Pada tahun 2016 Menteri Dalam Negeri membatalkan 3.143 Peraturan Daerah bermasalah. Kemudian pada tahun 2017 Mahkamah Konstitusi mengeluarkan sebuah Putusan yang mencabut kewenangan Menteri Dalam Negeri untuk membatalkan Peraturan Daerah. Akan tetapi masih ada Pemerintah Daerah yang melaksanakan Peraturan Daerah yang dibatalkan oleh Menteri Dalam Negeri sebelum keluarnya Putusan Mahkamah Konstitusi. Penelitian ini bertujuan, untuk menganalisis kekuatan eksekutorial Keputusan Menteri Dalam Negeri yang membatalkan peraturan daerah sebelum Putusan Mahkamah Konstitusi serta untuk menganalisis kedudukan peraturan daerah yang dibatalkan oleh Keputusan Menteri Dalam Negeri yang masih dilaksanakan oleh Pemerintah Daerah setelah Putusan Mahkamah Konstitusi. Metode penelitian yang digunakan adalah penelitian hukum normatif. Sumber data penelitian adalah data sekunder yang terdiri dari bahan hukum primer, bahan hukum sekunder dan bahan hukum tertier. Hasil penelitian menunjukkan bahwa pertama. Menteri Dalam Negeri masih dapat melaksanakan Keputusan untuk membatalkan Peraturan Daerah karena Putusan Mahkamah Konstitusi tidak berlaku surut, namun idealnya yang lebih berhak membatalkan Peraturan Daerah adalah Mahkamah Agung. Kedua, Kedudukan Peraturan Daerah yang dibatalkan oleh Keputusan Menteri Dalam Negeri yang masih dilaksanakan oleh Pemerintah Daerah setelah dikeluarkannya Putusan Mahkamah Konstitusi maka Peraturan Daerah tersebut tidak langsung batal karena ada mekanisme yang harus dilakukan yaitu pencabutan. Selama belum ada pencabutan, maka Peraturan Daerah dimaksud tetap ada tetapi tidak bisa dilaksanakan. Disarankan kepada Pemerintah Pusat agar merevisi Undang-Undang Nomor 23 Tahun 2014 khususnya pasal yang mengatur tentang pembatalan Peraturan Daerah dan apabila mengeluarkan suatu peraturan perundang-undangan harus berpedoman pada hierarki peraturan perundang-undangan yang berlaku saat itu.In 2016 the Minister of Home Affairs canceled 3,143 problematic Regional Regulations. Then in 2017 the Constitutional Court issued a Decision revoking the authority of the Minister of Home Affairs to cancel the Regional Regulation. However, there are still Regional Governments who carry out Regional Regulations that have been canceled by the Minister of Home Affairs before the decision of the Constitutional Court is issued. This study aims to analyze the executorial power of the Decree of the Minister of Home Affairs which overturned regional regulations before the Constitutional Court Decision and to analyze the position of regional regulations which were canceled by the Decree of the Minister of Home Affairs which was still implemented by the Regional Government after the Constitutional Court Decision. The research method used is normative legal research. The source of research data is secondary data consisting of primary legal materials, secondary legal materials and tertiary legal materials. The results of the study indicate that : first, The Minister of Home Affairs can still implement the Decision to cancel Regional Regulations because the Constitutional Court Decision does not apply retroactively, but ideally the more entitled to cancel Regional Regulations is the Supreme Court. Second, the position of the Regional Regulation which was canceled by the Decree of the Minister of Home Affairs which is still carried out by the Regional Government after the issuance of the Constitutional Court Decision, the Regional Regulation is not immediately canceled because there is a mechanism that must be done, namely revocation. As long as there has been no revocation, then the Regional Regulation in question still exists but cannot be implemented. It is recommended to the Central Government to revise Act. No. 23 Year 2014 specifically the articles governing the cancellation of Regional Regulations and when issuing a law and regulation must be guided by the hierarchy of legislation in force at that time.

