The right of adults to education: A comparative analysis from the Portuguese and Italian policy agenda

The subject of this article is the right of adults to education, with a focus on the critical analysis of education policy. We discuss human rights as a framework for citizenship in two national contexts of Southern Europe with the purpose of underlining key differences and similarities in countries with diverse histories but a similarly high number of low-qualified adults among their population. In view of the above, this paper provides a detailed historical context for adult education policy in those countries and expounds on how current Portuguese and Italian educational policy agendas have considered the right of adults to education in the context of their democratic regimes. For critical analysis we use Tomaševski’s theoretical 4A framework, built mainly for school contexts, and apply it to adult education policy. The objective is to understand ways of realizing the right of adults to education by means of policy measures undertaken by governments in those national states. Thus, we employed as an object of analysis the study of availability, accessibility, acceptability and adaptability of adult education and learning against the backdrop of current changes occurring in Europe. This heuristic exercise makes a significant contribution to adult education literature in times of neoliberal trends.

Resumo: O principal objetivo do artigo é enfatizar a indisciplina na modalidade EJA dentre suas causas e consequências. O tema traz consigo uma abordagem bastante enriquecedora sobre como observar e lidar com estas determinadas situações presentes no cotidiano escolar. A modalidade EJA é uma proposta de ensino que atende um determinado público bastante adversa, por se tratar de alunos que de uma maneira ou outra não finalizaram os estudos no tempo certo. E a indisciplina vem sendo explanada com frequência nos grupos docentes, porém sem nenhuma perspectiva de metodologias para conseguir driblar tal questão sobre o ensino. As bases teóricas para a construção do artigo discorrem de citações e argumentos em teóricos bastantes influenciadores na perspectiva abordada, vindo ao encontro de autores como FREIRE (2001), MATOS (2012), SANTOS (2012) dentre outros, além de informações com veracidade em cima das Leis educacionais como a LDB e CNE, além de afirmações de minha autoria sobre todo o estudado mediante a pesquisa. O processo metodológico para a construção discorre de estudo analítico e observação crítica acerca do conteúdo a ser pesquisado por meio de uma pesquisa de caráter qualitativo em estudo bibliográfico a respeito do tema. Os resultados apresentados no entorno do artigo surgem como possíveis respostas e hipóteses à problemática apresentada, dentre suas aquisições, uma nova perspectiva de formação para professores com problemas atuais na sala de aulas, assim como observar os diversos tipos de indisciplina escolar apresentados na modalidade EJA. Ao concluir o estudo, fica a oportunidade de querer buscar mais informações do tema a fim de aprofundar ainda mais o conhecimento e transformar em metodologias para um melhor ensino aprendizagem na EJA. Palavras-Chave: Educação; Educação de Jovens e Adultos; Indisciplina. Abstract: The main aim  of the article is to emphasize indiscipline in the EJA modality among its causes and consequences. The theme brings with it a very enriching approach on how to observe and deal with these certain situations present in everyday school life. The EJA modality is a teaching proposal that caters to a very adverse audience, as they are students who, in one way or another, did not finish their studies at the right time. And indiscipline has been frequently explained in the teaching groups, but without any perspective of methodologies to get around this issue about teaching. The theoretical bases for the construction of the article are based on citations and arguments in theorists who are quite influential in the perspective addressed, coming to the meeting of authors such as FREIRE (2001), MATOS (2012), SANTOS (2012) among others, as well as truthful information in above the educational laws such as the LDB and CNE, in addition to statements of my authorship about everything studied through the research. The methodological process for the construction is based on an analytical study and critical observation about the content to be researched through qualitative research in a bibliographical study about the subject. The results presented around the article appear as possible answers and hypotheses to the problem presented, among its acquisitions, a new perspective of training for teachers with current problems in the classroom, as well as observing the different types of school indiscipline presented in the EJA modality. Upon completing the study, there is the opportunity to seek more information on the topic in order to further deepen the knowledge and transform it into methodologies for better teaching and learning in EJA.Keywords: Education. Resumo: O presente artigo visa a abordar a orientação legislativa definida no tocante ao uso, manejo e apropriação dos recursos hídricos, a partir da análise do contexto histórico da evolução do reconhecimento da água como bem ambiental, público, finito e dotado de valor econômico, cuja utilização, disposição e acesso constituem-se em direito fundamental, a ser protegido por regulação e gestão ambiental. A análise crítica é situada especialmente no tocante à imposição do instrumento de política nacional de outorga do direito de uso das águas subterrâneas, em que se analisou, à luz da ponderação de interesses, o entendimento dos Tribunais Superiores quanto à prevalência da preservação da água sobre outros direitos. Para o desenvolvimento do estudo, foi utilizada uma abordagem qualitativa e natureza descritiva, tendo como norte metodológico o método dedutivo, por meio da técnica monográfica, com realização de revisão bibliográfica de artigos e obras doutrinárias nacionais referentes ao tema e análises de decisões. Abstract: The present article aims to address the legislative orientation defined regarding the use, management and appropriation of water resources, based on the analysis of the historical context related to the evolution of the recognition of water as an environmental, public, finite and endowed with economic value, whose use, disposition and access constitute a fundamental right, to be protected through regulation and environmental management. The critical analysis is focused in particular on the imposition of the instrument of national policy for granting the right to use groundwater, in which, in light of the balance of interests, the Supreme Courts' understanding of the prevalence of water preservation over others rights. For the development of the study, a qualitative and descriptive approach was used, using the methodological approach as the deductive method, through the monographic technique, with the accomplishment of bibliographical revision of articles and national doctrinal works referring to the subject and analysis of decisions.

