheme on two premises: a) that law reveals biopolitical and disciplinary aspects of social control; and b) that urban public space presents a valuable case for the analysis of these aspects.a qualitative content analysis of national and municipal legislation has revealed that national legislation is driven by biopolitical objectives and municipal legislation by disciplinary ones. the national legislation focuses the regulation of public space on public order, public calm, and public dignity – public mores that must be upheld in the interest of the population and expanding beyond strictly public space. disciplinarity is evident in municipal legislation insofar as it breaks space up into governable fragments, imposing painstakingly detailed prohibitions and obligations, and building a hierarchy inside the population between the desired and subnormal subject Show More ... ... Victims Of Parental Kidnappings In Light Of Polish Criminal Law (Based On The Results Of Case Law Research

[full article, abstract in english; abstract in lithuanian] this paper concerns the victims of parental abductions in poland. the aim of the article is to present the victims of parental abductions in the light of the polish criminal case law. the study has an empirical character because it presents the results of research carried out using a criminal case law analysis. the study included 59 criminal cases concerning the parental kidnapping of a child. the research revealed that the polish law treats the person from whom the child was kidnapped as a victim of parental kidnapping. interestingly, the child is not considered a victim. based on the research, a conclusion was formulated that parental abductions are not only the result of disputes between the parents of a child, but that children can also be abducted from the care of other people, for example, the directors of orphanages or grandparents who look after the children. this article argues that parental abductions are not only a problem for families but also for institutions professionally involved in childcare Show More ... ... Heroin Smuggling In Serbia

[full article, abstract in english; abstract in lithuanian] drug trafficking is a very lucrative criminal activity, with a growing number of organized criminal groups from the balkans. according to europol’s report, about 5000 organized criminal groups are active in the european union.2 according to the results of the national survey on the lifestyles of the citizens in the republic of serbia in 2014, the use of psychoactive substances and games of chance and illegal drug use at least once during a lifetime was recorded at 8.0% of the total population aged 18 to 64 (10.8% of males and 5.2% of females), with greater prevalence (12.8%) in the younger adult population aged 18 to 34. the number of heroin users who inject drugs in serbia is between 10 000 and 25 000. the main estimated number is 20 000 heroin users who inject drugs, i.e., 0.4% of the population aged 15 to 64. based on the analysis of data on drug-related deaths, it can be noted that there has been a decline in the number of deaths in the past five years, and most of these cases are related to opiates. in the territory of the republic of serbia, the production of heroin has not been recorded, and that gives trafficking a greater primacy, which is supported by the fact that high quality heroin is further trafficked in the form of a base that is mixed with other substances (paracetamol, caffeine, sugar etc.). in this way, such a high degree of purity of heroin allows the members of criminal groups to increase the quantity of narcotics by mixing substances suitable for this and, in that way, achieve greater profits. the most commonly used illegal drug among the adult population is cannabis (marijuana and hashish), and the use of the mentioned drugs has been recorded at least once during a lifetime in 7.7% of subjects aged 18 to 64 (10.4% of men and 4.9% of women). the use of other illegal drugs is very rare; 1.6% of questioned individuals (2.5% of the population aged 18 to 34) have used other illegal drugs Show More ... ... Mediacija Lietuvos Baudžiamojoje Ir Administracinių Nusižengimų Justicijoje Teisminėje Bylos Nagrinėjimo Stadijoje

