This study aims to analyze the expansion of the absolute competence of Administrative Courts to examine factual actions and/or illegal acts by the government. This paper is a doctrinal legal research using statute and conceptual approach. The result of this study argued that the expansion posed a legal problem since the absolute authority is determined by law. In this case, it is transferred through a Supreme Court Regulation without changing the law. The other problem was also found in the legal basis for judicial review and limited compensation. Ideally, it should be preceded by amending the law, broadening the legal basis for review, and providing fair compensation.   Received: 27 July 2021 / Accepted: 27 September 2021 / Published: 5 November 2021

Since the enactment of Law No. 11 of 2012 concerning the Criminal Justice System for Children in Indonesia needs to be sought immediately for Law Enforcement Officials (APH) who do not understand and know about the obligation to adopt a Restorative justice approach in the implementation of the Child Criminal Justice System. The norm that regulates the obligation to approach restorative justice in the handling of Children dealing with the Law (ABH) contained in article 5 paragraph 1 of the Child Criminal Justice System Law and this Law has also adopted the International instrument of the Convention on the Rights of the Child (CRC) ratified by the government of the Republic of Indonesia with a Presidential Decree Number 36 of 1990 concerning Ratification of the Convention on the Rights of the Child in addition to other international regulations such as the Beijing Rules, Riyadh Guidelines and Tokyo Rules which are certainly in line with the Constitution 1945 concerning the purpose of the country which was wrong was to realize social justice and promote public welfare. This restorative justice approach certainly has the same spirit as the ideological values ​​of Pancasila, politics, and the Indonesian national socio-culture which prioritizes solutions through deliberation to reach consensus so that this restorative justice approach is also one of legal reforms that elevates the values ​​of local wisdom from the Nation Indonesia. The conceptual approach and the approach to legislation (the statue approach) are the approaches used in this study and maximize the implementation of the implementation of restorative justice in every handling of children facing the law (ABH) at each stage of the investigation, prosecution and trial. research is to provide confirmation to every Law Enforcement Officer of the obligation to take a Restorative Justice approach in every Handling of ABH.

Law No. 30/ 2014 on Government Administration brings the strength and the averment on the performance of the governmental functions which include executive, legislative, and juridical in order to provide the public services (bestuurzorg). Such regulation also aims to prevent and to eliminate any kinds of the maladministration done by the government officials/organs in implementing their functions so that good governance can be realized. In implementing their function, the government should rely on the useful performance (doelmatigheid) and the effectiveness (doeltreffenhgeid) according to the norms of each authority. It is a sophism when the ‘authority’ and/or the ‘competence’ mentioned under the Law No. 30/ 2014 on Government Administration are defined differently in the letterlijk gramatikal wet without associating those terms with an understanding of bevoegheid in an administrative legal concept. An idea that distinctively defines the term ‘competence’ as a right and ‘authority’ as a power is considered as an inconsistent idea, which may cause dualism and distortion in the common law enforcement reffering to the administrative law, particularly related to the concept of the authority abuse of power mentioned under the Law No. 31/ 1999 amended by the Law No. 20/ 2001 on deeds against corruption. As the result, when the notion of ‘authority abuse of power’ is defined as a right (as mentioned in article 1, subsection 5 jo. article 17, Law No. 30/ 2014 on Government Administration), it will be characterized into the absolute competence of the administrative jurisdiction, and when the notion of ‘authority abuse of power’ is defined as a power (as mentioned in article 3, Law No. 31/ 1999 on deeds against corruption), it will be characterized into the absolute competence of the corruption-act jurisdiction. Meanwhile, implementing the government’s ‘competence’ and/or ‘authority’ is characterized into one concept based on the norms of the authority power.

