 Abstract The purpose of the research from this journal is to determine how the position of extramarital child in inheritance law applies in Indonesia. Then afterwards, it will appear how the inheritance law in the Indonesian state regulates the inheritance rights of the out-of-wedlock child. From this research, various problems will also arise that arise as a result of the position of extramarital children who have inheritance rights which must also be recognized, which will then be offered solutions through this journal research based on the laws and regulations that have legally regulated it. The purpose of marriage is to form a happy, eternal and prosperous family. A harmonious family life also arises when a child is blessed. However, some people prefer to have children without a marriage bond. This causes problems in terms of inheritance distribution. In this matter it has been conveyed in accordance with Law Number 1 of 1974 concerning marriage, many have touched on family issues which are closely related to a basis of marriage as Article 1, that: "Marriage is a physical and spiritual bond between a man and a woman as husband and wife with the goal of forming a happy and eternal family (household) based on the One Godhead. " Then, how is the distribution of inheritance for children out of wedlock? Do extramarital child children have the right to inherit?Keyword: extramarital child; inheritance; inheritance rights AbstrakTujuan dari penelitian dari jurnal ini adalah untuk menentukan bagaimana posisi anak luar kawin dalam huklum waris yang berlaku di Indonesia. Kemudian setelahnya, akan dimunculkan bagaimana hukum waris di negara Indonesia mengatur hak mewaris dari anak luar kawin tersebut. Dari penelitian ini, akan dimunculkan juga berbagai permasalahan yang timbul sebagai akibat dari adanya posisi anak luar kawin yang memiliki hak mewaris yang juga harus diakui, yang kemudian akan ditawarkan solusi melalui penelitian jurnal ini dengan berdasarkan pada peraturan peraturan perundang-undangan yang telah mengaturnya secara sah. Tujuan dari perkawinan yaitu membentuk keluarga yang bahagia, kekal dan sejahtera. Kehidupan berkeluarga yang harmonis juga muncul jika telah dianugerahi seorang anak. Namun, beberapa orang lebih memilih untuk memiliki anak tanpa adanya ikatan pernikahan. Hal tersebut menyebabkan munculnya masalah dalam hal pembagian waris. Dalam permasalahan ini telah disampaikan sesuai dengan Undang-Undang Nomor 16 Tahun 2019 tentang Perubahan atas Undang-Undang Nomor 1 tahun 1974 tentang Perkawinan banyak disinggung perihal masalah kekeluargaan yang berhubungan erat dengan suatu dasar perkawinan sebagaimana Pasal 1, bahwa : “Perkawinan ialah ikatan lahir batin antara seorang pria dan seorang wanita sebagai suami istri dengan tujuan membentuk keluarga (rumah tangga) yang bahagia dan kekal berdasarkan Ketuhanan Yang Maha Esa.” Lalu, bagaimana pembagian waris untuk Anak Luar Kawin? Apakah Anak Luar Kawin memiliki Hak sebagai Pewaris?

Pernikahan adalah suatu ikatan lahir batin antara seorang pria dengan seorang wanita sebagai suami istri dengan tujuan membentuk keluarga (rumah tangga) bahagia dan kekal berdasarkan ketuhanan Yang Maha Esa. Perkawinan adalah sah apabila dilakukan atas dasar agama, adat istiadat dan undang-undang, oleh karena itu pernikahan merupakan ikatan yang dilandasi pada moral etika dan agama, kedewasaan calon suami- istri harus telah ”masak jiwa raganya”. Oleh karena itu, agar dapat mewujudkan tujuan pernikahan yang baik serta tercapainya kehidupan keluarga yang harmonis, maka dibutuhkan kematangan baik jasmani maupun spiritual bagi pasangan yang ingin melakukan pernikahan. Tetapi dalam kenyataannya, masih ada terjadi pernikahan di bawah usia. Di mana hal tersebut sangatlah beresiko bagi pernikahan yang akan dijalani. Menyikapi fenomena tersebut, maka para pelayan atau hamba Tuhan memiliki komitmen untuk menolong, mengarahkan, membimbing, menopang dan menuntun supaya orang tua memahami dasar pernikahan Kristen yang Alkitabiah. Marriage is a spiritual bond between a man and a woman as husband and wife with the aim of forming a happy and eternal family (household) based on the divinity of the Almighty. Marriage is legal if it is done on the basis of religion, customs and laws, therefore marriage is a bond based on moral ethics and religion, the maturity of a prospective husband and wife must have "cooked their body and soul". Therefore, in order to realize the goal of a good marriage and the achievement of a harmonious family life, it takes both physical and spiritual maturity for couples who want to get married. But in reality, there is still underage marriage. Where it is very risky for the marriage that will be lived. Responding to this phenomenon, the servants or servants of God have a commitment to help, direct, guide, support and guide so that parents understand the basic Christian biblical marriage.

