Pemilu yang adil dan kredibel hanya dapat direalisasikan jika dikelola oleh badan independen. Konstitusi menyatakan bahwa pemilihan dilakukan oleh badan penyelenggara yang mandiri tanpa menjelaskan lebih lanjut makna kemandirian tersebut. Melalui metode penelitian hukum normatif dan dengan menggunakan pendekatan perundang-undangan dan pendekatan kasus, penelitian ini bertujuan untuk mengetahui model kelembagaan penyelenggara pemilu pascareformasi dan makna independensi Pasal 22E ayat (5) UUD 1945 berdasarkan interpretasi Mahkamah Konstitusi. Hasil penelitian menunjukkan bahwa model kelembagaan penyelenggara pemilu pascareformasi adalah model independen yang tidak melibatkan perwakilan partai politik dan birokrasi. Sebagaimana tampak dari berbagai putusan pengujian undang-undang, Mahkamah Konstitusi menafsirkan bahwa kemandirian lembaga penyelenggara pemilu yang dikehendaki oleh UUD 1945 adalah kemandirian institusional, kemandirian fungsional, dan kemandirian personal.Credible and fair election can only be realized if managed by an independent institution. The Constitution states that elections are carried out by independent electoral management bodies without further explanation of the meaning of independence. Through normative legal research methods and by using statutory and case approaches, this research aims to find out the model of post-reform election management bodies and the meaning of independence of Article 22E paragraph (5) of the 1945 Constitution based on Constitutional Court interpretation. The results of this research found that the post-reform election organizing model is an independent model that does not involve representatives of political parties and bureaucracy. As can be seen from the judicial review rulings, the Constitutional Court interprets that the independence of election management bodies desired by the 1945 Constitution includes institutional independence, functional independence and personal independence.

The problem began because there was an Application to Judicial Review Article 182 Letter l specifically in the phrase "other work" Law Number 7 of 2017. The applicant requested the Constitutional Court to interpret the phrase "other work". The request was finally granted by the Constitutional Court which interpreted the phrase "other work" in Article 182 letter l of the Act to also serve as a Political Party Functionary. For the Decision, there are Parties who disagree, finally the KPU Regulation Number 26 Year 2018 which accommodates the MK Decision so that candidates for DPD members resign from Political Parties to the Administrative Court and MA. The problem is that the Decision of the Administrative Court and Supreme Court is different from the Constitutional Court Decision, both decisions allow political party functionaries to register as candidates for the DPD. In solving these problems the author uses the Normative Legal Research Method, the author's conclusion is that the principle of the Erga Omnes and the principle of the Negative legislator attached to the Constitutional Court Decision is not effective. While the author's suggestion is that there is a need for a revision of the Constitutional Court Law by adding sanctions to institutions or communities that do not follow the MK Decision.

