Implementation of national development that utilizes natural resources, environmental legislation becomes an important aspect as the legal basis. This research uses normative juridical approach, through the approach of legislation approach, conceptual approach and anlytis approach. Limitations of research on the Inventory of positive law and research on legal system. The result of theresearch shows that the concept of harmonization of the regulation of the environment in the framework of sustainable development must be based on theprinciples, theories and philosophies which underlie the formation of a law. It should consider the characteristics of the Indonesian nation so that the rules can be easily implemented.

This study aims to discover the principles of law in the use of natural resources. Pemanfaatan natural resources for the development and preservation of environmental functions must not be contradictory and mutual sacrifice, even the two should be mutually supportive and running parallel. The research method used is Normative or Doctrinal Law research, namely research on Legal Principles, Concepts, and Implementation in society. The type of pure legal research is research based on the view that law is a positive norm in the national legal system of legislation. Oriented in a positivistic understanding with a doctrinal method, a statute approach, a conceptual approach. The findings of this study are that the characteristics of laws and regulations that regulate the use of natural resources already contain the principles of sustainable development. Characteristics of statutory regulations governing the use of natural resources in the future in order to guarantee the value of certainty, the value of justice, and the value of the benefit in regulating the use of natural resources according to their function.

We argue that environmental legislation and regulation of more developed countries reflects significantly their moral values, but in less developed countries it differs significantly from their moral values. We examined this topic by using the keywords “sustainability” and “sustainable development”, studying web pages and articles published between 1974 to 2018 in Web of Science, Scopus and Google. Australia, Zimbabwe, and Uganda were ranked as the top three countries in the number of Google searches for sustainability. The top five cities that appeared in sustainability searches through Google are all from Africa. In terms of academic publications, China, India, and Brazil record among the largest numbers of sustainability and sustainable development articles in Scopus. Six out of the ten top productive institutions publishing sustainable development articles indexed in Scopus were located in developing countries, indicating that developing countries are well aware of the issues surrounding sustainable development. Our results show that when environmental law reflects moral values for betterment, legal adoption is more likely to be successful, which usually happens in well-developed regions. In less-developed states, environmental law differs significantly from moral values, such that changes in moral values are necessary for successful legal implementation. Our study has important implications for the development of policies and cultures, together with the enforcement of environmental laws and regulations in all countries.

AbstractThis analysis of Senegal environmental law is based on the example of a local context of rural communities located in the eastern Senegal area where the Bassari population is settled. The environmental legislation in Senegal does not seem to fit the local and rural realities. Our approach proposes to build a patrimonial legal system involving responsibility of the different actors in decision making. Law should be elaborated consensually by the different stakeholders, so that it will be easier to implement. We have conceived a «local environmental agreement» in order to link the local (legitimate) and national (legal) requirements. The aim of this article is to develop a conceptual and practical basis for legal and institutional patrimonial management of the natural resources.

Laden with statistical details, this chapter compares the national sustainable development strategies in India and Germany. Examining the constitutions and environmental laws, as well as their administration through courts and otherwise, it argues that in both these countries sound legal basis exists for the development and implementation of a sustainable national strategy. Examining closely the overall developmental strategies in India, the chapter finds contradiction between them and the environment strategies. Consequently, it arrives at the conclusion that the overall developmental strategies in India are non-sustainable in the long or even short run.

