A failed general election will result in a re-election and will certainly require additional budget. The purpose of this research is to find out the mechanism for the implementation of the re-election and to analyze the use of the State Revenue and Expenditure Budget in the implementation of the re-election. The research method used is normative legal research with a statutory approach and a conceptual approach. The results of this study indicate that the mechanism for implementing the re-election is a dispute over the results of the disputed General Election, by presidential candidates and members of the legislative candidates through the Constitutional Court decision. The mechanism for the provision of funds from the State Revenue and Expenditure Budget in the implementation of the re-General Election is the submission of additional costs by the General Election Commission to the Budget Institution and the Budget Department to revise the budget for the implementation of General Elections that are undergoing re-election.

ABSTRAKPerubahan Kewenangan Badan Pengawas Pemilihan Umum terhadap Pelanggaran Pemilihan Umum Legislatif berdasarkan Undang-undang Nomor 7 Tahun 2017 Tentang Pemilihan Umum. Tujuan penelitian ini adalah: (1). Untuk mengetahui latar belakang terjadinya perubahan kewenangan Badan Pengawas Pemilihan Umum terhadap pelanggaran pemilihan umum legislative berdasarkan Undang-undang Nomor 7 Tahun 2017 Tentang Pemilihan Umum, (2). Untuk mengetahui mekanisme penyelesaian pelanggaran Pemilihan Umum oleh Badan Pengawas Pemilihan Umum terhadap pelanggaran pemilihan umum legislatif berdasarkan Undang-undang Nomor 7 tahun 2017 Tentang Pemilihan Umum. Jenis penelitian ini adalah penelitian hukum yang bersifat yuridis normatif dengan menggunakan dua pendekatan yakni pendekatan peraturan perundang-undangan dan pendekatan konseptual. Hasil penelitian yang melatarbelakangi perubahan kewenangan pelanggaran Pemilu yakni adanya aspirasi Bawaslu yang kesulitan dalam praktik, dimana saat terjadi pelanggaran administrasi Pemilu yang semestinya diselesaikan dengan cepat, tidak bisa dilakukan karena proses penerusan laporan dari pengawas Pemilu ke Komisi Pemilihan Umum/Komisi Pemilihan Umum Daerah tidak diproses secara cepat dan tidak diberi putusan serta tindakan. Disisi lain adanya usulan agar Bawaslu dan Mahkamah Konstitusi menjadi dua lembaga yang menangani perselisihan Pemilu. Mahkamah Konstitusi menangani perselisihan hasil Pemilu, sedangkan Bawaslu menangani pelanggaran ketentuan Administrasi pemilu, menjadi penyidik dan penuntut pelanggaran ketentuan pidana Pemilu, perselisihan antara Komisi Pemilihan Umum dengan peserta Pemilu, perselisihan antara peserta Pemilu. Bawaslu hendak dikembangkan menjadi penegak hukum dan menyelesaikan sebagian sengketa Pemilu. Pelanggaran Pemilu dibagi menjadi enam jenis yaitu Tindak Pidana Pemilu, Kode Etik Penyelenggara Pemilu, Pelanggaran Administrasi Pemilu, Sengketa Pemilu, Perselisihan hasil Pemilu, sengketa tata usaha Negara. Keseluruhan pelanggaran Pemilu ini ditangani oleh masing-masing lembaga yang berbeda.Kata kunci: pemilu legislatif; pelanggaran pemilu; mekanisme penanganan pelanggaran pemiluABSTRACTT Changes to the Authority of the General Election Supervisory Board on Violations of Legislative General Elections based on Law Number 7 of 2017 concerning General Elections. The objectives of this study are: (1). To find out the background of the change in authority of the General Election Supervisory Agency against violations of the legislative general election based on Law Number 7 of 2017 concerning General Elections, (2). To find out the mechanism for resolving violations of the General Election by the General Election Supervisory Board against violations of legislative elections based on Law Number 7 of 2017 concerning General Elections. This type of research is legal normative juridical research using two approaches namely the approach of legislation and a conceptual approach. The results of the research behind the change in election violation authority are the aspirations of Bawaslu which have difficulties in practice, where during the election administration violations which should be resolved quickly, cannot be done because the process of forwarding reports from Election supervisors to the Election Commission/Regional Election Commission is not processed quickly and not given decisions and actions. On the other hand there is a proposal that the Election Supervisory Body and the Constitutional Court be two institutions that handle election disputes. The Constitutional Court handles disputes over election results, while the Election Supervisory Body handles violations of electoral administration provisions, becomes investigators and prosecutors of violations of Election criminal provisions, disputes between the General Election Commission and election participants, disputes between election participants. Bawaslu wants to be developed into law enforcement and resolve some election disputes. Election Violations are divided into six types, namely Election Crimes, Election Organizers Code of Ethics, Election Administration Violations, Election Disputes, Election Results Disputes, State administrative disputes. In welcoming 2019 concurrent general elections, the General Election Commission issued PKPU No. 20 of 2018, one of which banned former convicts of corruption from becoming legislative candidates on the grounds that corruption is an extraordinary offense that is commonly practiced by legislators both individually and in congregation. The regulation is stated in Article 4 paragraph (3) PKPU No. 20 of 2018 concerning Nominations for Members of DPR, Provincial DPRD and Regency / City DPRD. However, the regulation was canceled with the issuance of Supreme Court decision No. 46 P / HUM / 2018. Based on this, the limitation of the problem of this research is how to measure the aspects of the legal objectives behind the decision No. 46 P / HUM / 2018 which are more pro-corrupt so that they can understand the judge's decidendi ratio in canceling the prohibition of ex-convicts from becoming legislators. This type of research is normative legal research with a statutory approach and conceptual approach. The theoretical basis in the presentation of research results is the theory of legal goals by Gustav Radbruch namely justice, certainty and usefulness which is compared with Islamic law. The results of this study indicate that the Supreme Court's consideration overturned PKPU No. 20 of 2018 because it is considered contrary to Article 240 of Law No. 7 of 2017 concerning General Elections and Article 12 of Law No. 12 of 2011 concerning Formation of Laws and Regulations. The Supreme Court's considerations in the a quo ruling contain the three legal objectives. However, it is more inclined to legal certainty, so it does not reflect the value of justice that lives in the community. The cause of not achieving the values of justice that live in the community in the a quo decision is because the basis for testing the regulation is Law No. 7 of 2017 concerning General Elections does not prohibit such matters, even though the nomination rules on the executive body namely the President and Vice President require that they do not have a bad track record. Likewise when viewed from Islamic law which requires legislative candidates called ahlul ahli wal aqdi must have a fair way which means having integrity and a good image in the society.