Tulisan ini ingin menjawab dua isu utama mengenai hubungan hukum internasional dan pengujian undang-undang oleh Mahkamah Konstitusi RI (MKRI). Isu pertama adalah legitimasi penggunaan hukum internasional sebagai alat interpretasi dalam pengujian undang-undang, sedangkan isu kedua adalah urgensi penguasaan hukum internasional oleh hakim MKRI. Tulisan ini merupakan penelitian hukum yang menggunakan pendekatan konseptual dan pendekatan historis dalam menjelaskan perkembangan pengujian undang-undang di Indonesia sekaligus menemukan legitimasi penggunaan hukum internasional oleh MK RI. Kesimpulan dari tulisan ini menegaskan bahwa hukum internasional memiliki sumbangsih yang penting dalam perannya sebagai alat interpretasi dalam proses pengujian undang-undang oleh Mahkamah Konstitusi, khususnya terkait hak asasi manusia. Justifikasi keabsahan praktik penggunaan hukum internasional tersebut ditarik dari tradisi ketatanegaraan yang secara implisit dikehendaki UUD NRI Tahun 1945. Manfaat positif yang diberikan hukum internasional nyatanya harus disertai juga dengan penguasaan hukum internasional oleh hakim MK RI supaya hukum internasional dapat digunakan secara tepat. Pembahasan dalam tulisan ini dibagi ke dalam empat sub bahasan inti yakni, pengujian undang-undang, penggunaan hukum internasional sebagai the interpretative tool dalam pengujian undang-undang oleh MK, legitimasi penggunaan hukum internasional sebagai the interpretative tool dalam pengujian undang-undang, pentingnya penguasaan hukum internasional oleh hakim MK.This article intentionally answers two principal issues regarding the relationship between international law and judicial review by the Constitutional Court of the Republic of Indonesia. The first issue is the legitimacy of international use as an interpretative tool in judicial review. The second issue talks about the necessity of urgent international law mastery by the Constitutional Court’s judges. This legal research utilizes both a conceptual approach and a historical approach to explain the development of judicial review in Indonesia, and to find legitimacy of international law by the Constitutional Court. The analysis in this article affirms that international law positively contributes as an interpretative tool in judicial review by the Constitutional Court, particularly pertaining to human rights. A justification of a legitimate international law use is withdrawn from constitutional tradition which is implicitly desired by the Indonesian Constitution (UUD NRI 1945). Since international law has provided better insights into norms, a mastery of international law should be encouraged. There are four main discussions in this article: judicial review, application of international law in judicial review process, legitimacy of international law application in judicial review, and the importance of international law mastering by Constitutional Court judges.

The purpose of this research is to determine the constitutional complaint mechanism based on comparisons in other countries, practices, and adaptation of constitutional complaints under the authority of the Constitutional Court of the Republic of Indonesia. Many cases with constitutional complaint substance have been submitted to the Constitutional Court of the Republic of Indonesia even though they don’t have this authority. This research uses a normative legal research method using a statutory approach, a conceptual approach, a comparative approach, and a case approach. This research indicates that the constitutional complaint mechanism in Germany, South Korea, and South Africa has been well implemented. In practice, cases with constitutional complaint substance are filed to the Constitutional Court of the Republic of Indonesia by changing the form by using the legal means of a judicial review, such as case number 16/PUU-VI/ 2008, case number 140/PUU-XIII/2015 and case number 102/PUU-VII/2009. Due to the consideration of the structure, substance, and culture of law, adaptation of constitutional complaint within the authority of the Constitutional Court of the Republic of Indonesia needs to be carried out by amending Law Number 24 of 2003 jo. Law Number 7 of 2020 concerning the Constitutional Court.

Political parties as legal entities may be subject to criminal liability as they are seen from the characteristic of political parties in accordance with the characteristics of the legal entity. The dissolution of political parties becomes one of the legal issues governed by Indonesian legislation. The problem of this research is: 1) how is the Constitutional Court Authority in the dissolution of political parties in Indonesia? 2) How is the mechanism of dissolution of political parties? The type of research and approach problems used is normative legal research and statutory approaches. The source of the legal material used is the primary source of legal material and the source of secondary legal material. The technique of collecting legal materials is the technique of library study. The collected legal materials are processed and analyzed using legal arguments. The result of this research is the procedure of the dissolution of political parties in the Constitutional Court as follows: Application submission, application registration and trial schedule, preliminary examination, trial examination, meeting Judge, the verdict of the Constitutional Court. The result of the dissolution of political parties may result in external rights and obligations, due to elected positions, due to the status of managers and members and the consequences of internal rights and obligations.

