AbstractThird-party agreements can take many forms and can be a difficult area in which to determine clear-cut definitions. It is intended that this chapter will clarify some of the differences and identify some of the similarities.Agreements can be between any two or more organisations. It would be unusual, though not inappropriate, for there to be agreements between two departments within the same organisation. Agreements may occur in this case when, for example, a new process is introduced on a trial basis and it has not yet become ‘business as usual’ and part of the normal internal interaction.There will always be local variations in the naming of contract types, so this should be considered in interpretation.Any organisation with which there is an agreement, of whatever structure, should be validated and audited.

China expanded the application of the third-party treatment model (TPTM) in 2017 for effectively tackling the issues related to industrial pollution on a trial basis, and the model could diversify the government’s toolbox for addressing industrial pollution. With multiple players such as local governments, polluters, and environmental services providers (ESP) involved in the TPTM, appropriate guidance and coordination among the three players are critical to the success of the TPTM. This study constructs an evolutionary game model for the three players to capture their interaction mechanisms and simulates the three-player evolutionary game dynamics with the replicator dynamics equation. The simulation results show that heavier penalties for pollution and lower regulatory costs incurred by local governments could effectively improve the performance of the TPTM. Moreover, although environmental incentives provided by the central government to local levels do not affect the ultimate performance of the TPTM, they do shorten the time needed for the effect of the TPTM to emerge. The study concludes by proposing policy recommendations based on these results.

Abstract. The ability to model surface processes and to couple them to both subsurface and atmospheric regimes has proven invaluable to research in the Earth and planetary sciences. However, creating a new model typically demands a very large investment of time, and modifying an existing model to address a new problem typically means the new work is constrained to its detriment by model adaptations for a different problem. Landlab is an open-source software framework explicitly designed to accelerate the development of new process models by providing (1) a set of tools and existing grid structures – including both regular and irregular grids – to make it faster and easier to develop new process components, or numerical implementations of physical processes; (2) a suite of stable, modular, and interoperable process components that can be combined to create an integrated model; and (3) a set of tools for data input, output, manipulation, and visualization. A set of example models built with these components is also provided. Landlab's structure makes it ideal not only for fully developed modelling applications but also for model prototyping and classroom use. Because of its modular nature, it can also act as a platform for model intercomparison and epistemic uncertainty and sensitivity analyses. Landlab exposes a standardized model interoperability interface, and is able to couple to third-party models and software. Landlab also offers tools to allow the creation of cellular automata, and allows native coupling of such models to more traditional continuous differential equation-based modules. We illustrate the principles of component coupling in Landlab using a model of landform evolution, a cellular ecohydrologic model, and a flood-wave routing model.

The Asia-Pacific region offers an example of low legalization of regional institutions and perhaps an explicit aversion to legalization. An examination of three key regional institutions—ASEAN (Association of Southeast Asian Nations), APEC (Asia-Pacific Economic Cooperation), and the ARF (ASEAN Regional Forum)—confirms a regional process of institution building without legalization. Recent developments in these institutions permit some discrimination among competing explanations for low legalization. On the one hand, ASEAN has embraced a legalized dispute-settlement mechanism; Asian governments have also employed legalized global institutions. On the other hand, the ARF and APEC continue to resist clear-cut legal obligations and third-party dispute resolution. This pattern suggests that legalization is best viewed as driven by the demands of economic integration and as a strategic response by governments in particular institutional settings. These explanations undermine alternatives based on domestic legal culture and uniformly high sovereignty costs. The Asian economic crisis has reopened a debate over regional institutions, which may fix on legalization as part of a new regional institutional design.

