In early October 2017, the Indonesian government, represented by the Directorate General of Intellectual Property of the Ministry of Justice and Human Rights, has officially ratified the Protocol Relating to the Madrid Agreement Concerning the International Registration of Marks (Madrid Protocol). The ratification is contained in the Presidential Regulation No. 92 of 2017 on Ratification of Protocol Relating to the Madrid Agreement Concerning the International Registration of Marks, 1989. The Presidential Regulation shall be the legal basis of enforcement that regulates the international trademark registration in Indonesia. The concept offered through the international trademark registration system based on the Madrid Protocol is its practicality which passes only one examination, one Language, one currency and it is integrated by the International Bureau administered by WIPO without changing the sovereignty of each member country which ratifies the system. The objective of this paper is to find out how the trademark registration is implemented based on the Madrid Protocol after its ratification in Indonesia and how the system will impact. The results of this paper will be beneficial for the public so that they know the mechanism of the international trademark registration and the impact of this system

Abstract: Equation Basic Element In A Famous Brand (Analysis of the Decision of the Supreme Court Number 162 K / Pdt.Sus-IPR / 2014). Criteria for determining the equation of the constituents in a well-known brand that is the similarity of images, sounds, names, words, letters, numbers, color composition or a combination of these elements, either for goods or services that are similar or dissimilar based on general knowledge of the public, the brand earned a reputation as a massive campaign, and with evidence of the trademark registration in several countries. The impact of the decision of the Supreme Court Number 162 K / Pdt.Sus-IPR / 2014 for brand owners who have registered and well-known to always protect its brand, namely by taking into account the bad faith of the owner of the other brands. If there are other brands that have been registered in the Directorate General of Intellectual Property and published in General News Brands, the owner of the mark that has been registered in advance immediately appealed and the cancellation of the trademark. Abstrak: Persamaan Unsur Pokok Pada Suatu Merek Terkenal (Analisis atas Putusan MA Nomor 162 K/Pdt.Sus-HKI/2014). Kriteria penentuan persamaan unsur pokok pada suatu merek terkenal yaitu adanya kemiripan gambar, bunyi, nama, kata, huruf-huruf, angka-angka, susunan warna atau kombinasi dari unsur-unsur tersebut, baik terhadap barang atau jasa yang sejenis maupun tidak sejenis yang didasarkan pada pengetahuan umum masyarakat, reputasi merek yang diperoleh karena promosi besar-besaran, dan disertai bukti pendaftaran merek tersebut di beberapa negara. Dampak dari putusan Mahkamah Agung Nomor 162 K/Pdt.Sus-HKI/2014 bagi pemilik merek yang telah terdaftar dan terkenal agar selalu melindungi mereknya yaitu dengan memperhatikan adanya itikad tidak baik dari pemilik merek lain. Apabila terdapat merek lain yang telah terdaftar di Dirjen HKI dan diumumkan dalam Berita Umum Merek, maka pemilik merek yang telah terdaftar terlebih dahulu segera mengajukan keberatan dan pembatalan merek tersebut. <p>This study examines the registration of collective marks owned by the<br />Association of Knitting Indonesia Central Java (Java ARI) on the knitting craft<br />products manufactured and marketed independently. In addition, the assessment<br />conducted on the mechanism of collective trademark registration in the relevant<br />institutions. The research method used juridical empirical approach. Juridical<br />aspect is based on Law No.20 of 2016 on Marks and Geographical Indications<br />and related legislation, while reviewing the empirical aspects of the business<br />activities carried on ARI Java. The results showed that ARI Java brand label have<br />met the brand element that can be registered as a collective trademark<br />registration with domicile at the Directorate General of Intellectual Property of<br />the Ministry of Law and Human Rights in Central Java.</p><p> </p>

The writing of this law examines the supervision of the Directorate General of Intellectual Property of the Ministry of Law and Human Rights in the process of receiving trademark registration which is still weak. So that until now there are still identical or counterfeit brands that have passed trademark registration in Indonesia. This paper uses a normative juridical research method that is descriptive-analytical. The result of this research is that there are still gaps that can be exploited by individuals in the process of trademark registration, especially in the process of announcing the official brand news. This paper concludes the need for tighter supervision by utilizing information technology, therefore creating a smartphone application is useful for the trademark registration process and as a medium of communication. The application can also provide notifications when brands validity period ends.

The study analyzed selected issues related to the scope of human rights and freedoms during the COVID-19 pandemic in Poland and Russia. The author wanted to compare the regulations issued by a Member State of the European Union and a country outside the European Union, often using undemocratic methods of exercising power. The work focuses on research problems related to the principles of protection, the confrontation of individual interests with the public interest, and the impact of the regimes introduced during the COVID-19 pandemic on human rights law in both countries. The thesis of the study is that in the event of a threat to public health, analogous restrictions on human rights are introduced both in an undemocratic country and in a country belonging to international structures identifying with democratic values. The state of the COVID-19 pandemic has exposed, and in some area even contributed to the creation of mechanisms reserved for crisis situations, posing a direct and real threat to public safety and health.