A harmonious family life will be achieved when the husband and wife occur in a balanced relationship, which the husband and wife are able to acquire the right and obligation of each well. Basically, the ideal concept of relationship between husband and wife in islam is equality partnership. Most of residents in Perum Reninggo Asri work at PT. Pertamina Cilacap, thus the family financial needs are sufficient. Husband has a dominant, superior role in family, and entirely holds the family finances, so that the wife is just given money for buying daily needs. Understanding and practice of the relationship between husband and wife in the fullfilment of rights and obligations that occur in Perum Reninggo Asri Gumilir Cilacap which a husband who bear the economic needs of the family, demanded a wife in the Reninggo Asri housing must be able to perform duties at home totally. This article examines the understanding and practice of relationsip between husband and wife which occur in Perum Reninggo Asri with approach of maqasid asy-syari’ah. [Sebuah keluarga yang harmonis akan tercapai apabila dalam kehidupan suami isteri terdapat relasi yang seimbang, di mana antara suami dan isteri mampu memenuhi hak dan kewajiban masing-masing dengan baik. Pada dasarnya, konsep hubungan antara suami isteri yang ideal menurut Islam adalah konsep kemitrasejajaran atau hubungan yang setara. Warga di Perum Reninggo Asri mayoritas bekerja di PT. Pertamina Cilacap, sehingga pemenuhan kebutuhan finansial keluarga dikatakan cukup. Suami sebagai pencari nafkah juga mempunyai peran yang dominan dan superior terhadap keluarga. Suami sepenuhnya memegang keuangan keluarga, sehingga isteri hanya diberi uang untuk belanja kebutuhan pokok sehari-hari. Pemahaman dan praktik relasi suami isteri dalam hal pemenuhan hak dan kewajiban yang terjadi di Perum Reninggo Asri Gumilir Cilacap bahwa seorang suami yang secara keseluruhan menanggung kebutuhan ekonomi keluarga menuntut seorang isteri di Perumahan Reninggo Asri harus dapat menjalankan kewajibannya di rumah secara totalitas. Marriage is a bond between man and woman which is also the religion of Islam is a way of worship, that in the community there is monogamy: one husband and one wife, but there are also polygamous marriage is one man with more than one wife with their applicable laws and regulations for implementation. The purpose of this study was to: 1) To determine the function of the marriage covenant can provide legal protection of the rights wife and children in polygamous marriages. 2) To determine the right of wife and children in polygamous marriages. 3) To know the legal remedies can be done to determine the rights of wives and children in polygamous marriages. Based on the results of data analysis concluded that: 1) The function of the marriage contract may provide legal protection of the rights of the wife and children in polygamous marriages as a certainty or limitation of rights received by his wife and children during the marriage took place and as a measure for husbands to act fairly in polygamous marriages , 2) The position of the right wife and children in polygamous marriages, namely the right wife by the husband proportionate balanced well after their second marriage and so are the rights of children still get their right in accordance with the provisions of the Act. 3) Remedies that can be done to determine the right istir and children in polygamous marriages with authentic mating agreements made governing the boundary between the rights and obligations of husband and wife in a polygamous marriage.Keywords: Marriage; Polygamy; Marriages Agreement; Wife and Children's Rights.

