Up to 1993, EC member states could ask permission from the Commission of the EC to apply quantitative restrictions at their national borders, on the basis of art. 115 of the Treaty establishing the EC. The completion of the internal market in the EC abolished the internal borders, as a result of which the national quantitative restrictions became obsolete. We assume that the pressure on member states’ governments to apply these trade restrictions has not disappeared with the abolishment of the internal borders. For that reason we analyze the factors that may explain the member states’ wish to use the opportunity of art. 115. We use the political economy approach to trade policy. This approach has been introduced as traditional economics was not able to explain the widespread use of trade barriers by policy-makers. By taking into account the specific position of politicians and policy-makers, and the role of trade policy in the decision-making process with respect to social and economic policies, a better explanation of trade policy may be obtained.

The inequality within the 27 European member states has been studied. Six indicators proclaimed by Eurostat to be the main indicators charactere the countries: (i) the relative median at-risk-of-poverty gap, (ii) the income distribution, (iii) the income share of the bottom 40% of the population, (iv) the purchasing power adjusted GDP per capita, (v) the adjusted gross disposable income of households per capita and (vi) the asylum applications by state of procedure. The resulting multi-indicator system was analyzed applying partial ordering methodology, i.e., including all indicators simultaneously without any pretreatment. The degree of inequality was studied for the years 2010, 2015 and 2019. The EU member states were partially ordered and ranked. For all three years Luxembourg, The Netherlands, Austria, and Finland are found to be highly ranked, i.e., having rather low inequality. Bulgaria and Romania are, on the other hand, for all three years ranked low, with the highest degree of inequality. Excluding the asylum indicator, the risk-poverty-gap and the adjusted gross disposable income were found as the most important indicators. If, however, the asylum application is included, this indicator turns out as the most important for the mutual ranking of the countries. A set of additional indicators was studied disclosing the educational aspect as of major importance to achieve equality. Special partial ordering tools were applied to study the role of the single indicators, e.g., in relation to elucidate the incomparability of some countries to all other countries within the union.

This book looks at the impact of the expanding power of the EU in terms of fundamental rights and values. The current chapter lays down the framework for this analysis. Law did not always have a central role to play in the context of medicine and health. The role of law grew after the Second Word War and the Nuremberg Doctors Trials (1947), in which preventing the repetition of atrocities that were committed in the name of medicine became a guidepost for future law regarding patients’ rights and bioethics. In the period after the War, across the EU Member States, health law developed as a legal discipline in which a balance was struck in medicine and public health between law, bioethics, and fundamental rights. The role of EU fundamental rights protections in the context of public health and health care developed in relation with the growth of multilevel governance and litigation (national, international, Council of Europe, and European Union). For the analysis here, this chapter develops an EU rights and values framework that goes beyond the strictly legal and allows for a ‘normative language’ that takes into consideration fundamental rights as an expression of important shared values in the context of the European Union. The perspective of EU fundamental rights and values can demonstrate possible tensions caused by EU health policy: implications in terms of fundamental rights can show how highly sensitive national policy issues may be affected by the Member States’ participation in EU policymaking activities.

Abstract This article critically assesses EU harmonisation in the field of labour immigration. It argues that EU directives are limited both in scope and intensity which explains their relatively low effectiveness and added value. Given the current political and institutional context, the article claims that a truly common labour immigration policy is unrealistic. Labour immigration remains a predominantly national prerogative and EU rules have done little to overcome normative competition between EU Member States. Looking forward, the EU should adopt complementary measures to Member States’ policies. The role of the EU in this sensitive policy area should be better defined and justified, in particular in relation to the principle of subsidiarity.

By applying the rational choice principal–agent model, this article examines the European Union member states’ principal control of the European External Action Service (eeas) agent. More specifically, the article applies mechanisms of agency monitoring, control and sanctions that are inherent in the principal–agent model to analyse the establishment and functioning of the eeas. These mechanisms aim to ensure the eeas’s compliance with its mandate, thereby curtailing its ability to pursue own objectives that are independent from the principal. The findings reveal that the eeas is tightly controlled by the eu member states. Moreover the European Commission has tools to exercise horizontal checks vis-à-vis the eeas. The application of the principal–agent model to control the eeas is not without its limits. The model falls short of conceptualizing the role of the European Parliament, which remains an outlier to this model.

