The release of decisions with Home Ministers, Ministers of Law and Human Rights, Ministers of Communications and Informatics, Attorney General, The Police Chief of the Republic of Indonesia (Kapolri) and the Head of the National Body of Counter-Terrorism has been the basis for the dissolution and banning of all activities of the Islamic Defenders Front (FPI). Following up on this, it issued a declaration of Maklumat Kapolri No. 1/Mak/I/2021 on compliance with the ban on activities, the use of symbols and attributes and the application of fpi activities. Articel 2d of the maklumat forbidding access, uploading, and disseminating content related to FPI via the Internet is considered to have limited human rights. The study aims to see if there are any infractions and irregularities within the human rights code of the FPI content in the declaration. As for the research method used was normative juridical with a legal and conceptual approach. The source of data used is legislation on human rights, books, articles, and other sources related to the study. It was found in the study that article 2d of the maklumat went beyond the human rights code based on the principles of siracusa and the testing of three sets (three part test). Not only that, article 2d of the maklumat also threatens the freedom of press from journalists and the media in charge of spreading information to the public. The advice of the author regarding this matter should be the chief of police to update the declaration according to the purpose and purpose of the declaration issued, or at least revoke article 2d of the maklumat that feels has restricted the special human rights of free expression. This is so that the entire legal action in this country is consistent with the principles of the state of law and human rights.Keywords: human rights, freedom of expression, freedom of pers

Tujuan Penelitian menganalisis proses penyelesaian pelanggaran Hak Asasi Manusia (HAM) berat pada Persitiwa Trisaksi oelh Kejaksanaan Agung Republik Indonesia. Metode Penelitian yang digunakan adalah metode penelitian hukum. Normative dengan pendekatan kualitatif yang diuraikan secara deskriptif. Hasil peneltian menunjukan bahwa pelanggaran HAM berat pada peristiwa penanganan demonstrasi di Kampus Universitas Trisakti pada tahun 1998, oleh aparat keamanan; sehingga menyebabkan tewasnya empat orang mahasiswa dan ratusan lainnya luka. Komnas HAM telah melakukan (investigasi) penyelidikan terhadap peristiwa tersebut, dan laporan Komnas HAM menyimpulkan telah terjadi pelanggaran HAM berat atas insiden tersebut. Hasil penyelidikan tersebut telah dilaporankn Komnas HAM, dan berkas laporan tersebut telah diserahkan kepada Jaksa Agung; tetapi sampai saat ini (±18 tahun) Jaksa Agung belum memproses ke tingkat peneyidikan dan penuntutan. Alasan Jaksa Agung, berkaitan dengan hal-hal teknis yuridis, yang oleh publik dianggap tidak relevan dengan substansi kasus/masalah. Tetapi intinya aspek politis dan non yudisial lebih mengitari kasus-kasus tersebut. The purpose of this research is to analyze the process of resolving gross violations of human rights (HAM) at the Trisaksi event by the Supreme Court of the Republic of Indonesia. The research method used is legal research methods. Normative with a qualitative approach described descriptively. The research results show that gross human rights violations during the handling of demonstrations at the Trisakti University Campus in 1998, by security forces; causing the death of four students and hundreds of others injured. Komnas HAM has conducted (investigated) investigations into the incident, and the Komnas HAM report concludes that gross human rights violations have occurred in the incident. The results of the investigation have been reported by Komnas HAM, and the report files have been submitted to the Attorney General; but until now (± 18 years) the Attorney General has not yet proceeded to the level of investigation and prosecution. The Attorney General's reasons relate to juridical technical matters which the public deems irrelevant to the substance of the case / problem. But in essence, the political and non-judicial aspects surround these cases.

