Reduced to temporary guests, victims, threats, or enemies, those who are forced to seek refuge have to navigate a political minefield. To seek recognition in the public sphere is an especially treacherous endeavor under these conditions. Faced with a range of imposed identities–including the refugee label itself–the quest for “more visibility” through documentary images is fraught with contradictions for the displaced. This article considers the ways in which filmmakers and artists with experience of displacement work with documentary methods and forms in the face of these extreme difficulties. As they challenge and seek alternatives to conventional forms of documentary, a range of new expressions and tendencies can be discerned in the wake of “The European Refugee Crisis,” from so-called participatory documentary to essayistic and more experimental approaches. The article discusses, among other films, Purple Sea (2020), Midnight Traveler (2019), and My New European Life (2019).

In the face of Trumpism and its peculiar mix of the buffoonish and the lethal, Foster suggests that we “pump up” past theoretical concepts by raising them to a higher degree. Social media, for example, could thereby be considered the “fifth estate,” a force that outdoes the “fourth estate” of journalistic media and thereby evacuates the last residues of the public sphere that, over fifty years ago, Jürgen Habermas associated with the advent of print culture. Peter Sloterdijk's notion of cynical reason, too, must be raised to a higher power in order to comprehend the Trumpist mentality; perhaps in this post-truth era, we should speak instead of “noncynical unreason”? And while the concept of the “primal father” is so outrageous that it cannot be inflated, Foster argues, it is one that we must grapple with in the face of a figure who, like Freud's figure, embodies the law and simultaneously performs its transgression.

Jürgen Habermas (1929-) é um filósofo alemão e um dos mais influentes sociólogos do pós-guerra. Conhecido por suas teorias sobre o agir comunicativo e a esfera pública, é reconhecido internacionalmente como o principal representante da chamada “segunda geração” da Escola de Frankfurt. Também é considerado um dos mais importantes intelectuais contemporâneos. No presente trabalho, objetivamos refletir sobre o resgate promovido por este filósofo do projeto kantiano de esclarecimento (Aufklärung); movimento realizado em contraposição a tradição nietzschiana herdada por Adorno e Horkheimer, os quais entendem que, frente as aporias do mundo contemporâneo, esse projeto de emancipação nos termos apontados por Kant estaria dissipado.AbstractJürgen Habermas (1929-) is a German philosopher and one of the most influential postwar sociologists. Known for his theories on communicative action and the public sphere, he is internationally recognized as the main representative of the so-called "second generation" of the Frankfurt School. He is also considered one of the most important contemporary intellectuals. In the present work, we aim to reflect on the rescue promoted by this philosopher of the Kantian project of enlightenment (Aufklärung); movement against the Nietzschean tradition inherited by Adorno and Horkheimer, who understand that, in the face of the aporias of the contemporary world, this project of emancipation in the terms pointed out by Kant would be dissipated.

It is not highly contentious to claim that the 2008 global economic crisis may be also understood as a failure of the welfare state in European countries. The rise of economic inequalities in Europe, as a major sequel of the 2008 economic crisis and the increase of migrant flows, has fostered and become a breeding ground for racial, religious, or ideological hatred in the western world. However, compared to previous periods in recent history when tensions arose, citizens can now channel their feelings, thoughts, and political ideals through the institutions of the state’s basic structure. Thus, citizens are having a say by channelling their claims through democratic means and different forms of political participation. One relevant articulation has been new expressions of radical populism, nativism, and far-right ideologies which have burst into the public sphere, at the local, regional, and European levels. This combination has turned the economic and refugee crisis into what is mainly a crisis of European politics.Published online: 31 October 2018

This concluding chapter discusses how values are returning today in the guise of dominant norms, both in the secular world and in religion. Today's crisis is not simply a crisis of values, but of referring to values at all. For what should values be founded on? On one hand, religions, which are no longer in sync with Europe's dominant cultures, are returning to the public sphere on behalf of a normative demand. On the other hand, the secular culture that professes freedom and rights is coming to a head in a burst of normative production. This is a normativity toward all forms of religion and religiosity, of course, but also normativity with respect to its own foundation, the social contract, and human nature, that of the desiring subject. Ultimately, the chapter argues that it is time to re-examine the question of values, to restore the particular cultural and social aspects of norms and to reinject them into society. In the face of globalization, the issue is at once to be more in touch with society and to act as a counterweight to other influences in the world: only Europe can meet these two objectives.

