Penelitian ini bertujuan untuk mengkaji isu krusial yang terkait dengan dikeluarkan PERPU NO. 1 Tahun 2020 tentang Kebijakan Keuangan Negara Dan Stabilitas Sistem Keuangan Untuk Penanganan Pandemi Corona Disease 2019 (“Covid-19”) yang diubah menjadi Undang-Undang Nomor 2 Tahun 2020. Untuk dapat mengetahui makna Kerugian Negara dan Penerapan Itikad baik sesuai dengan Pasal 27. Penelitian ini menggunakan metode normatif dengan menggunakan studi dokumen yang meliputi bahan hukum primer, sekunder dan tersier. Hasil penelitian ini menunjukkan bahwa Undang-Undang Nomor 2 Tahun 2020. Terkait dengan hal-hal yang terdapat dalam Pasal 27 PERPU No 1 Tahun 2020 juga dinilai berpotensi memunculkan korupsi dengan adanya Pasal 27 ayat 1 terutama frasa “bukan merupakan kerugian Negara”. Unsur terpenting dari suatu kerugian Negara adalah adanya perbuatan melawan hukum dan nilai kerugian yang riill. Oleh karena itu, pengaturan frasa “bukan merupakan kerugian Negara” dalam Pasal 27 ayat 1 PERPU No 1 Tahun 2020 agar tidak terjadi salah penafsiran atas Pasal tersebut maka perlu diatur lebih detail dalam penjelasan pasal demi pasal pada PERPU yang dimaksud. This study aims to examine the crucial issues associated with the issuance of PERPU NO. 1 of 2020 concerning State Financial Policy and Financial System Stability for Handling the 2019 Corona Disease Pandemic (“Covid-19”) which was amended to Law Number 2 of 2020. To be able to find out the meaning of State Loss and Implementation of Good faith in accordance with Article 27. This study uses a normative method by using document studies which include primary, secondary and tertiary legal materials. The results of this study indicate that Law Nomoor 2 of 2020. In relation to matters contained in Article 27 of PERPU No. 1 of 2020 it is also considered to have the potential to cause corruption with the existence of Article 27 paragraph 1, especially the phrase "not a loss to the State". The most important element of a State loss is an act against the law and the real value of the loss. Therefore, the regulation of the phrase "not a loss to the State" in Article 27 paragraph 1 of PERPU No. 1 of 2020 so that there is no misinterpretation of the Article, it is necessary to regulate in more detail the explanation of article by article in the PERPU referred to.

AbstractThe aim of the research is to offer novelty regarding the constitualism of the Government Regulation in Lieu of Law regarding Covid-19 which has now become a Law. This study uses a normative research method, with a focus on solving issues (problems) based on legal principles, legal rules, as well as on recognized legal expert opinion or doctrine. Through this research, the researcher offers that the perppu which has now become a law must be declared invalid or revoked because it is unconstitutional. As is well known, the Government issued Government Regulation in Lieu of Law Number 1 of 2020 concerning State Financial Policy and Financial System Stability for Handling Pandemic Corona Virus Disease 2019 (COVID-19) and / or in the Context of Facing Threats that Endanger the National Economy and / Or Financial System Stability, on March 31, 2020 (now Law Number 2 of 2020, on May 18, 2020). In Article 27 paragraph (1), paragraph (2), and paragraph (3) it is stated that there are parties who have "privileges", namely obtaining legal immunity from all actions they take on the basis of implementing the Covid Perppu. Of course this is a problem, because as a rule of law, Indonesia must provide justice in the form of equal treatment before the law or equality before the law to society without exception. This is stated in Article 27 paragraph (1), Article 28D paragraph (1), and Article 28I paragraph (2) of the 1945 Constitution of the Republic of Indonesia. Thus, the Perppu which has now become a law is contrary to the Constitution, so it must be canceled or declared invalid.Keywords: constitution; Covid-19; equality before the lawAbstrakTujuan penelitian, yaitu menawarkan kebaruan mengenai konstitualisme dari Peraturan Pemerintah Pengganti Undang-undang mengenai Covid-19 yang sekarang telah menjadi Undang-Undang. Penelitian ini menggunakan metode penelitian normatif, dengan berfokus pada pemecahan isu (masalah) yang didasarkan pada asas hukum, aturan hukum, maupun pada doktrin atau pendapat ahli hukum yang diakui. Melalui penelitian ini, peneliti menawarkan bahwa, perppu yang sekarang telah menjadi undang-undang tersebut harus dinyatakan tidak berlaku atau dicabut karena inkonstitusional. Seperti diketahui, Pemerintah mengeluarkan Peraturan Pemerintah Pengganti Undang-Undang Republik Indonesia Nomor 1 Tahun 2020 tentang Kebijakan Keuangan Negara Dan Stabilitas Sistem Keuangan Untuk Penanganan Pandemi Corona Virus Disease 2019 (COVID-19) Dan/Atau Dalam Rangka Menghadapi Ancaman Yang Membahayakan Perekonomian Nasional Dan/Atau Stabilitas Sistem Keuangan, pada tanggal 31 Maret 2020 (sekarang menjadi Undang-Undang Nomor 2 Tahun 2020, pada tanggal 18 Mei 2020). Dalam Pasal 27 ayat (1), ayat (2), dan ayat (3) disebutkan bahwa ada pihak-pihak yang mendapat “keistimewaan”, yaitu mendapat kekebalan hukum dari segala tindakan yang dilakukannya atas dasar pelaksanaan perppu covid tersebut. Tentu itu menjadi masalah, karena sebagai negara hukum, Indonesia harus memberikan keadilan berupa perlakuan yang sama didepan hukum atau equality before the law kepada masyarakat tanpa terkecuali. Hal tesebut tercantum dalam Pasal 27 ayat (1), Pasal 28D ayat (1), dan Pasal 28I ayat (2) Undang-Undang Dasar Negara Republik Indonesia Tahun 1945. Sehingga, Perppu yang kini telah menjadi undang-undang tersebut bertentangan dengan Konstitusi, sehingga harus di batalkan atau dinyatakan tidak berlaku.

