The article discusses the issues of the economic organization of forestry and proposals for its transformation from the sphere of budgetary services to the branch of material production, based on the international practice of profitable forestry without its integration with the timber processing industry. We have given a brief description of the low investment attractiveness of forestry production due to its long-term nature, which requires a special source of funding, and also described the advantages of state forestry organizations in terms of state ownership of forests over private forest use, burdened with forest reproduction activities (forest lease). The paper presents the general provisions of the forest management model based on the licensed right to conduct forestry by legal entities and individual entrepreneurs in state forests.

The article discusses the concept of the draft Federal Law of the Forest Code of the Russian Federation put forward by the CEPL staff. The timeliness of such a discussion by the wide professional community is recognized. Proposals are being made to change a number of provisions of the Concept. It is proposed to clarify the status of “wild forests”. The thesis about the inadmissibility of leaving the cutting areas of oak forests for natural overgrowth is emphasized, which leads to the transformation of strategically valuable oak formations of the Central Black Earth Region into significantly less valuable deciduous forests without his participation. The authors support the position on the unacceptability of the existing model of private forest management, which leads to “deterioration of the state of forests, reduction of their economic and ecological potential.” A number of proposals are being made to improve the country’s forestry. It is proposed to restore the Ministry of Forestry, transfer the use of forest resources to state forestry enterprises, staffed with personnel, equipment and machinery for the production of all types of forestry work. To add to the section on the indefinite use of forest plots, research institutions, educational institutions, in the use of which there are forest plots for long-term research. It is necessary to exclude other types of use of forest areas (for example, hunting use), where research or educational activities are carried out.

An analysis of a numerous official documents and publications reveals a serious crisis of forest management in Russia. Forest management paradigm, defined by the Forest Code ideologues, will lead inevitably to the Russian forest fund degradation. Meanwhile, forestry is production industry in which laws of the market economy are in force. For this reason, forest management should be reconstructed in Russia. A principle of forestry revival will be impartial ecological and market economic assessment of forest resources, which would be instrumental in transition of the subsidized scheme of forest management financing to a system that would provide rational forestry and a profit. Forestry organization is the key task of forest inventory that is completed in close connection with forest economy and forest management. Specific problems of sustainable forestry organization and forest use should be solved on this basis. When State owns forests in the market economy environments, stumpage sale at prices lower than the cost for reforestation cannot be allowed. In view of this, market transition of forest use is crucial to establish payments for standing timber based on rental income. This will guarantee the financing of reforestation as well as assignments to the budget at the different levels. Chief reorganization objective of forest management in Russia is outlined as follows: ensuring economic efficiency of the forest sector; sustainable use of forest resources and reforestation; forest conservation for the next generations.

The article notes the relevance of the Concept of the draft Federal law “Forest code of the Russian Federation”. One of the sections of this Concept (point 3.7.10) concerning reforestation issues is considered. The importance of the approach proposed in the Concept, which provides for more flexible legal regulation of technological issues of reforestation, taking into account regional, forest-growing and economic conditions, is emphasized. Questions that require clarification or more detailed disclosure are noted.

Pursuant to relevant provision of the Federal Law No. 190-FZ On Radioactive Waste Management and Amendments to Certain Legislative Acts of the Russian Federation of July 11, 2011, radioactive waste generated due to the peaceful uses of nuclear charges has been attributed to the non-retrievable radioactive waste (RW) category. Accordingly, relevant RW subsoil areas are currently considered as facilities holding non-retrievable RW with periodic radiation monitoring that should be performed and certain measures provided to ensure the long-term safety of the population. The article presents the results of a radiation survey performed in 2019 for the site with non-retrievable RW inventory generated from the Meteorite-5 peaceful nuclear explosion.

The author of the Concept demonstrates a scientific approach and a professional point of view. The author offers a number of new and interesting ideas. In general, the article does not contain defiantly unacceptable judgments, and you can unconditionally subscribe to a number of them. The fact of the existence of such a Concept, obviously, increases the chances of success for the next, new edition of the Forest Code. A significant increase in the forest role of the regions is correctly proposed, although this will certainly increase the number of references and blankets in the text of the law.

This paper presents a concept draft bill of the Federal Law “Forest Code of the Russian Federation”, which proposes some new approaches to public forest management improvement. The related questions had been discussed during scientific debates held by the Scientific Council of the Russian Academy of Sciences on forests in 2015–2019. The goal of the draft bill is to modernise the forest law of the Russian Federation to bring it in line with changes in the state of forests, their increasing role in climate regulation and other ecosystem services, as well as the further development of market relations in the Russian economy. The Concept Paper is based on an idea of a transition from the development of natural forests as a source of timber to the organisation of economic activities aimed at the cultivation of highly productive forest stands on available forest land. Provisions aimed at developing economic mechanisms to ensure forestry profitability in a market economy, both through forest products and ecosystem services, make up an important part of the Concept Paper. Approaches to the further development of public and private forest management, which will improve the efficiency of forest use, protection, conservation and regeneration, are outlined. Legal mechanisms for improving the public forest management system and forms of state and business participation in forest management are proposed.

Based on the materials of long-term research of departmental materials and production experience, an attempt was made to analyze the possibility of implementing the Russian Federation Government decree of May 7, 2019 № 566 «On the approval of the rules for performing reforestation or afforestation by persons using forests in accordance with Article 43–46 of the Forest code of the Russian Federation and by persons who have applied for an application to change the designated purpose of the forest area». It is noted that, despite the timeliness of the Russian Federation government resolution it does not fully comply with the regional conditions of a number of constituent entities of the Russian Federation and in particular the Khanty-Mansiisk Autonomous district — Yugra. In areas of oil and gas production, carrying out compensatory measures by creating forest plantations using ball-rooted seedlings on hard to reach burnt areas and in dead plantations will lead to unreasonably high costs for reforestation and the lack of agrotechnical and silvicultural care will result in the death of forest crops as well as discredit the compensatory measures. Considering some work experience on compensatory reforestation in the Khanty-Mansiisk Autonomous district — Yugra the suggestions were made to improve the compensatory measures.

The article is devoted to the study and analysis of the use of forests, including for agriculture. The use of forests is the central institution of forest law, the concept of “use of forests” is one of the main concepts in the Forest Code of the Russian Federation. The legislator refused to use the terms” forest management law”,” forest management”, which were used in the Forest Code of the Russian Federation in 1997.The meaning of the concept of” forest use “and its relationship with the concept of” forest management”, which is traditionally used in the science of forest law, is defined. From a scientific point of view, the term “forest use” coincides in its meaning with the term “forest management”.