Freedom of expression and press freedom is the embodiment of the recognition of human rights. Freedom of expression is also the existence of press to disclose the news with honesty and do not get a pressure to deliver the news to the public space, which in news production is known as a work of journalism. Now the  press has gained freedom of expression in the news production process which is guaranteed in the state constitution. Although Article 28 of the Constitution of the Republic of Indonesia 1945 does not point directly at the press, However, Article 28 F emphasis on processing and storage as well as ownership, excavations to information. It also contains provisions on the freedom of expression of others, which should be valued and respected. It shows equality for everyone in his position before the law in accordance with Article 27 1945 Constitution, which emphasizes the recognition of constitutional rights that belong to every person in the state of law in the Republic of Indonesia. Thus the press, which have freedom of expression in the writings of journalistic works are required to be responsible for the published news. So as not to face the legal issues and criminalization, then press should perform tasks and functions to enforce ethics as the precautionary principle when processing the news and broadcast it to the public space, as well as upholding human rights. This chapter examines the events leading to the protests of the press community, culminating in the trial of the daily newspaper, Sóng Thền. It aims to provide a primary source for future studies of the Republic of Vietnam, with a focus on the press. Secondly, the chapter attempts to show that despite governmental efforts in controlling the media, South Vietnamese journalists did not just submit but fought back, without communist influences as many people believed, to defend freedom of expression recognized by the 1967 constitution. They did their job as journalists to inform the public of state affairs and the progress of the war against communism. This is thus a personal account of the trial of Sóng Thền.

This article aims to identify and analyze the legal implications and analyze the regulation of public interest as a condition for implementing deponeering by the Attorney General for the sake of the public interest in the perspective of the development of criminal procedural law. This research is a legal research, obtained from statutory studies (statute approach), concept (conceptual approach), cases. The result of this research is that there is discrimination against equality before the law contained in Article 27 Paragraph (1) of the 1945 Constitution of the Republic of Indonesia and can trigger misinterpretation by the Attorney General. Then in its implementation there is no clear regulation regarding the application of the opportunity principle related to the authority of the attorney general in the implementation of case waiver (deponeering) for the public interest in the Criminal Procedure Code.  Abstrak Artikel ini bertujuan untuk mengetahui dan menganalisis implikasi hukum serta menganalisis terhadap regulasi kepentingan umum sebagai syarat pelaksanaan pengesampingan perkara (deponeering) oleh Jaksa Agung demi kepentingan umum dalam prespektif perkembangan hukum acara pidana.  Penelitian ini merupakan penelitian hukum, yang diperoleh dari studi perundang-undangan (statute approach), konsep (conceptual approach), kasus. Hasil dari penelitian ini adalah adanya diskriminatif terhadap equality before the law yang terdapat dalam Pasal 27 Ayat (1) Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 dan dapat memicu salah tafsir oleh Jaksa Agung. Lalu di dalam pelaksanaannya belum terdapat regulasi yang jelas mengenai penerapan asas oportunitas yang berhubungan dengan kewenangan jaksa agung dalam pelaksanaan pengesampingan perkara (deponeering) demi kepentingan umum di dalam Kitab Undang-Undang Hukum acara Pidana (KUHAP).

Tulisan ini bertujuan untuk mengetahui pengaturan kewenangan jaksa penuntut umum dalam tindak pidana korupsi, serta mengkaji dan menganalisis limitative kewenangan jaksa dalam tindak pidana korupsi, sudahkah mencerminkan adanya kepastian hukum, keadilan dan kemanfaatan sesuai dengan tujuan hukum di Indonesia. Metode yang digunakan dalam tulisan ini menggunakan metode penelitian hukum normatif dengan pendekatan undang-undang (Statute approach) dan pendekatan konseptual (Conceptual approach). Hasil penelitian menunjukkan bahwa dalam penanganan tindak pidana korupsi, Jaksa berwenang melakukan penyelidikan, penyidikan dan penuntutan. Hal-hal yang menjadi limitatif kewenangan jaksa penuntut umum dalam penanganan tindak pidana korupsi diatur dalam Kitab Undang-Undang Hukum Acara Pidana, Undang-Undang Nomor 16 Tahun 2004 tentang Kejaksaan Republik Indonesia, serta Undang-Undang Nomor 31 Tahun 1999 tentang Pemberantasan Tindak Pidana Korupsi. This paper aims to determine the regulation of the authority of the public prosecutor in criminal acts of corruption, and to study and analyze the limitative authority of prosecoturs in criminal acts of corruption, has it reflected the existence of legal certainty, justice and usefulness in accordance with the legal objectives in Indonesia. The method used in this paper uses the normative legal research method with the statute approach and conceptual approach. The results showed that in handling corruption, the prosecutor has the authority to conduct investigations, investigations and prosecutions. Matters which become the limitative authority of public prosecutors in handling corruption are regulated inKitab Undang-Undang Hukum Acara Pidana, Undang-Undang Nomor 16 tahun 2004 concerning the attorney general of the republic of Indonesia, Undang-Undang Nomor 31 Tahun 1999 concerning eradication of criminal acts.

