Decommissioning in Brazil: legal aspects of a technical analysis

Abstract This paper presents legal contributions to the technical analysis of the decommissioning stages of the oil industry. We seek to contribute to decision making based on multicriteria analysis about the options for uninstalling specific equipment in the production chain: subsea equipment. The objective is to demonstrate that there is legal predictability supported by the technical aspect for the options that are possible in each case. The methodology used was the literary revision combined with a national and international legislative analysis that allowed the presentation of the final conclusion. The comparison between the international norms, as well as the Brazilian legislation, in particular, the national solid waste policy demonstrated the legality of the application of a multicriteria analysis to base the decisions by the companies, as well as the inspection agencies.

The purposes of this research were to determine the cost, revenue, and profit of fruit seedling marketing and the feasibility of marketing business of fruit seedling at the CV. Flora Chania in Palaran Subcity, Samarinda City. This research was conducted during 3 months from March to May 2019. The data were collected secondary data. The analysis included calculation of cost, revenue, profit, Net Present Value (NPV), Internal Rate of Return (IRR), Net Benefit Cost Ratio (Net B/C Ratio), dan payback period. The research results showed an average operational cost of IDR248,945,720.00 year-1 or IDR20,745,477.00 month-1, an average revenue of IDR349,900,000.00 year-1 or IDR29,083,333.00 month-1 and the average income of IDR100,818,566.00 year-1 or IDR8,326,547.00 month-1. This research found  the NPV value of IDR37,464,538.00 at a factor discount rate of 10%, IRR value of 4.6%, Net B/C Ratio value of 1.32, while the payback period of 1 year and 4 months. The results of this research  indicate that based on an assessment of technical aspect, management and legal aspects, market and marketing aspects, and financial aspect, the marketing of fruit seedling is feasible to be developed.

This paper presents a gridd study of Mini Hydro Power Generation (MHPP) of Palangai Hulu, 2 x 4.9 MW. It is owned by PT. Dempo Sumber Energi (DSE) located at Palangai of South Pesisir Regency. The objective is to fulfill the legal aspects, technical aspects and economic aspects to develop of MHPP. The legal aspect is one of the requirements that must be fulfilled prior to the signing of Power Purchase Agreement (PPA) between DSE and State Electricity Company that called PLN. Technical aspect is to analyze the operational impact of the distribution system after MHPP connecting to the PLN distribution system, while the economic aspect is to analyze how much result energy of MHPP can be absorbed by PLN. Uultimately, it is described the financial feasibility of MHPP. The result is, legal aspect of development of MHPP of Palangai Hulu feasible to be continued to next process to sign contract of PPA. Technically, there is no negative impact of operating the PLN distribution system after the MHPP is connected to the PLN Rayon Balai Selasa system that analyzes using ETAP. Point of Connection (POC) as the selling point of electrical energy by DSE to the most economical PLN is on substation circuit of Balai Selasa. The energy production of MHPP Palangai Hulu can be absorbed 96.4% starting in 2018. The cost of POC is Rp. 11,577,000,000.

Biological invasions are among the main causes of biodiversity loss on planet. Losses are accentuated in streams, which are sensitive to human impacts, since they have specialized fauna and higher degree of endemism. Despite this, studies on invasions by non-native fish in streams are incipient in Brazil. In this review, we present an introduction on the process (i.e., stages) of biological invasion, the environmental factors that influence the establishment and the impacts of non-native species in streams. A methodological step-by-step is also presented as a way to guide the conduct of studies on non-native species in Brazilian streams. In addition, management actions measures are presented to prevent new cases of introductions and suggestions for studies on invasions in streams. Avoiding propagule pressure and environmental education, as well as legal aspects of Brazilian legislation, are management actions that can prevent new introductions. Finally, gaps in knowledge and perspectives are raised as an incentive for interested parties to enter the subject and develop new studies on non-native fishes in Brazilian streams.

