The existence of UKM in Kuningan Regency is very diverse not only in the form of traditional foods of Kuningan but also spread in various creative businesses. That the Government's policy is clear, as of December 31, 2015 has opened the MEA or the Asean Economic Community, so that it has an impact on the circulation of trade traffic that will involve various countries and crossing national borders, including possibly coming to Kuningan, will enter foreign entrepreneurs to join in the competition with existing SMEs. The problem discussed is how to increase the legal awareness of small business actors on trademark rights and copyrights, as well as what efforts can be done by the government in giving legal protection to small and medium business groups. The method used is to provide socialization, legal counseling and mentoring of trademark rights and copyright. The results of the counseling revealed that the community's legal awareness of copyright and brand rights is still low therefore there needs to be legal protection measures for SMEs in Kuningan Regency. Therefore carried out socialization and legal counseling to SMEs in Kuningan Regency, regarding Intellectual Property Rights (IPR) especially about the importance of protecting the brand and reputation of the company by registering the trademark or patent rights in accordance with the mechanism of the Act. Legal protection must be done because the Copyright Act and Trademark rights regulate that registration of trademark rights uses the First To File system instead of the First To Inventory, meaning that who first registers will be served and protected by the law.Keywords: Legal Protection, Trademark Rights, Copyright�AbstrakKeberadaan UKM di Kabupaten Kuningan sangat beragam tidak saja dalam bentuk makanan-makanan tradisional khas Kuningan tapi juga tersebar dalam berbagai usaha kreatif. Bahwa Kebijakan Pemerintah jelas, per 31 Desember 2015 telah dibuka MEA atau Masyarakat Ekonomi Asean, sehingga berdampak pada� peredaran lalulintas perdagangan yang akan melibatkan berbagai Negara dan melintasi batas-batas Negara, termasuk mungkin akan datang ke Kuningan, akan masuk para pengusaha asing untuk ikut berkompetisi dengan para UKM yang telah ada. Permasalahan yang dibahas adalah bagaimana meningkatkan kesadaran hukum para pelaku usaha kecil terhadap hak merek dan hak cipta, serta upaya apa yang bisa dilakukan oleh pemerintah dalam memeberikan perlindungan hukum kepada kelompok usaha kecil dan menengah. Metode yang digunakan adalah dengan memberikan sosialisasi, penyuluhan hukum dan pendampingan pendafaptaran hak merek dan hak cipta. Hasil penyuluhan mengemukakan bahwa kesadaran hukum masyarakat terhadap hak cipta dan hak merek masih rendah oleh karena itu �perlu ada upaya perlindungan hukum bagi para UKM yang ada di Kaupaten Kuningan. Oleh karena itu dilakukan sosialisasi dan penyuluhan hukum kepada para UKM yang ada di Kabupaten Kuningan,mengenai Hak Kekayaan Intelektual (HKI)� khususnya tentang pentingnya menjaga merek dan reputasi perusahaan dengan mendaftarakan merek atau hak patennya sesuai dengan mekanisme Undang Undang. Perlindungan hukum harus dilakukan karena Undang Undang Hak Cipta dan hak Merek mengatur bahwa pendaftaran Hak merek menggunakan system� First To File bukan First To Invent, artinya siapa yang pertama kali mendaftar itulah yang akan dilayani dan dilindungi oleh udang undang.Kata kunci : Perlindungan Hukum, Hak Merek, Hak Cipta

This paper studies about the Apple Inc. case in Ireland. The European Commission found out indications of tax evasion by Apple Inc. As one of important investors in Ireland, the case becomes a consideration for the Ireland government to maintain a condusive investment climate. This paper aims to understand how did Apple Inc. withstand the severe trust problem they are facing in Ireland. In order to do that, literature review method is used systematically in this paper. Overall, the study finds that one of the important aspects is the Irish government policy support. The support basically is the international relation political strategy between the Irish government and Apple Inc. From this case, Indonesia should take lesson learned in order to improve investors’ confidence in Indonesia, especially after the implementation of ASEAN Economic Community is implemented.Keywords: tax evasion, Apple Inc., Ireland, investor trustAbstrakTulisan ini mengkaji kasus Apple Inc. yang terjadi di Irlandia. Komisi Uni Eropa menemukan adanya indikasi penghindaran pajak (tax evasion) yang dilakukan Apple Inc. Sebagai salah satu investor di Irlandia, kasus ini tentu menjadi pertimbangan bagi pemerintah Irlandia dalam memelihara iklim investasi yang berkesinambungan. Tulisan ini bertujuan untuk melihat aspek yang mempengaruhi Apple Inc. yang sampai saat ini tetap bertahan di Irlandia ketika permasalahan yang berat telah menggoyahkan kepercayaan perusahaan tersebut. Untuk menemukan aspek tersebut, kasus ini dipelajari dengan menggunakan metode literatur review secara sistematis. Secara keseluruhan, kajian ini menemukan bahwa dukungan kebijakan pemerintah Irlandia menjadi salah satu aspek penting bagi keputusan Apple Inc. Dukungan tersebut pada dasarnya merupakan strategi politik hubungan internasional pemerintah Irlandia dan Apple Inc. Melalui kasus ini pula, Indonesia dapat mengambil pelajaran yang diperlukaan untuk meningkatkan kepercayaan investor di Indonesia, terutama setelah diberlakukannya komunitas Masyarakat Ekonomi ASEAN.Kata kunci: tax evasion, Apple Inc., Irlandia, kepercayaan investor