The role of taxes is very important in the state finances. Taxes become necessary in financing the expenditures of the state, especially the routine state expenditures. However, not infrequently there are taxpayer actions that cause in State losses. The condition is realized by the government so that the government issued Law Number 11 Year 2016 on Tax Amnesty. However, with the issuance of the Tax Forgiveness Law, it has resulted in various views in the community because for some obedient taxpayers, it is assumed that taxpayers are granted the convenience of their mistakes. So that does not reflect justice as one of the objectives of the law. Based on the issue, the authors will conduct further research on the legality of tax debt relief in the framework of tax forgiveness and the urgency of determining the tax forgiveness rule. This study is qualified as a normative juridical legal research with a type of legal research doctrinal using a statutory approach, and a conceptual approach. From this research, it is expected that the writer can analyze related to the legality of tax debt relief in the framework of tax forgiveness and the urgency of determining tax forgiveness rule.

One of the authorities of the Constitutional Court governed by the Constitution of the Republic of Indonesia in 1945 was the examining of laws against the contitution or judicial review. Inside the regulations which governing the implementation of this authority, the Constitutional Court only acts as a negative legislator, namely canceling or reinforcing a norm tested by the Petitioner. But in practice, the Constitutional Court has changed its role to become a positive legislator, who is forming a new legal norm, which is the authority of legislators. The Constitutional Court should not be able to form a new legal norm because there is no legal basis which regulate that. But Constitutional Court can form a new legal norm in some urgent circumstances, relating to Human Rights, and preventing legal vacuum. In addition, the establishment of laws by lawmakers that require a long process and time. This is compelling Constitutional Court to make substitute norm before the law was established by the legislators. In the Decision of the Constitutional Court Number 46/PUU-XVI/2016, the Court actually wants to establish a new legal norm, but because the articles in the petitioned have criminal sanctions, and if the Constitutional Court approves the petition, the Constitutional Court has formulated a new criminal act that can only be formed by the lawmaker. Whereas in the Decision of the Constitutional Court Number 21/PUU-XII/2014, the Constitutional Court established a new norm because in the article a quo there were no criminal sanctions.

ABSTRACTOne of the police authorities is a discretionary action, where the action can also be done at the time of the investigation in dealing the juvenile offenders to protect children’s right to get justice and maximum legal protection. In the Law Number 11 of 2012 on the Juvenile Criminal Justice System stipulate about the investigator authority to carry out action of diversion, but this only applies to children under sentence of less than 7 years in prison and does not apply in children who are subject to punishments of more than 7 years in prison. This is contrary to the 1945 Constitution and the Law Number 23 of 2002 which emphasizes the protection of children before the law an the efforts to avoid imprisonment of the juvenile offenders.The thesis describes the police authority and the legal mechanisms and policies by the investigator in protecting the right on the juvenile offenders that puts the principles of legal protection. In order to avoid negative effects on children, therefore the police discretion is needed to avoid restrictions on freedom of the children’s right. The method used is a normative legal research method, where the normative or library legal research method is done by examining existing library materials.The writer suggested to the government to be more serious in dealing with the problems of children, especially for the juvenile offenders so that the welfare and right of children are protected and to avoid restrictions on freedom and minimize for juvenile offenders.