AbstractThis research aims to analyze whether a husband/wife has the right to act by themselves in the case of land right purchase or mortgage, also the means that can be done to induce legal certainty in this matter. The purchase of land rights using money from the marital property should be done together by the husband and wife, or with a statement of approval from the husband/wife. The mortgage of a land right which is a part of a marital property or inheritance property must be done together by all the joint-owners; if an authority is required, it must be given in the form of Power of Attorney to Impose Mortgage. The means that can be done to induce legal certainty in this matter is by making some changes in the laws and regulations concerning marriage, land, and mortgage. IntisariPenelitian ini bertujuan untuk menganalisis apakah seorang suami/istri berwenang untuk bertindak sendiri dalam membeli dan/atau menjaminkan harta bersama berupa hak atas tanah serta upaya untuk mewujudkan kepastian hukum dalam hal tersebut. Pembelian hak atas tanah menggunakan uang dari harta bersama seharusnya dilakukan bersama-sama oleh suami-istri atau diberikan pernyataan persetujuan dari istri/suaminya. Penjaminan hak atas tanah yang merupakan harta bersama maupun harta warisan seharusnya dilakukan bersama-sama oleh para mede-eigenaar; jika menggunakan kuasa, harus dalam bentuk Surat Kuasa Membebankan Hak Tanggungan. Upaya untuk mewujudkan kepastian hukum dalam hal ini adalah mengubah beberapa ketentuan peraturan perundang-undangan mengenai perkawinan, pertanahan dan Hak Tanggungan.

The legal position of Astra's children in Balinese traditional inheritance law after their parents are legally married will follow their father. Many are found in community life, the incidence of children born to women who are not yet in a legal marriage bond so that it can cause problems. This study aims to explain the legal position of Astra's children after the enactment of Law Number 1 of 1974 concerning Marriage and to describe the inheritance rights of Astra's children in Balinese customary law after their biological parents are legally married. This study used normative research by examining the prevailing laws and regulations by relating the realities in the field, in this regard, of course, the right approach is the Legislative Approach. The legal materials used were primary and secondary legal materials. Furthermore, the collected legal materials are processed and analyzed using systematic interpretation analysis techniques. The results showed that the position of Anak Astra after the enactment of Law no. 1 of 1974, legally only has a civil relationship with his mother and his mother's family. The rights of Astra's children in Balinese customary law After their biological parents get married legally in Bali, it is after Astra's child is born in a legal marriage that his rights and status are according to his father (purusa).

