The ability of politics and diplomacy becomes the main asset when talking about the state. The problem when human rights come against the law, will lead to a tendency to be take the side of the law, as opposed to giving unpleasant things to those who make mistakes. This not infrequently results in the death penalty which eventually (again) contradicts the Human Right to live properly and in protection. This condition occurs in migrant workers who work in several countries in Asia. They were accused of mistakes that incidentally have not been proven but immediately get a death sentence. The best national ambassadors were assigned to conflict areas, succeeded in the mission of saving them. Consistency, innovation, and enrichment when diplomacy is equipped with the ability to read the situation is the key to the success of diplomats when rescuing. Indonesia's ability to maintain good relations with other countries finally deserves to be regarded as the peak of achievement.

Kedudukan hukuman mati terhadap pengedaran narkotika di Indonesia  sebagai strategi penanggulangan terhadap pengedaran narkotika  masih menimbulkan pihak yang menyetujui dan menolaknya. Pihak yang  menolak hukuman mati dikenakan pada pengedar nakotika dengan alasan hak asasi manusia atau hak keberlanjutan hidup terpidana, sedangkan ada kelompok yang menyetujui pelaksanaan hukuman mati yang juga dengan alasan demi kepentingan hak asasi manusia. Pihak yang menyetujui hukuman untuk pengedar ini menilai, bahwa sanksi yang dikenakan berupa hukuman mati dapat membuat jera atau takut calon-calon pelaku yang bermaksud mengedarkan narkotika atau hak hidup banyak generasi muda ikut diselamatkan menjadi korban kecanduan narkotika akibat ketakutan di kalangan calon-calon penjahat. hukuman mati bagi pengedar narkotika dalam kajian hukum positip sudah diatur dalam Undang-Undang Nomor. 35 tahun 2009 tentang Narkotika.Kata kunci: narkotika, hukuman, akibat, kedudukan, urgensi The death penalty for narcotics distribution in Indonesia as a counter strategy against narcotics distribution still raises those who approve and reject it. Parties that reject the death penalty are imposed on narcotics distributors on the grounds of human rights or the right to a life sentence, while there are groups that approve the execution of the death sentence as well as for the sake of human rights. The party who approved the sentence for the distributor ruled that sanctions imposed on the death penalty could scare or intimidate potential perpetrators who intend to distribute narcotics or livelihoods for many young people to be rescued as victims of narcotics addiction due to fear among potential criminals. the death penalty for narcotics traffickers in a positive legal study is set out in the Law of Numbers. 35 of 2009 on Narcotics. Human Rights are the basic rights of every human being as God's creatures who are equal to one another. The application of the death penalty by the state through a court decision means that the state revokes the convict's right to life which is an unlimited human right. Therefore, its implementation must take into account the rights of the convict. The purpose of this paper is to find out whether the imposition of the death penalty for criminals is against human rights. What are the criteria for imposing the death penalty for perpetrators of crimes that do not conflict with human rights? The method used is a normative research method using secondary data. It can be concluded that the imposition of the death penalty is against human rights. However, in its application, it can be justified on the grounds of defending human rights and only for crimes that go beyond humanity and damage human civilization. The implementation of the criminal justice process must be transparent and fair.

Penjatuhan pidana mati merupakan bagian terpenting dari proses peradilan pidana. Penerapan pidana mati oleh Negara melalui putusan pengadilan, berarti Negara mengambil hak hidup terpidana yang merupakan hak asasi manusia yang sifatnya tidak dapat dibatasi (non derogable). Oleh karena itu penerapannya harus memperhatikan Hak Asasi Manusia terpidana. Tujuan penelitian ini adalah untuk mengetahui penjatuhan hukuman mati bagi pelaku kejahatan, bertentangan dengan atau tidak dengan hak asasi manusia dan kriteria penjatuhan pidana mati bagi pelaku kejahatan yang tidak bertentangan dengan hak asasi manusia. Metode yang digunakan adalah pendekatan yuridis normatif dengan menggunakan data sekunder. Dapat disimpulkan bahwa penjatuhan pidana mati bertentangan dengan Hak Asasi Manusia dan penetapan dapat dibenarkan dengan alasan membela hak asasi manusia dan hanya pada kejahatan yang bersifat melampaui batas kemanusiaan.AbstractThe death penalty is an important thing in the criminal justice process. SummarySome advocates of Québec separatism claim that Quebecers could retain their Canadian nationality following Québec’s secession from Canada. This article examines international nationality law to test the accuracy of that claim. A device known as an option exists in international law as a means of allowing individuals to determine for themselves the effect of state succession upon their nationality. This article considers the place of options in the law of state succession, both as it now stands and as proposed by the International Law Commission’s Draft Articles on the Nationality of Natural Persons in Relation to the Succession of States, 1997. Four possible arguments in favour of a Québécois option are given, the most convincing of which arises by analogy to state practice in the use of plebiscites. This argument suggests that international law would require the state of Québec to grant all Canadians affected by Québec’s secession a right to opt for Canadian nationality instead of Québécois nationality with the caveat that those opting to retain Canadian nationality could face expulsion from Québec. Finally, the article suggests that the development of human rights in international law should extend to recognize a true human right of option in cases of state succession. Regrettably, the ILC Draft hinders, rather than encourages, this desirable development.