Social security is one of the basic rights of workers both local and migrant workers as stated on Art. 25 Universal Declaration of Human Rights. The enactment of single markets and production based in the era of ASEAN Economic Community inevitably brings migrant workers particularly in Indonesia and Singapore. This must be in line with a proper legal instruments to protect migrant workers’ rights in a social security participation. This study aims to compare on how Indonesia and Singapore provide legal protection to migrant workers in the social security participation and what social security programs that can be followed in both countries. The research method used is a normative research method with a statute approach. The result of the study shows that Indonesia has provided protection for migrant workers the same way as local workers as stated on Art. 22 Universal Declaration of Human Rights, whereas Singapore only provides the social security to local workers. Migrant workers get the protection through other ways, namely insurance and bilateral/multilateral agreements. For the social security programs followed by migrant workers, both Indonesia and Singapore do not provide the programs related to what has been regulated on Art. 25 Universal Declaration of Human Rights.

Free trade agreement of ASEAN Economic Community (AEC) immediately will be implementedin the region. The four pillars of the AEC concept is a reference in the enforcement process. All memberstates have made preparations including Indonesia. Small and Medium-sized Enterprises also makepreparations. The preparation of the Indonesian government in the deal and how the measures taken toprotect Small and Medium-sized Enterprises is a discussion in the review of this article. Policies madeby the government, including the measures taken for businesses Small and Medium-sized Enterprises,still found some difficulties in implementation.Because entirely not going well then the nomination acceleration trade policies comprehensivelyneeds to be activated immediately so that the various policy papers that the government made will be ableto work together with entreperenurs. This study also found unrediness of national products, especiallySmall and Medium-sized Enterprises in competing due to human resources, inadequate infrastructureand the investment climate.

In the facing of the ASEAN Economic Community 2015, the Legal Protection of batik brand in Pekalongan plays a very important and requires a more adequate regulatory system. Free trade globalization can only be maintained by maintaining a healthy climate for business competition. The demand for legal protection of batik brand is growing rapidly as the number of people who plagiarized brand of batik. One brand that needs to be protected is the batik brand of Pekalongan as the largest industrial centers of batik in Indonesia. The methods of This research uses empirical juridical approach to the specification of descriptive analytical study which the author tries to explain the preparation of  batik pekalongan society Towards the ASEAN Economic Community in 2015. So far if there is a dispute in the brand of batik fairly resolved peacefully and families, but in the case of infringement of trademark of batik, then the holder of legitimate trademark rights can be conduct civil or criminal action lawsuit to court, or can be resolve by arbitration as an alternative, such as regulated in Act No. 30 of 1999 on Arbitration and alternative dispute resolution.

Countries as member of the ASEAN established economic community to provide easy entry and exit of goods from the Southeast Asia countries. It aims to creating fail economic growth in Southeast Asia, improving living standards and reducing the poverty. This situation had an impact on the existence of intellectual property rights, primarily trade secrets to be protected because the trade secrets do not legally require registration. The research method uses a legal research. The legal research is a process of finding the laws, legal principles and the legal doctrines in order to answer the legal issues. The approach that is used in the legal research is statute approach. The results of the research are that legal protection of trade secrets toward the ASEAN economic community covers producing methods, processing methods, selling methods, or other information on technology and/or business that has added values but the public do not know. Property rights can be obtained without registration. The legal protection of trade secrets is regulated in TRIPS and Act No. 30 of 2000. However, regulation of property rights on the trade secret rights is still not available, so there is legal uncertainty.

At this time the Asean Economic Community is being held which is a free trade system in ASEAN Countries (Asean Economic Community), so that traditional knowledge is important to be protected by sui generis in Indonesia which causes the absence of legislation who specifically regulates traditional knowledge because it deals with the transfer of technology, economic development and national honor, and attracts investors in the field of research development in Indonesia, one of the countries that has natural resources and human resources in resulting in a variety of traditional knowledge as a feature of local wisdom, traditional knowledge has a very strategic value to be protected by sui generis in the field of intellectual property as a nation's intellectual work. Protection of traditional knowledge requires regulations in order to regulate the use of sharing benefits that are balanced and equitable for people who have the right to traditional knowledge. The current application of the IPR regime is not optimal in its application to protect traditional knowledge especially regarding traditional medicine against violations committed by foreign countries. The impact of legal protection on traditional knowledge is known to other countries, especially the ASEAN Economic Community as a society that values and utilizes traditional knowledge as an increase in regional income.
