The crime that is rife and continues to grow until now is a crime against property. One crime that is a crime against property is a crime of embezzlement. Crimes of embezzlement are regulated in book II of the Criminal Law Act in Articles 372 - 377 KUHP which is a crime that often occurs in various layers of the lower layers of society, abuse of trust that dominates as the main element of this crime. Embezzlement has different types, one of which is embezzlement by occupation is a community disease that is closely related to crime, which in its historical process from generation to generation turns out that the crime is a crime that harms others and or the agency where the offender works. Criminal acts against embezzlement by position must be different from ordinary embezzlement because there are incriminating elements in it as regulated in the Criminal Code. Judges' considerations and legal facts are an influential part in determining the sanction imposed in criminal proceedings.

Starting from the need for capital, in practice some people are reluctant to make credit with banks, because the process is considered difficult, and too convoluted. Therefore, some people prefer to borrow a certain amount of money from individuals or what is better known as debt or credit. Talking about the debt and credit agreement, it will be closely related to collateral because every creditor needs a sense of security for the funds he lends. The author's research is made to examine and find out what efforts can be made if there is default in an underhand debt acknowledgment that guarantees the title of title to land without being preceded by a principal agreement, as well as the judge's consideration (Ratio Decidendi) in the Cassation Decision Number 837K / Pdt / 2019 concerning default in the debt acknowledgment. The research method used in this study is a descriptive normative juridical approach, namely research that refers to the legal norms contained in statutory regulations and court decisions. The results of the research obtained by the author in this study are the first consideration of the judge in deciding Case Number 837 / K / Pdt / 2019 is not quite right because in theory the judge's decision overrides legal certainty for a civil case by deciding in default of a debt acknowledgment, which then the judge also also declared null and void the debt acknowledgment. Where based on the provisions of Article 12 of Law Number 4 of 1996 concerning Mortgage Rights, the guarantee which is the object of the author's research, is a forbidden cause that is contrary to the validity of an agreement, so that the legal consequences are null and void from the start without having to obey prior default in the debt recognition deed. So that the author's suggestion is necessary for parties who want to carry out lending and borrowing activities, especially in terms of debt and credit, first understand any rules and legal norms that apply to their actions, so that they will not cause losses among the parties who bind themselves in the future.

The Baduy tribe is one of the indigenous tribes that live in Indonesia. When compared to other indigenous tribes in Indonesia, the Baduy tribe is located closest to the capital city of the country. This is special to describe, how Baduy maintains its customs and customary laws in the midst of the influence of technological advances and the development of positive Indonesian law which is especially because of its geographical location not far from the metropolitan city, namely Jakarta and its surroundings. Then the purpose of this research is also to reveal how the Baduy people are bound or bind themselves to customary laws which among or some of them can be said to be inconflict with human rights law, such as the prohibition of formal education, prohibition of technological activities, prohibition of building proper community facilities according to their abilities. age, and other special rules that are not as free as the outside Baduy community in general. The patterns of behavior and social order in the Baduy customary community need to be identified together and carefully, whether the existence of Baduy custom is worth preserving completely and forever if there are rules that are not in accordance with Indonesian positive law such as relevance to the ideals of the nation and the law -State Law. Or it turns out that the clash of legal rules is actually a variation of a separate legal system for the benefit of the Indonesian State in general and for the Baduy indigenous people in particular

Indonesia is a country that adopts a democratic system. In carrying out general elections it is a necessity that has been mandated by the 1945 Constitution in accordance with the sounds of Article 22E Paragraphs (1), (2), (3), (4), (5) and (6). This requirement makes it a condition in selecting Regional Representative Council Members. The  government, through Perppu No. 2 of 2020, remains unmoved that the regional head election will be held on 9 December 2020. Apparently this year 2020 has become a year unlike previous years, because in this year specifically Indonesia is in the Covid-19 pandemic and broadly Covid-19 has become a world epidemic today. Initially the 2020 elections will be held on September 23, 2020 to select 9 governors, 224 regents, and 37 mayors simultaneously. In conducting this analysis, the author uses a juridical normative approach, which is an approach aimed at studying the principles of law, and legal schemes. The discussion that the author will elaborate on is how the election is based on laws and regulations, also what kind of problems will arise in the holding of the elections during a pandemic, and what kind of implementation techniques, In order to know the limits of the application of the law to elections in the Covid-19 pandemic.

