PREVENTIVE ENVIRONMENT OF CORRUPTION-RELATED OFFENCES IN THE PENAL SYSTEM

В статье раскрываются особенности профилактики коррупции в учреждениях и органах уголовно-исполнительной системы (далее - УИС). Акцентируется внимание на необходимости усиления профилактической работы в процессе формирования среды предупреждения коррупционных правонарушений в УИС. Авторами предпринята попытка конкретизации и систематизации состояния профилактической работы на различных уровнях служебной деятельности и предложена система принципов профилактики коррупционных правонарушений. Антикоррупционная среда рассматривается в качестве основы профилактической работы. Делается вывод о том, что по параметрам своего развития пенитенциарное общество в России уже пришло к потребности ключевой и системной работы по предупреждению и профилактике коррупции в УИС. В указанном направлении очень важно использование всех имеющихся возможностей как социальных, так и технических наук. Профилактика должна базироваться на специальных знаниях в области государственной службы и управления, социального развития и психологии. В результате исследования предложены эффективные меры оперативно-организационной работы по профилактике рассматриваемых правонарушений, такие как: регулярный анализ практики применения судами антикоррупционного законодательства (в рамках служебной подготовки); ознакомление личного состава с обзорами; духовно-нравственное воспитание сотрудников, основанное на преемственности добропорядочных основ и традиций; повышение уровня профессионального правосознания. The article reveals the features of corruption prevention in institutions and bodies of the Penal system (hereinafter referred to as the PS). Attention is focused on the need to strengthen preventive work in the process of creating an environment for preventing corruption-related offenses in the Penal system. The authors attempt to specify and systematize the state of preventive work at various levels of official activity and propose a system of principles for the prevention of corruption-related offenses. The anti-corruption environment is considered as the basis of preventive work. It is concluded that according to the parameters of its development, the penitentiary society in Russia has already come to the need for key and systematic work on the prevention and precaution of corruption in the penitentiary system. In this direction, it is very important to use all the available opportunities of both social and technical sciences. Prevention should be based on specialized knowledge in public service and management, social development, and psychology. The study suggested effective measures operational and organizational work for prevention of considered offences, such as regular analysis of practice of application by courts of anti-corruption legislation (within the framework of service training); introduction of personnel reviews; spiritual and moral education, based on continuity, the good foundations and traditions; raising the level of professional sense of justice.

The need in corruption prevention and the necessity to create the anti-corruption legal base are recognized by all states. This particular research is devoted to modern trends in corruption observed inside the penal system. The authors analyze views of researchers on this phenomenon as well as anti-corruption solutions and prove the importance of developing anti-corruption sense of justice and moral education of penal corection system officers. They also offer particular prevention measures aimed at developing anti-corruption sense of justice of officers. In the course of their research the authors analyze provisions of the federal law No, 273 On Corruption Prevention dated December 25, 2008 and offer measures aimed at anti-corruption behavior of officers. As a result of their research, the authors emphasize the need to develop anti-corruption policy and anti-corruption culture as well as the need to teach anti-corruption behavior and sense of justice to penal correction system officers and the need to discover and eliminate causes of corruption. They also conclude that there is a need to develop anti-corruption standards that are being developed by state authorities today for particular spheres of social relations.

The integrity advisers are the central actors of integrity management systems of the administrative organizational structure, whose main task is to promote the implementation of the integrity approach within state administration institutions. As a complementary part of this task, we can separate the tasks of corruption prevention and the improvement of organizational integrity, of which the latter being discussed in more detail in this research and presentation. Integrity advisers play a key role in the development of organizational culture among public administration bodies, such as bodies exercising administrative authority. Looking at the topic more closely, with regard to the activities of integrity advisers, it can be clearly established that one of the engines of their operation is the proper and deep communication, which is not only necessary within the public administration and inter-agency transactions, but it also means communication activities that can be interpreted in the relationship between the public and clients. Equally important is their training and other activities aimed at developing staff awareness, relationships, situation assessment and action practices, which, in addition to and in part within public service training, provide an opportunity to shape organizational culture. The presentation and the paper aims to show the role of integrity advisors in developing organizational culture and transparency in the administration based on recent research experience about online presence of integrity advisors and in-depth interview surveys.

Recent evidence shows public service motivation (PSM) may be unrelated to one’s consideration of a public service career. In places where civil service examinations prevail, even adverse selection (selecting low-PSM individuals) can occur. This leaves public sector managers with tough questions: “Can we improve new recruits’ PSM? Does training matter?” The present study attempts to answer these questions by using a case of onboard training in Taiwan. We hypothesize that PSM, along with public service–related knowledge and a positive attitude toward public service work, improves after training, and that the improvement hinges on trainees’ satisfaction with training and perceived usefulness of training. Analytical results indicate that knowledge and attitudes are more “trainable” than PSM. Meanwhile, training satisfaction is associated with the growth of public service–related knowledge, while perceived training usefulness relates to a positive attitude toward public service work and PSM. Overall, these findings advance our understanding of the effectiveness of public service training, its determinants, and the implications for public employees’ public service orientations.

The 1930s saw a dramatic escalation in the size and scope of the Soviet Union’s system of penal labour camps, the Gulag. Through analyses of memoir and other sources, the experiences of the Gulag’s prisoners at this time have been the subject of a great deal of scholarly investigation. Yet the guards who watched over these prisoners have received considerably less attention. Newspapers printed for the VOKhR guards in the mid-1930s offer some information on their readers’ everyday duties and their status, both inside the Gulag and as citizens of the USSR. Publications taken from one particularly large camp responsible for the construction of the Baikal-Amur railway (BAMlag) depict guards as self-disciplined, industrious soldiers engaged in a war for economic and social development. But the specific dynamics and changing circumstances of the Soviet penal system at this time created an unusual contrast between newspapers printed for the guards and those printed for the prisoners of BAMlag. While the criticism levelled at prisoners by their own newspaper was often mitigated by a rehabilitative discourse, the guards were judged as full members of Soviet society, often harshly. However, the precise implications of this were rendered ambiguous by the indeterminate position of the Gulag itself at this point in Soviet history.

