The heirs whose whereabouts cannot be determined are the heirs who have lost the news, so it is not known whether he is alive or dead. These are usually called missing persons. However, in fact, a lot of heirs ignore the inheritance rights of an heir whose existence cannot be determined. Based on this background, this research was conducted with the aim of elaborating the arrangement of inheritance rights for heirs whose existence cannot be determined and the legal consequences for heirs whose existence is known after the inheritance is divided. This study used a normative legal research method with a statutory and conceptual approach. The results of this study showed that the existence of inheritance rights for heirs that cannot be determined is regulated in Article 463 of the Civil Code. The inheritance rights of heirs whose existence cannot be determined remain attached to it in accordance with the provisions of Article 467 of the Civil Code. However, as long as the whereabouts of the heir are not known, the position will be replaced by the successor heirs. Furthermore, as a legal consequence after an heir is known to exist, the replacement heir is obliged to return all the inherited assets received under the provisions of Article 482 paragraph (1) of the Civil Code.

Credit agreements are usually accompanied by a collateral agreement and an insurance agreement. This insurance agreement is a means of transferring risk for the bank, especially life insurance in the event of a debtor's death, besides credit can also fall to the heirs if the debtor dies before paying off the remaining credit. This study aims to analyze the legal consequences of the Bank's Credit Agreement in the event that the Debtor dies and to find out the responsibility of the Insurance Party for the Bank's Credit Agreement in the event the Debtor dies. This study uses a normative research method with a statutory approach and a conceptual approach. The results show that the legal consequence of the credit agreement in the event that the debtor dies, there are two possibilities, namely that the credit goes to the heirs as regulated in article 833 of the Civil Code (Burgerlijk Wetboek) or the guarantee is executed by the bank, and the second possibility is that the credit is written off due to a life insurance clause or a life insurance agreement with a banker's clause, which means that the insurance company must be responsible for paying off the remaining debts of the debtor who died according to the terms and conditions of the policy, otherwise the interested party can file a summons to sue the insurance company. From this, the conclusion is that the parties must fully understand the contents of the credit agreement made, so that later if this risk occurs, there will be clarity on the payment of the debtor's remaining debt.

One of the legal products made by notary as a part of their authorities is a deed, both authentic deeds and underhand-made deeds. In addition to these deeds, a notary also has the authority to issue a certificate which is commonly referred to as a covernote. A certificate or covernote is a statement or note in the form of information confirming that a land ownership deed is in the process of a certificate making that is due to a process of roya, transfer of name of land ownership and splitting of one certificate into two. This study examines two issues related to notary authority, namely the basis for the notary’s authority in issuing a covernote and the legal consequences of making the covernote. This study uses a normative legal research method and a conceptual approach as well as a statutory approach. The results showed that the covernote issued by a notary was actually an ordinary certificate, not a legal product of a notary. Covernote only contains an explanation of the deed that is in the process of certification which has not been completed and will be completed within a period determined by the notary itself, so the covernote is not legally binding. The notary is authorized to make a covernote, but it is not regulated in the laws and regulations so that, if it is concluded, the covernote is not a legal product of a notary. The legal consequences for the notary if they fail to carry out the covernote, they can be held liable to solve them immediately. The legal consequence of not fulfilling the contents of the covernote is a violation of Article 1366 of the Criminal Code because notaries are considered negligent in carrying out their duties and authorities.

This study aims to determine how the arrangements for the unilateral termination of the contract/agreement and what are the legal consequences arising from the unilateral termination of the contract. The research method used is normative juridical. The approach used in this research is the statute approach and the case approach, and the conceptual approach. The conclusion of the research results is that; contract termination arrangements and legal consequences are regulated in Articles 1266, 1267, 1243 and 1365 of the Civil Code. The conditions for an agreement to be canceled unilaterally are that the agreement must be reciprocal, there is default, and the cancellation must be requested from the judge. Unilateral termination of the agreement due to default without going through the court is an act against the law. The legal consequence of the unilateral termination of the agreement due to default is a claim for compensation from the party who feels aggrieved. The Civil Code does not explicitly regulate the differentiation of compensation as a result of default with compensation as a result of an act against the law. Based on the research results, it is found that compensation as a result of default is compensation in the form of material, while compensation for an illegal act is compensation in the form of material and immaterial. It is hoped that in the future there will be clear regulations regarding compensation as a result of default and compensation as a result of acts against the law.

