<p>Abstract<br />Freies ermessen is the authority freegiven to government officials in order to provide the best service for citizens , which is a consequence of the concept of the welfare state aimed at the welfare of society . In this case , there is principle that government should not refuse to solve a problem with no reason or no rules , so that the public interest is not harmed , officials were given the authority to interpret and apply its own rule for resolving the problems faced by the community. However , to avoid irregularities freies ermessen then it must comply with the general principles of good governance and required their means of control , control of the judicial , political and administrative .<br /><em>Key Words:Freies ermessen , officials , the welfare state</em></p><p>Abstrak<br />Freies ermessen merupakan kewenangan bebas yang diberikan kepada pejabat pemerintahan dalam rangka memberikan pelayanan yang terbaik bagi warga masyarakat, yang merupakan konsekuensi dari adanya konsep negara kesejahteraan (welfarestate) yang bertujuan untuk mensejahterakan masyarakat. Dalam hal ini dikenal adanya prinsip bahwa pemerintah tidak boleh menolak untuk menyelesaikan suatu masalah dengan alasan tidak atau belum ada aturannya, sehingga agar kepentingan masyarakat tidak dirugikan, pejabat diberi kewenangan untuk menafsirkan dan menerapkan sendiri suatu aturan untuk menyelesaiakan masalah yang dihadapi oleh masyarakat. Namun demikian, untuk menghindari penyimpangan maka freies ermessen itu harus sesuai dengan asas-asas umum pemerintahan yang baik serta diperlukan adanya sarana kontrol, baik kontrol yudisial, politik maupun administratif.<br /><em>Kata Kunci: freies ermessen, pejabat, negara kesejahteraan</em></p>

Shifting the notion countries formal law into state law meteriil (wefare staat) within the meaning of the welfare state agency or official  Administrative often take a variety of specific policy measures, among others, creating what is commonly called policy rule(beleidsregel). Such products can not be separated from the association Freies  ermessen. In order setting is a rule or rules of conduct set that regulation (Regeling) can be found in the legislation (Algemeen verbindende voorschriften) internal rules that apply to the (interne regelingen) and policy (beleidrege). Establishing the policy rule (beleidsregel) is located on the beoordelingsruimte (space considerations) given by the legislators to officials or governing bodies to take action on its own initiative public law that is setting, determination and positive action to resolve the problem- governance problems faced. Freis ermessen only intended use in the public interest. Freis ernessen implementation should be morally accountable to God Almighty, uphold the dignity and the degree of human dignity and the values ??of truth and justice, promoting unity and oneness, for the sake of joint / public interest. Tests on policy rule is more geared to doelmatigheid guided by the general principles of good governance

Public participation aimed at improving the effectiveness of governance by involving citizens in governance policy formulation and decision-making processes. It was designed to promote transparency, accountability and effectiveness of any modern government. Although Kenya has legally adopted public participation in day-to-day government activities, challenges still cripple its effectiveness as documented by several scholars. Instead of reducing conflicts between the government and the public, it has heightened witnessing so many petitions of government missing on priorities in terms of development and government policies. Results show that participation weakly relates with governance hence frictions sustainable development. Theoretically, public participation influences governance efficiency and development, directly and indirectly, thus sustainable development policy and implementation depends on Public participation and good governance. However, an effective public participation in governance is has been fractioned by the government. Instead of being a promoter/sponsor of public participation, the government of Kenya has failed to put structures that would spur participation of citizens in policy making and other days to activities. This has brought about wrong priority setting and misappropriation of public resources; The government officials and political class interference ultimately limit public opinion and input effects on decision-making and policy formulation, which might be an inner factor determining the failure of public participation in Kenya. The study suggests the need for strengthening public participation by establishing an independent institution to preside over public participation processes.

The Public Expenditure/GDP ratio is one of the most significant metrics that measure the state's share of the economy. It can be said that there is an interventionist state type in countries where this rate is high, or it can be argued that the share of the public sector in the economy is low in countries where this rate is low. It is also possible to argue that the countries' economic, sociological, and political factors play an essential role in determining this ratio. Regulations, which are the most important tools of the welfare state, may arise through economic controls as well as through social policies. This study aims to find an answer to the question of whether this situation is possible for a developing country such as Turkey while Nordic countries, which determine a system different from other welfare models, succeed in raising social welfare without giving up the principles such as equality and justice that they have despite the globalization effect. Before the welfare state, people were protected from disabilities resulting from illness, old age, and other infirmities by care work provided within the family. When the state assumes responsibility for care-work tasks, in effect it assumes parental roles, thereby becoming a form offamilial governmentin which the public provision of goods and services is analogous to care work provided in the family. My research pushes back the origins of the state’s obligation to care for people to a preindustrial form of government, hereditary monarchies—what Max Weber termed patrimonialism. It explicates how monarchs were cast as the parents of the people, thereby constituting kingship as a care work regime that assigned to political rulers parental responsibility for the welfare of the people. Using historical and quantitative analysis, I establish that retaining the legitimacy of monarchies as the first form of familial government in the course of Western European democratizing makes it more credible to the public and to political elites to accept the welfare state as the second form of familial government. That, in turn, promotes a more robust public sector supportive of social provision. The results reformulate conceptions of the contemporary welfare state and its developmental legacies.

Objective - This research aims to reveal the failure of accrual accounting to create good governance and clean government in local governments in Indonesia. Additionally, the research seeks to examine the increase in accrual based rapid growth in Indonesia and the instance of corruption among government officials. Methodology/Technique - In connection with this objective, the study explains the practical perspective of political intervention during the adoption of accrual accounting and examines the role of the community in the implementation of accrual accounting using a critical phenomenology method. Findings - The findings of this study show that accrual-based accounting encourages deviant behaviour within the public sector and hence, good governance and clean government cannot be achieved. Accrual basis in this regard becomes a means for actors to conceal fraud by exploiting the weaknesses of accrual-based accounting to allow for creative accounting. Novelty - This study uses a qualitative method to describe the implementation of accrual-based accounting in local governments in Indonesia, which is a new approach to this phenomenon. This chapter explores the story of the 1942 Beveridge Report and the beginnings of the welfare state. The policies proposed by Beveridge and the 1945–48 legislation were logical extensions of government's expanding role in social welfare policy beginning with the Liberal Welfare Reforms. This does not mean that the importance of the postwar legislation should be downplayed. Because of the adoption of the National Health Service, universal coverage, and equality of treatment, Britain after 1948 deserves to be called a welfare state, while Edwardian and interwar Britain do not. Unfortunately, despite the enthusiasm with which the public greeted the welfare state, the postwar policies did not eliminate economic insecurity.

This article considers the current state of help with funeral expenses in Britain. It argues that assistance has been progressively and deliberately eroded to the point where the famous ‘from the cradle to the grave’ protection of the welfare state has been removed from increasing numbers of poor people. The article sets these developments within the context of the contemporary British funeral industry, with emphasis upon its treatment of less-well-off consumers. The changing nature of social security provision for funeral expenses is traced in detail, including the actions of the incoming 1997 Labour government. This article investigates the public health role of local authorities in the case of burials, concluding that such services are insufficiently robust to meet the new weight placed upon them. The article ends with a consideration of the impact which these different changes produce in the lives of individuals upon whom they have an effect.