Kebutuhan akan pembangunan fisik semakin meningkat seiring dengan bertambahnya jumlah penduduk. Problematika penyediaan tanah untuk pembangunan terjadi karena adanya pergeseran makna dan nilai tanah, sebagai akibat dari berkembangnya ideologi ekonomi kapitalis. Rakyat cenderung tidak mau melepaskan tanahnya kepada pemerintah untuk tujuan pembangunan dengan dalih bahwa besaran nilai ganti kerugian yang ditetapkan atas tanah terlalu rendah dan tidak adil. Oleh karena itu, perlu dilakukan revisi kebijakan dalam aspek pertanahan yang mengarahkan pada mekanisme pengelolaan aset tanah negara terintegrasi yang dapat mengakomodasi keinginan semua pihak, sehingga dapat menjamin terciptanya keadilan sosial (al-‘Adalah al-Ijtima’iyyah). Penerapan konsep bank tanah sebagai sarana pengelolaan aset tanah negara dapat menjadi solusi dalam mengatasi krisis tanah untuk pembangunan yang terjadi saat ini. Konsep bank tanah yang memperoleh tanah melalui mekanisme jual beli, tukar menukar, hibah maupun lelang akan memenuhi rasa keadilan yang diidam-idamkan oleh rakyat. Sebelum menerapkan konsep bank tanah melalui suatu instrumen hukum, maka konsep tersebut harus terlebih dahulu disesuaikan dengan hukum positif nasional, khususnya dalam sistem hukum agraria. Hal ini perlu dilakukan untuk menghindari terjadinya disharmonisasi antar peraturan perundang-undangan dalam sistem hukum agraria yang saling berhubungan antara satu dan yang lainnya. Artikel ini bertujuan untuk menganalisis landasan hukum mengenai konsep bank tanah sebagai pengelola aset tanah negara yang dapat mewujudkan keadilan sosial (al-‘Adalah al-Ijtima’iyyah) bagi seluruh rakyat Indonesia.(The need for physical development is increasing as the increase in population. Any problems in clearing land for development are caused by shifts in land meaning and value, as a consequence of the development of the capitalist economic ideology. The people tend not to relinquish their land to the government for development purposes under the pretext that the amount of compensation paid for land is too low and unfair. Therefore, it is necessary to revise the policy in the land aspect that leads to the integrated state land asset management mechanism that can accommodate the wishes of all parties, so as to ensure the creation of social justice (al-'Adalah al-Ijtima'iyyah). Implementation of the concept of a land bank as a means of managing state land assets can be a solution in overcoming the land crisis for development that occurs today. The concept of a land bank acquiring land through buying and selling mechanisms, exchange, grants, and auctions will satisfy the sense of justice coveted by the people. Before applying the concept of the land bank through a legal instrument, the concept must be adjusted to national positive law, especially in the legal system of agrarian. This needs to be done to avoid the occurrence of dis-harmonization between laws and regulations in the agrarian legal system that is interconnected between one and the other. The place and function of custom as a species of law—distinguished from custom as simply polite manners or cherished cultural traditions—has long been a source of research and debate among legal theorists and historians. One school of thought, reflecting the authority of written statute in modern jurisprudence, has relegated custom in a juridical sense to “primitive” societies, whereas proper law belongs to a world of state sovereignty. Other scholars have revisited the continuing validity of custom, including a trenchant body of work on the use (and manipulation) of custom in modern colonial regimes. At the same time, some have seen benefits in the acknowledgment of custom as a source of norms. A 2006 collection of articles, for instance, explored ways in which customary law might serve as a better foundation for the sustainable development of natural resources. As David Bederman has written, “Custom can be a signal strength for any legal system—preliterate or literate, primitive or modern.”

The global situation in the sphere of natural resources determines the legal basis of responsibility of individual states for rational use and protection of these resources. In the Russian Constitution and Russian legislation provide the powers of the Russian Federation in the sphere of sustainable development and rational use of land, subsoil, water, forests, wildlife, recognition and justification of its sovereignty. The independence of Russia in the field of nature management and environmental protection is based on international principles, Federal laws and regulations, and justified by the environmental vector of the national economy modernization, legislation, and manifested in the implementation of free citizens´ access to natural resources, participation in discussion, adoption of ecologically important decisions, in development of the independent state and public environmental expertise of economic projects, strategic assessments of environmental situations.

Indonesia is known as a rich natural resources country, but at the same time has a problem of water shortage, soil degradation, pollution, agriculture and forest production, biodiversity conservation, and mineral and energy sustainability. The national natural resources management planning alignment with SDGs programme, particularly the water resources management,  afforestation programme,  a guide for sustainable management of Indonesia’s biodiversity, government and non-government organizations participant in conservation practice, exploring alternative energy sources to reduce dependence on oil, mainstreaming of SDGs into National Development agenda, National Action Plan, and  SDGs program for Sub-national level. This program was participated by all stakeholders included government, civil society organizations, philanthropy and business society, academics as well as experts. This literature review paper will discuss about the natural resources management to deliver sustainable development goals programme in Indonesian, with specific and focus topics for water and pollution, soil, land product  (agriculture, forest and biological resources), mineral and energy. The objective of this paper was to describe  the alignment of the natural resources management planning and SDGs programme as evaluation to improve their implementation in Indonesia. Though the government has already implemented SDGs program but innovative strategic need to be developed.Indonesia dikenal sebagai negara yang kaya sumberdaya alam, tetapi pada saat yang sama menghadapi masalah kelangkaan air, degradasi lahan, polusi, produksi pertanian dan kehutanan, konservasi keanekaragaman hayati, keberlangsungan mineral dan energi. Rencana pengelolaan sumberdaya alam nasional sejalan dengan program SDGs,  khususnya terkait pengelolaan air, program perhutanian, pengelolaan keanekaragaman hayati secara berkelanjutan, pemerintah dan para pihak yang berpartisipasi dalam praktek konservasi, eksplorasi energi alternatif untuk mengurangi ketergantungan pada minyak bumi, dan pengarus-utamakaan program SDGs ke dalam agenda pembangunan nasional, rencana aksi nasional, dan program di tingkat wilayah. Program ini diikuti oleh seluruh para pihak, termasuk pemerintah, organisasi masyarakat sipil, masyarakat bisnis dan filantropi, kaum akademisi dan para ahli. Studi Pustaka ini akan membahas tentang pengelolaan sumberdaya alam untuk mencapai program pembangunan berkelanjutan di Indonesia, khususnya tentang masalah air, polusi, produsi lahan (meliputi pertanian, hutan, sumberdaya biologi), mineral dan energi. Tujuan penulisan naskah adalah untuk memberikan gambaran keterkaitan antara rencana pengelolaan sumberdaya alam dan pelaksanaan program pembangunan berkelanjutan, sebagai evaluasi untuk meningkatkan implementasinya di Indonesia. Meskipun pemerintah telah melaksanakan program SDGs, tetapi strategi yang inovatif perlu dikembangkan.