Adanya ketidakseimbangan dalam penggunaan perjanjian baku dalam perjanjian sewa beli kendaraan bermotor pada perusahaan pembiayaan di Kota Banda Aceh memberi perlindungan hak kepada penjual daripada pembeli, sehingga lebih banyak risiko kerugian yang harus dipikul oleh pembeli. Pokok permasalahan dalam artikel ini adalah apakah klausula baku dalam perjanjian sewa beli kendaraan bermotor pada perusahaan pembiayaan melanggar ketentuan peraturan perundang-undangan tentang perlindungan konsumen. Jenis metode penelitian yang digunakan dalam artikel ini adalah jenis metode penelitian hukum normatif. Pendekatan penelitian hukum yang digunakan dalam artikel ini terdiri dari, pendekatan peraturan perundang-undangan, pendekatan kasus, dan pendekatan konseptual. Hasil penelitian menunjukkan bahwa perjanjian baku pada perusahaan pembiayaan PT ADMF bertentangan dengan ketentuan KUH Perdata, khususnya dalam Pasal 1266, Pasal 1267, Pasal 1337, Pasal 1338 ayat (1), ayat (2), dan ayat (3), Pasal 1339 KUH Perdata, dan juga bertentangan dengan ketentuan UUPK, khususnya dalam Pasal 4, Pasal 7, Pasal 18 ayat (1), dan ayat (2) UUPK. Oleh karena itu, penggunaan perjanjian baku dalam perjanjian sewa beli kendaraan bermotor pada perusahaan pembiayaan harus ditinjau dan disesuaikan agar tidak bertentangan dengan ketentuan undang-undang.  Standard Agreement in The Hir-Purchase Agreement for the Motor Vehicles in a Finance Company in Banda Aceh  The existence of an imbalance in the use of standard agreement in the hire-purchase agreement for motor vehicles in a finance company in Banda Aceh gives protection to the seller rather than the buyer, thus more risk of loss to be borne by the buyer. The main issue in this article is whether the standard clause in the hire purchase agreement of motor vehicles in the finance company violates the provisions of legislation on consumer protection. The research method used in this article was the normative legal research method. The legal research approaches used in this article consist of, statutory approach, case approach and conceptual approach. The results showed that the standard agreements used by PT ADMF was contradictory to the provisions of the Civil Code, particularly in Article 1266, Article 1267, Article 1337, Article 1338 Paragraph (1), Paragraph (2), and Paragraph (3), Article 1339 Civil Code, and also contrary to the provisions of UUPK, particularly in Article 4, Article 7, and Article 18 paragraph (1) and paragraph (2) UUPK. Therefore, the standard agreements in the hire-purchase agreement of motor vehicles in the finance company should be reviewed and adjusted so as not violates the provisions of legislation.

The relationship between the ruler and the land is closely related to obligations in the form of ayahan for village karma for both the banjar and the village. This study aims to determine the control of village coral and the legal consequences if there is village karma that neglects its obligations. The research method used in this research is empirical legal research with a conceptual approach. Data that has been collected through interview techniques. The results of this study indicate that the right for village krama who has carried out their obligations is to legally obtain Karang Desa land protected by the village. If Krama Desa dies, he will receive land. Meanwhile, the obligation of the village manners who occupy the village reef is obliged to take part in the village temple during the odalan fee in the form of pepesan money (klangsah palpalan penjor) and must be present at the time of mutual cooperation activities. Through this research, it is hoped that the village officers will socialize more often about Karang Desa, especially regarding their rights and obligations so that one day the Krama Desa who violates them will not be given sanctions.

This research is conducted to find out and analyse the implementation of criminal law in motive element of planed murder perpetrator as well as to find out and analyse the vindication of motive of planed murder perpertator by applying normative legal research method. Aimed to analyze the implementation of positive law norms under statute, case and historical, comparative and conceptual approach. Research result shown that implementation of Article 340 KUHP depends on judge’s point of view poured in his legal considerations. The point of view can be Monistic where motive is not a significance consideration as long as the crime lead to certain legal consequences or dualistic where motive is important to consider in order to determine perpetrator’s grade of guilt (psychologically) since dualistis point of view differentiate between objective element and subjective element (guilt element). To proof that there is motive element in a planed murder, Judge shall apply vindication principle used in Indonesia’s criminal law procedure according to Article 184 KUHP and law number 48 of 2009 concerning judiciary power.

