The Criminal Procedure Code of Ukraine stipulates that a search is conducted to identify and fix the infor-mation about the circumstances of the offense of criminal offenses finding tools criminal offense or property that was taken as a result of its commitment, and locating wanted persons It is noted that scientists have identical views on the need for careful preparation to prepare for the search. Individual values to obtain a positive result if training takes counteraction to investigation. Attention is drawn, in order to avoid possible impact on the investigation and the investigation process should minimize the amount of information coming from the investigator stakeholders that can act as participants of the proceedings and other persons, including the officials. At the same time should be hidden by an activity a criminal offense, setting orienting information about the individuals involved. The data obtained in the first place, by examining data about a person searches, venue search and objects to be searched more. It is emphasized that the search explores the psychological readiness to achieve, resulting in the concentration of all other feelings, focus and effectiveness of attention. The investigator should be aware of the possibility of creating conflict situations during the search and the way in which they are resolved. The conflict can be pronounced, which complicates searches. Therefore, the investigator’s commitment to conducting searches and minimizing external disturbances are also important components in developing the confidence of the searchers in the imminence of detecting caches. The need to minimize the time required to prepare for a search is indicated. This will reduce the possibility for interested persons to obtain statements of pending investigative action. Attention is drawn to the fact that the preparation of a search is a guarantee of its effectiveness.

The article examines the perspective on criminalization of smuggling of goods arising in connection with the Draft Law of Ukraine «On Amendments to the Criminal Code of Ukraine and the Criminal Procedure Code of Ukraine on criminalization of smuggling of goods and excisable goods and inaccurate declaration of goods» (№ 5420). The Draft Law provides for the following criminal offenses: smuggling (Article 201); transporting across the customs border of Ukraine out of customs control or with concealment from customs control of timber or lumber of valuable and rare species of trees, unprocessed timber, as well as other timber prohibited for export out of the customs territory of Ukraine (Article 201-1); smuggling of goods (Articles 201-2); smuggling of excisable goods (Articles 201-3); smuggling of narcotic drugs, psychotropic substances, their analogues or precursors or falsified medicines (Article 305). They form a homogeneous group of actions, between which there must be systemic connections. It follows that the reasons for formulating the peculiar title of Article 201-1 are missing. The title of this article should be formulated as follows: «Smuggling of timber or lumber of valuable and rare species of trees, unprocessed timber, as well as other timber prohibited for export out of the customs territory of Ukraine». It was found that Article 201-2 of the Draft Law provides for the general description of a criminal offense, and the description of criminal offenses specified in Articles 201, 201-1, 201-3 and 305 of the Draft Law are peculiar. In this regard, it seems appropriate to swap the Criminal Law provisions of Articles 201 and 201-2 of the Draft Law. In Section 4 of Article 201-4 of the Draft Law, the phrase «assistance in any form by a customs official to commit such acts with the use of power or official position» is not a qualifying feature, but an independent structure. If there is a need to criminalize this act, it may be provided for in a separate article or should be specified in a separate section of Article 201-4 of the Draft Law as an independent act. It is established that on the one hand, the criminalization of smuggling of goods is an urgent need in Ukraine, on the other side the present Draft Law of Ukraine cannot effectively address this issue, as it requires additional elaboration.

The scientific article is devoted to the study of some aspects of the investigation of criminal offenses against morality. Peculiarities of forensic characteristics as an element of the methodology of investigation of this category of criminal offenses are considered. The author emphasizes that any method of investigating certain types of criminal offenses has a certain structure, an important element of which is the forensic characteristics. The concept of forensic characteristics as an element of methodology, quantity, content and significance of structural elements of this scientific category remain vague and contradictory. Moreover, at the turn of the millennium, the question of the expediency of the existence of forensic characteristics as a scientific category in general became acute. Therefore, it should be borne in mind that the value of forensic characteristics can be divided into practical and theoretical. For police officers who are directly involved in the investigation, the most important thing is the practical application of a tool that will help in the investigation process. It is noted that the method of investigation of certain types of criminal offenses is a system of sci-entific provisions, as well as methodological and practical recommendations developed on their basis for the investigation of certain types and groups of criminally punishable acts. It is emphasized that the structure of the studied scientific category is as follows: forensic charac-teristics of criminal offenses; analysis of primary information and initiation of criminal proceedings; cir-cumstances to be proved in criminal proceedings; typical investigative situations; features of conducting initial investigative (search) actions, covert investigative (search) actions and other measures; features of further investigative (search) actions, covert investigative (search) actions and other measures; features of the use of special knowledge during the investigation of a criminal offense; preventive activities of the investigator in relation to the causes and conditions that contributed to the commission of a criminal offense; features of the investigator's activity at the final stage of the investigation.

