E-commerce transaction as a trade transaction contract between sellers and buyers using the internet media provide convenience for both consumers and businesses, but these transactions also have some weaknesses that can lead to legal problems. This research discusses issues regarding the validity of the agreement related to e-commerce transactions and the law enforcement efforts in resolving e-commerce transaction disputes. This research uses a normative research method with a statute and conceptual approach. The collection of legal materials is carried out using the literature study method which is then systematically compiled and analyzed using the described method. The validity of the agreement is related to e-commerce transactions if it meets Article 1320 of the Civil Code, including the agreement of those who bound themselves, the ability to make an agreement, the existence of a certain matter, and the existence of a halal cause. Law enforcement efforts in resolving e-commerce transaction disputes are carried out preventively through legislation and repressive measures through litigation and non-litigation channels such as through arbitration, consultation, mediation, conciliation, or expert judgment. In addition, it can also be resolved through BPSK, LPKSM, and the Directorate of Consumer Protection.

AbstractPornography has become a material for sale and purchase transactions. Pornographic transactions on the internet have many processes , so that there are many laws and regulations that can be applied. This creates legal uncertainty. The formulation of the problem in this research is the qualification of criminal acts related to pornography selling and buying transactions on the internet media and the accountability of criminals in selling and buying pornography on the internet media. The research method used is legal research through a conceptual approach and a statutory approach to assess existing legal problems. The results of this study show that the sale and purchase of pornography via the internet can be applied to the ITE and pornography laws. Then the responsibility depends on the evidence in the process of proving in court what the form of pornography is.Keywords: Criminal Liability; Transactions; Buying and Selling; Pornography; Internet.AbstrakPornografi sudah menjadi bahan yang di transaksi jualbelikan. Transaksi pornografi di media internet memiliki banyak proses seperti penawaran, kesepakatan, penyerahan barang, dan pembayaran sehingga terdapat banyak peraturan perundang-undangan yang dapat diterapkan. Hal ini membuat ketidak pastian hukum. Rumusan masalah dalam penelitian ini adalah Kualifikasi tindak pidana terkait transaksi jualbeli pornografi di media internet dan pertanggungjawaban pelaku tindak pidana dalam transaksi jualbeli pornografi di media internet. Metode penelitian yang digunakan adalah legal research dengan melalui pendekatan konseptual dan pendekatan peraturan perundang-undangan untuk mengkaji permasalahan hukum yang ada. Hasil dari penelitian tersebut diketahui bahwa transaksi jualbeli pornografi melalui internet dapat diterapkan Undang-Undang ITE dan Pornografi. kemudian pertanggungjawabannya tergantung dari pembuktian dalam proses pembuktian di dalam persidangan apakah bentuk dari pornografi tersebut.Kata Kunci: Pertanggungjawaban Pidana; Transaksi; Jual Beli, Pornografi; Internet.