PurposeThis study, an exploratory one, aims to empirically investigate the association of national intellectual capital (NIC) with the national digital transformation readiness of the European Union's (EU’s) member states. Apart from building the conceptual model of NIC, this study explores the role of NIC dimensions in the digital divide between European countries.Design/methodology/approachBased on the literature review and the available EU statistical data and indexes, the theoretical framework and conceptual model for NIC were developed. The model explores the relation of NIC and its dimensions (human, social, structural, relational and renewable/development capital) on the readiness of European countries for digital transformation and the digital divide. Significant differences between EU countries in NIC and digital readiness were tested. Multiple linear regression was used to explore the association of each NIC dimension with digital transformation and digital divide within the EU.FindingsDespite a positive association between all dimensions of NIC and digital transformation readiness, the proposed model of NIC was not confirmed in full. Regression analysis proved social capital and working skills, a dimension of human capital, to be the predictors of digital transformation at a national level, able to detect certain elements of digital divide between EU member states. Structural capital, knowledge and education, as dimensions of human capital, were predictors of the digital divide in terms of the integration of digital media in companies.Research limitations/implicationsThis research has a limited propensity for generalisation due to the lack of common measurement models in the field of NIC exploration.Practical implicationsThis research offers policy makers an indication of the relationships between NIC and digital transformation, pointing out which dimensions of NIC should be strengthened to allow the EU to meet the challenges of digital economy and to overcome the digital divide between EU member states.Social implicationsThe use of digital technologies is key in creating active and informed citizens in the public sphere and productive companies and economic growth in the business sphere.Originality/valueThis study provides an original theoretical framework and conceptual model through which to analyse the relationship between NIC and digital transformation, which has thus far not been explored at the level of the EU. This research makes an original contribution to the empirical exploration of NIC and produces new insights in the fields of digital transformation and intellectual capital.

AbstractWhile humanitarian intervention in cases of state instability remains a disputed concept in international law, there is consensus in the international community over the need to provide protection to refugees, one of the corollaries of such instability. Using the European Union (EU) as a case study, this article takes a policy perspective to examine competing conceptions of both 'responsibility' and 'protection' among EU Member States. Responsibility can be seen either as the duty to move refugees around the EU such that each Member State takes its fair share, or the duty to assist those Member States who receive the highest numbers of migrants due to geography by way of practical and financial help. Similarly, protection can imply that which the EU offers within its boundaries, encompassed within the Common European Asylum System, or something broader that looks at where people are coming from and seeks to work with countries of origin and transit to provide protection outside the Union and tackle the causes of forced migration. Whether one or both of these concepts comes to dominate policy discourse over the long-term, the challenge will be to ensure an uncompromised understanding of protection among policy-makers.