The Constitutional Court based on Article 24C of the 1945 Constitution of the Republic of Indonesia has 4 authorities and 1 obligation. These provisions are further contained in Article 10 of Law Number 24 Year 2003 concerning the Constitutional Court. The constitutional authority of the Constitutional Court in examining, adjudicating and deciding cases of judicial review of the constitution is about the constitutionality of norms. The method used is normative (doctrinal) legal research, using secondary data in the form of primary, tertiary and secondary legal materials. One of the legal materials used as the basis for analysis is the judge's decision and its implications for the judicial review. The results of the study that, the authority to test the Act against the 1945 Constitution theoretically or practically, makes the Constitutional Court as a controlling and balancing body in the administration of state power. The KPK is not the object of the Parlement questionnaire rights. The ruling emphasized that the KPK was an institution that could be the object of the questionnaire right by the Parlement. The implications of the decision of the Constitutional Court Number 36 / PUU-XV / 2017, can be grouped in two ways, namely: first, the implications are positively charged, namely the affirmation of the ownership of the House of Representatives questionnaire rights in Indonesian governance. Second, the negative implication is the possibility of using the DPR's excessive questionnaire rights without regard to existing limitations.Keywords : constitutional court; KPK; parlement.Mahkamah Konstitusi berdasarkan Pasal 24C UUD NRI Tahun 1945 memiliki 4 kewenangan dan 1 kewajiban. Ketentuan tersebut dituangkan lebih lanjut dalam Pasal 10 UU Nomor 24 Tahun 2003 tentang Mahkamah Konstitusi. Kewenangan konstitusional Mahkamah Konstitusi dalam memeriksa, mengadili dan memutus perkara pengujian undang-undang terhadap Undang-Undang Dasar adalah mengenai konstitusionalitas norma. Metode yang digunakan adalah penelitian hukum normatif (doktrinal), dengan menggunakan data sekunder berupa bahan hukum primer, tersier dan sekunder. Salah satu bahan hukum yang dijadikan dasar analisis adalah putusan hakim dan implikasinya terhadap yudicial review. Hasil penelitian bahwa, kewenangan menguji Undang-Undang terhadap Undang-Undang Dasar 1945 secara teoritis atau praktis, menjadikan Mahkamah Konstitusi sebagai lembaga pengontrol dan penyeimbang dalam penyelenggaraan kekuasaan negara, Dalam Putusan Nomor 36/PUU-XV/2017, Mahkamah Konstitusi memutuskan menolak permohonan pemohon yang pada intinya menyebut KPK bukan merupakan objek hak angket DPR. Putusan tersebut menegaskan KPK merupakan lembaga yang dapat menjadi objek hak angket oleh DPR. Implikasi dari putusan Mahkamah Konstitusi Nomor 36/PUU-XV/2017 tersebut, dapat dikelompokkan dalam dua hal, yaitu: pertama, implikasi yang bermuatan positif, yaitu penegasan dimilikinya hak angket Dewan Perwakilan Rakyat dalam ketatanegaran Indonesia. Kedua, Implikasi yang bermuatan negatif yaitu adanya kemungkinan penggunaan hak angket DPR yang eksesif tanpa memperhatikan batasan-batasan yang ada.Kata Kunci: DPR; KPK; Mahkamah Konstitusi.

Tujuan penelitian ini adalah menggambarkan secara sistematis hal-hal yang berkaitan dengan kewenangan kelembagaan negara setelah perubahan UUD 1945. Metode penelitiannya adalah penelitian hukum-normatif dengan menggunakan pendekatan konsep dan perundang-undangan. Hasil dari penelitian ini menyimpulkan bahwa adanya perubahan mendasar terkait dengan pola pembagian kekuasaan pada tiga cabang kekuasaan ; legislatif, eksekutif, dan yudikatif. Lembaga berwenang dalam pembuatan UU, lembaga eksekutif tetap dalam tugas pemerintahan dan lembaga yudisial telah memperkuat fungsi dan peranannya di bidang peradilan dengan membentuk institusi baru yaitu Mahkamah Konstitusi. Lembaga ini mempunyai kewenangan melakukan uji materi (judicial review) UU atas UUD, yang sebelumnya menjadi tugas dari MA.<br /><br />The objective of this research is to systematically describe aspects relating to the authority of state instrumentalities after the amandment of UUD 1945. The method of this research is normative- legal research using conceptual legislation approaches. The result reveals a fundamental changing on authority distribution pattern within three authority branches: legislative, executive and judicative. The legislative body of the state holds an authority to dispense regulations, while the executive body is responsible for running the governance, and the judicial body strengthens its function and its role in court system and possesses authority to form new institution namely Constitutional Court. This institution has the authority to undertake judicial review on the Constitution which is used to be the responsibility of Supreme Court.<br /><br /><br />Kata Kunci: Kewenangan Kelembagaan Negara, Perubahan UUD 1945<br /><br />