RESUMO  A corrupção vem se apresentando no âmbito das instituições privadas e democráticas, assim como, a nível internacional, entre os setores público e privado. No início da década de 90, começam a surgir uma série de estudos por parte dos organismos internacionais, das agências multilaterais e das organizações não governamentais procurando fornecer uma programação globalizada com temas ligados aos direitos humanos. São inúmeras denúncias noticiadas nos meios de comunicação acerca das práticas corruptivas, o que, acarreta no uso de campanhas anticorrupção por parte de governos para repressão a todos aqueles opositores ou críticos da sua gestão. Isso, de certo, modo pode trazer restrições aos direitos dos denunciantes, contribuindo para violação aos direitos humanos de todo e qualquer pessoa identificada como objetivo político, da transparência e publicidade, da liberdade de expressão e pensamento.  O presente trabalho pretende analisar a proteção dos direitos humanos em seus tratados e convenções internacionais, no que diz respeito aos denunciantes e de todos aqueles que investigam casos de corrupção ligados a ilícitos, práticas fraudulentas em organizações de natureza pública e privada. De tal modo que, a participação do cidadão  mediante o livre exercício da liberdade de expressão e do acesso á informação, possibilita o exercício da cidadania, sem censura estatal, como forma de diminuir a incidência dos atos de corrupção e um controle benéfico ao poder público e a iniciativa privada. Palavras chaves: corrupção, direitos humanos e denunciantes.  ABSTRACT Corruption has been taking place within private and democratic institutions, as well as internationally, between the public and private sectors. In the early 1990s, a series of studies by international organizations, multilateral agencies and non-governmental organizations on the subject began to emerge, seeking to provide a globalized programming with themes related to human rights, There are numerous reports in the media about corrupt practices, which leads to the use of anti-corruption campaigns by governments to repress all those who oppose or critically manage them. This, in a way, may bring restrictions on the rights of whistleblowers, contributing to the violation of the human rights of anyone identified as a political objective, transparency and publicity, freedom of expression and thought. This paper aims to analyze the protection of human rights without their international treaties and conventions, with respect to whistleblowers and all those who investigate cases of corruption linked to illicit, fraudulent practices in organizations of a public and private nature. In such a way that citizen participation and access to information make it possible to exercise authentic citizenship as a means of reducing the incidence of acts of corruption and beneficial control of public power and private initiative, and may contain the benefits of corruption to the public. certain privileged groups and sectors. Keywords: corruption, human rights and whistleblowers.

In accordance with the Decree of the Minister of Justice and Human Rights Number M-05 HT.01.01 of 2002 concerning the Enforcement of the Legal Entity Administration System at the Directorate General of General Legal Administration of the Ministry of Justice and Human Rights of the Republic of Indonesia, determines that all legal entity settlements include the ratification of the deed of establishment PT, application for approval and submission of deed reports, amendments to articles of association, fiduciary registration, will registration, are carried out with the online Legal Entity Administration System. So the notary has the authority to register all these legal acts online. The purpose of this research is to find out the role of the Notary in registering deeds and legalization of legal entities through the Directorate General of AHU Online services and to find out the responsibilities of the Notary if there are problems in registering deeds and legal entity approval through the services of the Directorate General of AHU Online. This study uses a normative juridical research method using a statutory approach and a conceptual approach. The results of the research, namely, the role of the notary in registering deeds and ratifying legal entities is entering deed data, checking all deed data to avoid data entry errors and the notary has the responsibility if there is an error from the notary's office, the notary will make corrections at a cost of Notary, however in this regard there is still cooperation from the applicant regarding the required data.

