Efforts to overcome crime through peace based on Restorative Justice, namely justice for all parties are greatly missed by everyone. In carrying out law enforcement duties, the State Police Investigator of the Republic of Indonesia has the duties, functions, and authorities in the field of investigating criminal acts in accordance with the applicable laws and regulations. Based on the Regulation of the National Police Chief Number .6 of 2019 concerning Criminal Investigation, it has a role to carry out prevention efforts without having to use the Criminal Justice System (SPP), namely by resolving cases through the peace process. This process is due to the desire of the community who wants the case to be completed immediately and no longer be complicated. The resolution can be supported by the police's discretionary authority so that the type of research is descriptive empirical juridical, using primary data by means of interviews and secondary data by means of documentation studies. Then all data were processed using qualitative data analysis. Based on the research results, the Pemayung Police Sector policy is to settle criminal cases peacefully (penal police), or through the settlement of criminal cases involving the perpetrator, victim and/or their family and related parties, with the aim of achieving justice for all parties/restorative justice can be carried out, if it does not cause public unrest or there is no community rejection, it will not have an impact on social conflict and the case is still in the process of investigation and investigation. So that it can be directed to a settlement by conducting mediation to the parties, both the victim and the suspect. From the results of the mediation, it was agreed by the parties, both from the reporting party and the reported party as a suspect, admitting all his actions. And from the results of the mediation there was an agreement with the parties (victim and suspect) and a letter of peace was made and the revocation of the Police Report by the victim but after that, the victim came and asked again for the case to be continued, the investigator explained that the agreement had become an agreement of both parties and was binding and the investigation has been discontinued.

This study aims to determine and analyze the process of handling fraud and embezzlement by Central Java Regional Police Criminal Investigation investigators and the progress of handling fraud and embezzlement crime at the Central Java Regional Police Criminal Investigation Directorate. The approach method used is empirical juridical with descriptive analytical research specifications. The data used in the form of primary data and secondary data so that the method of data collection through field studies and literature studies. Data analysis method used is qualitative analysis. As a knife of analysis, the concepts of restorative justice, legal system theory and progressive legal theory are used.The results of the study concluded that the process of investigating fraud and embezzlement in the East Java Regional Police Criminal Investigation Directorate was in accordance with the provisions of the Criminal Procedure Code and the National Police Chief Regulation Number 6 of 2019 on Criminal Investigations. The progress in handling fraud and embezzlement in the Central Java Regional Police Criminal Investigation Directorate is related to the application of restorative justice in investigating criminal acts that starts with two components of the legal basis, namely rules and behavior. <p>Penanggulangan perkara pidana yang terjadi di tengah masyarakat dapat diselesaikan dengan dua metode, yaitu penal dan non penal. Penyelesaian secara non penal salah satunya merupakan Mediasi Penal. Mediasi penal sendiri lahir dari budaya yang ada di dalam masyarakat sehingga kandungan nilai-nilainya sesuai dengan karakteristik Bangsa Indonesia. Namun penerapan mediasi penal ini belum memiliki landasan yuridis yang kuat sehingga perlu diteliti lebih lanjut apa model mediasi yang digunakan serta bagaimana peran aparat penegak hukum. Dalam artikel ini akan dipaparkan proses penyelesaian perkara pidana melalui mediasi penal di tingkat penyidikan dan peran aparat penegak hukum dalam proses mediasi penal. Data pendukung artikel ini menggunakan hasil penelitian dengan jenis kualitatif dan metode pendekatan yuridis sosiologis yang mendasarkan pada data primer dan data sekunder. Pada dasarnya, mediasi penal telah familiar dilaksanakan ditingkat kepolisian didasarkan pada Surat Kapolri No Pol: B/3022/XII/2009/SDEOPS tanggal 14 Desember 2009 tentang Penanganan Kasus Melalui <em>Alternatif Dispute Resolution</em> dengan bentuk mediasi penal yang digunakan adalah <em>victim offender mediation</em>. Model VOM ini dianggap paling layak untuk diterapkan karena mempertemukan antara kedua belah pihak sehingga mengakomodir kepentingan para pihak demi terwujudnya keadilan restoratif.</p><p>Overcoming criminal cases that occur in the middle of society can be solved by two methods, namely reasoning and non-punishment. Non-reasoning settlement is one of them is Penal Mediation. The reasoning mediation itself is born from the culture that exists in society so that the content of its values is in accordance with the characteristics of the Indonesian Nation. However, the application of this reasoning mediation does not yet have a strong juridical basis so it needs to be investigated further what the mediation model is used and how the role of law enforcement officers is. In this article will be presented the process of solving criminal cases through reasoning mediation at the level of investigation and the role of law enforcement officers in the process of judicial mediation. Supporting data for this article uses the results of research with qualitative types and sociological juridical approaches that base on primary data and secondary data. Basically, the reasoning mediation is familiar is carried out at the police level based on National Police Chief No Pol: B / 3022 / XII / 2009 / SDEOPS dated December 14, 2009 concerning Case Handling through Dispute Resolution Alternatives with the form of reasoning mediation that is victim offender mediation. This VOM model is considered the most feasible to implement because it brings together the two parties so that it accommodates the interests of the parties in order to realize restorative justice.</p>