This thesis addressed the issue of election criminal law enforcement in the era of simultaneous general election in 2019. Based on data released by The General Election Supervisory Agency (Bawaslu) there were 2,724 reports and findings of alleged violations of election crimes, which continued with the investigation of 582 cases, closed at the investigation stage there were 132 cases, then closed at prosecuting 41 cases, and ajudicated by the court in 319 cases. Meanwhile, based on the Indonesian Legal Roundtable (ILR) data from the whole cases in electoral crime, 170 cases or 53% were sentenced to conditional or probation. The method of this research is used normative legal research methods (normative juridical). Data research compiled based on suited laws and regulations through statutory approach, case approach, historical approach, comparative approach, and conceptual approach. Furthermore, normatively the data is analyzed based on applicable regulations as positive legal norms by interpreting and constructing statements contained in documents and applicable laws. The results of this study are to reveal and analyze the law enforcement applied in handling election crimes that occurred in simultaneous general elections in 2019. Analyzing the formulation of criminal law in tackling more effective general election crimes for the future through the formulation definite regulations, fair, not multi-interpreted and attend to all parties in equal rights of each individual before the law in order to establish a general election which honest and fair as well as legitimate

This research is intended to discuss the relevance of the application of presidential threshold and the implementation of simultaneous general elections in Indonesia. The concept of simultaneous general elections is the implementation of legislative and executive elections which are carried out simultaneously. The implementation of the first simultaneous general elections in Indonesia was motivated by a request for a judicial review of Law Number 42 Year 2008 concerning the Election of the President and Vice President. The Constitutional Court issued the Constitutional Court Decision Number 14/PUU-IX/2013 with the decision granting part of the request which later gave birth to the implementation of simultaneous elections in Indonesia starting in 2019. However, from the various articles that were reviewed, there was one article that was not decided by the Constitutional Court, namely regarding the presidential threshold. The Constitutional Court is of the opinion that the regulation regarding the presidential threshold is an open legal policy for the legislature. This paper is a normative legal research, with conceptual approach and statute approach to find answers to existing problems. The research source used is secondary data consisting of primary legal materials and secondary legal materials as explanation for primary legal materials. From the results of this research, it was found that the simultaneous elections and the presidential threshold were not compatible. On the one hand, the presidential threshold aims to simplify the number of parties.