We have entered the sixteenth year of the publication Contemporary Military Challenges with a wish to mark a few important anniversaries. In 2004, Slovenia joined the European Union and became a NATO member. Slovenia has thus been an active member of two distinguished international organisations for ten years. At the same time, this denotes a decade of active participation of Slovenian Armed Forces members in international operations and missions organised by the Alliance. In addition, it is the year in which the Slovenian Armed Forces reached the full age of its presence in the international environment. Eighteen years ago, in May 1997, twenty five members of Slovenian Armed Forces medical unit were deployed to a peace operation ALBA in Albania. If we look deeper into the past, Slovenian General Rudolf Maister was born one hundred and forty years ago. He significantly influenced the evolution of developments before World War I, but mostly Slovenian national consciousness. This year marks the hundredth anniversary of the beginning of World War I. The anniversary itself or the reasons for it are certainly not motivational – quite the opposite. It was an event on a worldwide scale which caused a great number of deaths and thus represented a devastating catastrophe. At that time, people did not even imagine what wars could bring for the future generations. All these anniversaries, and more could be found, impacted the substantive premise of this year’s issues. This is, of course, not because we would wish to turn backwards and deal with the historical issues. After all, we are the “Contemporary Military Challenges”. What mainly interests us is what have we learned from these examples and experiences. Is today’s situation any different because of them? Are we any better? For this purpose, we have published on our Slovenian (http://www.slovenskavojska. si/publikacije/sodobni-vojaski-izzivi/) and English (http://www.slovenskavojska. si/publikacije/sodobni-vojaski-izzivi/) websites an invitation for authors who would wish to deal with this subject. We are an interdisciplinary scientific and technical publication, which publishes articles on topical issues, research and expert discussions, as well as on technical and social science analyses covering the fields of international and national security and defence; global security challenges; crisis management; civil-military cooperation, and operations, development and transformation of the armed forces. The main topics that entertain our interest have been incorporated into the titles of individual issues. This year’s second issue will be entitled “Recent education and training trends in security, defence and military sectors”, the third one “Ten years of Slovenia’s NATO membership”, and the fourth one “100th anniversary of the beginning of World War I - have we learned anything from the conflicts in the past 100 years”. This year’s first issue was reserved for the topics suggested by the authors and we have received some very interesting articles. Ljubo Štampar in his article entitled Respect for human rights and fundamental freedoms in armed forces of EU member states: approaches, practices and mechanisms presents, in relation to the armed forces, the human rights and freedoms as the foundations of modern democratic societies. He compares freedom of speech, right to announce candidacy in the election or join political parties, freedom of association, freedom of trade unions and right to strike in individual EU member states. Vinko Vegič in his article The role of armed forces in Europe: from territorial defence to various security tasks establishes that two of the most important changes in the role of the armed forces include the need for a defence of the territory, and the appearance of some relatively differing and often poorly defined tasks. Countries have to adapt their defence doctrines and military structure to these two subjects, whereby the public (potentially) plays a decisive role. The young, patriotism and national security: armed forces as a pillar of patriotic structures is the article by Vladimir Prebilič and Jelena Juvan. The authors base their findings on the circumstances already described by Vinko Vegič, and establish the relation among the system of national security, values and patriotism among young people in Slovenia. Do the results of the survey represent a cause for concern? The transformation of armed forces has been a topical issue, especially in the recent two years, and has intrigued Mihael Nagelj enough to verify the theoretical and practical understanding of this notion in the defence system. His findings are presented in the article entitled Defence sector transformation: as understood in the world and Slovenia. Tomaž Pajntar, the author of the article Security of buildings in the event of a terrorist bomb attack writes about a blast as a result of an explosion and its effects on the buildings and their security. He carefully analyses and illustrates the laws of explosions, the knowledge of which is very important in the provision of building security. In her article entitled Information management and network collaboration in the Slovenian Armed Forces – a necessity or only a topical issue, Dragica Dovč presents the theory and practice of terms that at first seem very familiar. However, the results of her survey based on the case of the Slovenian Armed Forces, reveal that this field of work is still fairly unexplored. So, here is one more reason for other friends of defence and military topics to join the group of writers.

Abstract European countries are working towards carbon neutrality of the building sector. Regulations and initiatives, including the European Green Deal, aim at promoting circular buildings and low carbon design. Therefore, this paper seeks to investigate the role of legislation in paving the way towards achieving the circularity of buildings design and construction. A systematic literature review is conducted to compare the current regulations in different EU member states that address carbon emissions and life cycle thinking to achieve circularity. The study aims to demonstrate how the low-carbon emissions regulations in leading countries can lead to making the construction sector’s circularity. The research is focused on five leading EU member states in low carbon buildings, including Denmark, Finland, France, the Netherlands, and Sweden. The study compares the performance indicators, metrics, and target thresholds found in the five selected states’ regulations and examines them across a circularity assessment framework developed earlier by the authors. This paper provides insights on low emission building regulations state-of-the-art. Moreover, it offers a better understanding of the relationship between low-carbon emissions regulations and building circularity. The article explains the role of the legislative landscape and its impact on circular building design practices. Key findings from the study will assist the European Commission to identify policy options to support the uptake of “Circular economy principles for buildings design” in European, national and local policies.