[straipsnis ir santrauka lietuvių kalba; santrauka anglų kalba] straipsnyje nagrinėjamos mediacijos baudžiamojoje ir administracinių nusižengimų justicijoje įgyvendinimo galimybės teisminėje bylos nagrinėjimo stadijoje. tyrimas apima: 1) pagrindinius konflikto šalių abejojimus, susijusius su dalyvavimu mediacijos procese, nes daug mediacijos procesų neįvyksta dėl konflikto šalių nenoro dalyvauti mediacijoje; 2) mediacijos taikymo pagrindus baudžiamojoje ir administracinių nusižengimų justicijoje teisminėje bylos nagrinėjimo stadijoje; 3) meditacijos proceso ypatumus teisminėje bylos nagrinėjimo stadijoje. atliekant tyrimą buvo taikomi sisteminės analizės, lyginamasis metodai, analizuojama mokslinė literatūra, teisės aktai ir teismų praktika. straipsnyje daug dėmesio skiriama šiaulių apylinkės teismo sprendimams baudžiamosiose ir administracinių nusižengimų bylose, kuriose taikyta mediacija, nes būtent šio teismo jurisprudencijoje plačiai naudojama meditacijos paslauga atsiradus mediacijos pareigybei lietuvos probacijos tarnybose.kadangi absoliuti dauguma aptartų konflikto šalių abejojimų dėl ginčo sprendimo mediacijos būdu iškyla dėl atitinkamų žinių stokos, tai visuomenės švietimas apie meditaciją turi vykti nuolat įvairių teisinių profesijų atstovų. tačiau ypatingą vaidmenį šioje srityje reikėtų skirti teisėjams, pirmiausia atsižvelgiant į jų autoritetą baudžiamojoje ir administracinėje justicijoje. institucinė sąranga, o būtent probacijos tarnybose dirbantys mediatoriai, sudaro galimybes teisėjui į teismą kviesti mediatorius, kaip probacijos tarnybos atstovus, ir išklausius jų bei proceso šalių nuomonės, bylą perduoti meditacijos procesui. mediacijos metu ne visada galima pasiekti susitarimą, tačiau dėl tarpusavio pagarbos šis instrumentas leidžia konflikto dalyviams kultūringai koegzistuoti ateityje Show More ... ... [straipsnis ir santrauka lietuvių kalba; santrauka anglų kalba] minesotos daugiafazis asmenybės aprašas-2 (mmpi-2) yra vienas dažniausiai pasaulyje naudojamų savistata paremtų klausimynų, skirtų pradiniam asmenybės savybių ir psichopatologijos įvertinimui įvairiausiose srityse, įskaitant ir teisėsaugą. skirtingose nuteistųjų asmenų populiacijose atliekamuose tyrimuose dažniausiai nustatoma, kad teisės pažeidėjams būdingas asocialumas, impulsų kontrolės stygius, neatsakingumas ir kitos charakteristikos, atsispindinčios atskirų mmpi-2 skalių įverčiuose. šio tyrimo tikslas – įvertinti laisvės atėmimo bausmę lietuvoje atliekančių vyrų ir moterų asmenybės charakteristikas naudojant mmpi-2 ir išanalizuoti rezultatus gretinant juos su įprastai teisės pažeidėjų populiacijų tyrimuose gaunamais rezultatais. tyrimo rezultatai parodė, kad lietuvos nuteistuosius charakterizuojančios skalės atitinka kitose kultūrinėse aplinkose atliktų tyrimų rezultatus. laisvės atėmimo bausmę atliekančius nuteistuosius geriausiai charakterizavo aukštesni psichopatiškumo (pd), paranojiškumo (pa), antisocialaus elgesio (rc4), persekiojimo idėjų (rc6), nesivaldymo (disc), perdėtai kontroliuojamo priešiškumo (o-h), macandrew taisytos alkoholizmo (mac-r) skalių įverčiai bei žemesni ego stiprumo (es) ir socialinės atsakomybės (re) skalių įverčiai. gauti rezultatai atitinka daugelio kitų tyrimų rezultatus, ir tai pagrindžia mmpi-2 naudojimą nuteistųjų psichologiniam įvertinimui lietuvoje. [straipsnis ir santrauka lietuvių kalba; santrauka anglų kalba] straipsnyje nagrinėjamas kognityvinės-elgesio korekcinės programos equip poveikis lietuvos vaikų socializacijos centrų auklėtinių kognityviniams iškraipymams, socialiniams įgūdžiams ir probleminiam elgesiui. atliktas kiekybinis tyrimas, kuriame dalyvavo 124 11–17 m. amžiaus vsc auklėtiniai (74 vaikinai ir 50 merginų). tyrimo metu buvo lyginami equip ir palyginamosios grupės duomenys prieš ir po equip programos vykdymo, naudotas mąstymo klaidų klausimynas hit, socialinių įgūdžių vertinimo metodika bei demografinė anketa. atlikto tyrimo rezultatai atskleidė reikšmingus equip programoje dalyvavusių vsc auklėtinių mąstymo klaidų, elgesio problemų ir socialinių įgūdžių pokyčius, tuo tarpu vsc auklėtinių, nedalyvavusių korekcinėje programoje, kintamųjų pokyčių nenustatyta arba jie nėra statistiškai reikšmingi. analizė patvirtino, kad equip programos dalyvių amžius bei programos vykdymo intensyvumas yra svarbios sąlygos siekiant didesnio equip programos poveikio. Mediation In Germany And Other Western Countries