Abstract-This trade activity by utilizing internet media is known as electronic commerce, or abbreviated as e-commerce. Regarding the relevance of existing legislation with the need for regulations in buying and selling transactions through internet media, especially the seller's responsibility. The formulation of the problem in this writing is how the legal protection for the parties in the sale and purchase agreement through the internet media and how the seller's responsibility in the sale and purchase agreement based on article 1320 of the Civil Code. The author uses the type of normative legal research and the problem approach used is the basis of the conceptual approach and legislation. The agreement needed to give birth to an agreement mandated in Article 1320 of the Civil Code is considered to have been reached if the statement of one party was received by the other party. In summary, an agreement is considered to have taken place when one of the parties agreed. The government should provide more stringent supervision for the parties who carry out this electronic transaction, namely by conducting a registration of all activities involving public interest in electronic traffic. Berkaitan dengan relevansi peraturan perundang–undangan yang sudah ada dengan kebutuhan akan peraturan dalam transaksi jual beli melalui media internet terutama pertanggungjawaban penjual. Rumusan masalah dalam penulisan ini adalah bagaimana perlindungan hukum bagi para pihak dalam perjanjian jual beli melalui media internet dan Bagaimana tanggung jawab penjual dalam perjanjian jual beli barang berdasarkan pasal 1320 KUH Perdata. Penulis menggunakan tipe penelitian hukum normative dan pendekatan masalah yang digunakan adalah dasar pendekatan konseptual dan Peraturan perundang-undangan. Persetujuan antara kedua orang yang menjalin suatu hubungan keperdataan di anggap telah sah apabila keduanya setuju. Ringkasnya, suatu perjanjian dianggap telah terjadi pada saat salah satu pihak menyatakan sepakat. Pemerintah seyogyanya memberikan pengawasan yang lebih ketat lagi bagi para pihak yang melakukan transaksi elektronik ini yaitu dengan jalan melakukan suatu pendaftaran terhadap segala kegiatan yang menyangkut kepentingan umum didalam lalu lintas elektronik. Adanya ketidakseimbangan dalam penggunaan perjanjian baku dalam perjanjian sewa beli kendaraan bermotor pada perusahaan pembiayaan di Kota Banda Aceh memberi perlindungan hak kepada penjual daripada pembeli, sehingga lebih banyak risiko kerugian yang harus dipikul oleh pembeli. Pokok permasalahan dalam artikel ini adalah apakah klausula baku dalam perjanjian sewa beli kendaraan bermotor pada perusahaan pembiayaan melanggar ketentuan peraturan perundang-undangan tentang perlindungan konsumen. Jenis metode penelitian yang digunakan dalam artikel ini adalah jenis metode penelitian hukum normatif. Pendekatan penelitian hukum yang digunakan dalam artikel ini terdiri dari, pendekatan peraturan perundang-undangan, pendekatan kasus, dan pendekatan konseptual. Hasil penelitian menunjukkan bahwa perjanjian baku pada perusahaan pembiayaan PT ADMF bertentangan dengan ketentuan KUH Perdata, khususnya dalam Pasal 1266, Pasal 1267, Pasal 1337, Pasal 1338 ayat (1), ayat (2), dan ayat (3), Pasal 1339 KUH Perdata, dan juga bertentangan dengan ketentuan UUPK, khususnya dalam Pasal 4, Pasal 7, Pasal 18 ayat (1), dan ayat (2) UUPK. Oleh karena itu, penggunaan perjanjian baku dalam perjanjian sewa beli kendaraan bermotor pada perusahaan pembiayaan harus ditinjau dan disesuaikan agar tidak bertentangan dengan ketentuan undang-undang.  Standard Agreement in The Hir-Purchase Agreement for the Motor Vehicles in a Finance Company in Banda Aceh  The existence of an imbalance in the use of standard agreement in the hire-purchase agreement for motor vehicles in a finance company in Banda Aceh gives protection to the seller rather than the buyer, thus more risk of loss to be borne by the buyer. The main issue in this article is whether the standard clause in the hire purchase agreement of motor vehicles in the finance company violates the provisions of legislation on consumer protection. The research method used in this article was the normative legal research method. The legal research approaches used in this article consist of, statutory approach, case approach and conceptual approach. The results showed that the standard agreements used by PT ADMF was contradictory to the provisions of the Civil Code, particularly in Article 1266, Article 1267, Article 1337, Article 1338 Paragraph (1), Paragraph (2), and Paragraph (3), Article 1339 Civil Code, and also contrary to the provisions of UUPK, particularly in Article 4, Article 7, and Article 18 paragraph (1) and paragraph (2) UUPK. Therefore, the standard agreements in the hire-purchase agreement of motor vehicles in the finance company should be reviewed and adjusted so as not violates the provisions of legislation.

Medicines must have halal certification to ensure the halalness of the product. Article 4 of the Law on Halal Product Guarantee, stipulates that all products circulating in Indonesia must be certified halal. In fact, many medicinal products are already circulating in the community but do not yet have a halal certificate. So this raises legal problems related to consumer protection. The purpose of this research is to reveal the authority of related institutions in halal certification of medicinal products circulating in Indonesia as well as legal protection for consumers if a medicinal product that has been disseminated has a halal label even though it does not have a halal label. This study uses a normative legal research method with a conceptual approach and legislation. The source of legal material in this study is the primary and secondary legal materials. The technique of collecting legal materials by analyzing and quoting applicable laws from books, literature, and other sources. The results showed that with the establishment of the Halal Product Guarantee Organizer, the halal regulation of drugs circulating in Indonesia is subject to the Halal Product Guarantee Law No. 33 of 2014 which regulates that certification and labeling of halal products is mandatory. If business actors violate their obligations under these regulations, they will be subject to administrative sanctions in the form of written warnings, administrative fines, and suspension of halal certification.

Rampant and rampant crime against children on social media, resulting in increasingly restless and worried every parent, especially trafficking child prostitution, and carried out using the internet media. This online prostitution also spreads the contents of child pornography, whether done by the perpetrators themselves, a group of people or even corporations. The aim is to find out how to deal with civil society in dealing with child crimes through online prostitution, the ways that civil society do in eradicating crimes or criminal acts that occur in the environment or civil society life so that they are always vigilant, cautious and not easily trapped in criminal acts or crimes that occur in social medial that is by using social media namely through the internet, or facebook, instagram and so forth. While the research method used is normative research that is by examining and processing theories or in existing concepts and regulations and even legislation that is considered relevant and related to this research, in this case cannot be separated by using books or literature which exists. The results of this finding are various mitigation efforts that can be carried out by civil society in responding to criminal acts related to online prostitution of children, namely by carrying out various measures which are also called preventive, repressive, persuasive, curative and rehabilitation, considered to be able to reduce prostitution crime. existing children on social media, accompanied by a mindset which is advanced modern and supervision from the community and law enforcement which exist.