Constitutional Court Decision of Number 137/PUU-XIII/2015and Decision Number 56/PUU-XIV/2016 which state that theauthority of the Minister of Home Affairs and the Governor asthe representative of the central government in cancelingProvincial Regulations, District Regulation/City Regulation,Governor Regulation, and Regent Regulation/Regulation ofMayor was inconstitutional. So only the Supreme Court has theauthority to revoke Provincial Regulations, DistrictRegulation/City Regulations, Governor Regulation, and RegentRegulation/Regulation of Mayor. This analysis makes use of thelegal juridical normative research method. The results showthat in a state of unity it is appropriate that higher levels ofgovernment are given the authority to supervise theregulations set in the regions. The supervision can beimplemented by conducting such a guidance to the regionthrough the strengthening of executive preview or legal normreview before it is legally binding in general

Kajian ini untuk mengkaji eksistensi Komisi Yudisial Republik Indonesa dalam menciptakan hakim agung yang berkualitas dan berintegritas. Metode peneltia yang digunaka menggunakan metode peneltian hukum normatif. Hasil kajian menunjukkan bahwa Kewenangan Komisi Yudisial sebagaimana diatur dalam Pasal 24B ayat (1) UUD 1945 mengalami dinamika dan perubahan dalam penafsiran baik pada tingkat legislasi di DPR, ajudikasi di Mahkamah Konstitusi dan Mahkamah Agung, maupun pada tingkat regulasi di Mahkamah Agung dan Komisi Yudisial.Eksistensi Komisi Yudisial mengusulkan pengangkatan hakim agung telah mengalami perluasan makna mencakup hakim ad hoc di Mahkamah Agung serta penguatan dengan dihapuskan kewenangan DPR untuk memilih calon hakim agung dan hanya menyetujui atau tidak menyetujui calon hakim agung usulan Komisi Yudisial. This study is to study the existence of the Judicial Commission of the Republic of Indonesia in creating high-quality judges with integrity. The research method used uses normative legal research methods. The results showed that the authority of the Judicial Commission as referred to in Article 24B paragraph (1) of the 1945 Constitution experienced dynamics and changes in interpretation both at the legislative level in the DPR, adjudication in the Constitutional Court and Supreme Court, as well as in the Supreme Court and Judicial Commission. The existence of the Judicial Commission proposing the appointment of a Supreme Court judge has broadened the meaning including ad hoc judges in the Supreme Court and strengthened by abolishing the authority of the DPR to elect candidate judges and only approving or not approving candidates for the proposed Judicial Commission.

The legal requirements are regulated in Article 1320 of the Civil Code (KUHPerdata). If the valid conditions of the promise are not fulfilled, then the law that results is that the agreement can be canceled or null and void. In the Court's practice contained in the Supreme Decision Number 1081K / PDT / 2018, there was a sale and purchase agreement between the Plaintiff's husband and the Defendant, the sale and purchase agreement was made by the Plaintiff's partner without the consent of the Plaintiff as his legal wife. Supreme Court Decision No. 1081K / PDT / 2018 stated that the sale and purchase agreement was invalid and null and void. Apart from that, in its decision, the Defendant's UN Supreme Court had committed an illegal act. The research method used is a normative juridical approach using secondary data obtained from literature studies, namely statutory regulations, legal theories, and the opinions of leading legal scholars. This research uses descriptive analytical research specifications that describe the regulations that are in accordance with legal theories that oversee the implementation practices of the problems under study. The data analysis method used is qualitative normative method. Based on the research results, it can be denied that the sale and purchase agreement in the Supreme Court Decision Number 1081K / PDT / 2018 is not legally valid. The agreement does not fulfill the validity requirements of the agreement in Article 1320 of the Civil Code, namely halal skills and causes because it violates Article 36 paragraph (2) of the Marriage Law No. 1 of 1974 resulting in the sale and purchase agreement to be null and void.Keywords: Buying and Selling, Acts against the Law, Agreement, Marriage, Collective Property