The subject of this article is the problems of the nature, essence and purpose of prosecutorial activity. The purpose of the article is to study and justify the role of the human rights function in prosecutorial activities in the concept of a modern legal state. At the heart of prosecutorial activity is the implementation of the main function of the Prosecutor’s office – its rights and freedoms, their protection. This means that any type (branch) of Prosecutor's supervision is permeated with human rights content in relation to a citizen, society, or the state. This is confirmed by the fact that the Federal law “On the Prosecutor's office of the Russian Federation” establishes an independent type of Prosecutor's supervision-supervision over the observance of human and civil rights and freedoms. It is argued that the legislation enshrines the human rights activities of the Prosecutor's office as its most important function. It is proposed to add this to the Law “On the Prosecutor's office of the Russian Federation”.

Our conversation might begin by looking backward a bit. The human rights movement from 1945 onward has been one of the signature accomplishments of the field of international law, one that refocused our attention from a largely interstate system to a system where the individual moved in from the periphery to the center. Human rights champions point to numerous landmark treaties, numerous institutions, and the rise of NGOs as a critical vehicle for developing and monitoring human rights rules. Yet others look at the international human right system and still see the state as overly central, tolerating and paying lip service to human rights, but too easily discarding them when they prove to be inconvenient. The persistence of racism comes to mind. As a general matter, how would you assess the strengths and weaknesses of the system that was built essentially during your lifetime?

Penelitian ini bertujuan untuk menganalisis yurisdiksi Pengadilan Pidana Internasional dengan Pengadilan HAM Indonesia. Masalah penelitian Bagaimana yurisdiksi dibandingkan dengan pengadilan kriminal internasional dan pengadilan HAM di Indonesia? dan Apa Peluang untuk Pengenaan Yurisdiksi Pengadilan Pidana Internasional di Indonesia? Metode penelitian menggunakan penelitian yuridis normatif. Hasil penelitian menunjukkan bahwa perbandingan yurisdiksi Pengadilan Pidana Internasional dan Pengadilan Hak Asasi Manusia dapat dilihat dari yurisdiksi pidana, pribadi, temporal dan teritorial. Indonesia bukan negara pihak dan bukan negara yang menerima yurisdiksi Mahkamah Pidana Internasional. Meski begitu, Yurisdiksi Mahkamah Pidana Internasional dapat diterapkan di Indonesia mengingat perbedaan yurisdiksi pidana kedua pengadilan tersebut, karena ada 2 (dua) kejahatan yaitu kejahatan perang dan kejahatan agresi yang tidak diatur dalam Pengadilan HAM Indonesia. , jika ada situasi di Indonesia yang dirujuk oleh Dewan PBB dan keamanan Indonesia dianggap tidak mau dan tidak dapat membawa para pelaku kejahatan untuk diadili di pengadilan. This study aims to analyze the protection of labor rights in this case Indonesian migrant workers abroad within the framework of the ASEAN Economic Community and Law no. 18 of 2017 concerning Protection of Indonesian Migrant Workers' labor rights within the framework of the ASEAN Economic Community. Research problems, First, What is the Form of Protection for Indonesian Migrant Workers, Second, What is the Form of Legal Efforts for Indonesian Migrant Workers who are disadvantaged? The research method uses socio-legal research by observing the ASEAN Declaration of Human Rights and Law No. 18 of 2017, as well as other Indonesian Laws and Regulations. The results showed that the Protection of Indonesian Migrant Workers (PMI) is all efforts to protect the interests of prospective PMI and their families in realizing guaranteed fulfillment of rights in all their activities. The author will analyze the issue of the extent to which the state protects labor rights in this case Indonesian migrant workers abroad within the framework of the ASEAN Economic Community and Law No. 18 of 2017 concerning Protection of Indonesian Migrant Workers.

Advocates are the most vulnerable professions to be Gatekeepers in money laundering. Indeed, the advocate profession is part of the law enforcement apparatus that can contribute better in preventing money laundering activities to develop. Affirmation about the role of advocate that can suppress the occurrence of money laundering crime, that is with the issuance of PP. 43 of 2015, which places advocates as one of the reporting parties in the agenda of eradicating money laundering crime. However, the substance of the rule draws criticism from some misguided advocates in interpreting the intent and purpose of the arrangement. Moreover there are some advocates who consider that the rule is against the rules that regulate immunity rights in the profession advocate. The misinterpretation of some advocates related to the immunity rights inherent in the profession, causing the work of the advocate profession to be considered irrelevant, and not worthy of being called the nobleprofession (OfficiumNobile), But as a bad profession in integrity and promoting commercialization. In fact, the basic purpose of the arrangement of PP. 43 of 2015, which places the advocate profession as one of the reporting parties on the eradication agenda of money laundering, is a form of respect for the profession of advocate who is a noble profession, by prioritizing his professional responsibilities to the state, society and God, as well as his obligations as part of The legal profession to uphold the law and uphold the value of human rights while on duty.