The Constitutional Court is one of the branches of judicial power that has authority to adjudicate at the first and last level whose decision is final to test the law against the Constitution as regulated in Article 24C paragraph (1) of the 1945 Constitution. The final nature of  decision of the constitutional court is binding on the entire community since it was said in the Open Plenary Session. Therefore, decision of constitutional court that invalidates the validity of a law must be followed up by legislators in the cumulative list open to the national legislation program. But in practice there are 2 (two) decisions that have not been followed up, namely Constitutional Court Decision Number 31 / PUU-XI / 2013 and Constitutional Court Decision Number 30 / PUU-XVI / 2018. Based on this description, it will be examined regarding the legal implications of not implementing the Constitutional Court Decision in case of judicial review? The author examines the problem using the method of normative legal research with the statutory approach. From the results of this study, it was found that the non-follow-up of the two decisions had violated the principle of rule of law in concept of the rule of law, and caused the loss of the decision-making power, and was a form of neglect of principle of legal awareness. So it is necessary to make changes in stages of the Constitutional Court Law and the House of Representatives' Regulations on Rules of Procedure.

Kajian ini untuk mengkaji eksistensi Komisi Yudisial Republik Indonesa dalam menciptakan hakim agung yang berkualitas dan berintegritas. Metode peneltia yang digunaka menggunakan metode peneltian hukum normatif. Hasil kajian menunjukkan bahwa Kewenangan Komisi Yudisial sebagaimana diatur dalam Pasal 24B ayat (1) UUD 1945 mengalami dinamika dan perubahan dalam penafsiran baik pada tingkat legislasi di DPR, ajudikasi di Mahkamah Konstitusi dan Mahkamah Agung, maupun pada tingkat regulasi di Mahkamah Agung dan Komisi Yudisial.Eksistensi Komisi Yudisial mengusulkan pengangkatan hakim agung telah mengalami perluasan makna mencakup hakim ad hoc di Mahkamah Agung serta penguatan dengan dihapuskan kewenangan DPR untuk memilih calon hakim agung dan hanya menyetujui atau tidak menyetujui calon hakim agung usulan Komisi Yudisial. This study is to study the existence of the Judicial Commission of the Republic of Indonesia in creating high-quality judges with integrity. The research method used uses normative legal research methods. The results showed that the authority of the Judicial Commission as referred to in Article 24B paragraph (1) of the 1945 Constitution experienced dynamics and changes in interpretation both at the legislative level in the DPR, adjudication in the Constitutional Court and Supreme Court, as well as in the Supreme Court and Judicial Commission. The existence of the Judicial Commission proposing the appointment of a Supreme Court judge has broadened the meaning including ad hoc judges in the Supreme Court and strengthened by abolishing the authority of the DPR to elect candidate judges and only approving or not approving candidates for the proposed Judicial Commission.

In judicial review on Article 9 of Law No. 42 of 2008 on Election of President and Vice-President which regulates presidential threshold, the Constitutional Court declined it since it is an open legal policy mandated by Article 6 paragraph (5) of the 1945 Constitution that the administration of President and Vice-President election will be further regulated in a Law. This reason is deemed insufficient as the Article 6 paragraph (5) regulates procedures (phases of the process), not requirements for candidates of President and Vice President to be eligible on participating in the election. Moreover, Article 9 of Law No. 42 of 2008 potentially expands the norms as stipulated in Article 6A paragraph (2) of the 1945 Constitution in which the candidates for President and Vice President shall be nominated by a political party or coalition of political parties participating in the election prior to the election without any other frills (the threshold).The term presidential threshold that is being used up until now is actually incorrect term; instead, presidential candidacy threshold should be considered as the more appropriate term.Keywords: Presidential Election, Presidential threshold, Constitutional Court Verdict.