Credit agreements are usually accompanied by a collateral agreement and an insurance agreement. This insurance agreement is a means of transferring risk for the bank, especially life insurance in the event of a debtor's death, besides credit can also fall to the heirs if the debtor dies before paying off the remaining credit. This study aims to analyze the legal consequences of the Bank's Credit Agreement in the event that the Debtor dies and to find out the responsibility of the Insurance Party for the Bank's Credit Agreement in the event the Debtor dies. This study uses a normative research method with a statutory approach and a conceptual approach. The results show that the legal consequence of the credit agreement in the event that the debtor dies, there are two possibilities, namely that the credit goes to the heirs as regulated in article 833 of the Civil Code (Burgerlijk Wetboek) or the guarantee is executed by the bank, and the second possibility is that the credit is written off due to a life insurance clause or a life insurance agreement with a banker's clause, which means that the insurance company must be responsible for paying off the remaining debts of the debtor who died according to the terms and conditions of the policy, otherwise the interested party can file a summons to sue the insurance company. From this, the conclusion is that the parties must fully understand the contents of the credit agreement made, so that later if this risk occurs, there will be clarity on the payment of the debtor's remaining debt.

Legal protection for consumers in an electronic commerce transaction in Indonesia is crucial for the development of the society’s economy. The aim of this research is to know how is the legal protection for online transaction users is in Indonesia. The method of study is the juridicial-normative method. The data collection is done through literature study. The research results show that the legal protection in the Electronic Transaction Agreement in Indonesia is regulated in Articles 47 and 48 of the Governmental Decree, No. 82 of 2012 regarding the Establishment of the Electronic System and Transaction. Legal protection for the society is written in Article 46 of the Constitution No. 11 of 2008 regarding Electronic Information and Transaction and Article 62 of the Constitution No. 8 of 1999 regarding Consumer Protection. Legal protection towards consumers in electronic transaction in Indonesia is regulated strictly both in the aspects of criminal and civil laws. AbstractThe trend of the spread of Coronavirus (Covid)-19 which continues to soar has an impact on society for health, peace and safety of the soul.  Public awareness and compliance with laws and regulations and the government's call for a Large-Scale Social Restrictions (PSBB) policy are important not to be violated or ignored.  The application of criminal sanctions for fines is an alternative sanction in law enforcement so that people are deterred, educated and as a means of government social control. The research method is normative juridical supported by empirical research using secondary data in the form of books, legislation and the internet. Type of qualitative research. One of the duties of the judge was to settle the case to sentence the perpetrators of the crime by saying that the defendant was acquitted or convicted based on at least 2 evidence and the judge based on the evidence was convinced that the error violated the article charged. The judge has the freedom to impose a sentence against the defendant who is not only fundamental to the provisions of the Law but also the judge can explore the values of law and justice in society. In the current practice, many judges have ruled below the minimum criminal provisions contained in an article as in the case of narcotics in this study. This cannot be blamed because the judge has the authority and freedom to make a decision, but this will certainly make legal certainty impossible. Legal problems in this research are how the authority of judges against the existence of a minimum punishment provision in narcotics crime and what constitutes the objective is stipulated by minimum punishment provisions. The research method taken is a normative juridical method, research data obtained through literature study and retrieval of decision files as a supplement. the results of the study show that judges may just make a decision under the minimum criminal provisions because the judge not only has to pay attention to legal certainty but also the purpose of other laws is to provide justice.

The heirs whose whereabouts cannot be determined are the heirs who have lost the news, so it is not known whether he is alive or dead. These are usually called missing persons. However, in fact, a lot of heirs ignore the inheritance rights of an heir whose existence cannot be determined. Based on this background, this research was conducted with the aim of elaborating the arrangement of inheritance rights for heirs whose existence cannot be determined and the legal consequences for heirs whose existence is known after the inheritance is divided. This study used a normative legal research method with a statutory and conceptual approach. The results of this study showed that the existence of inheritance rights for heirs that cannot be determined is regulated in Article 463 of the Civil Code. The inheritance rights of heirs whose existence cannot be determined remain attached to it in accordance with the provisions of Article 467 of the Civil Code. However, as long as the whereabouts of the heir are not known, the position will be replaced by the successor heirs. Furthermore, as a legal consequence after an heir is known to exist, the replacement heir is obliged to return all the inherited assets received under the provisions of Article 482 paragraph (1) of the Civil Code.
