The problems raised in the doctrine of constitutional law related to the implementation of a decision taken in a referendum in matters of particular importance to the state, as well as the generally marginal use of the institution of popular vote in the constitutional prac-tice, give rise to reflection on the introduction of the institution of a referendum law into the Polish constitutional system. In this article the author considers the advantages and disadvantages of such a solution, analyzing at the same time contemporary normative regulations concerning such acts in other countries. The research leads to the conclusion that despite the risks involved, the refer-endum law should appear in the Polish constitutional system in the future, as it would not only give a chance for a more complete reflection of the will of the collective subject of sovereignty without the necessity of its decoding by the parliament, but it could also be an impulse for the development of the referendum practice in the Republic of Poland. However, it is important to introduce proce-dural barriers that will prevent depreciation of this institution.

Impeachment is not new in the history of Indonesian constitution, but the change in the Constitution has caused a change in the constitutional system as well as related to the mechanism of the dismissal of the President and / or Vice President. how is the Impeachment reviewed globally, the history of impeachment in Indonesia and the implementation of impeachment in other countries, the impeachment process of the president according to the 1945 Constitution of the Republic of Indonesia. The process of impeachment in Indonesia after changing the constitution goes through three stages, namely impeachment in the House of Representatives, the Court The Constitution, and the People's Consultative Assembly. Since its founding of the republic, Americans have devised a variety of different ways to reconcile unity with depth, separation with checks, and presidentialism with republicanism. This chapter surveys the succession of informal institutional and organizational improvisations that periodically altered practical working relationships within the American constitutional system. These extra-constitutional contrivances created several distinctive “systems” of administration, each of which preserved the republican idea of inter-branch collaboration. Nineteenth-century remedies were party-based; twentieth-century remedies were administration-based. The move from one system to the next marked a profound change in the operation of government at large, but at every turn, a more powerful presidency was corralled into novel arrangements that reaffirmed collective responsibility. The origins of our beleaguered republic lay in the 1970s, when that spirit of accommodation began to break down. Presidents grew more independent in their political and institutional powers, and they asserted their right to unitary control over the executive branch more vigorously. In the congressional pushback, collaboration gave way to a constitutional face-off.

By presenting the Court’s principal lines of case law regarding the allocation of powers in the Italian constitutional system, this chapter explores the constitutionally regulated relationships among the President, Executive, Parliament, and Judiciary. It reveals that rather than a “separation of powers” in the conventional sense of contemporary constitutional models, the Italian system is best described as instituting a set of reciprocal “relations of powers” with the Constitutional Court as the “judge of powers” that maintains and guarantees these interrelationships of constitutional actors. The chapter explores this role of the Constitutional Court in its relations with both Parliament and the President of the Republic, as well as the Court’s regulation of the relationship between the President and the Executive.

The regional head as the organizer of the government in the region is also an extension of the central government, has a pretty heavy task, therefore in order for the State's goals to be achieved, regional heads must be chosen that are truly credible, qualified and qualified, so that it can bring success to regional development in carrying out government affairs as mandated by the Act, which will ultimately have a positive impact, in the form of support for national development. This research is intended to examine, criticize and analyze which are expected to provide solutions related to the development of the authority to form laws in the constitutional system of the Republic of Indonesia. The formulation of the problem in this study are the dynamics of regional elections in Indonesia in the reformation era and the implications of the dynamics of regional elections in the Indonesian constitutional system. The method of approach used in this study is normative juridical, which is an approach that uses the positivist concept which states that law is identical with written norms created and enacted by authorized institutions or officials. The dynamics of regional head elections in Indonesia in the Reformation era include the conditions for pairs of candidates for regional head elections and the mechanism for regional head elections. Pairs of regional head candidates must be proposed by political parties or a combination of eligible political parties.

The 1945 Constitution of the Republic of Indonesia was amended for four times between 1999 and 2002) in the reformation era. These constitutional changes have altered the principles and the structure of the Indonesian primary state‟s institutions. Broadly speaking, all of the power branches – i.e. legislative, executive and judiciary organs– are now interrelated horizontally in running the country and none of them is superior to the others. Such constitu-tional system is generally found in countries that employ a presidential system. However, by reviewing the authority hold by the legislatures, it is found that some characteristics of a parlia-mentary system are also applied in Indonesia