The availability of nafkah (money given by husband to his wife for household expenses) in family life often becomes a source of conflict. Moreover, nafkah often becomes a reason for husband and wife for divorce. This is due to the obligation for providing nafkah is relied on husband (man) rather than wife (woman). Yet, on the one hand, “nafkah relied on husband” is often used by husband to powerfully control over his wife. On the other hand, in a culture of matrilocal residence (in wife’s home with her parents), “nafkah relied on husband” can be also used by wife to powerfully control her husband  and this becomes a means for woman to subordinate and oppress her husband. Furthemore, for both husband or wife, “nafkah relied on husband” may often becomes a trigger to divorce. Therefore, it is important to redefine such strict division of gender role and contextually give more priority to equality in gender role in households life.Copyright (c) 2015 by Al-Ihkam. <div><p>Perkawinan merupakan salah satu bentuk atau wujud untuk membentuk keluarga yang bahagia dan kekal, serta untuk melanjutkan keturunan. Untuk mewujudkan tujuan dari adanya perkawinan tersebut, seringkali suami dan isteri memiliki kendala dalam memperoleh keturunan. Oleh karena itu, perkembangan teknologi khususnya dalam medis memberikan alternatif demi memperoleh keturunan, salah satu caranya dengan proses bayi tabung. Pelaksanaan bayi tabung dapat dilakukan dengan berbagai cara, salah satunya donor sperma. Sementara itu, anak yang sah berdasarkan Pasal 42 Undang-Undang Perkawinan dan definisi orang tua menurut Pasal 1 angka 4 Undang-Undang Nomor 35 Tahun 2014 tentang Perubahan Atas Undang-Undang Nomor 23 Tahun 2002 tentang Perlindungan Anak memberikan hak dan kewajiban bagi masing-masing, salah satunya hak mewaris bagi anak.Penelitian ini dilakukan dengan yuridis normatif dengan pendekatan perundang-undang (<em>statue approach</em>) untuk membandingkan peraturan mengenai hak mewaris anak melalui proses bayi tabung dengan teori hukum yang ada. Deskriptif analitis digunakan untuk mendeskripsikan dan memberikan gambaran mengenai peraturan perundang-undangan yang berlaku dengan hak mewaris anak melalui proses bayi tabung khususnya donor sperma, sehingga penelitian ini merupakan penelitian kualtitatif.<strong><em> </em></strong>Proses bayi tabung dengan donor sperma dilakukan berdasarkan atas izin suami, maka kedudukan anak tersebut disamakan dengan anak yang sah yang lahir dalam perkawinan yang sah menurut BW. Oleh karena itu, anak tersebut sesuai dengan Pasal 830 BW termasuk dalam golongan I mewaris dari orang tuanya apabila orang tuanya telah meninggal dan terikat dengan <em>Legittieme Portie</em> sebagaimana anak sah dalam BW.</p><p>Marriage is one form or form to form a happy and eternal family, and to continue descent. To realize the purpose of the marriage, husband and wife often have obstacles in obtaining offspring. Therefore, the development of technology, especially in medicine, provides an alternative for obtaining offspring, one of the ways is through the process of IVF. The implementation of IVF can be done in various ways, one of which is sperm donors. Meanwhile, legal children based on Article 42 of the Marriage Act and the definition of parents according to Article 1 number 4 of Act Number 35 of 2014 concerning Amendments to Law Number 23 of 2002 concerning Child Protection provide rights and obligations for each one of them is inheritance rights for children. This study was conducted with normative juridical approach to the statue (statue approach) to compare regulations regarding the right to inherit children through IVF process with existing legal theory. Descriptive analytics is used to describe and provide an overview of applicable laws and regulations with the right to inherit children through IVF processes, especially sperm donors, so this research is a qualitative study. The process of IVF with sperm donors is carried out based on the husband's permission, so the position of the child is equated with a legitimate child born into a legal marriage according to BW. Therefore, the child in accordance with Article 830 BW is included in group I inheriting from his parents if his parents have died and are bound by Legittieme Portie as a legitimate child in BW.</p></div>

All people who enter the gates of family life through marriages intend to achieve a  prosperous and harmonious family life and receive blessing in this world and the next. Marriages must therefore be done in accordance with religious law. A marriage is legal if conducted in accordance with one’s religion, and must be recorded in the Office of Religious Affairs (KUA). Marriages which are not recorded by authorized officials are sirri marriages, and are contrary to legislation. Furthermore, its harm can be seen from its consequence, the lack of legal certainty between husband and wife and the children. This entails the legal consequence that sirri marriages do not have a Marital Deed and children borne of such marriage receive no government recognition, and are considered children born out of wedlock, only having civil relations with the mother and the mother’s family. The wife and children abandoned by a biological father cannot take legal action for the fulfillment of their economic rights or for joint marital assets.

One of the rights guaranteed by the 1945 Constitution of the Republic of Indonesia is the right to marry and have children. Marriage is the beginning of the process of embodiment of the formation of a family in human life. Therefore, marriage is not merely the fulfillment of biological needs, but more than that. Marriage is a part of Human Rights stipulated in Article 10 of the Human Rights Law that everyone shall have the right to start a family and to continue the offspring through legitimate marriage and it may only take place at the free will of the prospective husband and future wife. Marriage is the inner bond between a man and a woman as a husband and wife with the aim of forming a happy and eternal family (household) based on the One Supreme God (Article 1 of the Marriage Law). Based on the article, it can be seen that the purpose of marriage is to establish a happiness and an eternal household based on the One God. Marriage is permissible for those who have met the age limit for marriage as set forth in Article 7(1) of the Marriage Law, for man nineteeen years old and for woman sixteen years old, but in fact under age marriages still happen. According to human rights perspective, under age marriage is the action of grabbing children freedom, namely the right to grow and develop optimally. Prevention of under age marriage, should be done so the children still get their basic rights.