The article covers some aspects of the investigation of mass riots. The essence and system of forensic characterization of the specified actions for their faster and more effective investigation are considered. It is noted that a criminal offense has a large number of characteristics, which in criminology are systematized in such a scientific category as «forensic characteristics». For half a century the criminological characteristic has entered into a technique of investigation of criminal offenses as a stable element. With regard to mass riots, it should be emphasized that the investigation of these acts has important features, which, inter alia, are related to the study of a certain category. The position of the authors is supported, who believe that for police officers who are directly in-volved in the investigation, the most important thing is the practical application of a tool that will help in the investigation process. That is, the real value of the forensic characterization of a particular type of crime is the possibility of its practical application, the ability to resolve certain issues in view of it and, of course, the ability to make it to investigate certain categories of crimes faster and more efficient. At the same time, the use of such an information system requires in each case to identify a key element through which you can make a «login» to the system in order to obtain the necessary information. The selection of a key element for a particular case depends on the investigative situation at this stage of the investigation. The author concludes that a forensic characterization is a system of information about forensically significant features of criminally punishable acts of a certain type, which reflects the legitimate links between them and serves to build and verify investigative versions during their investigation. The system of forensic characteristics of mass riots includes the following elements: the method of committing a criminal offense; the situation of mass riots; the subject of the criminal act; traces of the offense; the identity of the victim; the identity of the offender. The legislation of Ukraine does not contain a legal definition of the concept of “jurisdiction”, although at the theoretical level this legal category has repeatedly become the subject of scientific research, its content and types have been constantly transformed depending on changes in the legislation of Ukraine. The socio-political situation caused by the violation of the territorial integrity of Ukraine, the priority of the state’s criminal policy in the fight against terrorism, corruption, have become a prerequisite for the emergence of new bodies of pre-trial investigation, changes in the procedural status of the investigator. This allows us to continue scientific research in the direction of improving the definition of “jurisdiction”, the definition of its characteristic components, species and more. The article discusses the relation between the terms “investigator competence” and “jurisdiction”, arguing that the former is broader. Attention is drawn to the normative construction of the articles of the Criminal Procedure Code of Ukraine, which define the rules of subsidiarity, in particular, in retrospect. Analysis of the criteria under which a criminal proceeding is assigned to the sphere of activity (management) of a particular pre-trial investigation body, in particular, the place of commission of a criminal offense, qualification of a criminal offense (event of a criminal offense, nature of the consequences, the subject of the criminal offense, its form guilt), the special status of the subject of the crime, the type and size of the object of the crime and the harm caused by the criminal offense, the status of the victim, the connectedness of actions, etc., allowed to conclude on the expediency of introducing into scientific circulation the concept of “criminal procedural characteristics of criminal offenses” The author defines the concept of “jurisdiction” by which the constituent competence of an investigator for conducting pre-trial investigation of a certain category of criminal proceedings, which is determined depending on the criminal procedural characteristic of a criminal offense, should be understood.

The criminal responsibility of the perpetrators of criminal acts of legislative elections in 2014 in Decision No. 70/Pid./2014/PT.TJK based on the presence of errors and intentional element in the commission of a crime, the defendant's ability to be responsible, there is no justification and forgiving for the defendant in committing criminal offenses legislative elections, by deliberately adding voice to a certain election participants. The judges convict the Defendants therefore with imprisonment for 3 (three) months, and a fine IDR 500.000 (five hundred thousand rupiah) provided that if the fine is not paid then replaced with imprisonment for 1 (one) month. Basic legal considerations judges in imposing criminal offense to legislative elections in 2014 juridically is the fulfillment of the evidence in the trial referred to in Article 183 and Article 184 Criminal Procedure Code. Philosophically considered that the criminal as a guidance to the behavior of the accused. Sociologically consists of aggravating factors, namely the defendant as the election organizer has injured the implementation of democracy and the mitigating circumstances that the defendants confessed and has not been convicted, have family responsibilities and polite during the trial. Keywords: Criminal Liability, Election, Legislative

Crime embezzlement car rentals are lately often devastating car rental owner. This is an issue where the meaning of a rule of law if the crime committed community can not be followed by the rule of law, such as crimes by way of evasion is one of the types of crimes against human wealth which is stated in Article 372 of the Criminal Code, which is a crime that does not exist inexhaustible, both from the bottom layer to the top layer of society can also be committing a criminal act embezzlement is a crime that originated from the existence of a trust in others, and that trust is lost because of the lack of an honesty. It is stated that the crime of embezzlement have a problem that is closely linked to attitudes, moral, mental, honesty and trust humans as individuals. The purpose of this study are as follows: 1) To determine and analyze the occurrence of the crime of embezzlement car rental. 2) To know and analyze the application of Article 372 of the Criminal Code the crime of embezzlement in the rental car. 3) To know and analyze the efforts of the police in preventing crime of embezzlement car lease. This study uses normative juridical approach that is used to make the description clear, systematic, transparent and precise about the facts / specific nature of the area and population which is then analyzed to obtain the desired facts. Criminal offense embezzlement rental car can be imprisoned if they meet the overall elements of the offenses charged by the public prosecutor and the offender accountable for his actions. If the offender does not meet one of the elements of which the accused, then it can not be convicted. The elements of criminal responsibility are: 1) committing illegal or criminal acts; 2) for the criminal should be able to be responsible; 3) to have a fault; 4) absence of an excuse. The conclusion from this study is the adoption of Article 372 of the Criminal Code in criminal offenses of embezzlement car rental where the incidence of criminal acts committed tenants for the rented goods belonging to the owner of the rental rights because of misuse or abuse of trust in which the crime of embezzlement are set in the provisions of Article 372 of the Criminal Code.