Constitution of the Republic Indonesia 1945 states that Indonesia is a state of law. It is affirmed that the Republic of Indonesia is based on law (rechstaat), not for power merely (machtstaat). Children are the next generation of the nation that must be protected by their rights, so that if there is a criminal act involving children, it should not end in a prison sentence but can be settled in a certain way outside the court. Based on the consideration, the author disscuses this journal with the title "Discretion of Police outside the Court in the settlement of theft cases by children in the family". The problem of the study is about how the application and effectiveness of Police Discretion outside the Court in resolving theft cases by children in the family. In this research, the authors used legal research with an empirical juridical approach by using primary data sources obtained from interviews with National Police investigators and secondary data sources obtained by searching literature such as laws, books and legal dictionaries. The research method used isqualitative data analysis to obtain descriptive analytical data from the sources of data obtained. The conclusion is that there is no regulation which becomes the legal basis for the National Police to settle criminal cases by applying Restorative Justice approaches, especially in the crime of theft committed by child.

This research aims to identify and analyze the existence of the application of criminal penalties in the handling of criminal cases Child Protection in Indonesia and analyze the effectiveness of criminal fines when viewed from the perspective of children as victims of crime.Method used is socio-juridical using primary and secondary data. Primary data collection technique is done with the interview, and secondary data by reading, reviewing and analyzing primary legal materials, secondary legal materials, tertiary legal materials with qualitative analysis techniques, interpreted logically and systematically and drawn conclusions.Based on the survey results revealed that the existence of the application of criminal penalties in the handling of criminal cases Child Protection in Indonesia criminal fines in criminal prospects are just as an alternative or substitute for imprisonment or confinement. And effectiveness this penalty has not run optimally because the defendant would prefer to replace the criminal penalties to imprisonment.The conclusion of this thesis is that the implementation or execution of criminal penalties in Indonesia have not been effective or not maximized because law enforcement or judges tend to prefer the imprisonment of the criminal finesKeywords: Criminal Fines; Criminal Prison; Children.

The problems of this study were 1) the process of resolving the crime of traffic accident committed by a child which causing death in Jurisdiction Police Cirebon, 2) the difference between the completion of the crime of traffic accident by a child which causing death by perpetrators of adults in Police Cirebon City? 3) consideration of the law by the police in the Cirebon City Police enforcement of laws against the crime of traffic accident causing death committed by a child.The method used is research that combines Juridical and Empirical. The source of research data derived from primary data and secondary data obtained by collecting documents and interviewing criminal cases with informants.Based on research findings conducted by researchers regarding law enforcement in case of a traffic accident causing death committed by minors resolved with the criminal justice process method to process outside the criminal justice and restorative justice approach that is Diversion. Based on Act No. 11 of 2012 on the Criminal Justice System Child involvement of multiple stakeholders in the settlement became a mandatory provision. Constraints law enforcement officials in the execution of diversion itself is the factor of legal, officials law enforcement factors, community factors and factors of facilities and infrastructure.Keywords: Law Enforcement; Police; Accident; Traffic; Child.

The research is qualitative research in the form of descriptive analysis using sociological juridical approach. Types and sources of data used are primary data and secondary data. Data collected through the study of literature and interviews, while the juridical analysis using qualitative analysis. The approach used for the treatment of children in conflict with the law based on values, principles and norms. Pure approach puts the welfare and well-being approach to legal intervention. The punishment model approach to restorative justice called today considered more feasible. For the sake of freedom and rights of the child (fundamental rights and freedom of children) as well as the various interests related to the welfare of children. A limiting factor in the application of Restorative Justice against children in violation of the Act Traffic is due to the factor of legislation often misinterpretation, the factor of law enforcement is the lack of knowledge and skills of investigators in solving criminal cases traffic, factors of infrastructure, a factor of society who do not know information about Restorative justice, Cultural factors personal character actors and victims and their families who do not support the case outside of court settlement or peace. Efforts of traffic guards to avoid conflicts / complaints by victims neutral officer, the offender is directed to the relationship and extend our condolences to the victims, conduct deliberations and request assistance from the Institute of Corrections.Keywords: Restorative Justice; Traffic Accident; Child Actors.

In the jurisdiction of the Bali Police, there are also VIP and VVIP escorts which are special escorts from the Police for working visits of government officials visiting the Unitary State of the Republic of Indonesia. In carrying out these mentoring activities, it must be in accordance with the established Standard Operating Procedure (SOP). This study aimed to examine the legal arrangements regarding the security of escorts carried out by Polri members on the way to their destination and reveal the sanctions received by Polri members in carrying out escorts that are not in accordance with Standard Operating Procedures. This study used a normative legal approach to problems and legislation. Sources of data used were primary data and secondary data obtained through reading and taking notes. Furthermore, the data were analyzed descriptively qualitatively. The results of the study indicated that the right to escort is also regulated in Law No. 22 of 2009 Article 134 concerning Road Traffic and Transportation. Sanctions received by Polri members who do not enforce discipline in escort are contained in Government Regulation of the Republic of Indonesia Number 2 of 2003 concerning Discipline of Polri Members or sanctions for violating the implementation of Polri's professional code of ethics as regulated in National Police Chief Regulation Number 14 of 2011 concerning Polri's Professional Code of Ethics.

