Social enterprises are very diverse across Europe. There is a wide range of different legislative approaches and different organisational and legal forms on the national level. In some countries, existing legal forms such as associations, foundations, cooperatives and share companies are used as social enterprises. In other countries, new legal forms are designed for social enterprises by adapting existing legal forms (companies, cooperatives), e.g. social cooperatives in Italy, cooperative collective interest companies in France, community interest companies in the UK.The reason for the variety of approaches how to implement the idea of social enterprise, is in the lack of uniform binding rules on the level of the EU. Here, we present our views on the legal framework needed to implement the concept of social entrepreneurship in the EU in a more efficient and effective manner.First, we present a range of definition of social entrepreneurship and enterprises, many of them not consistent and/or sufficiently elaborated. Further, some historical roots are presented on social and self-managed economy, and the concept of social enterprise is elaborated from the point of view of its eligibility. Comparative analysis aims to prove critical diversity of approaches across the EU that leads to stagnating in place and lagging behind.

Social entrepreneurship has to be perceived in the context of social economy. It is the production, supply and / or organization of consumption of goods with a socially significant effect. The objectives of the paper are: to define the essence of the social entrepreneurship, its relation to the other business models and the social enterprise as an organizational subject of social entrepreneursh. The institutional framework and the legal foundations of these processes in the EU and Bulgaria have been outlined. Some specific problems - institutional, legal, economic are concerned and directions are given for solving them.

The article is aimed at illuminating the essence and basic criteria that characterize social entrepreneurship, analyzing its tendencies and identifying the main problems of social entrepreneurship development in the process of its formation in Ukraine. The historical stages of development of social entrepreneurship in Ukraine are provided. Approaches to interpretation of the essence of social entrepreneurship are examined. Attention is focused on the innovative component of social entrepreneurship. The essence of social entrepreneurship is researched, its main features are closer defined. The key differences between traditional and social enterprise are specified. An estimation of social entrepreneurship in the conditions of development of the market economy of Ukraine is presented. The advantages, types of social entrepreneurship, organizational and legal forms and industry affiliation of social enterprises are analyzed. Domestic social enterprises were researched on the criteria for duration of their existence along with their size. The territorial distribution of enterprises by regions of Ukraine is analyzed. During the research, the main aspects that hinder the development of social entrepreneurship at the regional level are identified. The main problems of development and formation of social entrepreneurship in Ukraine are examined and substantiated. It is noted that one of the directions of activity directed towards supporting the growth of social entrepreneurship is optimization of the legal environment. The prospects for the development of social entrepreneurship for households in Ukraine are defined. It is emphasized the importance of promoting social entrepreneurship among the population and raising its awareness of this type of activity. It is proved that in today's conditions social entrepreneurship is an effective innovative instrument for solving social problems. Examples of successful social enterprises in Ukraine are provided.

Social Entrepreneurship (SE) describes a new entrepreneurial form combining the generation of financial and social value. In recent years, research interest in SE increased in various disciplines with a particular focus on the characteristics of social enterprises. Whereas a clear-cut definition of SE is yet to be found, there is evidence that culture and economy affect and shape features of SE activity. In addition, sector-dependent differences are supposed. Building on Institutional Theory and employing a mixed qualitative and quantitative approach, this study sheds light on the existence of international and inter-sector differences by examining 161 UK and Indian social enterprises. A content analysis and analyses of variance were employed and yielded similarities as well as several significant differences on an international and inter-sector level, e.g., regarding innovativeness and the generation of revenue. The current study contributes to a more nuanced picture of the SE landscape by comparing social enterprise characteristics in a developed and a developing country on the one hand and different sectors on the other hand. Furthermore, I highlight the benefits of jointly applying qualitative and quantitative methodologies. Future research should pay more attention to the innate heterogeneity among social enterprises and further consolidate and extend these findings.

AbstractFailures of compliance with European Union (EU) directives have revealed the EU as a political system capable of enacting laws in a wide range of different policy areas, but facing difficulties to ensure their actual implementation. Although the EU relies on national enforcement agencies to ensure compliance with the EU legislation, there is scarce analysis of the differential deterrent effect of national enforcement in EU law compliance. This article examines the enforcement of an EU water directive, the Urban Waste Water Treatment Directive, in Spain and the UK. It focuses on the existing national sanctions for disciplining actors in charge of complying with EU requirements, and on the actual use of punitive sanctions. The analysis shows that a more comprehensive and active disciplinary regime at the national level contributes to explain a higher degree of compliance with EU law. The article calls for a detailed examination of the national administrative and criminal sanction system for a more comprehensive understanding of the incentives and disincentives to comply with EU law at the national state level.