This article explores issues related to the Right to Information movement in India specifically in relation to the public sphere, a concept that is habitually invoked to describe spaces for deliberation and communication. It explores the role played by the jan sunwai (public hearings) in the creation of a counter public sphere based on the local idiom, local means of communication and performative traditions that enabled a balance between speaking, listening and actioning. The article focuses on the Right to Information movement and the jan sunwai as an important indigenous means and pedagogical device used by this movement to mobilise, radicalise and give voice to marginalised people who have traditionally been expected to remain silent, even in the face of the most atrocious atrocities committed by the forward castes and wealthy.

Adi Ophir has suggested that the political realm is an order of evils, producing and managing regular forms of suffering and violence rather than eliminating them. Thus, the political is always to some extent a corrupted order of justice. Emmanuel Levinas’ work presents in its focus on the face-to-face relationship a means of rethinking how to make the political more open to compassionate justice. Though Levinas himself doesn’t sufficiently take on this question, I argue that his work facilitates a way of thinking about commiserative shame that provides a means to connect the face-to-face to its potential effects in the political sphere. If such shame isn’t ignored or bypassed, it produces an unsettling relation to the other that in its adversity motivates a kind of responsibility and care for the other that can alter the public sphere.

The late Richard Rorty famously argued that faith-based positions grounded in comprehensive worldviews or unassailable texts served as ‘conversation-stoppers’ and should be excluded from the public sphere. This article argues that Rorty’s position flies in the face of his own postmodern epistemology as well as his insistence on the humility and virtues that should attend the collective pursuit of the social good. It suggests that there are two Rortys at work and that his epistemological ambivalence undermines the force of his argument.

This article shall analyse the attitude of the Catholic Church towards the process of Europeanization of Polish policy of equality and non-discrimination. It shall be an analysis of a single case, i.e. the debate around Poland’s adoption of the CAHVIO Convention of the Council of Europe. These analyses shall seek the answer to the question of how the Catholic Church sees the process of Europeanization of equality and anti-discrimination policy in Poland. Whether it supports it or opposes it. What role does it want to play in this process? How is the Church and its attitude towards Europeanization perceived by other participants of the public debate and how does this affect the ability of the Church to control the process of Europeanization? The theoretical approach used in the research shall be the paradigm of the public sphere and Europeanization. Methods and techniques of discourse analysis shall be applied as well.

Between 1991 and 1993, the artist José Leonilson contributed a weekly illustration to Folha de São Paulo, Brazil’s highest circulation daily newspaper. This article argues that these drawings inserted a minoritarian voice into the public sphere in a way that contested its normative operations by emphasizing the micropolitical and the intimate, often through allegory. Some of the illustrations address AIDS, to which Leonilson succumbed two weeks after the last was published, and this article situates his work in relation to the intertwining discourses around sexuality, public health and media in Brazil at the time. What emerges is a conception of mass media and of publicness as a space of fiction that could, paradoxically, be instrumentalized in the face of the increasing standardization of previously deviant and unclassified sexualities.

AbstractThe article takes up the difficult problem of the so-called disobedience of judges against the background of the experiences of the Polish departure from constitutional democracy in 2015–2020. The special role and responsibility of a judge in the state imposes restrictions on her freedom of opinion in the public sphere. Openly manifesting opposition to government policy, which in the case of an ordinary citizen is only the implementation of human rights and freedoms, may be described as controversial and contrary to applicable ethical regulations. The main thesis of this paper is the assertion that although judges who act as impartial arbitrators in disputes should generally refrain from ostentatiously opposing the actions of political authorities, they are not deprived of the possibility of protest. Also in the exercise of office, and not outside the sphere of their duties, judges should take into account overriding moral values that should be implemented by the legal order, and not the values or declarations guiding the government policies. The integrity of the judge, which prescribes restraint in statements and actions in the public sphere, as well as the care for the dignity of the office held, should not be confused with absolute subordination to the legislature or the executive, even if the judge is obliged to apply the law. The traditional attitude of the members of the judiciary, consisting in focusing only on the application of the law in individual cases and the lack of any political involvement, is being reviewed in the face of the spread of majoritarianism and the law abuse as normal techniques of exercising public authority. The disobedience of judges—although difficult to defend at first sight—may seem to be the only possible way to draw public attention to the corruption of the state system. The ‘disobediant’ judges can even be assigned the role of ‘whistleblowers’, which should help to ease their legal liability or their future rehabilitation.