Tulisan ini ingin menjawab dua isu utama mengenai hubungan hukum internasional dan pengujian undang-undang oleh Mahkamah Konstitusi RI (MKRI). Isu pertama adalah legitimasi penggunaan hukum internasional sebagai alat interpretasi dalam pengujian undang-undang, sedangkan isu kedua adalah urgensi penguasaan hukum internasional oleh hakim MKRI. Tulisan ini merupakan penelitian hukum yang menggunakan pendekatan konseptual dan pendekatan historis dalam menjelaskan perkembangan pengujian undang-undang di Indonesia sekaligus menemukan legitimasi penggunaan hukum internasional oleh MK RI. Kesimpulan dari tulisan ini menegaskan bahwa hukum internasional memiliki sumbangsih yang penting dalam perannya sebagai alat interpretasi dalam proses pengujian undang-undang oleh Mahkamah Konstitusi, khususnya terkait hak asasi manusia. Justifikasi keabsahan praktik penggunaan hukum internasional tersebut ditarik dari tradisi ketatanegaraan yang secara implisit dikehendaki UUD NRI Tahun 1945. Manfaat positif yang diberikan hukum internasional nyatanya harus disertai juga dengan penguasaan hukum internasional oleh hakim MK RI supaya hukum internasional dapat digunakan secara tepat. Pembahasan dalam tulisan ini dibagi ke dalam empat sub bahasan inti yakni, pengujian undang-undang, penggunaan hukum internasional sebagai the interpretative tool dalam pengujian undang-undang oleh MK, legitimasi penggunaan hukum internasional sebagai the interpretative tool dalam pengujian undang-undang, pentingnya penguasaan hukum internasional oleh hakim MK.This article intentionally answers two principal issues regarding the relationship between international law and judicial review by the Constitutional Court of the Republic of Indonesia. The first issue is the legitimacy of international use as an interpretative tool in judicial review. The second issue talks about the necessity of urgent international law mastery by the Constitutional Court’s judges. This legal research utilizes both a conceptual approach and a historical approach to explain the development of judicial review in Indonesia, and to find legitimacy of international law by the Constitutional Court. The analysis in this article affirms that international law positively contributes as an interpretative tool in judicial review by the Constitutional Court, particularly pertaining to human rights. A justification of a legitimate international law use is withdrawn from constitutional tradition which is implicitly desired by the Indonesian Constitution (UUD NRI 1945). Since international law has provided better insights into norms, a mastery of international law should be encouraged. There are four main discussions in this article: judicial review, application of international law in judicial review process, legitimacy of international law application in judicial review, and the importance of international law mastering by Constitutional Court judges.

In South African Human Rights Commission v Qwelane (hereinafter “Qwelane”) the constitutionality of the threshold test for the hate speech prohibition in section 10(1) of the Promotion of Equality and Prevention of Unfair Discrimination Act 4 of 2000 (hereinafter the “Equality Act”) was challenged. Although the court had no difficulty in finding that the publication in question fell squarely within the parameters of hate speech, the judgment is both incoherent and flawed. The court’s conjunctive interpretation of the section 10(1) requirements for hate speech also differs from the disjunctive interpretation given to the same provision in Herselman v Geleba (ECD (unreported) 2011-09-01 Case No 231/09 hereinafter “Herselman”) by the Eastern Cape High Court. The consequence is a “fragmented jurisprudence” which impacts on legal certainty, and which is especially dangerous when the legislation in question is critical to the achievement of the constitutional mandate (Daniels v Campbell NO 2004 (5) SA 331 (CC) par 104 hereinafter “Daniels”).This note demonstrates that the Qwelane court misapplied a number of key principles. These include: the court’s mandate in terms of section 39(2) of the Constitution of the Republic of South Africa, 1996 (hereinafter the “Constitution”); the need to strike an appropriate balance between competing rights in the constitutional framework; the importance of definitional certainty for a hate speech threshold test; the meaning to be ascribed to the terms “hate”, “hurt” and “harm” in the context of hate speech legislation; and the role of international law when interpreting legislation intended to give effect to international obligations.The consequence of these errors for hate speech regulation in South Africa is profound.

Law Number 40 of 1999 concerning the Press is one of the legal regulations that have a role in efforts to realize a good life together. The struggle of the Indonesian press to achieve freedom was finally achieved after the enactment of Law Number 40 of 1999 concerning the Press. The purpose of this study is to find out how the freedom and role of the press in law enforcement are reviewed from the perspective of Law Number 40 of 1999, concerning the press. This study uses a sociological juridical method, the results of research conducted on real facts in society with the intent and purpose of finding facts, then proceeding with finding problems, ultimately leading to problem identification and leading to problem solving. The results of the research include the press trying to carry out its functions, rights, obligations, and roles, so the press must respect the human rights of everyone. The press has an important role in realizing Human Rights (HAM), as guaranteed in the Decree of the People's Consultative Assembly of the Republic of Indonesia Number: XVII/MPR/1998. Based on the results of the research above, it is necessary to uphold the freedom of the press in conveying public information in an honest and balanced manner and that freedom of the press is not absolute for the press alone, but to guarantee the rights of the public to obtain information. what happened in the context of realizing press freedom as contained in Law/040/1999 concerning the Press.