The article provides an analysis and critique of the education component of the 2021 Sewell Report on Race and Ethnic Disparities. It commences by providing a critical summary of the report focusing on its spurious claims to objectivity, the erasure of racism and the inadequacy of its recommendations. The second part of the article focuses on developing a contextualised analysis of the report. Omi and Winant’s ideas about racial formation are used to provide a lens through which to interpret the Sewell report as part of a wider hegemonic project of the right to redefine what it means to be British in the context of a deepening organic crises of capitalism. The article outlines the nature of the crisis. It locates the report within a consideration of three ‘racial projects’ that have shaped education policy, namely, the nationalist, multicultural and antiracist projects. Through advocating a ‘colourblind’ approach to education policy and the selective appropriation of multicultural discourse, it will be argued that the report needs to be understood as part of a wider effort to reconfigure the nationalist project in response to crisis. It is suggested, however, that despite its many flaws, the Sewell report poses challenges for those who have traditionally been aligned to multiculturalism and antiracism in education. The article concludes by setting out a vision for a new progressive project aimed at advancing racial and cultural justice that it is suggested, can begin to address these challenges.

In 2011 the high profile murder of Clare Wood led to the introduction of the national domestic violence disclosure scheme (‘Clare’s Law’) in England and Wales. The scheme aims to prevent the perpetration of violence between intimate partners through the sharing of information about prior histories of violence. Despite already spreading to comparable jurisdictions in the UK and Australia, to date the merits of a domestic violence disclosure scheme have been the subject of limited scholarly review and analysis. This article provides a timely critical analysis of the need for and merits of Clare’s Law. It examines the data impediments to the scheme, the need to balance the right to protection with the right to privacy and the question of victim empowerment versus responsibilization and victim blaming. The article concludes that there is a need to heed caution in adopting this policy elsewhere.

ABSTRACT: During the first phases of the pandemic until today, many religious activities, especially liturgical celebrations, have been suspended and reorganised. Drastic measures and choices were necessary, always in balance with constitutional principles. In this social and historical context, digital platforms seem to have turned into liturgical spaces. The contribution aims to highlight the problems and opportunities that have arisen and to present the practices used within confessional systems, particularly the Catholic one. Also in relation to a research on the subject, promoted by the Giustino Fortunato University, reflections are offered that may favour a better relationship between the needs of worship and liturgical and confessional law in the field of sacraments and celebrations.

ResumoA história da democratização da educação traz consigo uma luta da classe trabalhadora de jovens e adultos, para que a educação seja mais acessível e gratuita a todos. Assim, com a Constituição Federal de 1988, o direito à igualdade, à educação e à universalização do ensino influenciaram a criação de políticas públicas voltadas ao desenvolvimento do ensino na educação brasileira. O artigo apresenta como objetivo compreender como a Arte e a EJA são concebidas nos documentos oficiais da Educação Básica e da Educação de Jovens e Adultos (EJA) no Estado do Tocantins. Esta pesquisa segue a abordagem qualitativa, de caráter descritivo e de natureza documental. A disciplina de Arte não está bem delineada nos anos da Educação Básica deste Estado, uma vez que, embora os documentos analisados afirmem da importância dessa área para a produção de conhecimento, não deixam claro se essa disciplina ocorrerá em todo o Ensino Fundamental, Ensino Médio e na EJA. É possível afirmar, portanto, que os jovens e os adultos vão à escola não por obrigação, mas porque eles têm interesse e necessidade de aprender. Por isso, que deve ser considerado nos processos pedagógicos em artes desenvolvidos com eles, assim como nos documentos/legislações que regem a Educação Básica no Estado do Tocantins os seus saberes e experiências construídos ao longo de suas vidas. AbstractThe history of the democratization of education brings with it a struggle by the working class of young and adults people to make education more accessible and free to all. Thus, with the 1988 Federal Constitution, the right to equality, to education, and the universalization of education influenced the public policies creation aimed at the development of teaching in Brazilian education. Its main objective is to understand how Art and Youth and Adult Education (YAE) are conceived in the official documents of Basic Education and YAE in the State of Tocantins, Brazil. This research follows the qualitative, descriptive and documental approach. The subject of Art is not well delineated in the years of Basic Education of this state, since, although the documents analyzed confirm the importance of this area for the knowledge production, they do not make clear if this subject will occur in the entire Elementary and High School Education, including in institutions that have YAE. It is possible to say, therefore, that young people and adults go to school not out of obligation, but because they have an interest and need to learn. That is why their knowledge and experiences built throughout their lives must be considered in the pedagogical processes in arts developed with them, as well as in the documents/legislations that govern basic education in the state of Tocantins. The authors, basing on a critical analysis of the experience of planning during the 20th century in a number of countries of Europe and Asia, and also on the lessons from the economics of "real socialism", set out to substantiate their conclusions on the advisability of "reloading" this institution. The aim is to create planning mechanisms, suited to the new economy, that incorporate forecasting, projections, direct and indirect selective regulation and so forth into integral programs of economic development and that set a vector of development for particular limited spheres of what remains on the whole a market economy. New planning institutions presuppose a supersession of the forms of bureaucratic centralism and a reliance on network forms of organization of the subject and process of planning.

The topic acquires its importance from a search in the strategies of the frivolous state and its characteristics with the ability to influence the regional, and what it revealed is a turning point in how to adapt from the variables and employ them to their advantage and try to prove their existence. Thus, the problem comes in the form of a question about the possibility of the frivolous state in light of the context of various regional and international events and trends. The answer to this question stems from the main hypothesis that (the aim which the frustrating state seeks to prove is that it finds itself compelled to choose several strategies that start from the nature of its characteristics and the goals that aim at it, which are centered in the circle of its interests in the field of its struggle for the sake of its survival and area of influence).