El Parlamento catalán aprobó en 2014 una Ley de consultas populares. Anteriormente, en 2013, había aprobado una Declaración de soberanía y del derecho a decidir del pueblo de Cataluña. Basándose en los citados documentos, el Presidente de la Generalitat convocó una «consulta popular no referendaria sobre el futuro político de Cataluña», que tendría lugar el 9 de noviembre de 2014. No se llegó a celebrar porque el Tribunal Constitucional decretó su suspensión, ya que el Gobierno había impugnado ante él la Ley, la Declaración y el Decreto de Convocatoria. La Generalitat, una asociación y dos particulares entendieron que los recursos del Gobierno fueron una intromisión en los derechos de los catalanes y acudieron al Tribunal Supremo. El presente trabajo estudia los Autos del Tribunal Supremo que les dan respuesta.Catalan Parliament approved in 2014 a Popular Enquiry Act. Previously, in 2013, they had approved a Declaration of Sovereignty and the right to decide of the people of Catalonia. Based on these documents, the President of the regional Government called to a «non-referendum popular enquiry about the political future of Catalonia», which would be held on November 9, 2014. It did not get to celebrate because the Constitutional Court ordered its suspension, as the central Government had impugned the Act, the Declaration and the Decree calling for the enquiry. The regional Government, an association and two people thought those impugnations were an intrusion on the Catalans’ rights and went before the Supreme Court. This paper studies the reply of the Supreme Court.

Testing the provision of Article 155 section (2) Law Number 13 of 2003 on Manpower has been decided by the Constitutional Court (CC) through decision Number 37/PUU/IX/2011. Prior to the Constitutional Court decision, there are many various interpretations of undetermined clause. The Constitutional Court firmly states that the undetermined clause must be interpreted as “having a permanent legal force ".This study aims to analyze how the judges dismissed dispute of work termination cases in Indonesia after the decision. The research applied juridical normative method  by using secondary data literature such as legal documents, previous studies and other references which are relevant to the judges' decision within the Supreme Court after the Constitutional Court decision. Based on the analysis temporary result, the judges within the Supreme Court in 3 regions (Padang, Pekanbaru and Jakarta Pusat) and the Supreme Court itself are not practically guided by the Constitutional Court decision. It obviously results in the lack of legal certainty for the parties, especially workers.Keyword: Constitutional Court, Industrial Relation Court, Interpretation, Supreme Court.

The demand for the minimum payment of the minimum wage has an expiration date, which is 2 years. The expiration date has been revoked with the Decision of the Constitutional Court Number 100/PUU-X/2012. In the Decision of the Industrial Relations Court Number 195/Pdt.Sus-PHI/2016/PN.Bdg juncto Decision of the Supreme Court Number 885K/Pdt.Sus-PHI/2017, the judge refused to grant the claim the minimum wage payment. Based on the verdict, what will be discussed in this paper are how the judges basis for filing a claim lacks payment of workers' minimum wages and how the legal consequences from the judge's consideration in filing a claim lack the minimum wage payment in the Industrial Relations Court Decision Number 195/Pdt.Sus-PHI/2016/PN.Bdg juncto Decision of the Supreme Court Number 885K/Pdt.Sus-PHI/2017. The research method used is normative legal research. Based on the research that has been done, the judge mistakenly interpreted the enactment of the Constitutional Court Decision Number 100/PUU-X/2012 so the judge refused to grant the claim for the lack of minimum wage payments submitted by the plaintiffs. The judge's judgment stated that the Constitutional Court Decision Number 100/PUU-X/2012 did not apply retroactively so that the normative rights expiration provisions last took effect on September 18, 2013. Even though the claim should have been partially granted by the judge because the employer proved to pay workers' wages under the minimum wage provisions applicable, namely for payment of wages in 2013. In addition, the plaintiffs also submitted the claim after the issuance of the Constitutional Court Decision Number 100/PUU-X/2012.

