This paper examines New Zealand’s distance selling regulation, in particular the changes made in the course of the recent consumer law reform. First, the paper assesses the reforms with regard to telemarketing. While some criticism is expressed as to the content of the prescribed disclosure by the supplier, the approach followed is approved of in general. The paper then examines the merits of a general right of withdrawal in distance selling contracts as it exists in the European Union. Analysing withdrawal rights from an economical, psychological and ethical perspective, the paper argues that both from a supplier’s and from a consumer’s point of view, the advantages are outweighed by the disadvantages that come with withdrawal rights.

The relevance of this study is determined by the need for an objective assessment of changes in the socio-economic situation of the population most vulnerable categories, in particular persons with disabilities, during the coronavirus pandemic. The past 2020 was marked by large-scale changes in the daily life of the population, especially its vulnerable categories. People with disabilities have experienced stress not only due to the need for self-isolation, but also due to a decrease in the availability and quality of critical areas of life. The purpose of this work is to formulate proposals aimed at improving social policy in relation to people with disabilities in Russia, taking into account the consequences of the coronavirus pandemic. The information base of the work was formed by the results of a sociological survey, demonstrating the changes that have occurred during the coronavirus pandemic in the financial situation of people with disabilities, the availability of health care and social protection services for them, psychological state and behavior. It is shown how much the help of volunteers and distance selling were in demand during this period on the part of the disabled. It was found that disabled people living alone were less likely to notice the impact of the pandemic and the introduced quarantine measures on their lives. Among the answers of the lonely respondents, there was also a large share of negative assessments which showed us that society is not ready for integration, the possibility of an independent life, and the media activities in terms of covering the problems which people with disabilities have. The novelty of the study is in identifying the differentiation of the reaction of people with disabilities to a pandemic situation, depending on the type of disabilities observed in them, as well as on the influence of the living alone factor. It is also substantiated that during the period of self-isolation, distance selling played a compensatory role, reducing the tension of the problem with the inaccessibility of the environment for the disabled. On the basis of empirical data, it was confirmed that the period of the pandemic was associated with a decrease in the accessibility of services in the field of health care and social protection for people with disabilities. In the final part of the study, recommendations were formulated regarding the improvement of the social support existing system for people with disabilities, taking into account the experience of the changes that occurred in the life of the group during the coronavirus pandemic.

AbstractThis article will cover issues related to the subject matter, parties and their rights and obligations when conducting e-commerce and distance selling within the European Union. E-commerce and distance sellingare particularly important within the EU, not only because there are sufficiently well-developed mechanisms to ensure the functioning of the internal market. E-commerce is distinguished as a separate segment in commercial activity. Nowadays the importance of E-commerce and distance selling grows every day. In this modern world of technology, e-commerce is becoming a very important option for many businesses as there are lots of companies that are interested in developing their online stores. Furthermore, in times of pandemics like COVID-19, E-commerce has proven to be significant. I describe different types of distance selling and consumer protection. The main policy objectives for consumer protection can be divided into three broad categories that correspond to different phases in the relationship between the operator and the user. One of the main roles for customer protection is the payment system who provides a way of transferring value between different parties in the economy and to facilitate transactions at minimal cost. The legal framework is presented with a focus on the tax effects of e-commerce in the European Union.

E-commerce is the retail phenomenon of the twenty first century and also – although it attracts less publicity - constitutes the medium within which many commercial transactions take place. This chapter will examine legislative initiatives in the United Kingdom and European Union that are designed to address some of the legal issues and problems that arise from on-line transactions. The main goal is to promote e-commerce both by means of conferring rights on consumers – as epitomised in the Distance Selling Directive that gives rights to inspect and return goods ordered on line- and give some businesses engaged in the sector a degree of immunity from some forms of legal liability. Key here is the notion of an “information society service” and provider as specified in the E-Commerce Directive. A further issue that arises in many e-commerce transactions is that consumers are able to contract with a supplier located in a different jurisdiction. Booking hotel accommodation is a frequently used example. Questions need to be resolved in this case which legal system and which courts will govern the transaction.