A mutual insurance society is one of the basic forms of conducting insurance activity. It is characterized by a very wide range of options which its founders and subsequently entitled members have in order to choose the organizational and systemic model of operation, to change it in the course of business, to define the concept of membership, to create various categories of members and provide them with different rights and duties, to determine the powers of statutory bodies, and, above all, to apply the method of mutuality. The Insurance and Reinsurance Activity Act regulates the basic legal framework of mutual companies, while referring quite a number of issues to the Polish Commercial Partnerships and Companies Code. This does not alter the fundamental principle on which the company's activity is based, namely that its articles of association play an extremely important role, which is much greater than in the case of public limited liability companies, and that members of a mutual insurance society enjoy considerable freedom to conduct business and categorize its members, which is unparalleled for other legal forms of business activity.

Introduction. Modern development of socio-economic sector makes adjustments to market environment. Enterprises require expansion of their activities and feel necessity to diversify risks. Satisfaction of consumer needs is accompanied by introduction of innovations in various areas. Focusing on marketing 3.0, when market activity should not only ensure enterprise’s profitability, but also care about consumer and environment, is embracing more and more enterprises and becoming modern business responsibility. Therefore, the problem of social entrepreneurship research in context of sustainable development is becoming relevant and important. Aim and tasks. The main aim of this work is to formulate theoretical means for social entrepreneurship research, which should reveal peculiarities of tools to achieve global goals of sustainable development. To achieve this goal, the following tasks have been solved in this study: analysis of definitions and study the essence of “social entrepreneurship” concept; interconnection of social entrepreneurship goals with global goals of sustainable development and compliance with modern concept of marketing 3.0. Results. Research of “social enterprise” definition allows to define it as stable business structure, tended to self-development, which forms mechanism of social support and infrastructure development through close integration into social system. Social entrepreneurship is aimed at solving social problems and other goals of marketing 3.0. Social enterprise is considered in context of sustainable development, which is a concept that requires balance between satisfying current needs of people and protecting interests of future generations, ensuring their necessity for safe and healthy environment, and it must be able to contribute to global goals of sustainable development at local level. Conclusions. Social enterprises have become an acceptable mechanism for solving socio-economic problems, as they are developing and expanding new tools to achieve global goals of sustainable development at local level. Social  entrepreneurship has opportunity to involve socially vulnerable groups in public life and expand citizens’ activity. Social entrepreneurship today is aimed at positive social changes and providing basic human needs in an optimal way.

In this paper, social entrepreneurship as a developing type of entrepreneurship is analyzed. On the level of the European Union (EU), social entrepreneurship is widely supported by different initiatives which aim to develop a suitable legal, administrative, and financial environment for social enterprises, but also allowing member states to regulate them individually. This paper focuses on the social entrepreneurship in Slovenia, where it is strictly shaped by the legislation. Consequently, social enterprises need to meet the legislation’s requirements which hinder their quantity and development. Additionally, the scope of social enterprises is narrowed to those companies that received the formal status of social enterprise. In the paper provided will be the data on social enterprises in Slovenia with some recommendation for further development of the framework for social entrepreneurship in the country.

AbstractSocial enterprises combine activities, processes, structures, and meanings associated with multiple institutional logics that may pose conflicting goals, norms, values, and practices. This in-depth multi-source case study of an ecological social enterprise in Malaysia reveals how the enactment of the family logic interacts with the market and ecological logics not only in conflicting but also in synergetic ways. By drawing attention to the institutional logic of the family in social entrepreneurship, this study highlights the heterogeneity of social enterprises. The findings have implications for research with social enterprises and family-owned firms in relation to the ethical obligations of these organizations and the interactions of multiple logics.



Policy-Making in the European Union explores the link between the modes and mechanisms of EU policy-making and its implementation at the national level. From defining the processes, institutions and modes through which policy-making operates, the text moves on to situate individual policies within these modes, detail their content, and analyse how they are implemented, navigating policy in all its complexities. The first part of the text examines processes, institutions, and the theoretical and analytical underpinnings of policy-making, while the second part considers a wide range of policy areas, from economics to the environment, and security to the single market. Throughout the text, theoretical approaches sit side by side with the reality of key events in the EU, including enlargement, the ratification of the Treaty of Lisbon, and the financial crisis and resulting Eurozone crisis, focusing on what determines how policies are made and implemented. This includes major developments such as the establishment of the European Stability Mechanism, the reform of the common agricultural policy, and new initiatives to promote EU energy security. In the final part, the chapters consider trends in EU policy-making and the challenges facing the EU.

The author analyzes the interaction of specific personal entrepreneurial culture components and the instrument to support social entrepreneurship as the UK highly innovative sector. Based on the analysis, the basic concept of building efficient interaction is proposed, and its strong points applicable to the emerging innovative support infrastructure of social entrepreneurship in Russia are specified.