The impact of tax on state revenue is very dominant these days. This happens because tax is a definite source in contributing funds to the state. Basically, it is a reflection of the mutual cooperation of the community in state financing regulated by legislation. One of the factors causing low taxpayer's compliance takes place because the public as taxpayers forget or maybe even simply ignore their obligation to pay taxes, especially personal income tax. This research is quantitative in nature, which involves testing hypotheses (explanatory). The population in this study is individual taxpayer registered at the Regional Office of the Directorate General of Taxes of the Special Region of Yogyakarta. Approximately 350,935 Individual Taxpayers at the end of 2015 were registered. The research results indicated a positive influence between the attitude of taxpayers and taxpayer's compliance. By contrast, with respect to taxpayer compliance, the analysis on tax elimination variable shows that there is no positive influence between the elimination of tax sanctions and taxpayer compliance. The analysis on tax awareness toward taxpayer compliance indicates a positive influence between tax awareness and taxpayer compliance. Abstrak Perananpajakterhadap pendapatan Negara sangat dominan pada masa sekarang ini.Ini terjadi karena pajak adalah sumber yang pasti dalam memberikan kontribusi dana kepada Negara karena merupakan cerminan dari kegotongroyongan masyarakatdalam pembiayaan negara yang diatur oleh perundang-undangan. Salah satu factor menyebabkan penerimaan pajak yang sulit tercapai yaitu kepatuhan wajib pajak yang rendah itu dibuktikan karena masyarakat selaku wajib pajak lupa, atau bahkan mungkin mengabaikan kewajibannya untuk membayar pajak, khususnya pajak penghasilan orang pribadi. Jenis penelitian ini merupakan penelitian kuantitatif dengan melakukan pengujian hipotesis (eksplanatory). Populasi dalam penelitian ini adalah Wajib Pajak Orang Pribadi yang terdaftar pada Kantor Wilayah Direktorat Jenderal Pajak Daerah Istimewa Yogyakarta, kurang lebih berjumlah 350.935 Wajib Pajak Orang Pribadi pada akhir tahun 2015. Hasil penelitian menunjukkan terdapat pengaruh yang positif antara Sikap wajib pajak dengan kepatuhan wajibpajak, sedangkan untuk variable kepatuhan wajib pajak terhadap penghapusan pajak menunjukkan tidak terdapat pengaruh positif antara penghapusan sanksi pajak dengan kepatuhan wajib pajak dan untuk variable kesadaran perpajakan terhadap kepatuhan wajib pajak menunjukkan terdapat pengaruh positif antara kesadaran perpajakan dengan kepatuhan wajib pajak. Kata kunci—Kesadaran Perpajakan; Kepatuhan Wajib Pajak; Wajib Pajak Orang Pribadi; Sikap Wajib Pajak.

The article deals with the contemporary legal and ethical challenges, caused by coronavirus COVID-19. It analyses the reason why the western world was so much surprized by that pandemics. The text mentions the succeses of western medicine in the battle against epidemics in the 20th century and sees it as one of the reason for underestimating the public health issues in 21st century. The article also emphasizes on other contemporary threat, the antimicrobiotic resistance and the need for new legal answers to pandemics. It deals with problem of human genome editing as the central topic by creating of hereditary immunity against new viral threats. The text also mentions the risks of such new treatment and the impact on human dignity that is understood as leading value in the contemporary legal regulation on biotechnology.

This article is an edited transcript of Professor Graeme W Austin's Inaugural Lecture, delivered in the Council Chamber of Victoria University of Wellington on 15 November 2012. Professor Austin was appointed Chair in Private Law in the Faculty of Law in November 2010. This lecture explores claims that in copyright law, the public domain is necessarily in opposition to proprietary rights, and suggests that in many contexts the incentives offered by copyright contribute to the vibrancy and volume of material that is available for downstream creativity and innovation. Drawing on his earlier work on the relationship between human rights law and intellectual property, Professor Austin's lecture advances the idea that cognisance of the human rights dimensions of intellectual property, including creators' human rights, should inform our understanding of the appropriate scope of the rights of copyright owners. The lecture concludes with a warning against the "Walmartization" of copyright.

Abstract Business competition is often found whose business competition is dishonest, especially towards trademarks. In terms of minimizing the occurrence of violations of unfair business competition, the government has a very im- portant role. The government needs to conduct socialization related to fair business competition on trademarks, by: conducting education, campaigns, providing understanding, providing training for of cers in the Directorate General of Intellectual Property, inviting the public in the ght against counterfeiting and imitation, and the exis- tence of monitoring, evaluation , and fostering by the Directorate General of Intellectual Property or the Business Competition Supervisory Commission (KPPU) and conducting strict reprimands and legal sanctions for business actors who continue to violate their business activities and are proven, then Law Number 20 Year 2016 concern- ing Trademarks and Geographical Indications , speci cally regulates the provision of criminal sanctions that are included in the provisions of Articles 100 and 102.   Keywords: business competition; dishonest; KPPU; legal sanctions.