Penelitian ini bertujuan untuk menganalisis diskursus pembatalan Perda pasca dikeluarkannya putusan MK No. 137/PUU-XIII/2015 dan No. 56/PUU-XIV/2016 atas pengujian UU No. 23 Tahun 2014 terhadap UUD 1945 yang dibatasi dalam dua rumusan masalah. Pertama, bagaimana implementasi pengujian Perda pasca Putusan MK No. 137/PUU-XIII/2015 dan No. 56/PUU-XIV/2016?. Kedua, apakah dampak putusan MK No. 137/PUU-XIII/2015 dan No. 56/PUU-XIV/2016 terhadap perkembangan hukum pemerintah daerah? Penelitian ini merupakan penelitian normatif dengan menggunakan pendekatan perundang-undangan (statute approach) dan pendekatan kasus (case approach). Data yang digunakan adalah data sekunder yang berupa bahan hukum primer, bahan hukum sekunder dan bahan hukum tersier. Hasil penelitian menunjukkan bahwa: pertama, pasca putusan MK pengujian Perda hanya dilakukan oleh sebuah lembaga yudisial melalui judicial review di Mahkamah Agung. Kedua, terdapat dua dampak penting atas dikeluarkannya putusan MK, pertama, dengan dibatalkannya Pasal 251 UU No. 23 Tahun 2014 maka hal ini mengakhiri dualisme pengujian Perda, karena Menteri tidak dapat lagi melakukan executive review. Kedua, putusan MK o. 137/PUU-XIII/2015 dan No. 56/PUU-XIV/2016 tidak menghapuskan pengawasan Pusat terhadap Perda karena masih dapat dilakukan pengawasan preventif melalui executive preview.This study aimed to analyze the discourse of cancellation after the issuance of local regulations following the Constitutional Court decision No. 137/PUU-XIII/2015 and No. 56/PUU-XIV/2016 on judicial review of Law No. 23 2014 towards the 1945 Constitution which are restricted in two formulation of the problem. First, how is the implementation of a post-test Constitutional Court Regulation No. 137/PUU-XIII/2015 and No. 56/PUU-XIV/2016? Second, what are the effects of the Constitutional Court decision No. 137/PUU-XIII/2015 and No. 56/PUU-XIV/2016 on the development of the local government law? This study is a normative with statute approach and case approach. The data used was secondary data in the form of primary, secondary, and tertiary legal materials. The results showed that: firstly, the following decision of the Constitutional Court about regional regulations review can only be conducted by a judicial body through a judicial review in the Supreme Court. Secondly, there are two important effects on the issuance of the decision of the Constitutional Court, first, by the cancellation of Article 251 of Law No. 23 year 2014 then the duality of local regulation testing is ended, because the Minister can no longer perform executive review. Second, the decision of the Constitutional Court No. 137/PUU-XIII/2015 and No. 56/PUU-XIV/2016 does not abolish the supervision of the Center Government because they do preventive supervision through executive preview.