The author has substantiated the need to establish the circumstances to be clarified and has determined their significance during the investigation. It has been emphasized that the circumstances to be clarified include the circumstances to be proved in criminal proceedings, criminal and forensic characteristics of a criminal offense. In order to determine the circumstances to be clarified during the investigation of interference in the activities of a law enforcement officer, the author has studied the circumstances to be clarified within the group of criminal offenses related to obstruction of the activities of a law enforcement officer, as well as during the investigation of interference in the activities of a forensic expert. Taking into account the specified scientific provisions, the author has defined a detailed list of circumstances to be clarified during the investigation of interference in the activities of a law enforcement officer. It has been established that the circumstances to be clarified during the interference in the activities of a law enforcement officer include: 1) circumstances related to the criminal offense, namely: time, place, situation and traces of a criminal offense, methods of its commission (preparation, direct commission and concealment), tools and means used during the interference, the scope of procedural costs; circumstances that are the basis for ceasing criminal proceedings; the reasons and conditions that contributed to the commission of a criminal offense; 2) circumstances related to the identity of the victim, including: socio-demographic characteristics of the victim, place of work, position held; official and functional responsibilities, the victim’s belonging to a law enforcement agency during the commission of a criminal offense against him; the type and scope of damage caused to the victim; 3) circumstances related to the identity of the offender, namely: socio-demographic data of the offender, physiological and psychological condition, gender, citizenship, financial status, place of work, the record of criminal conviction and the facts of bringing to administrative liability; the presence of dependent disabled people; the presence of guilt in the form of direct intent, the purpose of the action; circumstances that aggravate or mitigate the punishment of the offender are grounds for releasing from criminal liability or punishment that exclude criminal liability; presence of accomplices.

KUHAP sebagai hukum acara pidana yang bersifat umum tidak mengakui bukti elektronik sebagai salah satu jenis alat bukti yang sah. Di dalam praktik, bukti elektronik juga digunakan sebagai alat bukti yang sah untuk membuktikan tindak pidana yang terjadi di pengadilan. Dari hasil pembahasan dapat disimpulkan, bahwa bukti elektronik dalam hukum acara pidana berstatus sebagai alat bukti yang berdiri sendiri dan alat bukti yang tidak berdiri sendiri (pengganti bukti surat apabila memenuhi prinsip/dasar dalam functional equivalent approach dan perluasan bukti petunjuk) sebagaimana dicantumkan dalam beberapa undang-undang khusus dan instrumen hukum yang dikeluarkan oleh Mahkamah Agung. Walaupun bukti elektronik tidak diatur dalam KUHAP sebagai lex generalis, namun untuk tercapainya kebenaran materiil dapat juga digunakan sebagai alat bukti yang sah untuk pembuktian seluruh jenis tindak pidana di pengadilan. Hal itu didasarkan pada pengakuan dalam praktik peradilan pidana, beberapa undang-undang khusus, dan instrumen yang dikeluarkan oleh Mahkamah Agung.The Criminal Procedure Code as a general criminal procedure does not recognize electronic evidence as one of the admissible types of evidence. In practice, electronic evidence is also used as an admissible evidence to prove the criminal offenses in court. From the results of the discussion it can be concluded that electronic evidence in criminal procedure law is a dependent evidence and an independent evidence (substitution of letter proof if it meets the principle of functional equivalent approach and expansion of evidence) as specified in several special laws and instruments issued by the Supreme Court. The electronic evidence is not regulated in the Criminal Procedure Code as a lex generalis, however, to achieve material truth it can also be used as a valid evidence for the provision of all types of criminal offenses in court. It is based on recognition in the practice of criminal justice, some special laws, and instruments issued by the Supreme Court.

That is, to solve specific tasks of the investigation: to provide opportunities for the development of versions, to build correlations between individual elements, to ensure better planning of the investigation, and so on. Otherwise, it will really be a "phantom", ie an ineffective tool of investigation. At the same time, scientists continue to investigate illegal acts in terms of constructing their forensic characteristics. The scientific article is devoted to the study of some aspects of the investigation of criminal offenses against public order. The peculiarities of forensic characteristics as an element of the methodology of investigation of a certain category of criminal offenses are considered. The author emphasizes that the forensic characteristics should be based on the study of materials of criminal cases and proceedings, as well as has a direct practical direction. That is, to solve specific tasks of the investigation: to provide opportunities for proposing versions, building correlations between individual elements, ensuring better planning of the investigation, and so on. Otherwise, it will really be a "phantom", ie an ineffective tool of investigation. At the same time, scientists continue to investigate illegal acts in terms of constructing their forensic characteristics. In our opinion, this is really important for the methodology of investigation of any criminal offense, so we will try to solve the problem of its construction in the studied category of actions: against public order. The notion of forensic characteristics is formulated as a set of data on forensically important features and properties of an illegal act, which is due to the natural connections between its individual elements and provides construction and verification of versions to solve specific problems of criminal proceedings.