The government has long been giving protection to children. Protection is reflected in the issuance of various Law. One of them is the Law No. 23 of 2003 on Child Protection. The legal protection of children in conflicted with law and child as victims of crime are regulatedin articlenumber 64. Issuance of Law No. 3 of 1997 on Juvenile Court actually originates from a passion for protecting the rights of children in conflicted with the law. However, due to inadequate understanding and mindset of Juvenile Court, which is do not have the children’s perspective, what comes up is that the substance of Law on Juvenile Court is not to protect children but to prosecute children. The end of the government of Orde Baru that tends to be more authoritharian has emerged the transformation almost in all government hierarchy. The most important transformation is in the material contains or substantive of 1945 constitution, whether material that has been erased, revised or new material. Material contain of the 1945 constitution is the result of the amendment such as the Human Right.  The regulation about human right before amendment 1945 constitution regulated as right and duty of the republic citizen in Indonesia that contains the values of human right and regulated in the article 27 to article 34. The regulation of human right after amendment of 1945 constitution regulated in article 28A to 28J.  The regulation about the human right based on the Law Number 39 Year 1999 concerning the Human Right. It explain there is no right in Indonesia that has the absolute power and unlimited. Human Right is not the right that has the absolute characteristic. In the implementation, its limited by the right, morale, security and order of other people. Because of that,  in the human right also known the existence of human right duty. Pasal 3 PP 24 Tahun 1997 tentang Pendaftaran Tanah menyebutkan pendaftaran tanah bertujuan untuk memberikan kepastian hukum dan perlindungan hukum kepada pemegang hak atas suatu bidang tanah. Terbitnya  sertifikat Hak Milik atas tanah Jailani Yusuf cs yang merupakan objek sengketa, telah diputus berdasarkan Putusan Kasasi No.633 K/Pdt/2006. Permohonan pendaftaran hak yang diajukan oleh Abdullah Ibrahim dan Cut Ben Ibrahim ke Kantor Pertanahan Kabupaten Aceh Besar tanpa memberitahukan adanya Putusan Kasasi, sehingga melahirkan sertifikat yang subjek hukumnya tidak sesuai dengan Putusan Kasasi. Penelitian ini bertujuan, mengetahui pelaksanaan pendaftaran tanah yang melahirkan Sertifikat hak atas tanah yang subjek hukumnya tidak sesuai dengan Putusan Kasasi dan tanggung jawab Kantor Pertanahan atas  penerbitan sertifikat untuk atas pihak yang tidak berhak berdasarkan putusan pengadilan. Jenis Penelitian ini adalah penelitian yuridis empiris dengan meneliti keberlakuan hukum itu dalam kenyataan atau dalam masyarakat. Hasil penelitian menunjukan bahwa dalam pelaksanaan Pendaftaran tanah yang melahirkan Sertifikat No.11, 12 dan 21, 22, 23/2015 terdapat cacat hukum administratif yang disebabkan kesalahan subyek dan/atau obyek hak, karena di atas tanah yang diterbitkan sertifikat telah ada Putusan Kasasi. Akibatnya pihak yang mendaftarkan tanah bertanggung jawab secara hukum dan Kantor Pertanahan bertanggung jawab secara administratif.Article 3 of the Government Regulation Number 24, 1997 on Land Registration states that a land registration aiming to provide law certainty and law protection on land right holder over the land. The issuance on of the land certificate of Jailani Yusuf et.al is a dispute object; it has been decided based on Judicial Review Number 633 K/Pdt/2006. The application on the right registration that is proposed by Abdullah Ibrahim and Cut Ben Ibrahim to Land Authority Office of Aceh Besar without providing the review, hence it results in certificate issuance that the law subject is not based on the decision. This research aims to know the implementation of land registration in the making process of certificate that its legal subject is not based on the court decision, responsibility of land office of the change of certificate issuance for party that is no having right based on the court decision. This is juridical empirical research by exploring the law application into society. The research shows that in the implementation of land registration in making process of Certificates Numbers: 11, 12 and 21, 22, 23/2015 has administrative law lack caused by subject fault and/or object of right, as on the land certificate issued has been reviewed by the Supreme Court. The impact on parties registering their land is legally responsible and the Land Authority Office is administrative legally responsible.

Abstract Judicial review is one of the authorities of the Constitutional Court most often exercised. This research examines the background of the establishment of Constitutional Court in Indonesia and the ideal construction of the constituendum for the Constitutional Court in implementing the judicial review. This normative research uses regulatory and conceptual approach. The results showes first, the authority to judicial review should be placed in one institution, namely the Constitutional Court, since the continental tradion of laws and regulations is systematic, hyrarchial and pyramidal in nature. Second, the Consttutional Court’s decisions that are often ignored by the law forming institutions have resulted in the Law annulled by the Court not immediately followed up with the issuance of a replacement law. Third, judicial review should not be limited to the statute being reviewed, because the statute concerned are, more likely, related to the other statutes. And fourth, the Constitutional Court’s decisions should be regarded as constitutional jurisprudence and become referrences for the theory of constitution in general.