Ethically attuned readings of King Lear typically study, among other issues, Lear’s ethical revolution. More specifically, Shakespeare critics who have engaged with Levinasian treatments of this play often do not present a clear-cut account of Lear’s status with regard to the authentic encounter with the destitute yet commanding face of the Other, and the ineluctably intervening third party. Trying to unravel these complexities, I examine one of the possible reasons why ethical readers of King Lear equivocate when they study Lear and his ethical apotheosis. I will discuss Lear’s subjectivity and trace its gradual transition to a more heightened ethical awareness, but refuse to envision him as a perfect ethical character. Lear does improve significantly with regard to his relationship with the Other, but while he appears to temporarily touch a Levinasian standpoint, his subjectivity undergoes an apotheosis, eventuating in a deontological (perhaps pre-ontological) status which cannot reconcile itself with the presence of ‘the third party’. This, as I will discuss, is his ethical-political flaw which blocks a final recourse towards a probable reconciliation of the Other and the Third. Lear’s ethical awakening, I suggest, fails to reconcile with and restore justice.

Abstract My response to the commentaries focuses on four issues: (1) the diversity both within and between cultures of the many different faces of obligation; (2) the possible evolutionary roots of the sense of obligation, including possible sources that I did not consider; (3) the possible ontogenetic roots of the sense of obligation, including especially children's understanding of groups from a third-party perspective (rather than through participation, as in my account); and (4) the relation between philosophical accounts of normative phenomena in general – which are pitched as not totally empirical – and empirical accounts such as my own. I have tried to distinguish comments that argue for extensions of the theory from those that represent genuine disagreement.

Over the past few years it has become apparent in our multi-user facility that the computer system and software supplied in 1985 with our CAMECA CAMEBAX-MICRO electron microprobe analyzer has the greatest potential for improvement and updating of any component of the instrument. While the standard CAMECA software running on a DEC PDP-11/23+ computer under the RSX-11M operating system can perform almost any task required of the instrument, the commands are not always intuitive and can be difficult to remember for the casual user (of which our laboratory has many). Given the widespread and growing use of other microcomputers (such as PC’s and Macintoshes) by users of the microprobe, the PDP has become the “oddball” and has also fallen behind the state-of-the-art in terms of processing speed and disk storage capabilities. Upgrade paths within products available from DEC are considered to be too expensive for the benefits received. After using a Macintosh for other tasks in the laboratory, such as instrument use and billing records, word processing, and graphics display, its unique and “friendly” user interface suggested an easier-to-use system for computer control of the electron microprobe automation. Specifically a Macintosh IIx was chosen for its capacity for third-party add-on cards used in instrument control.

Abstract This article explains the development and use of ICD-9-CM diagnosis codes, CPT procedure codes, and HCPCS supply/device codes. Examples of appropriate coding combinations, and Coding rules adopted by most third party payers are given. Additionally, references for complete code lists on the Web and a list of voice-related CPT code edits are included. The reader is given adequate information to report an evaluation or treatment session with accurate diagnosis, procedure, and supply/device codes. Speech-language pathologists can accurately code services when given adequate resources and rules and are encouraged to insert relevant codes in the medical record rather than depend on billing personnel to accurately provide this information. Abstract In most cases of shoulder injury at work, causation analysis is not clear-cut and requires detailed, thoughtful, and time-consuming causation analysis; traditionally, physicians have approached this in a cursory manner, often presenting their findings as an opinion. An established method of causation analysis using six steps is outlined in the American College of Occupational and Environmental Medicine Guidelines and in the AMA Guides to the Evaluation of Disease and Injury Causation, Second Edition, as follows: 1) collect evidence of disease; 2) collect epidemiological data; 3) collect evidence of exposure; 4) collect other relevant factors; 5) evaluate the validity of the evidence; and 6) write a report with evaluation and conclusions. Evaluators also should recognize that thresholds for causation vary by state and are based on specific statutes or case law. Three cases illustrate evidence-based causation analysis using the six steps and illustrate how examiners can form well-founded opinions about whether a given condition is work related, nonoccupational, or some combination of these. An evaluator's causal conclusions should be rational, should be consistent with the facts of the individual case and medical literature, and should cite pertinent references. The opinion should be stated “to a reasonable degree of medical probability,” on a “more-probable-than-not” basis, or using a suitable phrase that meets the legal threshold in the applicable jurisdiction.