The establishment of Law No. 11 of 2012 on the Juvenile Criminal Justice System was driven by two aspects, those are restorative justice and the diversion attempt. Those two things aims towards out of court settlement revolving around juvenile criminal cases, as well as recovering losses suffered by victims and rehabilitating the juvenile delinquent. Child imprisinment is only used as the last resort. Therefore, it is quite reasonable to consider Litmas recommendation of not imprisoning children. However, this may not always be the case. This paper will then analyze the reasoning on why there still many recommendations from Bapas Community Advisors in the social research reports that are not considered during the prosecution process. This requires9psearch is a normative research completed by analyzing secondary data. This study explains that there are still many recommendations in Litmas that are not considered at the prosecution stage.

Restorative Justice (Keadilan Berbasis Musyawarah) adalah satu pendekatan utama, yang saat ini, berdasarkanUndang-undang Nomor 11 Tahun 2012 tentang Sistem Peradilan Pidana Anak, wajib dilakukan dalam perkaraanak yang berhadapan dengan hukum. Pendekatan ini lebih menitikberatkan pada kondisi terciptanya keadilandan keseimbangan bagi pelaku tindak pidana serta korbannya sendiri. Mekanisme tata cara dan peradilan pidanayang berfokus pada pemidanaan diubah menjadi proses dialog dan mediasi untuik menciptakan kesepakatan ataspenyelesaian perkara pidana yang lebih adil dan seimbang bagi pihak korban dan pelaku. Pokok permasalahandalam penelitian ini adalah (1) Apa latar belakang filosofis lahirnya Restorative Justice dalam UU SPPA? (2)Mengapa Restorative Justice harus dilakukan sebagai perlindungan terhadap anak yang berhadapan denganhukum; dan (3) Bagaimana cara menerapkan Restorative Justice dalam praktik peradilan pidana sebagaiperlindungan anak yang berhadapan dengan hukum. Metode pendekatan yang dipergunakan dalam penelitianini adalah yuridis normatif dan empiris, yaitu cara atau prosedur yang digunakan untuk memecahkan masalahpenelitian dengan meneliti data sekunder terlebih dahulu untuk kemudian dilanjutkan dengan meneliti dataprimer yang ada di lapangan. Data primer adalah data yang diperoleh langsung dari masyarakat. Hasilpenelitian menunjukkan bahwa Restorative Justice harus dilakukan sebagai wujud perlindungan atas anak yangberhadapan dengan hukum, karena pada dasarnya ia tidak dapat dilepaskan dari konteks yang melingkupinya,sehingga tidak adil apabila ia dikenai sanksi retributif, tanpa memperhatikan keberadaannya dan kondisi yangmelingkupinya. Implementasi Restorative Justice dalam UU Sistem Peradilan Pidana Anak adalah dilakukanmelalui mekanisme Diversi, dengan produk pengadilan berupa penetapan (Pasal 12 dan 52, dan non diversi/mediasi, yang bisa dilakukan di luar atau di dalam persidangan, dengan produk pengadilan berupa putusan,yaitu pidana atau tindakan (Pasal 69). Mekanisme dialog dan mediasi dilangsungkan dengan melibatkan selainkedua belah pihak pelaku dan korban, dapat juga pihak lain. Berdasarkan kesimpulan hasil penelitian dalampraktek peradilan pidana, penerapan Restorative Justice sebagai wujud perlindungan hak anak yang berhadapandengan hukum belum menjadi kecenderungan utama.AbstractRestorative Justice is one of main approach, this time, based on the Law Number 11/2012 concerning JuvenileJustice System need to be done in the case of children against the law. This approach stresses on condition ofhow to create justice and balance to offenders and the victims. Mechanism, procedure and criminal justice arefocused on criminalization changed into dialogue and mediation to find agreement/deal on a fair adjudicationof criminal case to victims and offenders. The main problem in this research is (1) what the background ofphilosophy inception of restorative justice in Indonesia positive law; (2) why restorative justice has to do aschildren protection against the law; and (3) how to apply restorative justice in criminal justice of childrenprotection against the law. This research uses normative and empirical juridical approach that is meansor procedure used to solve the research problem by researching secondary data, previously then proceedprimary data in the field. Primary data obtained by people through observation and interview. The result of thisresearch shows that restorative justice must be done as entity of children protection against the law, because itessentially cannot remove from context that cover it, so it is not fair if he/she has retributive sanction withoutpaying attention existence and condition surrounding him/her. The implementation of restorative justice of theJuvenile Justice System Law carried on diversion mechanism, with court product such as stipulation (articles12 and 52, and non diversion/mediation, can be conducted outside or inside of trial, with verdicts, namelycriminal or criminal action (article 69. Mechanism of dialogue and mediation is held by engaging otherparties. It concludes that the practice of criminal justice, restorative justice as entity of children protectionagainst the law has not become primary tendency, yet.