Indonesia is a democratic country. Every citizen has political rights guaranteed by the 1945 Constitution of the Republic of Indonesia.Protection of political rights as a human right owned by every citizen. Protection of citizens' political rights or individual political rights contained in the 1945 Constitution, namely Article 27 paragraph (1) states the equality of all citizens towards law and government; Article 28 concerning freedom; Article 28D paragraph (1) concerning the right to recognition, guarantee, protection and legal certainty for everyone; Article 28D paragraph (3) states that every citizen has the right to obtain equal opportunities in government; and Article 31 paragraph (1) to obtain education. Democracy occurs if there is recognition of political rights and the implementation of political participation of every citizen. Fulfillment of political rights before and after the prisoners also receive protection of their political rights. The political rights of ex-prisoners are protected by the constitution of the 1945 Constitution, Law Number 39 of 1999, and Law Number 7 of 2017 concerning General Elections, and Constitutional Court Rejection Number 4 / PUU-VII / 2009. Based on this matter, this study aims to find out and analyze individual political rights that are confiscated along with the execution of punishment, and to know and analyze individual political rights to be able to conduct themselves after inmates. This research is descriptive analytical with a normative juridical approach.

Consent given by a patient (or close family or guardian) who has previously been given sufficient information about the plan of action and the risks to the action, which is conveyed by the doctor and / or other health care worker in a way that is understandable to the patient according to the level of education . However, in practice, there are health services ranging from health clinics, health centers to hospitals that have their own variations on the consent form or informed consent form. This requires specifically discussing informed consent from the aspect of civil law so that it can examine the issues of the juridical aspects of medical action approval (informed consent) appropriately in the responsibility of implementing medical practice. So that there is legal power and material substance of the informed consent used.

Property rights to land are the strongest and fullest inherited rights that can be owned over land and Transfer of ownership rights to land is the transfer or transfer of ownership rights to a plot of land or several parcels of land from the original owner to the new owner due to something or certain legal actions. Kewajiban nasabah Debitur dalam perjanjian kredit adalah melunasi hutangnya dalam jangka waktu tertentu dengan sejumlah nominal yang disertai bunga. Namun demikian adanya faktor intern dan/atau ekstern, yang menyebabkan Debitur mengalami kredit macet, sehingga tidak bisa memenuhi prestasi yang telah dijanjikan sebagaimana terdapat dalam perjanjian kredit. Apabila nasabah Debitur yang mengalami kredit macet dan jika masih dimungkinkan untuk berprestasi lagi dalam memenuhi kewajibannya, maka bank biasanya akan melakukan penyelesaian secara baik yaitu menolong nasabah yang sedang mengalami kesulitan dengan melakukan penyelamatan. Adapun upaya penyelamatan yang dimaksud dapat berupa, penjadawalan kembali (rescheduling), persyaratan kembali (reconditioning), dan penataan kembali (restructuring). Tujuan penelitian ini adalah untuk menganalisis penerapan restrukturisasi kredit macet yang diatur dalam Pasal 21 Peraturan Otoritas Jasa Keuangan Nomor : 33/POJK.03/2018 dalam pelaksanaannya di BPR Lestari Jakarta Barat dan untuk mengetahui hambatan-hambatan dalam penerapan restrukturisasi kredit macet di BPR Lestari Jakarta Barat sesuai dengan Pasal 21 yang diatur dalam Peraturan  Otoritas Jasa Keuangan Nomor: 33/POJK.03/2018, dalam hal ini peneliti terjun langsung kelapangan untuk memproleh data dengan melakukan wawancara dengan Pimpinan dan Kepala bagian (Kabag) Kredit di BPR Lestari Jakarta Barat, Metode Penelitian skripsi yang digunakan, yaitu penelitian kepustakaan, maka pendekatan yang digunakan dalam penulisan skripsi ini adalah pendekatan perundang-undangan (statue approach), pendekatan konsep (conceptual approach), dan juga dengan pendekatan kasus (case approach), Berdasarkan hasil wawancara dengan Pak Enden selaku Kepala bagian (Kabag) Kredit ini bertentangan dengan kebijakan restruktur dalam butir (b) yang menerangkan bahwa pejabat atau pegawai yang ditugaskan dalam unit kerja atau pejabat yang ditunjuk untuk menangani Restrukturisasi Kredit tidak terlibat dalam proses pemberian Kredit kepada Debitur yang akan direstruktrurisasi tersebut, artinya baik itu bagian analis sebelum kredit itu dicairkan dan ketika kredit itu bermasalah itu dilakukan dengan pejabat atau pegawai yang berbeda, untuk saat ini di BPR Lestari Jakarta Barat itu masih dilakukan dengan pejabat atau pegawai yang sama, seharusnya untuk menjaga sikap konsistensi berdasarkan jabatan ini dilakukan dengan pejabat atau pegawai yang berbeda, tujuannya agar ada perbandingan dan bisa dievaluasi apabila ada koreksi.