AbstractThe international conference on the environment which was held in Stockholm, Sweden in 1972 to Rio de Janeiro 1992, to Rio + 10 in Johannesburg 2002, emphasized the need for coordination and integration between natural resources, human resources, and artificial resources in every national development, with a population, development approach, and the environment to the integration of social, economic and environmental aspects. The Government of Indonesia is committed to carrying out sustainable development with various efforts, one of which is the issuance of environmental permits. The environmental damage that occurs in the region, is the responsibility of local governments as a whole from the existence of the authority to issue permits granted. Corruption in the environmental sector is a barrier to the path of sustainable development. Licensing is one of the instruments to prevent natural damage as well as controlling environmental management activities. But on the other hand, licensing is a fertile ground for corrupt practices that hinder sustainable development. The purpose of this study is to provide an understanding of the importance of supervision of licensing for the creation of the concept of environmentally sustainable development. The research method used is a normative juridical research method that is descriptive analysis through doctrinal law review. It can be concluded that environmental problems and obstacles that occur in the licensing sector are often mixed with corrupt practices by the government which has the authority to give permits. Pemerintah Indonesia berkomitmen melaksanakan pembangunan berkelanjutan dengan berbagai upaya, salah satunya dalam penerbitan izin lingkungan. Kerusakan lingkungan yang terjadi di daerah, merupakan tanggung jawab pemerintah daerah sebagai satu kesatuan dari adanya kewenangan mengeluarkan perizinan yang diberikan. Korupsi yang terjadi di sektor lingkungan merupakan penghalang jalannya pembangunan berkelanjutan. Perizinan merupakan salah satu instrumen pencegah kerusakan alam sekaligus sebagai pengendali aktifitas pengelolaan lingkungan hidup. Namun disisi lain, perizinan menjadi ladang subur terjadinya praktik korupsi yang menghambat pembangunan berkelanjutan. Tujuan penelitian ini untuk memberikan pemahaman terkait pentingnya pengawasan terhadap perizinan demi terciptanya konsep pembangunan berkelanjutan berwawasan lingkungan. Metode penelitian yang digunakan yaitu metode penelitian yuridis normatif yang bersifat deskriptif analisis melalui pengkajian hukum doctrinal.Dapat disimpulkan bahwa permasalahan lingkungan hidup dan hambatan yang terjadi ada pada sektor perizinan seringkali dicampuri dengan praktik korupsi oleh pemerintah yang berwenang memberikan izin. Hal ini menimbulkan terhambatnya pembangunan berkelanjutan serta kerusakan pada lingkungan yang berdampak pada sektor perekonomi masyarakat.Kata kunci: Sumber Daya Alam (SDA), Perizinan, Kewenangan Pemerintah Daerah, Korupsi АннотацияМеждународная конференция по проблемам окружающей среды состоялась В Стокгольме, Швеция в 1972 году. По результатам этой конференции Индонезия взяла на себя обязательство осуществлять устойчивое развитие, и по сей день предпринимает различные усилия для поддержания этой договоренности. Коррупция в области охраны окружающей среды и природных ресурсов является препятствием на пути устойчивого развития. Лицензирование является одним из инструментов предотвращения разрушения природы, а также контроля за деятельностью по управлению окружающей средой. С другой стороны, лицензирование также становится благодатной почвой для коррупции. Местные органы власти в этом случае имеют право выдавать разрешения на деятельность, которая может нанести экологический ущерб в данной местности. Целью данного исследования является оценка деятельности в области лицензирования в экологической сфере и перспектив устойчивого экологического развития в Индонезии. Основным методом исследования была оценка нормативно-правовых актов в сфере экологического регулирования. На основании описательного анализа можно сделать вывод, что препятствия, возникающие на уровне отраслевого лицензирования, часто решаются методами коррупции со стороны государственных органов, что препятствует устойчивому развитию экологической сферы, наносит ущерб окружающей среде и препятствует развитию экономики.Ключевые слова: природные ресурсы (ПДД), лицензирование, Местные органы власти, коррупция