The purpose of this study was to determine the feasibility of developing the Oyster Mushroom business to be Oyster Mushroom Shredded to increase the profitability of the Oyster Mushroom Farmers and how much is the profitability of Oyster Mushroom farmers before and as young as the development of Shredded Oyster Mushrooms. The location of this study was the "CV. Maju Jaya" Oyster Mushroom Farmer in Jenangan sub-district, Ponorogo Regency.  The type of data used is secondary and primary data.  The analysis uses quantitative analysis for market and marketing aspects, Financial aspects and for qualitative analysis for Technical and Technology aspects, HR aspects, legal aspects. The results of this analysis of the market aspect have a great opportunity because only a few competitors are estimated to increase market share by 17% annually. On the technical aspect, the availability of raw materials is easily obtained because the location of production is one place with raw materials, equipment and machinery used that are already modern so as to speed up the production process. In the aspects of HRM, it has been planned that the workforce needs, organizational structure, salaries and employee skills improvement. In the legal aspect, analyzing the business in terms of business legality and explaining the home industry food acquisition procedure. Based on the analysis of the Fianasial aspect, it is feasible to do business development because it meets the investment criteria that are Net Present Value (NPV) of Rp. 156,603,848, Discounted Payback Period (  DPP), which is 3 years 3 months, and PI is 2.30, Internal Rate of Return (IRR) is 50.9%. Profitability prior to business development of Rp. 118,450,000 with ROI of 15% after developing a profitability business of Rp.  238,750,000 24%, then up by 9%. So that it can be concluded that the development of shredded Oyster Mushroom business to increase the profitability of Oyster Mushroom farmers is feasible to run.

The article analyzes the Belarusian legislation in the field of the petrochemical and oil refining industries, and draws conclusions on the work. The paper considers the concept of petrochemical and oil refining, the legal aspects of the regulation of these complexes are negative, and the impact of the complexes on the global environment is considered.

The purpose of this study was to determine how the analysis process for the results of financing agreement in Islamic banks (Bank BTN Syariah case study). The results showed that of the theory 5C, Bank BTN Syariah using 4C theory (Character, Capacity, Capital, Collateral) or the so-called four pillars. As for the theory 6A (Analysis of Legal Aspects, Analysis Marketing Aspect, Aspect Analysis Technical Analysis Aspects of Management, Analysis of Financial Aspect, Aspect Analysis Socioeconomic) the Bank BTN Syariah overall use of the theory. Risk mitigation strategies of financing and loss at Bank BTN Syariah divided into two types namely risk strategy proactive and reactive risk strategy . Proactive risk strategy carried out by the analysis of the character , financial capability and guarantees borrowers. Reactive risk strategy carried out by the approach of friendship , rescheduling and restructuring measures, as well as the withdrawal of the guarantee.

The article discusses the problems related to the implementation of the legal impact on modern Russia and the role of the principles of law as the underlying idea behind that impact. This research aims to structure visions of the main characteristics and classifications of the principles of law in the context of their formalization. The authors use the method of technical analysis of regulations, which is important to meet the requirements of legal engineering. As a result of the work carried out, the authors suggest that, on the one hand, it is important to aim at the standardization of the principles of law as accurately and accurately as possible in legislation. On the other hand, they assume that principles that are already assured in legislation but have not yet been recognized by the scientific community must also obtain an assessment and justified characteristics in the doctrine. They conclude that, from a technical-legal point of view, a principle of law that is not scientifically recognized does not disappear from the legal framework if it is institutionalized as such in effective legislation. On the contrary, essentially new principles enshrined in legislation should not be ignored by legal science.

The management model for the National Solid Waste Policy to develop sustainable actions, proposes the social inclusion of recyclable waste pickers in the waste management system. Compliance with the law, the form of participation of the waste pickers, and incentive mechanisms are configured as a relationship open to analysis. Therefore, the aim of this work was to investigate the potentials and limitations of a recycling cooperative, in terms of social technologies and inclusion, to encourage local development. The qualitative approach was aided by structured questionnaires, semi-structured interviews, and participant observation. The resulting evidence suggests that the organization of a cooperative, enabled access to information on the legislation of the National Solid Waste Policy. It showed the need to strengthen relationships with education institutions and public authorities. Despite the low levels of education of the members of the cooperative, projects and knowledge could be developed to aid social technologies. No technological innovations were observed, nor the production of alternative artifacts for recyclable materials. This weakens the cooperative in terms of articulation among peers, most notably the integration of the Catamare cooperative in the network of Cataparaná, to support the sale of material produced for industry. It may be concluded that joining the cooperative improved the social, economic, and political conditions of the members, but there were also structural limits to the recycling production chain that were not considered in the National Solid Waste Policy; and to a certain extent this weakens the development of sustainable actions. Furthermore, the organization of the cooperative hindered the development of social technologies and the social inclusion of the waste pickers.