ABSTRAKPerjanjian informed consent harus dilaksanakan dengan asas itikad baik. Asas ini merupakan asas bahwa para pihak, yaitu pihak kreditur dan debitur harus melaksanakan substansi kontrak berdasarkan kepercayaan atau keyakinan yang teguh maupun kemauan baik dari para pihak. Tulisan ini membahas informed consent Dokter dan Pasien berdasarkan asas Good Faith dan akibat hukum tidak dilaksanakannya informed consent Dokter dan Pasien berdasarkan asas Good Faith. Metode penelitian adalah penelitian hukum normative kajian tentang asas hukum, peneliti mengumpulkan data yang terdiri dari data primer, sekunder dan tertier. Teknik pengumpulan data yaitu wawancara dan kajian kepustakaan. Analisis data dilakukan secara kualitatif serta menarik kesimpulan penulis menggunakan metode berfikir deduktif.Kesimpulan dari penelitian ini adalah Informed consent antara dokter dan pasien harus berdasarkan asas good faith, bagi dokter informed consent memberikan rasa aman dalam menjalankan tindakan medis terhadap pasien. Bagi pasien, informed consent merupakan merupakan perwujudan dari hak pasien dimana pasien berhak mendapatkan informasi tentang penyakit yang dideritanya, tindakan medis apa yang hendak dilakukan, kemungkinan yang akan terjadi atas pengambilan keputusan tindakan medis. Apabila tidak ada informed consent berakibat tidak terpenuhinya salah satu syarat perjanjian menurut Pasal 1320 KUH Perdata, digolongkan sebagai wanprestasi dan digolongkan sebagai perbuatan melawan hukum berdasarkan Pasal 1365 KUHPerdata.Kata kunci: informed consent; good faith; dokter dan pasienABSTRACTAn informed consent agreement must be carried out in good faith. This principle is the principle that the parties, namely the creditors and debtors must carry out the substance of the contract based on the trust or firm belief or goodwill of the parties. This paper discusses the informed consent of Doctors and Patients based on the Good Faith principle and the legal consequences of not implementing the informed consent of Doctors and Patients based on the Good Faith principle. The research method is a normative legal research study of the principle of law, researchers collect data consisting of primary, secondary and tertiary data. Data collection techniques, namely interviews and literature review. Data analysis was carried out qualitatively and drawing conclusions from the author using deductive thinking methods. The conclusion of this study is that informed consent between doctors and patients must be based on the principle of good faith, for physicians informed consent to provide a sense of security in carrying out medical actions against patients. For patients, informed consent is an embodiment of the patient's right where the patient has the right to get information about the disease he is suffering from, what medical action he wants to take, the likelihood that will occur in making a decision on medical action. If no informed consent results in failure to fulfill one of the terms of the agreement under Article 1320 of the Civil Code, it is classified as a default and is classified as unlawful pursuant to Article 1365 of the Civil Code. AbstractNotaries are public officials appointed by the State to carry out the duties of the State in legal services such as making authentic deeds. In carrying out its duties and responsibilities making authentic notarial deeds sometimes make mistakes that affect civil, administrative and criminal sanctions. If seen in Article 16 paragraph (1) letter b of the UUJN that minuta deed must be made and kept as part of the Notary protocol. The purpose of this research is to analyze the importance of a notary to make a certificate of minutes in making a copy of the deed. What is the juridical effect on the deed of minutes not owned by a Notary in making a copy of the deed, then what is the legal consequence for the Notary who did not make the deed of minutes in making a copy of the deed. This legal research is a normative legal research approach that is carried out is the statutory approach and conceptual approach. The legal consequences for the minutes of the deed not possessed by the Notary in making a copy of the deed will cause the deed to be null and void by law because it violates the formal aspects in making the deed and the Notary does not carry out any of the obligations contained in Article 16 paragraph (1) letter b of the UUJN. The legal consequences for the Notary will be given a sanction as a responsibility, namely civil, administrative and criminal sanctions.Keywords: notary obligation, minuta deed, copy deedAbstrakNotaris merupakan pejabat umum yang diangkat oleh Negara untuk melakukan tugas-tugas Negara dalam pelayanan hukum seperti membuat akta otentik. Dalam menjalankan tugas dan tanggung jawabnya  membuat akta otentik notaris terkadang melakukan kesalahan yang berdampak kepada sanksi perdata, aministratif dan pidana. Jika dilihat dalam Pasal 16 ayat (1) huruf b UUJN bahwa minuta akta wajib dibuat dan disimpan sebagai bagian dari protokol Notaris. Tujuan dari penilitian ini adalah untuk menganalisis pentingnya notaris untuk membuat minuta akta dalam pembuatan salinan aktanya. Bagaimana akibat yuridis terhadap minuta akta yang tidak dimiliki Notaris dalam pembuatan salinan aktanya, kemudian apa akibat hukum untuk Notaris yang tidak membuat minuta akta dalam pembuatan salinan aktanya. Penelitian hukum ini merupakan penelitian hukum normatif pendekatan yang dilakukan adalah pendekatan perundang-undangan dan pendekatan konseptual. Akibat hukum untuk minuta akta yang tidak dimiliki Notaris dalam pembuatan salinan aktanya akan menyebabkan akta tersebut batal demi hukum sebab melanggar aspek formil dalam pembuatan akta dan Notaris tidak melaksanakan salah satu kewajibannya yang ada di dalam Pasal 16 ayat (1) huruf b UUJN. Akibat hukum bagi Notaris nantinya akan diberikan  sanksi sebagai pertanggungjawabannya yaitu sanksi perdata, administratif dan pidana.Kata kunci: kewajiban notaris, minuta akta, salinan akta