Throughout its history, Indonesia has held general elections many times from 1955 to 2019. During that long period of time, Indonesia implemented a different electoral system at each election. The arrangement of the electoral system in Indonesia always changes from time to time in each election administration. In the process of changing the laws and the regulations for every election, there has always been legal political dynamics. After the 2014 elections, there have been changes regarding the conduct of elections in Indonesia. The Constitutional Court (MK) granted the petition for a judicial review of Law Number 42 of 2008 concerning the Election of President and Vice President in 2014, so that the implementation of elections in Indonesia entered a new phase in 2019 and beyond. In 2019, for the first time Indonesia held simultaneous elections. The methodology used in this study is normative. The approaches used in this study are the historical approach, the statute approach, the legal analysis approach, and the conceptual approach. Legal arrangements regarding the conduct of elections always change, starting from the highest level of legislative regulations to the lowest (from the laws to the General Election Commission regulations, presidential decrees, ministerial regulations, or other regulations). The changes in the regulations regarding the implementation of elections in Indonesia have been present since the time of the 1955 elections until the 2019 elections. Since the implementation of the 1955 elections, Indonesia has always practiced a proportional electoral system, the electoral system that is considered suitable to be applied in Indonesia. This proportional electoral system is practiced with various modifications (both the open proportional electoral system and the closed proportional system). There are even district elements in the proportional electoral system in Indonesia, for example there are electoral districts that can be equated with districts in the district electoral system. The practice of the electoral system to be used in the elections in Indonesia is almost always subject to debate, both among constitutional law intellectuals and politics.