ABSTRAKPenelitian ini mempermasalahkan pembuktian sederhana dalam proses kepailitan terkait kewajiban pemberitahuan adanya peralihan piutang (cessie) kepada debitur. Putusan Nomor 02/PDT.SUS.PAILIT/2014/PN.Niaga.Mks telah mengabulkan permohonan kreditur cessionaries yang dikuatkan oleh Putusan Nomor 19 K/PDT.SUSPAILIT/2015, namun pada upaya hukum peninjauan kembali majelis hakim justru mengabulkan permohonan peninjauan kembali dengan alasan pembuktian sederhana terhadap cessie belum diberitahukan kepada debitur secara resmi melalui juru sita pengadilan. Rumusan masalah penelitian ini ialah bagaimana konsep pembuktian sederhana dalam kepailitan terhadap kewajiban pemberitahuan pengalihan piutang (cessie) pada pertimbangan majelis hakim peninjauan kembali Nomor 125 PK/PDT.SUS-PAILIT/2015. Metode penelitian ini menggunakan penelitian hukum normatif. Kesimpulan penelitian ini adalah konsep pembuktian sederhana di dalam pembuktian kepailitan tidak ada kewajiban pemberitahuan secara resmi melalui juru sita pengadilan karena Pasal 613 BW tidak mengaturnya, pemberitahuan hanya diajukan secara tertulis dan bisa kapanpun diberitahukan kepada debitur. Kata kunci: kepailitan, pembuktian sederhana, cessie.ABSTRACTThis analysis intends to question the simple proof in bankruptcy proceedings related to the transition of receivable notification obligation (cessie) to the debtors. The Commercial Court Decision Number 02/PDT.SUS.PAILIT/2014/PN.Niaga.Mks has granted the petitions of creditor’s cessionary which was strengthened by the Supreme Court Decision Number 19 K/PDT.SUSPAILIT/2015, but on the judicial review attempt, the Supreme Court has granted the petition for the judicial review on the grounds that a simple proof of cessie has not been officially disclosed to the debtor through a court bailiff. The formulation of this research problem is how the concept of simple proof in bankruptcy proceeding to the obligation of notification of transfer of receivables (cessie) in the consideration of Court Decision Number 125 PK/PDT.SUS-PAILIT/2015. The research method of this analysis is normative legal research. This analysis resolves thatin the simple proof concept of the bankruptcy proceedings, there is no obligation of official notice through the court bailiff because it is not set on Article 613 of Indonesia Civil Code Law, so the notification is only submitted in writing and may at any time be notified to the debtor. Constitutional Court Verdict Number 56 / PUU-XIV / 2016 have the potential to cause juridical implications in terms of carrying out control of the Regional Government. As for the purpose of this study is to analyze and find the ideal form related to the supervision of the Central Government in the formation of Regional Regulations after the issuance of the Constitutional Court Verdict Number 56 / PUU-XIV / 2016. The type of research used in this study is normative legal research. As for the implications after the issuance of the Constitutional Court Verdict Number 137 / PUU-XIV / 2016 on Central Government control in the formation of Regional Regulations namely; Contradictory to the Principles of the Unitary State, the Central Government Only has the Authority to Implement Preventive, Regional Regulations Can Only Be Applied for Judicial Review to the Supreme Court, Inhibit Central Government Policy on Deregulation, and Not in accordance with the Good Governance Principles. Whereas the conclusion is the central government can issue recommendations or recommendations to the regional government to immediately make an amendment to the regulation that is considered contrary to the provisions of the legislation higher law, public interest and decency, but if in a state of urgency the Central Government can become a defendant for judicial review of that Regional Regulation. Putusan Mahkamah Konstitusi Nomor 56/PUU-XIV/2016 berpotensi menimbulkan implikasi yuridis terutama dalam hal pengawasan pembentukan Peraturan Daerah. Adapun tujuan studi ini adalah untuk menganalisis dan menemukan bentuk yang ideal terkait pengawasan Pemerintah Pusat dalam pembentukan Peraturan Daerah pasca diterbitkannya Putusan Mahkamah Konstitusi Nomor 56/PUU-XIV/2016. Jenis penelitian yang digunakan dalam penelitian ini adalah penelitian hukum normatif. Adapun impilikasi pasca diterbitkannya Putusan Mahkamah Konstitusi Nomor 137/PUU-XIV/2016 terhadap pengawasan Pemerintah Pusat dalam pembentukan Peraturan Daerah yakni; Bertentangan dengan Prinsip Negara Kesatuan, Pemerintah Pusat Hanya Berwenang Melaksanakan Pengawasan Preventif, Perda Hanya Dapat Dimohonkan Uji Materiil/Judicial Review Kepada Mahkamah Agung, Menghambat Kebijakan Pemerintah Pusat Tentang Deregulasi, dan Tidak Mencerminkan Prinsip Good Governance. Pemerintah pusat dapat menerbitkan anjuran atau rekomendasi kepada Pemerintah Daerah untuk segera mengadakan perubahan terhadap Perda yang dianggap bertentangan dengan ketentuan Peraturan Perundang-undangan yang lebih tinggi, kepentingan umum, dan kesusilaan, namun apabila dalam keadaan mendesak Pemerintah Pusat dapat menjadi Pemohon uji materiil terhadap Perda tersebut.

The problem began because there was an Application to Judicial Review Article 182 Letter l specifically in the phrase "other work" Law Number 7 of 2017. The applicant requested the Constitutional Court to interpret the phrase "other work". The request was finally granted by the Constitutional Court which interpreted the phrase "other work" in Article 182 letter l of the Act to also serve as a Political Party Functionary. For the Decision, there are Parties who disagree, finally the KPU Regulation Number 26 Year 2018 which accommodates the MK Decision so that candidates for DPD members resign from Political Parties to the Administrative Court and MA. The problem is that the Decision of the Administrative Court and Supreme Court is different from the Constitutional Court Decision, both decisions allow political party functionaries to register as candidates for the DPD. In solving these problems the author uses the Normative Legal Research Method, the author's conclusion is that the principle of the Erga Omnes and the principle of the Negative legislator attached to the Constitutional Court Decision is not effective. While the author's suggestion is that there is a need for a revision of the Constitutional Court Law by adding sanctions to institutions or communities that do not follow the MK Decision.