Tujuan dari penelitian ini adalah untuk mengetahui dan menganalisa bagaimanakah pertimbangan Hakim dalam menerapkan terbuktinya unsur-unsur tindak pidana dan bagaimanakah pertimbangan Hakim dalam menjatuhkan pidana terhadap pelaku tindak pidana pelaku penyalahguna narkotika sebagaimana yang dihubungkan dengan SEMA No. 4 Tahun 2010 tentang Penempatan Penyalahgunaan, Korban Penyalahgunaan dan Pecandu Narkotika ke dalam lembaga rehabilitasi medis dan sosial. Sifat dalam penelitian hukum normatif ini adalah bersifat deskriptif yang bertujuan untuk menggambarkan secara lengkap dan sistematif mengenai masalah yang sedang diteliti terkait hak-hak yang dimiliki Terdakwa sehubungan dengan hak mendapatkan rehabilitasi medis dan sosial berdasarkan ketentuan hukum yang telah diatur dalam Pasal 4 UU No. 35 Tahun 2009 tentang Narkotika yang menyebutkan,”menjamin pengaturan upaya rehabilitasi medis dan rehabilitasi sosial bagi penyalahguna dan pecandu narkotika”. Dimana dengan metode ini dimaksudkan agar dapat menggambarkan dan menguraikan tentang dasar pertimbangan Hakim dalam memutuskan tindak pidana pelaku penyalahguna narkotika . Serta menggali lebih dalam melalui penelitian yang dilakukan oleh Penulis. Pengaturan tindak pidana penyalahgunaan narkotika berdasarkan Pasal 112 ayat (1) UU No. 35 Tahun 2009 tentang Narkotika. Seorang yang melakukan tindak pidana baru boleh di hukum apabila sipelaku di anggap sanggup mempertanggungjawabkan perbuatannya. Penuntut umum mendakwanya dengan dakwaan subsidair. Berdasarkan tuntutan tersebut Penuntut Umum mengajukan tuntutan sebagaiman diatur Pasal 112 ayat (1) UU No. 35 Tahun 2009 tentang Narkotika. Pertimbangan Hakim dalam menjatuhkan putusan pidana kepada Terdakwa yaitu dengan fakta-fakta yang ada dipersidangan melalui keterangan saksi, pemeriksaan terhadap keterangan Terdakwa yang dikuatkan dengan barang bukti yang dihadirkan dalam persidangan dihubungkan dengan unsur-unsur yang di dakwakan oleh Penuntut Umum dan Hakim menurut Pasal 183 dan 197 Kitab Undang-Undang Hukum Acara Pidana serta keyakinan Hakim dalam menjatuhkan putusan.