Decision of the Constitutional Court Number 14 / PUU-XI / 2013 in the test case of Law Number 42 of 2008 concerning General Elections of the President and Vice President whose decisions are final states that the holding of the 2019 General Elections and subsequent General Elections shall be held simultaneously. The holding of a simultaneous General Election in 2019 will certainly bring political impacts, both nationally and regionally. The birth of Law No. 7 of 2017 concerning General Elections has had a major impact and challenge for the Indonesian people in improving the electoral system and the implementation of better democracy. The purpose of this study is to find out how to realize political education for voters ahead of the 2019 simultaneous elections. This study is a juridical normative approach to legislation. From the results of the study there is a legal vacuum that requires the General Election Commission to conduct Socialization, Voter Education, and Community Participation in the 2019 Elections. The resulting conclusion is that political education for voters ahead of the 2019 concurrent elections is very important to carry out, as an effort to realize the Sovereignty of a Strong State. The resulting recommendation is to make a legal rule regarding the obligation to carry out political education for voters ahead of the 2019 simultaneous elections in an effort to realize the Strong Sovereign State Voters in the 2019 Election along with the threat of sanctions for election administrators in an Act intensifying political education for voters ahead of the Election in an effort to realize voters sovereignty in the next general election along with the existence of technical rules regarding sanctions for election administrators in a law. Abstrak Implikasi putusan mahkamah konstitusi terkait penggunaan KTP dan paspor dalam pemilihan presiden dan wakil presiden dalam kerangka menjamin hak memilih dalam pemilihan umum. Terkait dengan ini maka memunculkan permasalahan terkait implikasinya. Bagaimana implikasi baik secara langsung maupun tidak langsung putusan Mahkamah Konstitusi terkait penggunaan KTP dan Paspor dalam pemilihan umum. Mahkamah Konstitusi sebagai lembaga pelaksana kekuasaan kehakiman yang salah satu kewenangannya adalah menguji Undang-Undang terhadap UUD Negara Republik Indonesia Tahun 1945 dalam rangka mewujudkan negara demokrasi yang berdasarkan hukum sebagaimana termaktub dalam Pasal 1 UUD Negara Republik Indonesia Tahun 1945. Hasilnya adalah implikasi langsung yang terdiri dari penerapan KTP dan Paspor sebagai ganti DPT, Memunculkan putusan yang bersifat self executing, mengesampingkan Peraturan Pemerintah Pengganti Undang-undang, mengesampingkan keputusan dan peraturan KPU terkait aturan baru akibat putusan MK dan Implikasi tidak langsung yang terdiri dari Mengurangi terjadinya perselisihan hasil Pemilihan Umum Presiden, KPU bekerja ekstra. Tujuan ke depan penelitian ini adalah untuk mengetahui dan memberikan sumbangsih dalam dunia akademik terutama terkait tentang penjaminan hak asasi manusia terutama hak memilih dalam pemilihan presiden dan wakil presiden. Penelitian ini menggunakan metode kajian peraturan perundang-undangan yang sesuai dengan metode ilmu hukum. Kata Kunci: Putusan Mahkamah Konstitusi, Pemilu, Kartu Tanda Penduduk Abstract The implications of the constitutional court's decision regarding the use of resident identity cards and passports in the election of president and vice president in the framework of guaranteeing the right to vote in general elections. Related to this, problems arise regarding their implications. What are the implications of either directly or indirectly the decision of the Constitutional Court regarding the use of Identity Cards and Passports in general elections. The Constitutional Court as the executing agency of judicial power whose authority is to examine the Law against the State Constitution of the Republic of Indonesia of 1945 in order to realize a democratic state based on law as stipulated in Article 1 of the Constitution of the Republic of Indonesia of 1945. The result is implications directly consisting of the application of Identity Cards and Passports in lieu of the Permanent Voters List, Raising decisions that are self-executing, overriding Government Regulations Substituting the Law, overriding the decisions and regulations of the General Election Commission regarding new rules due to the Constitutional Court ruling and indirect implications consisting of Reducing the disputes over the results of the Presidential General Election, the Election Commission works extra. The future goal of this research is to know and contribute in the academic world, especially related to guaranteeing human rights, especially the right to vote in the presidential and vice presidential elections. Election or local election is a way of channeling the rights of every principle community, which means that the right to vote and vote is contained in his constitutional rights as citizens. In article 28 letter D of the Republic of Indonesia Republic of 1945 which reads that "every citizen has the right to have the same opportunity in government". The sound contained in the article contains the understanding that the State guarantees each of its citizens to obtain the rights to sit in government either as People's Representatives, regents, Mayors, Governors, or even become a President. The method used in this study is normative juridical legal research which uses a statutory approach. The issue raised by the author is How the Human Rights Perspective of Legislative Candidates in Organizing Elections and How Comparative Legal Arrangements for Former Legislative Candidates Examined From Law Number 7 of 2017 Concerning General Elections With Regulation of the Election Commission Number 20 of 2018 Regarding Nominating Members Regional Representative Council, Provincial Regional Representative Council, Regency / City Representative Council. In terms of the implementation of elections need to be held honestly, fairly and democratically based on the spirit of Democracy that has been carried out so far so as to create leaders and representatives of the people who side with their people. Speaking of Human Rights, everyone has the same rights before the State and applies to former corruption convicts who have or have the same political rights as other citizens guaranteed by the constitution.

Nepali Congress (NC) is one of the oldest political party of Nepal. It played a vital role to abolish the century long autocratic Rana rule in 1951. It fought against the party-less Panchayat system and the regressive step of the king. It opposes active kingship and communism. It believes in a representative democracy. It has participated in every election of Nepal that was conducted democratically. It won more than two-thirds majority seats in the first general election held in 1959. In every election, it stayed in the first or second position. This article tries to analyze the status of NC in the elections of Nepal. Data of seven general elections were examined in this article. Data were extracted basically from the reports of the Election Commission.

The aim of this paper is to analyze the regulation of general election of President and vice President in Indonesia. The method used is the normative juridical, with the history approach. Based on  results that the Election of President and Vice President in Indonesia changes from time to time, from the period 1945-1950 President and Vice President elected by PPKI by acclamation. The period 1950-1959 elected by agreement between the state of RIS and RI. After the 1959 period until now, the President and Vice President were elected by the people through general elections.