Electronic transaction agreement between PT. Juang Abadi Alam with Australian Rural Exports Pty. Ltd in the perspective of the ITE Law is legal and has consequences. In another perspective, Article 1320 of the Civil Code sees that an agreement will be valid when two conditions are fulfilled, namely subjective and objective conditions. The focus of this study is related to the validity of the digital signature (scanner) of an agreement in the perspective of civil law as well as the legal consequences of the agreement carried out online / electronically when one party defaults/breach of contract. The legal research method used in this study is normative juridical.The results of this study showed that the process of electronic commerce transactions (e-commerce) is carried out with 4 stages of the agreement theory namely supply, acceptance, payment and delivery. The validity of agreement with digital signatures in the perspective of civil law is referring to the National Electronic Transaction Information law and Government Regulations as implementing regulations of Electronic Transactions, which are associated with the principles of agreement in the Civil Code. In addition, the legal consequences of an agreement made online/electronically when one of the parties to the default/breach of contract is that a cancellation of the agreement can be requested from the judge as a legal consequence or the legal consequences of the contract in the sale and purchase agreement of goods online.

This study aims to find out about the legality of the inauguration of cyber-based notary deeds through the Zoom Conference media and the legal consequences of notarial deeds inaugurating the Zoom Conference media. The research method used is normative legal research methods that use a statutory approach and analysis of legal concepts based on primary and secondary legal materials. The study result show that according to Article 1868 of the Civil Code stipulates that the making of an authentic deeds is made is the presence of an authorized public official. Homeever, when referring to the explanation of Article 15 paragraph (3) of Law Number 2 of 2014 concerning the Position of Notary Public, there is no clarity regarding the explanation regarding electronic certification (cyber notary) whether tappers must remain physically present in front of a notary or may not ignore it virtually. Regarding the inauguration of deeds through the Zoom Conference media, its is necessary to have clearer regulations regarding the concept of cyber notary in the world of notary so that notaries can carry out their duties without violating laws and regulations. The concept of cyber notary, in the inauguration of the deed, it is felt that there is a need for regulations that clearly regulate how the terms or conditions in the inauguration of authentic deeds/notaries are carried out using the concept of cyber notary, one of which is the Zoom Cenference media.   Studi ini bertujuan untuk mengetahui mengenai legalitas peresmian akta Notaris berbasis cyber notary melalui media Konferensi Zoom dan akibat hukum peresmian akta otaris dilakukan dengan media Konferensi Zoom. Metode penelitian yang digunakan yaitu dengan metode penelitian hukum normatif yang menggunakan pendekatan perundang-undangan serta analisis konsep hukum dengan bersumber pada bahan-bahan hukum primer maupun sekunder. Hasil studi menunjukan bahwa menurut Pasal 1868 KUHPerdata menentukan mengenai pembuatan akta otentik tersebut dibuat dihadapan pejabat umum yang berwenang. Tetapi apabila merujuk terhadap penjelasan Pasal 15 ayat (3) Undang-Undang Nomor 2 Tahun 2014 Tentang Jabatan Notaris tidak ada kejelasan mengenai penjelasan mengenai sertifikasi elektronik (cyber notary) apakah para penghadap harus tetap hadir secara fisik dihadapan notaris ataukah boleh tidak melaikan secara virtual. Terkait dengan peresmian akta melalui media Konferensi Zoom maka diperlukan adanya pengaturan lebih jelas mengenai konsep cyber notary dalam dunia kenotariatan agar notaris dapat menjalankan tugas jabatannya tanpa menyalahi undang-undang dan peraturan perundang-undangan. Konsep cyber notary ini dalam peresmian akta dirasa perlunya ada pengaturan yang mengatur dengan jelas bagaimana ketentuan atau syarat dalam peresmian akta autentik/notaris yang dilakukan dengan menggunakan konsep cyber notary salah satunya adalah media Konferensi Zoom.