Explore the major ideological patterns of development of a socially philosophies of education in the context of the problems of institutionalization of knowledge about human and social development. To analyse system-integration aspect of social philosophy and education management in interaction with model of «new humanism» in formation of socially valuable orientations. Classification existing in the western philosophy of education and education of directions is spent, proceeding from basic principles of philosophical school or a current, first of all considering those the purpose and means which are really involved by them in process of education, social development and socially-moral education and being based on the basic installations, the purpose expressed by that or other direction, how its supporters imagine the person, its requirement, a social role, behaviour which the education system and education urged to form. Considering growing requirement of a practical embodiment of ideas of freedom, justice, aspiration to realisation of the human rights proclaimed a society, supporters of the concept of «new humanism» see the main objective in blocking a way to conformism, to a manipulation behaviour of the person and to create conditions for its free self-expression, for realisation by the person of a fundamental choice of acts in a concrete situation and by that to warn danger of formation of the unified form of behaviour. In it principles of «new humanism» approach with a position of  instrumentalism and neopragmatism. Before social philosophy of education/upbringing  it is necessary to define a problem factors which cause achievement of its main objective, to state an estimation to moral principles and personal qualities with which actually the education/education theory connects realisation of the problems, to show, why these, instead of any any other principles and qualities open to the person possibility to choose in a concrete situation socially powerful both morally defensible and comprehensible line of conduct in public the relation. Statement of a question on necessity of the philosophical analysis of problems of education and education in a social context serves as an indicator of understanding philosophers, teachers of an increasing role of the human and moral factor in society development. And, at last, the aspiration to develop socially-philosophical bases of pedagogics in general and education in particular, testifies that the western and domestic philosophers, teachers, representatives of social and psychological sciences, at least, the majority of them, have realised the public importance of an education system and education, its global character.

In the article the issues of correction of the psychology content of the convict’s group sense of justice are considered in the context of activities to improve the measures of psychological and pedagogical influence on persons in prison. Based on the analysis of the materials of the research conducted by the author it is concluded that in the process of serving the sentence in the group legal consciousness of convicts, legal ideas about the injustice of the formal legal system are constructed. Under these conditions a significant role in the regulation of behavior begins to belong to the norms of behavior adopted in the prison community, which contributes to the criminalization and “prisonisation” of the consciousness of convicts. It justifies the need to carry out activities to minimize the asocial influence of the prison subculture both on persons in prison and on the staff of the penal system. The conclusion is made about the need for a differentiated approach to the conduct of psycho-correctional work on changing the legal representations of convicts. For those who are in prisons for the first time programs on group work and legal education are offered. Convicted persons who have been convicted several times mainly with those who have become disillusioned with their way of life and intend to change it, taking advantage of the law-abiding behavior, individual correctional work is recommended.

В статье раскрываются аспекты коррупции и пенитенциарной коррупции как негативных социальных явлений, обосновывается общественная опасность коррупционных преступлений. Автором выделяются международный и национальный уровни правового регулирования противодействия коррупции, рассматриваются основные правовые акты в области борьбы с коррупцией, в частности раскрываются особенности Плана противодействия коррупции Федеральной службы исполнения наказаний на 2018-2020 гг. как основного ведомственного правового акта, обозначаются основные мероприятия, которые будут проводиться субъектами антикоррупционной деятельности по ликвидации и минимизации роста коррупционных преступлений. Раскрываются особенности коррупции в местах лишения свободы на современном этапе развития пенитенциарной системы. В качестве одной из особенностей выделяется основная группа пенитенциарных правонарушений, связанных с доставкой сотрудниками запрещенных предметов осужденным, подозреваемым и обвиняемым. Приводится официальная статистика Федеральной службы исполнения наказаний по указанной группе коррупционных правонарушений, совершаемых сотрудниками уголовно-исполнительной системы, а также данные по принадлежности сотрудников, совершивших коррупционные правонарушения, к различным структурным подразделениям исправительных колоний и следственных изоляторов. На основе их анализа определяется категория сотрудников, входящих в группу риска, на которых должна быть направлена профилактическая работа уполномоченных должностных лиц Федеральной службы исполнения наказаний. Автором обозначаются проблемы и перспективные направления научного поиска в области противодействия пенитенциарной коррупции.The article reveals the aspects of corruption and penitentiary corruption as negative social phenomena, justifies the public danger of corruption crimes. The author identifies the international and national levels of legal regulation of combating corruption, examines the main legal acts in the field of combating corruption, in particular, reveals the features of the Plan of combating corruption of the Federal penitentiary service for 2018-2020 as the main departmental legal act, identifies the main activities that will be carried out by the subjects of anti-corruption activities to eliminate and minimize the growth of corruption crimes and ways to eliminate the problems of the Federal penitentiary service. Features of corruption in places of imprisonment at the present stage of development of penitentiary system are revealed, as one of features the main group of the penitentiary offenses connected with delivery by employees of the forbidden subjects condemned, suspected and accused is allocated. The official statistics of the Federal Penitentiary Service on this group of corruption committed by employees of the Penal System is given. The data on identity of the employees who committed corruption offenses to various units of correctional colonies and remand centres, based on their analysis determines a category of employees included in the risk group, which needs to be directed to preventive work of the authorized officials of the Federal service of execution of punishments. The author identifies the problems and promising directions of scientific research in the field of combating penitentiary corruption.
