Reforms, in view of a comparative party-state model, become the instruments of self-reproduction and self-destruction of party-state power. The specific patterns of power distribution imply different development and transformation paths through different instruments of self-reproduction. This approach also points to the structural and dynamic background of the differences in the location, sequence, speed and political conditions of reforms during the operation and transformation of party-states. In view of the model the paper points to the inconsistencies that emerge in the comparative reform literature concerning the evaluation and strategies of reforms disconnected from their systemic-structural context.

The article analyzes the results of the state policy implementation withing the formation and development of the Soviet judicial system on the example of Smolensk Governoral Court. The authors set the goal, based on the analysis of sources not introduced into a wide scientific circulation, primarily stored at the State Archive of the Smolensk Region to restore the history of the creation and operation of justice institutions in the Smolensk region in the 1918s–1923s. The source base of the study was composed of documents stored at Smolensk State Regional Archive, materials on the history of the judiciary, statistical materials of the period under the study, documents on the history of the party-state bodies of the Smolensk region. The article studies current office documentation of both the higher and regional state bodies (Workers 'and Peasants' Government, People's Commissariat of Justice, Smolensk Governoral Executive Committee) and local authorities (Smolensk Council of Working People's Deputies, Executive Committee of Smolensk Governoral Council of Workers, Peasants' and Red Army Deputies), as well as Smolensk Governoral Court. The authors analyze the Soviet experience in the formation and development of judicial bodies under specific historical conditions; they consider transformations in the judicial system of the Smolensk Governorate in the 1917s–1922s, as well as the formation of Smolensk Governoral Court. The article studies legal foundations of the Soviet judicial system formation, characterizes processes of creating a judicial apparatus in the first years of Soviet power and analyzes activities of Smolensk Governoral Court during its formation. The authors reveal the essence, degree of efficiency, concrete results, political and socio-economic consequences, positive and negative lessons from the Soviet judicial system existed in Russia. The authors assume that the development of new legislation system in the 1920s was caused by the need to reform legal sources as the main means of socialism building. The authors conclude that the transformation of the Soviet judicial system completed the transition from the principle of «revolutionary expediency» to the principle of «revolutionary legality».

This chapter addresses the cultural politics, history and revival of Vietnamese court orchestras, which were first established at the beginning of the Nguyễn dynasty (1802–1945). Based on fieldwork in the city of Hue, it considers the decolonizing processes that have enabled Vietnamese court orchestras to take their place alongside other East Asian court orchestras as a display of national identity in the global community of nations. The metaphor of ‘orchestrating the nation’ is used to refer to the ways in which Vietnamese orchestras have been harnessed for sociopolitical ends in several historical periods. Court orchestras as heritage have recourse to a generic, precolonial past, yet they are not entirely uncoupled from local roots. Through a case-study of the revival of the Nam Giao Sacrifice, a ritual for ‘venerating heaven’, the chapter addresses the dynamics of interaction and exchange between staged performances of national heritage and local Buddhist and ancestor worship rituals. It argues that with growing concern about global climate change, the spiritual and ecological resonances of the Nam Giao Sacrifice have provided opportunities for the Party-state to reassert its position as the supreme guardian of the nation and its people.

This paper examines changing representations of women in Chinese television dramas since the early 1990s and interprets them within a framework of global socialist media cultures, considering both domestic developments and transnational trends. Drawing on the analysis of three selected dramas, it traces the trajectory of televised femininity from exemplary socialist worker-citizens devoted to family and community, to more individualized middle-class urbanites. It is tempting to see this transformation as an outcome of China's integration into the global capitalist economy, the attendant retreat of the party-state from the private realm, and the infusion of Western cultural gender ideals. Yet this interpretation downplays important continuities, and misses intriguing parallels with TV dramas produced in socialist Eastern Europe. The argument pays particular attention to the enduring appeal of the socialist-style superwoman who shoulders the double burden of a professional career and unpaid domestic work while also acting as a discerning citizen-consumer.

AbstractIn this work, we draw on available data to develop a comprehensive picture of the process through which “government service purchasing” has developed in China thus far. We argue that to understand the challenges that have begun to emerge in practice, it is important to look back and understand how government service purchasing has developed to date. Our hope is that by providing an overview of this development process, we can facilitate further research on what we believe is a phenomenon that will have deep implications for the relationships between Party, state, society, and market over the next decades in China.

Abstract Canadian commitments under trade and investment treaties have been an ongoing concern for Indigenous peoples. The Canada-United States-Mexico Agreement (CUSMA) is the first Canadian treaty to include a general exception for measures that a party state “deems necessary to fulfill its legal obligations to [I]ndigenous peoples.” This exception is likely to afford Canada broad, but not unlimited, discretion to determine what its legal obligations to Indigenous peoples require. There is a residual risk that Canada’s reliance on the exception could be challenged through the CUSMA dispute settlement process. A CUSMA panel would not have the expertise necessary to decide inevitably complex questions related to what Canada’s legal obligations to Indigenous peoples require. While state-to-state cases under the North American Free Trade Agreement have been rare, a CUSMA panel adjudication regarding the Indigenous general exception risks damaging consequences for Canada’s relationship with Indigenous peoples.

This paper examines and evaluates the content of news items reported in a sample of daily newspapers in China's biggest cities. Using three ‘Western’ media sources, an inventory of news items directly or indirectly related to the ‘downside’ of the economic reforms was generated. A simultaneous analysis of mainland newspapers finds that many of the same themes were reported, although the coverage tends to be thinner and less detailed. Some China scholars have suggested that the Party/state is losing control of the communications system in contemporary China, and the results of this study support such arguments; city-level newspapers are now publishing what is most interesting to their consumers and likely to win them a larger share of the market. The regime still manages the dissemination of sensitive political information, but the parallel dictates of commercialization result in the disorderly and unpredictable circulation of communications messages. Mainland newspapers still steer clear of stories considered too politically ‘sensitive’, but the margins of acceptability have been expanded to include news items that only a few years ago would have been excised. The state maintains control over what is included in the daily news as well as what is excluded, although it is unclear to what extent publishing decisions result from a process of state cooptation and self-censorship, as opposed to specific directives from Beijing.