empirical studies over the past decades have repeatedly shown the limited usefulness of harsh punishment in reducing crime. in response to these research results, historical approaches to crime reduction, such as mediation and restorative justice, have regained prominence, especially in germany and other western european countries. the women’s movement and the growing role of victimology have contributed to the increased use of these methods as alternatives to incarceration. the debates across these countries vary depending on the historical background of the penal climate in these states, which particularly explains the differences between eastern and western european countries in this regard. empirical studies show the positive impact of mediation on offenders as well as victims. yet in spite of these results, in most countries, including germany, the use of mediation remains limited, especially in regard to adult offenders. at the same time, the uses of mediation in non-criminal conflict settings, such as schools, family or work disputes have increased significantly with positive results Show More ... ... problem. police statistics are the most comprehensive continuous database on crime in most industrialized countries. they also form an important source for quantitative criminological research. they are produced primarily for administrative use and their definitions are closely connected with national legal systems. because of this, they comprise only a selected and biased part of crime and their comparability across jurisdictions is usually poor. this also applies to their comparability with other information sources of crime, including victimization surveys.aim. in this article, we demonstrate that by including a few basic descriptive variables (referring to the main characteristics of each criminal case) in the existing police data collecting systems, we can hugely improve their information value and their comparability.method. we have used empirical data from finland as an example. we have coded a randomized data sample of the assault offences reported to the police in 2005 by using two descriptive variables, proposed by the expert group on violence, appointed by the finnish national council for crime prevention. after that, we have compared the results with those of the 2006 national victimization survey that referred to the same period and used similar descriptive variables.results. even using just the fe additional variables, the comparison of the two data sources gave amply new information of the measured characteristics, and in the process of both data sources. some of the results were expected; for example, the comparison showed that violence recorded in police statistics was in terms of the injuries for men and women on average clearly more serious than the violence captured by the victimization survey. similarly, partner violence by men had clearly been recorded in the police data more completely than partner violence by women. some were, however, unexpected: according to our findings, for example, partner violence in private locations had the highest recording rate of the types of violence against women.conclusions. we are proposing that national statistics authorities adopt a simple improvement that increases the usefulness of their police crime data. the only requirements are that the database is electronic and that it records crime as individual events. the improvement is done by adding a small number or descriptive variables to the already existing variables. the descriptive variables should be about the parties involved in the offence, their relationship, and some concrete circumstances of the crime. this proposal does not require a complex reorganization of the existing information systems of police forces. the reform would only mean that a few new standard variables are introduced. most of the required information is already known to the police, it is just not coded by using standard codes.this reform would greatly improve the usefulness of the police crime data for purposes of crime analysis. it would also allow much better interpretations of crime trends and of regional crime differences. a further advantage of this reform would be that police-recorded crime and victimization survey data become directly comparable if they contain identical variables that describe the crime events. our approach is not restricted by criminal codes, since we are not suggesting any changes to the recording principles currently applied. we are only suggesting additional variables. we emphasize that our proposal is much simpler and much more easily introduced than the one being currently recommended by the united nations (international classification of crime 2015 Show More ... ...