The article presents the results of a study of the banking system stability under the conditions of increased financial support from the state during the financial and economic destabilization. The banking system stability in the euro zone has been analyzed to assess the prospects for monetary and financial development in Ukraine. The European experience proves that strengthening relations between banks and the state amidst the financialization process is harmful. The author of the article treats this relationship as a closed-loop problem of public and financial liquidity circulation, which leads to financial bleeding in the real economy and destabilization of the financial system, as a whole. This problem requires to be fixed by reducing banking transactions with government securities. The article gives facts proving that the search for solutions to this problem made in the European financial space has become one of the factors of financial and institutional transformations in the euro zone and the EU, in general, and has led to the creation of a banking union. The newly introduced legal framework has manifested itself as unable to stimulate efficient financial distribution. It has also been demonstrated that due to the public and financial liquidity circulation the banking system becomes subject to profound redesigning, thus losing its ability to conduct effective financial distribution in the real sector of economy.

ABSTRACT The number of cases or disputes in the field of land, one of which is due to the existence of multiple certificates, in which this problem can be caused by good ethics and good ethics. This is because land has a close relationship with humans, both for housing and for business. Therefore, the law requires the owner of land rights to register their land, so that they have legal guarantees and guarantees of their rights. Double certificates occur in the case of land being abandoned by a certified owner, for a period of more than 20 years so that the land grows with a thicket, which is then controlled by someone else in good faith for more than 20 years, then the person increases his right of ownership. This is justified by law because the person has controlled the land for more than 20 years, in addition, because the land has been neglected for more than 20 years, the right to annul the land is controlled by the State. Banyaknya kasus/sengketa dibidang pertanahan, yang salah satunya adalah karena adanya sertifikat ganda, yang mana masalah ini dapat dikarenakan etikat tidak baik maupun etikat baik. Hal ini dikarenakan bahwa tanah mempunyai hubungan yang erat dengan manusia, baik untuk tempat tinggal maupun untuk berusaha. Oleh karenanya Undang- Undang mewajibkan sipemilik hak atas tanah untuk mendaftarkan tanahnya, agar mempunyai jaminan hukum dan jaminan haknya. Sertifikat ganda terjadi dalam hal tanah ditelantarkan oleh pemiliknya yang sudah bersertifikat, dalam jangka waktu lebih dari 20 tahun sehingga tanah tersebut tumbuh semak belukat, yang kemudian dikuasai oleh orang lain dengan itikat baik selama lebih dari 20 tahun, kemudian orang tersebut meningkatkan haknya menjadi hak milik.Hal ini dibenarkan oleh undang-undang karena org tersebut telah menguasai tanah tersebut selama lebih dari 20 tahun, selain itu karena tanah tersebut ditelntarkan selama lebih Dri 20 tahun, maka haknya hapus tanah dikuasai oleh Negara. We study main features of the exotic case of q-deformed oscillators (so-called Tamm–Dancoff cutoff oscillator) and find some special properties: (i) degeneracy of the energy levels En1 = En1 + 1, n1 ≥ 1, at the real value[Formula: see text] of deformation parameter, as well as the occurrence of other degeneracies En1 = En1 + k, for k ≥ 2, at the corresponding values of q which depend on both n1 and k; (ii) the position and momentum operators X and Pcommute on the state|n1> if q is fixed as [Formula: see text], that implies unusual uncertainty relation; (iii) two commuting copies of the creation, annihilation, and number operators of this q-oscillator generate the corresponding q-deformation of the non-simple Lie algebra su(2) ⊕ u(1)whose nontrivial q-deformed commutation relation is: [J+, J-] = 2J0q2J3-1 where [Formula: see text] and [Formula: see text].

The debate in January 2007, as presented by the mass media, concerning whether an exemption should be provided for Roman Catholic Adoption Agencies from new laws prohibiting discrimination on grounds of sexual orientation in the provision of goods and services, rested upon two erroneous assumptions. The first was an assumption that awarding exemptions on grounds of religion was novel; the second was that the debate concerned whether there ought to be a religious exemption at all. This article seeks to engage with the real debate concerning the Equality Act (Sexual Orientation) Regulations 2007, which is not whether there ought to be a religious exemption (since one has been given) but rather the scope of the exemption. It also aims to show that religious exemptions are common in English law, including discrimination law, and to elucidate the various exemptions, paying particular attention to their beneficiaries and the basis on which discrimination is permitted. In short, this article seeks to understand the state of the law as a whole contextualising the recent moral panic.
