This article aims to examine the question of sexual abuse of minors and vulnerable adults by clerics and members of the Institute for Consecrated Life and the Society for Apostolic Life in the light of motu proprioVos Estis Lux Mundi and Vademecum. It starts with a brief description of sexual abuse, the mandatory report and then the response of the Ordinary. It shows that sexual abuse is a grave delict, and clerics or religious who have knowledge of information are obliged to report it to the Ordinary while maintaining the seal of confession, and the Ordinary has the grave obligation to take any reports seriously, promptly and decisively, taking into consideration that the procedural norms should be carefully observed. By using the analytical and critical method, the author argues that it is of the highest importance for the Ordinary to establish a system for receiving reports as well as preparing competent personnel in order to handle the case in a thorough and expeditious manner.

Key words: sexual abuse, minors, vulnerable adults, mandatory report, Ordinary

- This study analyses 37 questionnaires administered to the same number of auxiliaries of the Judge for the preliminary investigations with reference to the probatory incident on alleged minor victims of sexual abuse. The research wants to examine the real care and protection measures of the alleged victims during the period of time that goes from revelation to judicial hearing and to the moment of the same hearing. Besides, it aims to verify to what extent hearing is a hardship for the child and the eventual correlations between that and some variables about the procedures for the collection of witness, the need of protection and the setting features. The results show, even within the judicial course, a low, late or failed activation of the assistance, protection and care already provided by national rules and international conventions.Key words: auxiliary, probatory procedure, protected hearing, interview.Parole chiave: ausiliario, incidente probatorio, audizione protetta, intervista.

Despite recent signs of change, the Indian church was rather reluctant to acknowledge the clerical sexual abuse scandal as its own problem. In the Indian context, the scandal entails not only the abuse of minors, but also the abuse of women and other vulnerable adults by church personnel. The hierarchical structure of Indian society, gender relations based on patriarchy, and postcolonial attitudes provide a fertile ground for abuse. Clericalism, centralization of power in the church, and continuing negative attitudes to sexuality are further contributing factors. The clerical sexual abuse scandal calls for developing new ethical horizons based on a theology of a participatory church, and a reconsideration of the church’s attitude to sexuality and gender relations.

The purpose of this study was to identify characteristics of investigations of sexual abuse concerning vulnerable adults residing in facility settings that were associated with case substantiation. Data on 410 reports of sexual abuse were collected prospectively from Adult Protective Services (APS) and state licensure agency staff in New Hampshire, Oregon, Tennessee, Texas, and Wisconsin over a six-month period. Specifically, we examined differences between reports that were substantiated and those that were not by comparing characteristics of alleged victims, alleged perpetrators, and aspects of investigation using logistic regression. We found that a relatively low proportion of cases (18%) were substantiated overall. Compared to cases that were not substantiated, cases that were substantiated were more likely to feature nursing home residents, older victims, female victims, and allegations of physical contact between the alleged perpetrator and victim. Despite the high proportion of alleged perpetrators who were facility staff (51%) compared to resident perpetrators (25%), cases with resident-to-resident allegations of abuse were much more likely to be substantiated, accounting for 63% of substantiated cases. In light of these findings, we believe it is important that investigators are trained to handle sexual abuse cases appropriately and that they are able to investigate the case thoroughly, promptly, and with as much information as possible. It is also critical that investigators make substantiation decisions using the appropriate standard for confirmation (e.g., preponderance of the evidence, beyond a reasonable doubt, clear and convincing evidence) as state law dictates.

- In this article research is briefly reviewed on investigative interview techniques in children alleged victims of child sexual abuse. It is shown that such techniques represent a crucial factor in determining the accuracy and reliability of the witness report. Research in the psychology of eyewitness testimony provides important elements to understand which techniques are examples of good and which are examples of bad practice, which errors are commonly made in interviews, and which are the negative consequences of such common errors. Guidelines can limit the number of errors and render a report more accurate. Guidelines should be the same for every interviewer, and should be developed by a group of experts who are clearly familiar with the research data obtained in the psychology of eyewitness testimony.Key-words: eyewitness testimony, interview, children, sexual abuse.Parole chiave: testimonianza oculare, intervista, bambini, abuso sessuale.

Special measures have been implemented across the globe to improve evidence procedures in child sexual assault trials. The present study explored the day-to-day experiences and views on their use by five groups of Australian criminal justice practitioners (N = 335): judges, prosecutors, defence lawyers, police officers and witness assistance officers. Most practitioners reported routine use of pre-recorded police interviews and CCTV cross-examination of child complainants, but rare use with vulnerable adults. Despite persistent technical difficulties and lengthy waiting times for witnesses, high consensus emerged that special measures enhanced trial fairness and jury understanding. The perceived impact of special measures on conviction rates diverged widely. Defence lawyers disputed that this evidence was as reliable as in-person testimony. All practitioner groups endorsed expanded use of expert witness evidence and witness intermediaries. Ongoing professional development in all practitioner groups will further enhance justice outcomes for victims of child sexual abuse.