<p>Kedudukan komisi yudisial sebagai pengawas system peradilan di Indonesia di rasa sangat penting untuk menjadikan system peradilan di Indonesia professional dan berintegritas. Persoalan kemudian hadir pasca putusan <a href="http://kepaniteraan.mahkamahagung.go.id/kegiatan/1181-putusan-mk-no-43-puu-xiii-2015-proses-seleksi-hakim-tingkat-pertama-tidak-perlu-melibatkan-ky">MK No 43/PUU-XIII/2015</a> dimana dalam putusan menjadikan Komisi Yudisial tidak lagi sebagai pihak yang ikut serta mengawasi perekrutan hakim tingkat pertama. Padahal dalam system ketatanegaraan jika lembaga komisi yudisial peran dan fungsinya dibatasi akan menjadikan mahkamah agung sebagai lembaga absolute dalam kekuasaan yudikatif.</p><p>.</p><p>Pasca putusan Mahkamah Konstitusi <a href="http://kepaniteraan.mahkamahagung.go.id/kegiatan/1181-putusan-mk-no-43-puu-xiii-2015-proses-seleksi-hakim-tingkat-pertama-tidak-perlu-melibatkan-ky"> No 43/PUU-XIII/2015</a> tidaklah menjadi penghambat Komisi Yudisial dalam melakukan penegakan kode etik. Bahkan pada sisi lain Komisi Yudisial harus mampu melakukan penerobosan penafsiran bahwa putusan tersebut semata-mata memberikan ruang dan kedudukan Komisi Yudisial untuk merespon upaya kemerdekaan kekuasaan kehakiman yang secara mandiri dan merdeka akan tetapi harus sesuai real nilai-nilai pancasila dan Undang-Undang Dasar Negara Republik Indonesia dengan menempatkan Komisi Yudisial yang nantinya akan menguji idependensi hakim-hakim yang merupakan hasil seleksi dari Mahkamah Agung secara ketat dalam menjalankan tugas dan fungsinya sesuai dengan prinsip-prinsip dasar kode etik yang telah telah dicanangkan sesuai dengan peraturan perundang-undangan yang berlaku.</p><p>Status of the Judicial Commission as the regulatory system in the sense of justice in Indonesia Sangat system makes for a review of integrity and professional judiciary in Indonesia. Even on the other side of the Judicial Commission should be able to make a breakthrough interpretation that the decision merely provides the space and the position of the Judicial Commission to respond to the efforts of the independence of judiciary is independent and free but must be corresponding real values of Pancasila and the Constitution of the Republic Indonesia by placing the Judicial Commission which will examine idependensi judges were selected from the Supreme Court strictly in performing their duties and functions in accordance with the basic principles of the code of conduct that has been implemented in accordance with the legislation in force.</p>

Article 29 paragraph 1 of the 1945 Constitution of the Republic of Indonesia states that "the State is based on the One Supreme Godhead." This means that the state has given legitimacy to Islamic law as formal law in the Indonesian constitutional system. Islamic law has a great opportunity to be formalized into regulations, because the majority of Indonesians are Muslims. Perda Syariah itself in its journey has shown significant developments. There have been 433 regional regulations issued in Indonesia since 1998, however, these regional regulations with Islamic nuances have generated pro-contra attitudes from various parties. This study uses a qualitative research method with a literature approach. The results of the study state that there are still some parties who feel that regional regulations were born only as political needs that are less effective in their implementation, and others think that sharia regulations are an effort to regulate people's behavior so that they are in accordance with living norms.Keywords: Sharia Regional Regulation; Regional Autonomy; Formalization of Islamic Law Abstrak: Pasal 29 ayat 1 Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 menyatakan bahwa “Negara berdasarkan atas Ketuhanan Yang Maha Esa.” Artinya negara telah memberikan legitimasi hukum Islam sebagai hukum formal dalam sistem ketatanegaraan Indonesia. Hukum Islam memiliki peluang yang besar untuk diformalkan menjadi peraturan, karena mayoritas bangsa Indonesia adalah pemeluk agama Islam. Perda Syariah sendiri dalam perjalanannya telah menunjukkan perkembangan yang signifikan. Telah ada 433 Perda lahir di Indonesia sejak tahun 1998, namun Perda-perda bernuansa Islam tersebut menimbulkan sikap pro-kontra dari berbagai pihak. Penelitian ini menggunakan metode penelitian kualitatif dengan pendekatan literatur. Hasil penelitian menyatakan bahwa masih ada sebagian pihak merasa bahwa Perda lahir hanya sebagai kebutuhan politik yang kurang efektif dalam pelaksanaannya, dan  sebagian lain beranggapan bahwa Perda syariah adalah sebuah upaya untuk menertibkan perilaku masyarakat agar sesuai dengan norma-norma yang hidup.Kata Kunci: Perda Syariah; Otonomi Daerah; Formalisasi Hukum Islam

The author analyzes the composition, affairs and tasks of the Government, as well as the Government's attitude towards the National Assembly, the President of the Republic and the state administration, in order to more precisely normative position the Government as the bearer of executive power in the constitutional system of Serbia. The Government of the Republic of Serbia, together with the state administration, represents an extremely complex, fundamentally important system for the functioning of the institutional, legal and political order of our country. Building a legitimate and efficient relationship of cooperation with these bodies, while respecting the competencies and control mechanisms of the Government provided by the Constitution and laws, is a necessary factor in further upgrading Serbia as a state governed by the rule of law, achieving the principle of separation of powers in Serbia.

The paper analyzes Serbian system of local self-government under the Constitution of 2006 and its possible improvements. There are two major aspects of reform. On the one side, there are weaknesses in internal law and practice that were detected in last three decades and six concrete proposals for their correction. On the other side, considering that Serbia negotiates on integration with the EU, some improvements of the system should be a result of that process, fully in accordance with the European standards of local self-government. Reforming the local self-government in both of these directions should lead to better legal framework in the Republic of Serbia and upgrading the constitutional system.
