The article places Nigeria’s political and economic challenges in historical and global context. As opposed to viewing democracy or development emerging simply as the ‘will of the people’ or ‘political will’, it encourages a historical and structural view of the phenomena. Sustained democratic institutions and intensive economic growth emerge under particular conditions where the continued maintenance of hegemony and gate-keeping extractive states are no longer viable. A diversified capitalist class and economic power among a strong middle class are needed to demand greater democratic accountability. Industrial policy is essential to creating the structural change required for their emergence. Yet the dispersed and ethno-religiously fragmented distribution of power makes industrial policy implementation difficult. Given the salience of such historical and structural forces, postcolonial Nigerians should be seen as formative generations. Students and practitioners of development economics, policy and politics should be more creative in producing politically informed policies for the country.

The “will of the (national) people” is the ubiquitously invoked reference unit of populist politics. The essay tries to demystify the notion that such will can be conceived of as a unique and unified substance deriving from collective ethnic identity. Arguably, all political theory is concerned with arguing for ways by which citizens can make e pluribus unum—for example, by coming to agree on procedures and institutions by which conflicts of interest and ideas can be settled according to standards of fairness. It is argued that populists in their political rhetoric and practice typically try to circumvent the burden of such argument and proof. Instead, they appeal to the notion of some preexisting existential unity of the people’s will, which they can redeem only through practices of repression and exclusion.

The article deals with the fundamental, inherent in most of the countries of the world transformation of state power, its formation, functioning and division between the main branches as a result of the decentralization of such power, its subsidiarity. Attention is drawn to the specifics of state power, its func- tional features in the conditions of sovereignty of the states, their interconnec- tion. It is emphasized that the nature of the state power is connected with the nature of the political system of the state, with the form of government and many other aspects of a fundamental nature.It is analyzed that in the middle of national states the questions of legitima- cy, sovereignty of transparency of state power, its formation are acutely raised. Concerning the practical functioning of state power, a deeper study now needs a problem of separation of powers and the distribution of power. The use of this principle, which ensures the real subsidiarity of the authorities, the formation of more effective, responsible democratic relations between state power and civil society, is the first priority of the transformation of state power in the conditions of modern transformations of countries and societies. It is substantiated that the research of these problems will open up much wider opportunities for the provi- sion of state power not as a center authority, but also as a leading political structure but as a power of the people and the community. In the context of global democratization processes, such processes are crucial for a more humanistic and civilized arrangement of human life. It is noted that local self-government, as a specific form of public power, is also characterized by an expressive feature of a special subject of power (territorial community) as a set of large numbers of people; joint communal property; tax system, etc.

With the surge of populism in Europe, public service broadcasting has come under increased pressure. The established media are considered part of the corrupt elite not serving the interests of the people. The public service media, for which pluralism is at the core of their remit, are a particular thorn in the side of the populists. Therefore, they attack the financial basis of public service, which is supposed to guarantee their independence. The populist attacks on the traditional broadcasting corporations meet with the interests of neoliberal politics and of those political actors who want to evade public scrutiny and democratic control and do no longer feel committed to democratic accountability. The assaults on the public service media are thus an assault on freedom of the media and further increase the pressure on the democratic system.

Angesichts des markanten Aufstiegs des Rechtspopulismus in den vergangenen Jahren drängt sich die Frage immer wieder auf, ob oder inwiefern das Parlament den eigentlichen Volkswillen (noch) vertreten kann, und wie im Zeitalter der Globalisierung und Digitalisierung der eigentliche Volkswille überhaupt festzustellen und effektiv durchzusetzen ist. In dieser Hinsicht steht das Vertrauen in die Fähigkeit des Parlaments, den wahren Volkswillen herauszubilden und zu artikulieren, erneut vor großen Herausforderungen. Durch eine vergleichende Analyse zwischen den Demokratietheorien Böckenfördes und Kelsens zeigt der vorliegende Beitrag, weshalb und inwiefern das weitverbreitete Verständnis des Volkswillens und dessen Rolle in der parlamentarischen Demokratie gerade vor dem heutigen Hintergrund eine kritische Besinnung verdient. Es wird argumentiert, dass gerade in demokratischer Hinsicht nicht die Suche nach dem „wahren Volkswillen“, sondern nach wie vor die Gewährleistung der Menschen- bzw. Grundrechte der Einzelnen und insbesondere der Minderheiten von zentraler Bedeutung sein soll. In view of the spread of right-wing populism in recent years, the question as to how the will of the people is to be ascertained and expressed has attracted much attention in constitutional scholarship. In particular, the issue of whether or to what extent the parliament is (still) capable of representing and demonstrating the will of the people has been repeatedly discussed and debated. Through a comparative analysis of Böckenförde’s und Kelsen’s democratic theories, this article critically examines the problems of the widespread understanding of the will of the people as a real-empirical existence and its significance for the realization of democracy. Accordingly, it points out why and in what sense the reference to the so-called real will of the people would undermine rather than promote democracy. This article concludes by arguing that, precisely for the sake of democracy, what is crucial is not to determine what the “real will of the people” is, but rather to guarantee the freedom of the individual and especially of the minorities.

Abstract:The European Union has transcended many of the old prerogatives of national independence bringing about the very function of interdependence among Member States. Within the latter there are sub-state communities claiming simultaneously both self-government and ‘more Europe’. The future intent of this political process in the Old Continent is to make territorial subsidiarity consistent with home rule within European framework legislation and continental institutions. The first part of this article focuses on the idea of a closer European Union based upon the implementation of territorial subsidiarity, as well as on the challenges posed by democratic accountability, multi-level governance and the preservation of the European Social Model (ESM). The second section illustrates some of these challenges in practice through an analysis of how the meaning of independence has developed in a ‘stateless nation’ such as Catalonia. In Spain, the lack of territorial accommodation, together with a long-standing centre–periphery controversy, has fuelled claims for secession by some Catalan nationalists. The conclusions ponder on how ‘cosmopolitan localism’ can optimise both independence and interdependence of stateless nations like Catalonia in the global context.