Kontestan pilkada tidak hanya berasal dari partai politik, melainkan seiring dinamika pilkada yang terjadi di Aceh Tahun 2006, telah menuntut Mahkamah Konstitusi bernilai aksiologis melalui berbagai putusannya untuk mengakomodir calon perseorangan dalam kontestasi pilkada secara nasional. Bagaimana latar belakang implementasi calon perseorangan dalam pesta demokrasi, khususnya melalui pilkada? Bagaimana aksiologis mahkamah konstitusi dalam mengokohkan perwujudan nilai demokrasi, khususnya pada daerah otonom Aceh?. Penelitian ini merupakan penelitian hukum normatif, jenis data yang digunakan adalah data sekunder, yang terdiri dari bahan hukum primer (perundang-undangan, putusan Mahkamah Konstitusi), bahan hukum sekunder (karya ilmiah), dan bahan hukum tersier (ensiklopedia dan kamus). Adapun metode pengumpulan datanya adalah melalui studi kepustakaan, yaitu meneliti dan menggali bahan-bahan hukum, selanjutnya teknik analisis data yang dipakai adalah teknik analisis kualitatif. Keberadaan calon perseorangan dalam kontestasi pilkada nasional, diawali ketika pelaksanaan pilkada di Aceh pada Tahun 2006, berawal dari pelaksanaan pilkada di Aceh timbulnya kesadaran kolektif masyarakat tentang urgensitas calon perseorangan, fase berikutnya dilakukan judicial review atas Undang-Undang No. 32 Tahun 2004 tentang Pemerintahan Daerah, bermuara dengan putusan MK Nomor 5/PUU-V/2007, yang pada hakikatnya mengakomodir calon perseorangan sebagai salah satu kontestan dalam pilkada secara nasional. Mahkamah Konstitusi berperan secara aktif, menjadi lembaga negara yang bernilai aksiologis melalui berbagai putusannya (Putusan Mahkamah Konstitusi Nomor 35/PUU-VIII/2010, Putusan Mahkamah Konstitusi Nomor 108/PHPU.D-IX/2011, Putusan Mahkamah Konstitusi Nomor 1/SKLN-X/2012) dalam rangka meluruskan berbagai friksi dan sengkarut yang melingkupi Pilkada di Aceh.Regional head election contestants not only come from political parties, but in line with the electoral dynamics that occurred in Aceh in 2006, have demanded the Constitutional Court aesthetic value through various decisions to accommodate individual candidates in national election contestation. What is the background of the implementation of individual candidates in democracy parties, especially through elections? How is the axiological of the Constitutional Court in affirming the realization of the value of democracy, especially in the autonomous region of Aceh?. This study is a normative legal research, the type of data used is secondary data, consisting of primary legal material (legislation, Constitutional Court decision), secondary legal material (scientific work), and tertiary legal material (encyclopedia and dictionary). The existence of individual candidates in the national election contest, preceding the implementation of the elections in Aceh in 2006, started from the implementation of the elections in Aceh the emergence of collective awareness of the public about the urgency of individual candidates, the next phase of the judicial review of Law No. 32 of 2004 on Regional Government, led to the decision of Constitutional Court No. 5/PUU-V/2007, which essentially accommodate individual candidates as one contestant in the national election. The Constitutional Court is actively involved in becoming a state institution with axiological value through its decisions (Decision of the Constitutional Court No. 35/PUU-VIII/2010, and No.108/PHPU.D-IX/2011, also No. 1/SKLN-X/2012) in order to straighten out the various frictions surrounding the elections in Aceh.
